&lt;p style=&quot;text-align: left;&quot;&gt;Neither contradiction supports their reference to collect&amp;nbsp;the deficiency in the future.&amp;nbsp;&amp;nbsp;Since I have had several concerned&amp;nbsp;sellers who have received this&amp;nbsp;approval letter, I emailed a Bank of America escalation&amp;nbsp; negotiator to get their&amp;nbsp;explanation.&amp;nbsp; Here is what they said:&amp;nbsp;&lt;/p&gt;

We must reserve the right to collect the unpaid balance of the loan for the benefit of our investors and mortgage insurance companies that insures payment on the loan. The purpose of the short sale letter is to properly disclose this to the borrower so they may consider all of their options with respect to their mortgage loan.&lt;/p&gt;
&lt;p style=&quot;padding-left: 60px;&quot;&gt;&lt;strong&gt;In my experience with short sales, I have never know anyone to pursue the deficiency once the short sale has closed.&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;So, how can you alleviate concerns when receiving this letter?&lt;/strong&gt;&amp;nbsp; Of course, talk to your attorney if you do not feel comfortable, but consider the alternatives if you do not accept the short sale.&amp;nbsp; &lt;strong&gt;Deed-in-lieu of foreclosure&lt;/strong&gt;, which will produce the same&amp;nbsp;deficiency, and be worse on future borrowing ability?&amp;nbsp; Or &lt;strong&gt;foreclosure&lt;/strong&gt;, with severe future borrowing constraints, liabilities and consequences?&amp;nbsp; None of the choices are that palatable, but short sale is still clearly your best option.&lt;/p&gt;

      <title>Where have all the homes gone? </title>
      <description>&lt;p&gt;It is becoming increasingly difficult to find active listings that match the needs of my buyer clients in the Vacaville single family home market. This shows a local housing recovery and a healthy increase in the number of homes sold. December 2008 more than &lt;strong&gt;&lt;span style=&quot;text-decoration: underline;&quot;&gt;double&lt;/span&gt;&lt;/strong&gt; the number of homes sold in Vacaville than the year before in December.&lt;/p&gt;
&lt;p&gt;Foreclosure actions have been on hold for a few weeks and banks are supposed to be working with homeowners in distress situations but expect more NODs soon. Banks have been actively working with short sale offers and REO bank owned homes have been going into escrow with multiple offers.&lt;/p&gt;
&lt;p&gt;Currently there are &lt;strong&gt;296&lt;/strong&gt; single family homes (@ &lt;strong&gt;$177/sf average list price&lt;/strong&gt;)&amp;nbsp;on the market in Vacaville today Feb 3, 2009. (Prices range from $79,000 up to $1,375,000 with the average 1911sf home priced at $350,719).&lt;/p&gt;
&lt;p&gt;FHA minimum down payments were&lt;em&gt; increased&lt;/em&gt; to &lt;strong&gt;3.5%&lt;/strong&gt; on Jan 1st, 2009, the max limits for these loans was capped out at &lt;strong&gt;$400,200&lt;/strong&gt; after almost 9 months of being at $417,000 in Solano county.&lt;/p&gt;
&lt;p&gt;Energy efficient mortgages and more agreeable REO banks have put the bank owned homes into better condition for today's buyers.&lt;/p&gt;
&lt;p&gt;Don't forget to procure a one year home warranty on these homes since they are buying properties with few disclosures on them by the banks' own admission, they are not the occupants, banks don't know the condition of the homes.&lt;/p&gt;
&lt;p&gt;Write to your congressman/woman and let them know that it would surely be a&amp;nbsp;good thing that&amp;nbsp;if at some time the current family living in that home could be given the same offer/opportunity as the buyers are offered in a short sale or REO purchase, many people have time and many times much money invested in that home and are just as likely deserving of consideration. Keeping the homeowner in their home is not a bad thing.&amp;nbsp;&lt;/p&gt;</description>

