P A S S

Pull the Pin, at the top of a fire extinguisher. You find a pin that releases a locking mechanism and will allow you to discharge a fire extinguisher. In the event of a small fire has started.

Aim at the base of the fire, not at the flames themselves. This is highly important for you to understand. In order to put out a fire, you need to extinguish the fuel feeding the fire.

Press the fire extinguisher lever slowly, this will release the extinguishing agent in the fire extinguisher. Be sure to have a good hold of the lever, if the handle is released for any reason, the fire extinguisher is going to stop discharging.

Sweep from side to side, using a sweeping motion, move the fire extinguisher back and forth until the fire is completely out. Operate the fire extinguisher from a safe diistance, several feet away, and then move towards the fire as it starts to diminish. But remember to be sure to read the instructions on a fire extinguisher, before you may need to use it. Different fire extinguishers recommend operating them from different distances. Remember to aim at the base of the fire, and not at the flames!!

5 More Tips for Moving with Pets

Earlier I posted 5 Tips for Moving with Pets. From the same helpful folks at PetRealtyNetwork here are another 5:

•1.     Play it safe in the car. It's best to travel with your dog in a crate; second-best is to use a restraining harness. When it comes to cats, it's always best for their safety and yours to use a well-ventilated carrier in the car. Secure the crate or carrier with a seat belt and provide your pet with familiar toys. Never keep your pet in the open bed of a truck or the storage area of a moving van. In any season, a pet left alone in a parked vehicle is vulnerable to injury and theft. If you'll be using overnight lodging, plan ahead by searching for pet-friendly hotels. Have plenty of kitty litter and plastic bags on hand, and keep your pet on its regular diet and eating schedule.

•2.     Get ready for takeoff. When traveling by air, check with the airline about any pet requirements or restrictions to be sure you've prepared your pet for a safe trip. Some airlines will allow pets in the cabin, depending on the animal's size, but you'll need to purchase a special airline crate that fits under the seat in front of you. Give yourself plenty of time to work out any arrangements necessary including consulting with your veterinarian and the U.S. Department of Agriculture. If traveling is stressful for your pet, consult your veterinarian about ways that might lessen the stress of travel.

•3.     Find a new veterinary clinic and emergency hospital. Before you move, ask your vet to recommend a doctor in your new locale. Talk to other pet owners when visiting the new community, and call the state veterinary medical association (VMA) for veterinarians in your location. When choosing a new veterinary hospital, ask for an impromptu tour; kennels should be kept clean at all times, not just when a client's expected. You may also want to schedule an appointment to meet the vets. Now ask yourself: Are the receptionists, doctors, technicians, and assistants friendly, professional and knowledgeable? Are the office hours and location convenient? Does the clinic offer emergency or specialty services or boarding? If the hospital doesn't meet your criteria, keep looking until you're assured that your pet will receive the best possible care.

•4.     Prep your new home for pets. Pets may be frightened and confused in new surroundings. Upon your arrival at your new home, immediately set out all the familiar and necessary things your pet will need: food, water, medications, bed, litter box, toys, etc. Pack these items in a handy spot so they can be unpacked right away. Keep all external windows and doors closed when your pet is unsupervised, and be cautious of narrow gaps behind or between appliances where nervous pets may try to hide. If your old home is nearby, your pet may try to find a way back there. To be safe, give the new home owners or your former neighbors your phone number and a photo of your pet, and ask them to contact you if your pet is found nearby.

•5.     Learn more about your new area. Once you find a new veterinarian, ask if there are any local health concerns such as heartworm or Lyme disease, or any vaccinations or medications your pet may require. Also, be aware of any unique laws. For example, there are restrictive breed laws in some cities. Homeowner associations also may have restrictions - perhaps requiring that all dogs are kept on leashes. If you will be moving to a new country, carry an updated rabies vaccination and health certificate. It is very important to contact the Agriculture Department or embassy of the country or state to which you're traveling to obtain specific information on special documents, quarantine, or costs to bring the animal into the country.

Real Estate Prospecting - Turning Cheese into Soul - Open Houses

After a week away (thank you Robin!), I'm back in the saddle, talking about turning Prospecting Cheese into Soul... Today's topic is the non-cheesy Open House.

First, allow me to pontificate for a moment that I believe the first priority of any open-house-giver is to attempt to sell that house. After all, someone owns that house and has hired you, or an associate of yours to care enough about his listing to try to sell it. And no matter what you tell a seller ahead of time, he really does expect the offers to start pouring in at 4:05.

So, just remember that your primary obligation is to the seller, not yourself. Lecture over.

