First Time Homebuyers: Here's Another Reason to Buy!!

If you're considering buying your first home, here's another incentive for you. This week, New York State introduced another tax credit for first time homebuyers.

It's called the Mortgage Credit Certificate. It allows home buyers to take a dollar-for-dollar federal income tax deduction of 20% of mortgage interest paid each year. The remaining 80% of the mortgage interest would still be treated as an itemized tax deduction- as usual.

Governor David Paterson says the average homeowner could save about $1,520 per year for the first 10 years of the mortgage. This new tax credit would be on top of the federal tax credit of up to $8,000- which is due to expire at the end of November.

A first time homebuyer is defined as one who has not owned a home during the last three years. For the New York State Mortgage Credit Certificate, buyers must get a fixed rate mortgage with a partipating lender. So far, Wells Fargo, Bank of America and M&T Bank have signed up and others are expected to take part.

There are income and purchase price requirements, depending on where you live. For Ulster County, the annual income limit for a household of up to two people is $83,640 and for a household of 3 or more, the limit is $97,580 and the purchase price must be below $354,970 for single family homes. In Orange and Dutchess Counties, the income limit for a household of one or two people is $97,061 and for a household of 3 or more the limit is $111,620 and the house must be purchased for less than $387,740 for a single family. Purchase prices can be higher for 2, 3 and 4 family homes.

The program is expected to be available by the middle of September. If you currently have an offer on a home, you can still apply for the credit. Homebuyers- Buy a home and get a tax credit!

It seems there is some confusion and mis-conceptions over the $8000 tax credit for first time homebuyers. What many people do not realize is that not everyone qualifies for the full $8000. The maximum credit is $8000.

First time home buyers or those who have not owned a home in three years qualify if:

•· They are single and make less than $75,000 or married and make less than $150,000. Above those incomes the credit is adjusted. A single person making over $95,000 or a couple making over $170,000 will not get the credit. These figures are based on the adjusted gross income.

•· Purchase is for a primary residence.

•· Home must be purchased prior to December 1, 2009.

•· Home purchases between relatives or other gifts of residences do not qualify.

Did You PreBuy Your Fuel Oil This Year?

Many of those who heat their homes with fuel oil are seeing a decrease in the cost of heating their homes. This is a pleasant surprise for most. If you are one of those who prebuys your oil in the summer you could be not so pleasantly surprised.

The prebuy is one of the many choices most fuel oil companies offer their customers. This program allows a customer to enter a contract and prebuy their fuel in the summer when prices are typically lower saving money in the winter when fuel costs are usually higher. Well.... that is most years. This year is different. In the past most years customers saved a lot of money by pre-purchasing their oil this year the gamble has gone the other way. Prices of oil have dropped significantly. So this year you may be paying a higher price then those that did not pre-buy.

Most oil companies that offer the prebuy have to turn around and buy the oil for their customer, at the summer price so they are "locked in" to the contract too. The prebuy is a gamble that historically has benefited the consumer this year it has benefited the invester that purchased oil futures.

There are programs that cap the oil price, in which the customer pays a fee to keep the fuel oil price below a particular point that is set by the company and others that offer downside protection so the customer gets the lower price. Most full service companies offer budget programs that allow a monthly payment throughout the year to help spread the heating costs over months.

When purchasing a home it is a great idea to interview oil companies before deciding who you will buy your fuel oil from. Things to consider beside these programs is whether the company is a full service company. If you are not able to maintain your system it is important to find a company that offers 24 hour service.

In Ulster County assistance is offered through Home Energy Assistance Program (HEAP) which is is a Federally funded program that helps low income households pay home energy costs and funds programs for low cost residential weatherization and other energy related home repairs. HEAP is available to low income, TA and SSI households during the heating season (mid-November through April).

Veteran's Day- Cell Phones for Soldiers

This Veteran's Day we are all grateful to those who have fought for the freedoms we are so lucky to have in our country.

As a way of showing our appreciation and in a small way of giving back our family has started a Cell Phones For Soldiers campaign in Ulster County New York.

Collection sites will be at Erichsen's Fuel Service in Highland New York and at Dependable Energy in Shokan New York.

Those who read my blog regularly know I am Catholic.

I rarely post a religious or political blog. It is not that I am at all ashamed of my beliefs. The opposite is true I am strongly committed to my beliefs. They make me who I am which comes through in my posts in a subtle way. This is what is comfortable for me.

Today, though, our nation goes to the polls to vote. I have been deeply concerned about this election. and have been praying for wisdom. As part of the Catholic Bishops novena prayer for the election we as a community have prayed:

Immaculate Heart of Mary,

help us to conquer the menace of evil,

which so easily

takes root in the hearts of the people of today,

and whose immeasurable effects

already weigh down upon our modern world

and seem to block the paths toward the future.

