      <title>7 Tips To Remember When Buying A 'Short Sale'</title>

Understand that although the home seller may accept your purchase offer, there is another step involved in the process -- the home seller's lender approving the short sale. Here are a few keys to successfully purchasing a short-sale home.&lt;/p&gt;
&lt;ol&gt;
&lt;li&gt;Patience is necessary to accomplish the home purchase.&lt;br /&gt;&lt;br /&gt;&lt;/li&gt;
&lt;li&gt;Work with a professional real estate agent familiar with short sales. (Give us a call to assign us as your buyer's agent.)&lt;br /&gt;&lt;br /&gt;&lt;/li&gt;
&lt;li&gt;With your agent's expertise, educate yourself on the true market value of the home.&lt;br /&gt;&lt;br /&gt;&lt;/li&gt;
&lt;li&gt;Realize that the sellers (and their lender) will make no money on the sale of the home.&lt;br /&gt;&lt;br /&gt;&lt;/li&gt;
&lt;li&gt;Understand that the lender is more likely to accept the short sale if foreclosing on the property would cost even more.&lt;br /&gt;&lt;br /&gt;&lt;/li&gt;
&lt;li&gt;Be willing to renegotiate the purchase price if the lender sends a counterproposal through the seller's real estate agent.&lt;br /&gt;&lt;br /&gt;&lt;/li&gt;
&lt;li&gt;Be very flexible in your closing/settlement date since few short sales close in 30-60 days as typical home sales often do.&lt;/li&gt;

&lt;p&gt;&lt;strong&gt;First-time home buyers have been eligible for tax credits of up to $8,000 since last January&lt;/strong&gt; as part of this year's economic stimulus package.&amp;nbsp; The newly backed program will expand the credit to include existing home owners.&amp;nbsp;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Under the revised program, those who have owned a home for at least five years&lt;/strong&gt; will be able to apply for tax credits of up to $6,500 when they purchase their next home.&amp;nbsp;&amp;nbsp;To qualify, buyers will have to sign a purchase agreement by April 30, 2010 and close by June 30.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;The maximum purchase price on a home will be $800,000 with vacation homes not eligible. Income limitations are $125,000 for single tax payers and $225,000 for joint filers.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;The National Association of Realtors (NAR) and the National Association of Home Builders (NAHB)&lt;/strong&gt; have been lobbying hard for the extension and expansion of the tax credit.&amp;nbsp; NAR claims that so far, about 1.4 million first-time homebuyers have qualified for the program and they estimated that 350,000 of these buyers would not have otherwise purchased.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;The tax credit is also set to be extended for another year for military personnel&lt;/strong&gt; serving outside of the United States until June 30, 2011.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Senator Johnny Isakson, who heavily pushed for the extension&lt;/strong&gt;, along with his own version that would have increased the credit to $15,000 stated, &quot;This is probably the last extension.&quot;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;But, is this really true?&lt;/strong&gt;&amp;nbsp; When April 2011 comes around and the housing market is still not in full recovery mode, will the politicians be able to let this go and actually come to an end, or could it possibly become a more permanent subsidy?&amp;nbsp;&lt;/p&gt;

Or know someone who is? Compared with a few years ago, today's lenders are looking for higher credit scores to approve mortgages and to offer the best rates. Getting the best interest rate on a mortgage means qualifying for a larger loan amount or a smaller monthly payment.&lt;br /&gt;&lt;br /&gt;Many of our clients today are looking to move -- or are helping a family member buy a home in today's market. No matter if you are the buyer -- or you're helping an adult child or grandchild or niece, nephew, in-law or other relative -- knowing the new rules of credit is critical. That's why it's more important than ever for you or any borrower to keep a close eye on credit reports and do everything to improve one's credit score.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;What's The Score?&lt;/strong&gt;&lt;br /&gt;Your credit score is an objective measure lenders use to assess your creditworthiness. It summarizes a number of different types of financial behaviors that can help predict whether you are likely to meet your repayment obligations. Information about you comes from the &quot;Big Three&quot; credit reporting agencies -- Equifax, Experian and TransUnion -- which receive reports from creditors (usually monthly) about how you pay your bills, what type of accounts you have, etc. That information is compiled and updated in your credit report.&lt;br /&gt;&lt;br /&gt;Your credit score is developed using a mathematical formula that &quot;weighs&quot; various types of information in your credit report, depending on how well each type of information tends to predict credit behavior. For example, defaulting on a loan will affect your credit score a lot more than, say, two 30-day-late payments.&lt;br /&gt;&lt;br /&gt;The scoring model most commonly used by lenders comes from FICO (formerly known as Fair Isaac &amp;amp; Co.). There are other scoring models, however.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;What's Possible?&lt;/strong&gt;&lt;br /&gt;FICO scores can range from a low of 300 to a perfect score of 850, but some other models have slightly different ranges. Because not all lenders and credit agencies use exactly the same scoring model, your score can be different from one to another. In addition, credit reporting agencies may not all have exactly the same information about you, so that even if they use the same scoring model, the differing sets of input data will produce somewhat different scores. It's not uncommon for lenders to pull scores for you from all three reporting agencies to compare.&lt;br /&gt;&lt;br /&gt;&lt;img src=&quot;http://www.yourhome123.com/assets/images/content/newsletters/eNewsletter/11/dart.jpg&quot; border=&quot;0&quot; alt=&quot;&quot; /&gt;&lt;strong&gt;What's Good?&lt;/strong&gt;&lt;br /&gt;It's up to individual lenders to define what they consider to be a good credit score. As of mid-July this year, FICO reported that, on a national average, FICO scores of 760 and higher earned the lowest interest rates for a 30-year mortgage. Scores of 700 to 759 earned the next lowest rate. If you score below the mid-600s, you can expect to pay significantly higher interest rates and have greater difficulty getting credit.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Can It Change?&lt;/strong&gt;&lt;br /&gt;Credit scores change all the time, reflecting your changing balances, payments, etc. What's better: You can improve your score by understanding how the scoring models work. Although more than 100 variables are used in calculating your credit score, there are five major categories of important credit information reflected in a FICO score, as ranked below in order of importance:&lt;/p&gt;
&lt;ol&gt;
&lt;li&gt;&lt;strong&gt;Late payments, delinquencies, bankruptcies&lt;/strong&gt; -- about 35% of your score. Failing to pay creditors as scheduled is a red flag to lenders. What guarantee do they have that you won't do so again? The more recent a late or missed payment is, the more it will affect your score, since it implies a current trend that could affect the new lender.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Tip:&lt;/strong&gt; If you can't make a payment, or if you've missed one by accident, notify the creditor immediately to see if something can be worked out to keep the incident off your credit report.&lt;br /&gt;&lt;br /&gt;&lt;/li&gt;
&lt;li&gt;&lt;strong&gt;Outstanding debt&lt;/strong&gt; -- about 30%. People who are heavily extended with too much outstanding credit tend to be higher risks than those who use credit conservatively.       <description>&lt;p&gt;The annual &lt;strong&gt;Halloween parade&lt;/strong&gt; that was scheduled for today, October 18 at 2PM has been postponed until next &lt;strong&gt;Sunday, October 25 at 2PM&lt;/strong&gt;.&amp;nbsp; This is always a fun time.&amp;nbsp; There are usually entries from the local fire departments, Miss Cindy's School of dance, local bands, local businesses and even politicians.&amp;nbsp; The parade participants throw lots of candy&amp;nbsp;to the children lining the roads to watch the parade, while businesses give out coupons or information from their business.&amp;nbsp; Marci and I will be handing out some &lt;strong&gt;trick or treat bags&lt;/strong&gt; and hope to see you there.&amp;nbsp;&amp;nbsp;&lt;/p&gt;