All that said, most of us do look at an open house as an opportunity to pick up buyers. Maybe even sellers. So, how can you do that without resorting to Old School Cheese? (That sound kinda gross, doesn't it?)

My best advice for figuring out what NOT to do is to spend a sunny Sunday visiting other agents' open houses. Egads, some of us are cheesy. Or, if not cheesy, just plain dumb, aka, unprepared. I visited an open house last winter and eavesdropped in as a visitor asked the agent how old the furnace was. The agent smiled brightly and said those magic words: "I don't know, but I'd be happy to find out for you!" This piqued my curiosity, so I actually went into the basement and, get this - LOOKED at the furnace. It was obviously brand new. I'd think that anyone who had ever seen a furnace could tell that. Of course, that would have meant that the agent would have had to have made that long journey down the stairs to see for herself - but clearly that was too much to ask.

I've also heard rumors of agents requiring ID before allowing visitors into the property. Okay, maybe in a multi-gazillion dollar home, but your run-of-the-mill listing? Puh-leeeeeaze.

Do I require sign-in? No, I don't. I just don't feel comfy doing it, but it's not something I advise against. When I hold an open house, I'm looking for quality over quantity. I'm hoping to connect with one or two visitors; someone I have a natural rapport with. When I find that rapport with a visitor, it's easy for me to draw them into a conversation about real estate and most of the time; they ask ME for my card. I like that. If I had people sign-in, I know I wouldn't follow-up unless I felt that rapport, so I just don't bother.

When you hold an open house, pretend that there's a hidden camera watching your every move (who knows?). Don't do anything the seller wouldn't approve of. Don't criticize the house (that guest you're talking to might know the seller and report back, or he might be a seller prospect himself and be less than impressed with your professionalism!), or aggressively direct visitors toward your fancy list of "other properties they might consider instead." It's far less cheesy (and effective) to be able to simply discuss the market conversationally, rather than push a pre-prepared package on guests.

After my last post this seems appropriate again. We can't survive or strive if we let the short sighted among us deyne us the right to fail, because failure is the opposite side of the success coin! You simply can't have one with out the other.

Being empty nester's, Brenda and I more often than not watch the news during dinner, some days we make the mistake of paying to much attention. We heard that home owners never knew they had to make their payments and there ought to be a new law to protect them. Then they were interviewing high school students who had obviously not been allowed to fail, but socially promoted. Functional morons.

What about the poor morons?Then I remember that it had been suggested that Loan Originators should have kept these morons from these terrible loans. But, for more than three decades we've had civil rights laws that strive to take discrimination out of lending! Also in the name of civil rights we've developed the greatest opportunity for home ownership known to man!

The opportunities/the tools, were the very things that they would have the Loan Originators selectively discriminate the morons from! The only legal way to protects morons is to deny everyone the programs that helped so many.

What about the poor morons, they are not to stupid to get an attorney or call the state or the FTC and complain if they think you've keep them from a loan or home they qualified for. They would be in the right!

We could rewrite the law, that's easy! But, what about the overwhelming majority that use the same programs and succeeded?

Let's put this in a different perspective, Brilliant Little Janie is now in school, many students fail in school! Because of her carrying parents, she does well, maybe failure just isn't in her genes. Sitting next to her in first grade is Little Johnny Moron, who's parents don't care. Little Johnny is going to fail first grade. It's hurts to be called a failure! It hurts to fail. So we pass a law restricting what can be taught to first graders, so that even the Moron's kids can't fail.

The Moron's mother likes the new law, her kid can't fail. But, what about Little Jannie parents? Their daughter was going to succeed beyond their wildest dreams, but now to insure that the Moron's kids pass Little Jannie can't be challenged. She can't have the opportunity to succeed because Little Johnny Moron can be allowed to fail.

Failure is one of God's greatest gifts. Failure inspires great men and women! Failure empowers people knowing you can survive failure is one of mankind's most important asset. Failure can trap some, but they were already doomed, not everyone can succeed. Would you really limit Little Janie and everyone else to protect Little Johnny's feelings? Really?

Would you over turn 148 years of progress and the great accomplishments of the last 30 years, to keep a few from failing? Really?

Are you the one to decided who deserves a home of their own?

Everyone deserves the opportunity to fail! God gave mankind freewill knowing that we'd become sinners. Of what value would life be without the opportunity for personal success? Those that believe "it takes a village" see others as nothing more than swine in a sty!

Those that say there ought to be a law, forget there already is! If laws are broken then I suggest we try enforcing the existing ones before we further restrict everyone!

New Fannie Mae Automated Underwriting (DU) Eligibility Changes.