I received a request through ActiveRain from Raphael who wanted more information about the Broker/ Agent Relationship. This was a great question that people that are not in the real estate industry might not understand.

In New York the Department of State, Department of Licensing Services and the New York State Board of Real Estate regulate the real estate industry. New York State Real Property Law 12-A is the main source of the of the real estate laws.

The three real estate licenses that are available through New York State are the broker. The associate broker and the salesperson license.

The broker is authorized to operate his or her own real estate office. The associate broker has a brokers license but chooses to work through the sponsorship of another broker and the salesperson must work under the sponsorship of a broker. All fees are payable to the broker who in turn compensates the associate broker or salesperson, who may never accept a commission from anyone except his supervising or principal broker.

There may be some confusion on the who the agent is... The agent is the broker, associate broker or salesperson who is working for and in the best interest of a client. The client may be the buyer or seller who has established an agency relationship with a real estate professional.

A Realtor is a member of the National Association of Realtors. The designation has nothing to do with the licensing law. A broker, associate broker or salesperson can be a Realtor.

I am not a cold weather person- A little snow on Christmas is fine.

This morning the area mountains were snow capped!

It has been COLD! A real change and too quick....

That is unless you like to ski, snow tube or participate in any of the outdoor winter sports. Then you will be happy to hear that West Ulster County had it's first snow fall yesterday. Several schools were closed or released early due to the weather.

Now is a great time to think about finding a winter retreat in the Hudson Valley. There are many great homes on the market at really good prices.

Some Words Say So Much- a lesson from an 8 year old

Words can make such a difference in our world.

On Sunday, my 8 year old granddaughter had a soccer game with Highland United Soccer Club. Usually she plays a defensive postion for her travel team. She also plays in a recreational league where she plays in an offensive position as a wing. She is always dissappointed to be put in on defense- She wants to SCORE. On Sunday her team was up 5-0 so she got her chance- the coach put her in as a halfback, playing offense and defense. To our amazement Molly took off with speed we had never seen, usually not one of the faster kids on the field, she went after the ball got it an dribbled down the sidelines, brought it to the center and fired a dynamite shot on goal to score the teams sixth goal of the day. After that she was fired up. She was after the ball, dribbling around the other players, and making beautiful passes and had an assist.

After the game and all the high fives were said and done Molly and I were walking to the car. I told Molly I had never seen her run so fast. She said, "Oh Everett ( her older cousin) came to my practice and told me I was faster than that, so I showed him how fast I was and he said I was very fast."

Those simple words- "you are fast" changed her whole attitude and confidence level.

We are bombarded each day with words- The local and national campaigns seem to be so negative. Molly made me think- imagine how our country might react if we have some positive words coming at us- Wow think of the possibilities!

Winter Heating Worries???

My daughter owns a fuel oil company and my husband has been a oil burner technician for 35 years. Since my daughter just purchased her second company I have been pitching in to help the new company up and running. My husband is now working for my daughter as well.

As the heating season sets begins in the Hudson Valley we get calls everyday from people who are concerned about the cost of heating their homes this winter. I speak to people who, although the temperature is dropping, are holding off to turn on their heating system.

With the concern of the high cost of fuel many people may turn to alternative heating sources. Some safety practices to follow are:

When using a space heater:

Keep at least 36 inches of space between the heater and anythin that might catch fire.
Check the cord frequently- if it is hot or frayed do not use it.
Do not use space heaters when no one is home or when everyone is sleeping. Space heaters need to be monitored.
Do not use an extension cord with portable heaters.

When using unvented kerosene space heaters:(**Use of these is strictly prohibited in New York State in Multi family dwellings**)

Follow the manufacturers instructions closely for use and refueling.
Crack a window to provide adequate ventilation
Refuel OUTDOORS, away from the house- never on a porch, in a garage or in the basement.
Do not refuel when the heater is hot.

For maximun efficency have your oil burner sereviced by a professional every year. If you have a problem a few things to try before calling for service:

If you have no heat- check the emergency switch to be sure it did not get turned off accidentally. Push the reset button ONLY ONCE!!!
If you have smoke, soot or rumbling noise- turn the emergency switch off and call a professional.

New Home Warranty in New York State

There are great deals on the market for new construction homes. The question often arises as to what is covered when buying a new home in New York State. New York State law requires the buyer have certain warranties.

Covered under the new home warrantee are:

•· One year's protection against faulty workmanship and defective materials

•· Two year's protection against defective installation of the plumbing, electrical, heating, cooling and ventilation systems

•· Six year's protection against structural defects.

