First Time Home Buyer Tax Credit - Use it by December 1st or Lose it!

The government's First-Time Home Buyer Tax Credit expires December 1, 2009.

If you expect to use the program in conjunction with a home purchase, you may want to consider yourself officially "on the clock".

Assuming a 60-day window between contract and closing, there are now 77 days left to find a home and go under contract for it.

The First-Time Home Buyer Tax Credit refunds up to $8,000 at Tax Time for qualified home buyers. A few of the program's qualification criteria include:

1. Home buyer must not have owned a primary residence in the past 36 months

2. The home may not be purchased from a family member.

3. The household adjusted gross income must be below $95,000 for single tax filers and $170,000 for joint tax filers. To receive the full credit, it's $75,000 and $150,000 for singles and joint filers, respectively.

4. The tax credit itself is limited to $8,000 or 10% of the purchase price, whichever is less.

Remember, though: The refund is a true tax credit - not a deduction. This means that a taxpayer owing $8,000 to the IRS and claiming the $8,000 First-Time Home Buyer Tax Credit would owe the IRS nothing on April 15, 2010.

We had a tragic loss in our company over the weekend. One of our agents died tragically. He was a well-liked person, a family man, and an overall good soul.

One thing I've learned is not to take life for granted or too seriously. We have to enjoy every minute of it, and be the best person we can be.

Nothing matters more than providing for yourself, your family, and those that matter most to you.

UPDATED Stimulus Package Housing Tax Credit

Well it looks like the Senate & House have come to a compromise on the HUGE economic stimulus package with the grand total working out to be $789 Billion. Included in this package is the homebuyer tax credit that we have been hearing about for the past couple of weeks. It appears that the tax credit is going to be available to ALL home buyers and it is going to be capped at 10% or $8,000 which ever is lower. Now unlike the first time home buyer tax refund that has been in place since last July 2008 it looks like this $8000 COULD be a tax credit, and there were some serious differences between what the House and the Senate proposed. SO what is the difference?

The $7500 first time home buyer program that is in place now is a dollar for dollar refund. This means if a first time home buyer owes $0 in taxes they will get a $7500 check when they file taxes. If they owe $8000 in taxes they will only have to pay $500. Under this program the $7500 will have to be paid back, starting in the 3rd year they are in the home.

Under the proposal that was made by the HOUSE the $7500 tax credit would still be available to first time home buyers, under the same terms, BUT it would NOT have to be paid back essentially becoming a true $7500 refund paid by the government

The $15,000 home buyer tax credit proposed by the SENATE was basically going to allow home buyers to recoup up to $15,000 in Federal taxes that have either been withheld during the year(for W2'd employees) or are due come April. The most significant difference, FROM WHAT HAS BEEN RELEASED SO FAR, is that if a home buyer only paid $4000 in taxes this year they would ONLY get back that $4000, not the full $15,000. If a home buyer has enough deductions where they pay $0 in federal taxes they would get $0 of the $15,000. This credit could be used over a 2 year period.

So where we are now is some middle ground between the House and Senate proposals. We DO know that the amount is going to be $8000 but at the time of this email it hasn't been released if this is going to be a true refund like what first time home buyers have now, if it is going to have to be paid back or if it is going to be a tax credit like the senate proposed. Mindset is the key to success and prosperity.

I want to make it a goal to start writing, or "blogging" on a daily basis...which will probably last about a week.

The point of today's note is to attempt to help start the correction of the economy. Yes, I believe I have the entire solution for everyone. You know, it's interesting, they say the most NEW millionares are created during times of recession and depression. Yes, that's right. More millionaires emerge in our great country during econonomic slowdown.

They also say that the best salespeople make the most money during the worst markets...

Why is that, you ask? It can't possibly be more than good timing, or shear luck, can it? Well, I believe it's more than just "shear luck". I know for a fact it is.

It's a little thing called mindset. What we are THINKING at the moment. Right now, the reason folks are afraid to spend money, or are scared of what's supposedly happening right now, is simply their mindset. The mindset that they don't have enough money to pay their bills, the mindset that they might not have a job next week, or might not be able to find a new one.

It's simple, correct your mindset, and everything else will start to fall into place, and things will get better.

I need to correct my mindset starting today. In 2008, my second year in Real Estate, I closed 27 transactions. My goal is 40 this year. I just pended my first deal yesterday for the year. Time to correct my mindset, and focus on my goals...

How do you correct your mindset? Very simple, keep yourself around positive thoughts all the time. Surround yourself with those more successful than you are. Stay away from the water cooler at work. Keep your news watching to a minimum, and I'm talking, weather, sports, and nothing else. You'll hear what's going on from everyone else anyway...

Wow...I can't believe it's been this long since my last post. I used to be all about it, but have gotten...well...BUSY! HAHA.

Real Estate is exciting. That's it. No other way to describe this business. The media will make you think that we're in a down market, or declining market. I can tell you that is simply not true. We are in a correcting market.

Mortgage rates are great, housing prices are down, and there are more homes to see out there than there have been in a long time.

MUST READ for Buyers and Sellers

If you haven't heard already you will eventually hear that the Federal Reserve for the first time in 9 months has NOT cut their interest rate. This move comes in response to the growing risk of inflation which has driven up everything from mortgage rates to the price of a gallon of milk. We have included an article which breaks down what consumers can expect as a result of this move and gives an idea of what we may see in months to come. This excerpt should speak volumes to any buyers the fence or sellers that are holding off on a "market adjustment".