Today Fannie Mae released Automated Underwriting (DU) Version 8.0 and these changes are bound to have a big impact especially on multi-family houses. Some of the changes included in this release are as follows:

Minimum FICO score 620 (was 580)

2 Unit Owner Occupied Property - maximum LTV 80% for purchase & rate/term refinance (was 90%)

2 Unit Owner Occupied Property - maximum LTV 75% for cash out refinance (was 85%)

2 Unit Investment Property - maximum LTV 75% for purchase & rate/term refinance (was 80%)

Unit Investment Property - maximum LTV 70% for cash out refinance (was 75%)

In addition to the eligibility changes listed above, the updated version (DU 8.0) will limit the maximum allowable total expense ratio to 45 percent, with flexibilities offered up to 50 percent for certain loan case files with strong compensating factors.

If current debts exceed the maximum allowable total expense ratio, the loan case file will receive an Ineligible recommendation. DU will no longer return a Refer recommendation on loan case files that would have otherwise received an Approval, but had exceeded the maximum allowable total expense ratio.

All new cases submitted to DU will now be scored with the 8.0 version and the new eligibility will be applied. New cases submitted prior to today will be scored with the current version DU 7.1 and will continue to score as DU 7.1 on subsequent submissions, however, loans using DU version 7.1 must close by February 12, 2010.

I would STRONGLY recommend that if you have run a Borrowers file through DU before today, and received an Approved/Eligible, but the Borrower has not gone under contract yet, that you run it through DU again. I am sure that there will be many Borrowers that received an Approved Eligible under version 7.1, that will no longer receive an Approved/Eligible under version 8. It would be a shame to have a Realtor that you partner with run around trying to find one of their Buyers a house, and the Buyer no longer qualifies.

If you are a Realtor or a Buyer I would again STRONGLY recommend that you contact the Loan Officer or Broker that you are working with and ask them to run your file(s) through DU to make sure that you have not been affected by this change.

My Simple Approach to Blogging

Now that I have been around blogging for awhile, I think it is time that I provide feedback to those who have helped me along the way. First of all, thanks to all of you for your patience and your willingness to share, because that's the way it's done on Active Rain. Today, after taking inventory, I think I have a formula that I will apply moving forward. Here it is

I have coined it "My Simple Approach to Blogging."

1. Define the purpose of my blog to my target audience (Primarily buyers, sellers, investors, and anyone relocating to Albuquerque or Rio Rancho).

2. Post at least one article of relevance per week. I will be posting on the weekend.

3. Login to Active Rain daily to read the blogs of others, and to leave comments where necessary

4. Spend at least one hour per week to inquire about gadgets, widgets and the like, which could enhance my web presence

5. Spend at least one hour per week to checkout the Active Rain Blog and its Archive. I have recently discovered that there is a wealth of information there.

OK before I get started let me say that I know from experience that most REALTORS® are good hardworking trustworthy folk. BUT…….not all.

As in any profession there are wolves in sheep clothing. You may think they are looking out for you when the reality is they are just looking out for their wallet.

Recently I have had agents on the other side of the transaction literally crying and begging for me to get an offer accepted because they needed money for Christmas. I would like to say I was shocked but I wasn’t. In my 15 years of being a REALTOR® not much shocks me anymore. Agents begging to get paid is quite common.

What am I, as the representative for the Seller, supposed to do with this information? Keep it as a secret (professional courtesy) or tell my Seller and use it to our advantage? What do you do?

Folks this is a big deal. Why in the world would an agent, I don’t even know, give me this information? I’m a Broker for Pete’s sake!! Don’t they know I am going to use this information to help my customer/client get a better deal?

I know for a fact that one recent Buyer paid several thousand more for a property and is paying a higher interest rate on an owner financed deal because their REALTOR(R) was desperate. We countered accordingly knowing that the other agent would “sell the deal”. And they did.

How often does this happen? Are you a desperate REALTOR®? Are you costing your customer/client money because you need a paycheck? I hope not. What say you?

Holiday Networking: Please STOP humping my leg!

I was recently listening to Jason Crouch's Social Media Edge blog talk radio show and his guest Chris Brogan actually used the phrase when discussing a very aggressive person who was vying for his time and business. The fact remains that many people don't seem to have any idea how pushy and irritating they can be (though many do intentionally) in business and social settings. Ironically while I was on office property tour with some of my associates earlier in the day I experienced the same behavior...literally. One of the homes we visited had an English Bulldog as a pet and as I am fan of the breed, I stopped to pet and scratch the happy dog and enjoyed playing for a few moments. On the way out the dog came running around the corner for some more and in the excitement got more than a little carried away. I can understand this as I am friendly, outging and attractive in a rugged sort of manner and it's obvious...you can see it in the dog's ecstatic expression BUT this was too much! So don't let this happen to you and don't YOU be this dog in social situations! (Photo by my colleague Francie Little)

This brings me to the subject of networking during the holidays. It really is an excellent time to be out and about and frankly I enjoy visiting with friends, colleagues and many new people at the numerous social functions that occur during the season. I've already been to several parties this month and though I have not suffered the same gripping behavior I have been the recipiant of several moments that don't fit the bill. Please don't shove a card in my face and tell me to call you. If I am interested, I will ask for your card and hopefully my wife will remember your name if I forget. I am not out to sell anything except maybe me as a person behind my profession. Like most folks at nearly all parties, what we do for a living will come up and we will have plenty of time to visit about work and hopefully other things too!