      <title>Solar power, green companies, electric cars in Vacaville</title>
      <description>&lt;p&gt;Kaiser hospital has built a green building in North Vacaville, they have nearly finished it, and yet again this year they have delayed the opening until next year. Bad economy is not helping it, but we still like seeing our new hospital because we know they must someday open it, because there it is.&lt;/p&gt;
&lt;p&gt;Last month, November 2008, they did open up some of the medical specialty offices in the new hospital. This place is built green and it is green. SCIF, State Compensation Insurance just opened up a new, large office complex of buildings, put the solar panels up over the parking lot, shading the employees' cars, this will serve as a nice surprise in the summer when the employees get into their cars after working all day and the car is not so hot in the summer sun.&lt;/p&gt;
&lt;p&gt;Located in Vacaville California, one of the greenest spots in America in the right winter months, the beautiful&amp;nbsp;hills that surround Vacaville are gently rolling green hills, the rest of the year they are the golden hills.&lt;/p&gt;
&lt;p&gt;Vacaville is fast becoming the green and solar capital of the United States as it boasts many solar power stations installed at several local companies most recently including Mariani Fruit which is one of the original Vacaville mainstays in the days when Vacaville first became a settlement for the modern inhabitants of the 1800s when Juan Vaca and Juan Pena first brought their families here to live, relocating from New Mexico, they found the beauty and soil to be perfect for growing fruit and planted their families and their orchards here.&lt;/p&gt;
&lt;p&gt;The city of Winters maintains a perfect balance of soil, weather and farmers who support and grow the finest walnuts in the world, Mariani Fruit handles the bulk of the walnut harvest and processing with a facility in Winters to be near the growers and their main packaging and transportation center in Vacaville where they just energized their new solar plant on site.&lt;/p&gt;
&lt;p&gt;Also, Alza Corp or as they are now known as Johnson and Co, also operate their own solar array in Vacaville, not more than a mile from Mariani Fruit.&lt;/p&gt;
&lt;p&gt;P G &amp;amp; E sub-station in Vacaville also offers natural gas pumps for those cars that use that fuel, and other electric car charging stations are conveniently located all over the bay area as well. Vacaville, Dixon, Davis and West Sacramento fully support the alternate fuels of the cars being developed in our backyards at the West Sacramento Fuel Cell Conglomerate building.&lt;/p&gt;
&lt;p&gt;Experimentation of alternate ways to power vehicles will put California in front.&lt;/p&gt;
&lt;p&gt;Solar power is such an interesting way to harvest electrical energy from the sun. It consists of a plate that is chemically layered with certain types of minerals and chemicals, they interact by differing from each other, and when exposed to the sun, they displace this difference and send it thru the wiring that is attached to the plates, if not used immediately by the load of a building or vehicle, this energy is instantly lost, so it must either be sent back to the electric grid if not used, or stored in batteries, since the power created is dc power, converters are used to change the power into AC current. If the power is sent to the grid, the power company is allowed to buy it directly from you, however interesting is that this will fast become another issue in the future as the power companies are already not willing to pay us the same amount of money per kilowatt hour as they charge us to get it. Legislation will have to address the issue. I believe the power companies are arguing that it costs money to take in power when their business is to sell power, not to buy it in small quantities from the general public.&lt;/p&gt;
&lt;p&gt;Lastly, Vacaville is becoming the center of northern California for the number of solar homes they are building and have built in recent years. Most of these builders are installing a special roof tile that has the solar layers built right into them. Not all the roof tiles have the solar panels in them, and the power generated does not usually send the power back to the power company, but it sure helps with the bill! They call this spinning the meter backwards, and if you ever want to find out something interesting, try going out to your meter someday, have someone in the house turn lights and appliances on and off while the other person watches the meter spin. You will notice that the speed at which that wheel spins is in direct relation to how many things are on in your home, and they are not all equally as powerful at spinning the meter, your energy sucking appliances or the hanging light fixture with 9- 100 Watt bulbs may impress you when you watch it spin your meter! Power consumption is costly, with a little experimentation perhaps you can reduce your energy costs at home!&lt;/p&gt;</description>

If it is 10 PM, turn the clock to 9 PM and get an extra hours&amp;#39; sleep! OR, you can stay awake until 2AM and change all your clocks back to 1 AM, it&amp;#39;s up to you!&lt;/p&gt;&lt;p&gt;Arizona does not turn their clocks back or forward, so now they will be one hour different than California, in summer, they have the same hours as Pacific Time. They chose long ago not to participate in this practice.&lt;/p&gt;&lt;p&gt;Brazil is considering a 30 minute time change so their school children can walk to school in daylight hours, it is not being accepted very well there, so they are giving the public time to think about this type of a time change.&lt;/p&gt;&lt;p&gt;If you forget to change your clocks, you will find&amp;nbsp;yourself one hour&amp;nbsp;EARLY for church or any appointments on Sunday and if you are really out of touch you will be one hour&amp;nbsp;early to work on Monday morning! This will likely mean you will be put to work doing things such as turning on lights or making coffee with the other early risers! It&amp;#39;s up to you!&lt;/p&gt;&lt;p&gt;Daylight savings time is a good concept and thank goodness for digital clocks and computers, as almost all of your electronics will automatically reset as will your cell phone and TV, VCR, DVR etc...even some of your cars will know what time it is.&lt;/p&gt;&lt;p&gt;Last spring, we went to daylight savings time early, this really messed up even the electronics! THEY did not predict that happening! I downloaded software to tell my cell phone to change the time 2 weeks early and it wiped out every single APPOINTMENT I had listed in my cell phone! THIS was a disaster for me! I have fully recovered from it and now have backups to backups of everything. &lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;</description>