When a problem exists the new home owner must report the problem to the builder within 30 days after the expiration of the warranty. The builder is expected to make repairs within a reasonable amount of time after the problem is reported. The warranty does not cover construction done by the new homeowner.

Lawsuits must be filed within 4 years of the one year and two year warranty, and within seven years of the six year warranty.

These warranties are extended, when the home is sold within the warranty time to the next homeowner.

How to Avoid Carjacking

Driving to and from showings... scoping out new listings... parked outside a property waiting for clients. As a REALTOR^®, you spend a great amount of time in your car. Have you ever considered that you may be a likely target for a carjacking?

The latest statistics available from the federal government are for 2002, and they show that carjacking victimization rates were highest in urban areas (93%), followed by suburban and rural areas. A weapon was used in 74% of carjackings, including firearms (45%) and knives (11%).

Take some simple precautions to ensure that you don't lose your car to thieves!

When you're alone getting into your car, the first thing you should do is lock the doors. Be observant when approaching your car, looking underneath and in the back seat before entering.
If you're driving at night and are approached by a vehicle with blue lights, exercise caution. Call 9-1-1 to identify the vehicle, turn on your flashers to acknowledge that you see the police car, and keep moving until you're in a well-lit area. A legitimate law enforcement official will understand your caution.

In a parking lot, don't approach your vehicle if a van or other large vehicle with tinted windows is parked next to it. Find a security guard to walk you to your car, or look for a nearby couple walking to their car and say something like, "That vehicle wasn't there when I parked. Would you mind making sure I get into my car safely?"
Have your key ready to open the car door. Never stand next to your car searching through your purse.
Once in your car, lock the doors immediately.
Get moving. Don't sit inside of your vehicle adjusting the stereo, rummaging through shopping bags or your purse, or talking on your phone, especially if the lot is not well populated.
If you have an unlocking button or keyless entry system, make sure you unlock only the driver door. Unlocking all doors allows a predator to simply slide into your car from the passenger side.

•· Make sure that your dome light is always functioning properly. As you unlock your vehicle at night, glance into the back seat and make sure that an attacker has not gained access to your car.

Safety Tips for Clients

Your personal safety is crucially important-and so is the safety of your clients. As you become more aware of practices and perspectives that help keep you out of danger, share that knowledge with your buyers and sellers. They, too, can be vulnerable as they allow strangers into their homes, or visit other people's property.

Share this valuable advice with everyone, and you'll help them learn to protect themselves against crime:

Remind sellers that strangers will be walking through their home during showings or open houses. Tell them to hide any valuables in a safe place, including prescription medications and alcohol, as well as personal information such as bank statements that could be used for identity theft.

Warn your clients that not all agents, buyers and sellers are who they say they are. Strangers who stop by a listing unannounced should be asked to make an appointment with the REALTOR^®. Stress that your clients should never show a home without an agent present.

Inform your clients that they are responsible for their pets. If possible, animals should be removed during showings. Make clients aware that buyers and agents are sometimes attacked, and the owner will be held liable.

At an open house, be alert to the pattern of visitors' arrivals, especially near the end of showing hours. In some areas, a group of thieves will show up together near the end of the open house and, while a string of supposed buyers distracts the REALTOR^®, the rest of the group walks through the house, stealing valuables.

When you leave a property, whether after an open house or a showing, make sure that all doors and windows are locked. Thieves commonly use open houses to scout for valuables and possible points of entry, then return after the agent leaves.

Let your clients know that you will take all of the above safety precautions, but that when they return home, they should immediately verify that all doors are locked and all valuables accounted for.

The 10-Second Rule

One of the most common reasons that people find themselves in dangerous situations is that they weren't paying attention. Take a few precious seconds during the course of your day to assess your surroundings.

Take 2 seconds when you arrive at your destination.

• Is there any questionable activity in the area?

• Are you parked in a well-lit, visible location?

• Can you be blocked in the driveway by a prospect's vehicle?

Take 2 seconds after you step out of your car.

• Are there suspicious people around?

• Do you know exactly where you're going?

Take 2 seconds as you walk towards your destination.

• Are people coming and going or is the area unusually quiet?

• Do you observe any obstacles or hiding places in the parking lot or along the street?

• Is anyone loitering in the area?

Take 2 seconds at the door.

• Do you have an uneasy feeling as you're walking in?

• Is someone following you in?

Take 2 seconds as soon as you enter your destination.

• Does anything seem out of place?

• Is anyone present who shouldn't be there or who isn't expected?

It takes just 10 seconds to scope out your surroundings and spot and avoid danger. Make this "ten-second scan" a habit in your everyday work as a REALTOR.^® Then share it with someone else.