I am always amazed at the fact that people are so interested in talking about real estate so I try to be prepared with statistics and a general overview of my particular market as well as current trends and opinions. Parties seem to lighten the attitude and people are genuinely interested in the real estate market in a non-threatening environment. Because of this, I take the opportunity to share with as much or little as required and nothing more! My sharing is limited to as much as is comfortable and I always keep it light and never offer my own card or press for personal information. Again, I don't enjoy high pressure sales tactics or manipulatiion by people who dominate the conversation for their own self gratification or needs. I mean really, it's a party so let's all relax and have a good time! Before You Advise Your Clients Rent Their Current Home And Buy Another One, You Need To Know This!

When someone buys a home before selling their current home, they may have a problem: if they have a mortgage on the old home, that debt is included in their debt-to-income ratio.

In the old days (pre-2008), home buyers who did not sell their home first had at least a couple of ways to offset their mortgage debt.

Some lenders would accept the income reported on a rent survey prepared by a licensed appraiser. Other lenders would accept a rental agreement.

The lender would subtract 25% of the income obtained by either of these methods off the top to account for expenses and vacancy. They would then subtract out the PITI (principal, interest, taxes, and insurance). If there was a positive balance left after this calculation, it was added to the homebuyer's income. If there was a negative balance, it was added to their debts.

Most lenders still use this method to calculate the positive income or negative debt. Now, however, there is a twist. You need to be concerned with the amount of equity in the old property. In addition, more documentation is required for rental income to be included.

Fannie Mae now requires the following documentation to use rental income from a primary residence converted into a rental property:

An executed lease agreement

receipt from the tenant of a security deposit

supporting documentation of deposit of the security deposit into the homebuyer's account

These documents seem to make sense. However, what happens if the sale falls apart? Hopefully the rental agreement has a contingency for this so the homebuyer doesn't have to move out if his purchase doesn't happen.

Here is the part that has changed that really can be the deal-killer, especially in this market: the homebuyer must have 30% equity in their current home in order to use the rental income. If they do not have 30% equity, even if they have satisfied the conditions above, they must include the PITI on the old home as a debt with no rental offset!

Why, you may ask, is 30% equity required to use the rental income? Fannie Mae is worried about buying and bailing. Buying and bailing means buying a new home while your credit is good, and then walking away from the loan on the old home.

My guess is that Fannie Mae has an interest in such a large percentage of homes, this is how they keep people in the homes with a low percentage of equity. If they can't qualify, they are less likely to bail!

Fannie Mae now requires an appraisal on the current home that is no more than 60 days old at closing to determine if the homebuyer has 30% equity in the current home.

It's critically important for both loan originators and real estate agents to stay on top of current guidelines. By the way, did you know that starting on December 12th (tomorrow) Fannie Mae is reducing their maximum debt ratio from 55% to 45%?

Well, it's done. The Christmas tree is up, the decorations are scattered throughout the house. The stockings are hung by the front door with care (no chimney- it really doesn't get that cold here). I wanted to get everything up the weekend of Thanksgiving, like we did last year, but it just didn't happen. That gave us about 5 weeks to enjoy the tree, without feeling like it was up and then right back down again. Oh well. Anyway, we're all set.

During the holiday season, what is a seller to do? The house is on the market. Should they go all out and deck the halls, or should they keep it to a minimum to avoid the clutter? This is a question that comes up often at this time of year. Some even ask if they should keep their home on the market during the holidays. It's true, showings typically drop off on houses during Christmas. People are busy preparing for the season, heading out of town and spending money. Often the focus is not on buying that new home.

But, I will say, that the buyers that are out, are usually serious ones. If they're looking in December, they typically mean business. Also, often times December is the time to snatch up that great deal. Some sellers are hoping to get that house sold before the end of the year.

While your house is on the market, keep the decorations to a minimum and be sure that they are tasteful. A buyer is coming to look at the house, not at your beautiful Christmas items. Don't make the house show smaller due to decorations in every nook and cranny and don't forget to have a happy holiday season.