      <title>Why call your (about to be) ex-husband's divorce lawyer?</title>
      <description>&lt;p&gt;So, you&amp;#39;re a Realtor, and here are your customer buyers. You&amp;#39;ve been working together for a few weeks now and you pretty much know just what they are looking for, you&amp;#39;ve shown them every matching listing that&amp;#39;s out there on the active market and you are scanning every possible lead to find the &amp;quot;one&amp;quot;. Another agent in your office announced at the company meeting that she&amp;#39;s going to have a new listing next week that perfectly matches your buyer&amp;#39;s wish list.&lt;/p&gt;&lt;p&gt;So, you can&amp;#39;t wait to call and&amp;nbsp;tell them your good news when you return from the weekly caravan tour with your company. The tour takes quite a while as there are now more new listings than there are houses being sold. Finally, you grab a bite to eat for lunch and over to the office to call your clients....only they don&amp;#39;t answer the phone, you leave a cheery message to call you right back as soon as they get your message.&lt;/p&gt;&lt;p&gt;By the end of the day, you have researched everything about this house and know it&amp;#39;s just the one they were describing. You have checked the zoning, taxes, how many steps up to the front door, every aspect they wanted to know about their future home. And you wait, you don&amp;#39;t hear from them.&lt;/p&gt;&lt;p&gt;The next morning, you are at your office and you still have no messages from your customers. You decide to give them another quick jingle. Nothing, no answer. Not a word, no message for you. They ALWAYS answered their phone before!&lt;/p&gt;&lt;p&gt;Ultimately, weeks later you find out they had called the number on a sign for a house that didn&amp;#39;t even remotely match the description they gave you, although it looked exactly like a home they would love to live in, it wasn&amp;#39;t anything like they had described because it is often hard to describe what you would like and not know that is what you wanted until you see it one day, driving along the same street you go down every day and this one particular day, there is a FOR SALE sign on that house....&lt;/p&gt;&lt;p&gt;So they called the phone number on the sign!!!! And this seems so perfectly natural for a person to do this, call that number on that sign to see how much they want for it, and when you could go see it. Innocently enough you can even figure you are &amp;quot;helping&amp;quot; your Realtor out by doing this. You are finding this home on your own, you are excited and you figure once you see the house, you can call your agent and let them know you found the house! OR Alternately, you can figure, gee I found the house myself, why should I call that Realtor at THIS Stage of the game?&lt;/p&gt;&lt;p&gt;Here is the issue, there are 2 of them. One is that called &amp;#39;procuring cause&amp;#39; and the other is called buyer representation. By not calling your agent, you are deleting them from the picture altogether legally the Agent who first shows the property to you is the &amp;quot;procuring cause&amp;quot; and the agent who writes the offer is NOT the procuring cause unless they introduced you to the property and showed it to you. &lt;/p&gt;&lt;p&gt;So your second problem is buyer representation, you have literally none. The agent you called is the seller&amp;#39;s agent, you are calling him and he has a written agreement with the seller that says he will get the most money for his property as he can. Once you enter the picture unrepresented, you may choose to hire that agent as your own just by calling him and having him show you the property, so now you have someone else&amp;#39;s agent working for you..... And you cannot call your agent to represent you and the reason you need this is for many reasons. You will need unbiased property specific comparables upon which to base your offer price. You will need someone looking out after your own interests such as the best day for you to close escrow and not lose out on lease money, interest or pay too much for the house based upon the actual comparable recent sales. Inspections. Every buyer should get any and all inspections they deem necessary to satisfy themselves as to the condition of the property. Do you suppose the seller&amp;#39;s agent really WANTS you to get any and ALL inspections on the property their seller is selling to you? Appraisal. Seller&amp;#39;s agent duty is to provide for reference only the comparables they have on the property to support the seller&amp;#39;s asking price, is that in the buyer&amp;#39;s best interest? If he doesn&amp;#39;t do that, then is THAT in the&amp;nbsp; seller&amp;#39;s best interest?&lt;/p&gt;&lt;p&gt;Repairs, is he going to be unbiased when reviewing an inspection report that is recomending costly repairs to a home that he has a written contract with the seller to sell for the most money possible? You need someone to counsel you on the wisest way to figure out which repair request is rational and which are bound to agitate the seller and cause the seller to refuse to do ANY repairs? &lt;/p&gt;&lt;p&gt;You need someone on YOUR side and the only way to do that is to AVOID calling the number on the sign and call in your buyer agent or representative, especially when you are entering a model home builder&amp;#39;s showroom for the first time. You will not have anyone on your side, they builder has the salesperson, the contractor, the lender in many cases all on HIS side, and if you enter their property for the first time without your representative, then YOU will be more likely to lose out NOT the builder. Your agent will be more than happy to take you on a tour of any new home communities that match your description and price range and neighborhood, if they are not willing or able to do this when you want to go, call just about ANY real estate office, there should ALWAYS be someone available to accompany you as YOUR representative to buy that new home or even to call that sign for you. In most cases, unless the sign designates office exclusive or something similar, ANY area agent can work as your buyer&amp;#39;s agent on ANY listed property, even FOR SALE by OWNER properties will basically work with your agent if they are bringing in a serious qualified buyer who will close escrow on their home for sale.&lt;/p&gt;</description>