"Why it matters

Even as the Fed leaves rates unchanged, what they say about the economic picture could also influence consumer interest rates in one direction or another. "Most likely they will express concern about inflation," said Keith Gumbinger, vice president of HSHAssociates.com, an online publisher of consumer loan information, which could send consumer interest rates higher as people take that as a cue that the Fed intends to start raising rates soon. So if you are in the market for a house, now could be the time to pull the trigger before rates rise even further. As Tyson points out, yields on 10-year treasury notes are still relatively low, an indication that 30-year mortgages could still be a good deal."

Money is going to get more costly in coming months with rates on the rise. This is a great time for buyers to get serious before rates get too high and that dream house is no longer affordable. It is equally as good a time for sellers to get serious before they have to drop the price of their homes in order to compensate for the increase in rate. Goodbye to one of my comedic heroes

I must say that although irreverent, and often obscene, this man was pure genius, and I would die laughing. Although only 25, I grew up as a George Carlin fan, as I would play his old albums from my dad's turntable.

I had the privilege of seeing him live once, and I will remember it until the day I die.

George Carlin

GEORGE CARLIN, the comedian whose insights on life and language were immortalized in his "Seven Words You Can Never Say On TV" routine, died of heart failure SUNDAY. He was 71.

CARLIN, who had a history of heart trouble, went into ST. JOHN'S Health Center in SANTA MONICA on Sunday afternoon complaining of chest pain and died later that evening, said his publicist, JEFF ABRAHAM. He had performed as recently as last weekend at the ORLEANS CASINO AND HOTEL in LAS VEGAS.

CARLIN's jokes constantly breached the accepted boundaries of comedy and language, particularly with his routine on the "Seven Words" -- all of which are taboo on broadcast TV and radio to this day. When he uttered all seven at a show in MILWAUKEE in 1972, he was arrested on charges of disturbing the peace, freed on $150 bail and exonerated when a WISCONSIN judge dismissed the case, saying it was indecent but citing free speech and the lack of any disturbance.

When the words were later played on PACIFICA WBAI/NEW YORK, they resulted in a 1978 Supreme Court ruling upholding the government's authority to sanction stations for broadcasting offensive language during hours when children might be listening.

"So my name is a footnote in American legal history, which I'm perversely kind of proud of," he told THE ASSOCIATED PRESS earlier this year.

What do I do to earn my commission?

As an agent, I often get asked that question...so I wanted to share, with you, the consumer...what every agent should share with you before you sign the listing contract.

When you set the appointment, are they sending you a pre-listing packet? Most agents do send something out ahead of time, but it often contains, everything about them and how great they are. I call these packets fish wrapping.

A pre-listing packet should include the following:

Past Client References
Agent Track Record (For that year only)
Listing Plan of Action...what do they do to sell a home.
Marketing Services (just a simple description of what they do to get the word out)
Your Property CMA and their recommended price
An Estimate of Closing Costs based on their recommended price
The entire listing contract, and all disclosure forms.

When you set an appointment with me, you will see everything I mentioned above. By including everything a day or two before...it allows you to have questions ready for the agent, and familiarize yourself with the comps, as well as the contract.

From the moment an agent lists a home, you need to know what they're doing. What is their game plan? By having a copy of a Plan of Action, you can make sure everything is being followed to the letter.

How do you earn your 6 percent?

Let's face it, we get those folks all the time that want us to cut our commissions. We always get asked, "what do you do to earn your 6 percent?"

Well, I don't know about you, but I'm done justifying what I do for my 6. It's either work with me and take advantage of the programs I offer, or find someone else. No more 5 percent listings, not that I have had that many anyway...but there have been a few. Of course, there are exceptions if you can get a good priced property, and have a buyer for it when you walk in for the appointment.

What is the difference between 5 and 6 percent? To the seller, it's 1% of the sale price...and statistically, it means a higher sale price, and less days on market. To the seller, it ends up being more money to pay less commission if you ask me.

THE LISTING PLAN OF ACTION

My objectives are the following:

1. To assist in getting as many QUALIFIED buyers into your home until it is sold.

2. To communicate to you weekly the results of our activities.

The Following Are the Steps I Take to Get a Home Sold ... the "Pro-Active Approach":

1. Submit your home to our local Multiple Listing Service.

2. Price your home competitively ... to open the market vs. narrowing the market.

3. Follow the 30-10-1 rule. 30 Days on Market, 10 or less showings, and 0 offers means it's time to reduce the price.

8. Constantly update you as to any changes in the marketplace.

9. Prospect 3 hours per day and talk to 25 people per day looking for potential buyers.

What's your current listing inventory right now? How many homes are you currently marketing?

Me...I'm at four, looking to increase to 10 and eventually 20-30 this year. It's a challenge, that's for sure. I prospect for new listings daily, and I have to say, since I started my coaching program, I'm definitely listing less homes, but higher quality ones.

My question to you, how many listings do you walk into, where the seller wants you to list the home, but you don't want to take it? We let our ego get in the way, and we end up listing it to sit. Six months later it expires and someone else gets it for a lower price and then sells it. It happens all the time in this business.

What about this? Price your homes to sell, and refuse to take any overpriced listings. If you have listings that are not moving, do yourself and the real estate community a favor, and release the listing back to the seller.

If every one of us practiced this method, the market would always be healthy (no over-saturation), and we'd all make great money.

In today's competitive market, you really need to listen to your agent's advice today. Allow them to be your advocate throughout the entire listing process. Make sure you hire an agent that will price your home to sell.

Often times, the highest price is not the best. An agent that will list your home overpriced, assumes that they can take the listing now, and then beat you up on the price weekly until you cave in. That's not going to work in today's slowing real estate market.

My suggestion is to price your home 5% below the recent settled comparables. The market will not allow you to sell too low, as when a home is underpriced, more than likely you will received multiple offers and create a bidding war on the property.

Do the right thing, list your home with an agent that will be pro-active, and price it right from the beginning!