      <title>In losing a house, they found a home.</title>

&lt;p&gt;&lt;em&gt;&lt;strong&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; ~Gunther Moses~&lt;/strong&gt;&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;If you think buying a home can be scary, &lt;strong&gt;&lt;span style=&quot;text-decoration: underline;&quot;&gt;try renting a house.&lt;/span&gt;&lt;/strong&gt;&amp;nbsp; We hear stories daily on the obstacles present when buying and then closing on a home.&amp;nbsp; The fact is that once you own it, &lt;em&gt;&lt;strong&gt;you freaking own it.&lt;/strong&gt;&lt;/em&gt;&amp;nbsp; You own its troubles, its grace, its everything... for the most part, it's your place.&amp;nbsp; But if you are renting it ...&lt;/p&gt;
&lt;p&gt;There's a little story I'd like to share.&amp;nbsp; The participants are Lee &amp;amp; Shannon.&amp;nbsp; They rented their house for five years.&amp;nbsp; During that time, their Landlord seemed difficult, if not totally obnoxious.&amp;nbsp; If something went wrong with the house, phone calls went ignored and any communication from said party&amp;nbsp;seemed obsolete.&amp;nbsp; However, when the rent was due, that Landlord was always available.&amp;nbsp; And&lt;em&gt; 'he would get back to them in a few days'&lt;/em&gt; concerning any problems with the house.&amp;nbsp; Of course that 'few days' turned into the next month when rent was due.&amp;nbsp; Yet again, the rent&amp;nbsp;would be paid and the landlord skated around handling any problem with the living conditions.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;&lt;em&gt;Patterns persist.&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;Leaky facets, clogged drains, faulty electrical outlets, and a lack of hot water were only minor&amp;nbsp;areas of inconvenience.&amp;nbsp; Luckily, Lee knew how to deal with most of that type of stuff.&amp;nbsp; But when the basement was flooded by a particularly feeble bout of rain and phone call after email after phone call to the Landlord went unanswered, the floodgates of change called their name.&amp;nbsp; When they got a letter from the Mortgage Company to start making their payments directly to them, &lt;em&gt;&lt;strong&gt;that calling started to scream&lt;/strong&gt;&lt;/em&gt;.&lt;/p&gt;
&lt;p&gt;Home-ownership had been a dirty word to Lee &amp;amp; Shannon for quite sometime.&amp;nbsp; They had been content with renting.&amp;nbsp; Truth be told, they had owned one over 5 years back and were put into an adjustable rate mortgage at the time.&amp;nbsp; While a nice option for some people, it didn't turn out that way for them.&amp;nbsp; It happened to be a&amp;nbsp;treatment for buying over their heads.&amp;nbsp; Lee &amp;amp; Shannon got out and thankfully suffered no severe credit ramifications from the experience.&amp;nbsp; But they did suffer a very bad taste of what owning a home is all about.&lt;/p&gt;
&lt;p&gt;With their rental situation in limbo, they opened all doors to make sure a roof was above their head.&lt;/p&gt;
&lt;p&gt;From this front, they&amp;nbsp;found a Mortgage Guy and I forget his name... though I remember the last name rhymed with 'Party'. ;)&amp;nbsp;&amp;nbsp;They compared the cost to rent vs. the cost to own in the price range of their particular area and financial ability to afford such.&amp;nbsp; Not surprisingly, the numbers weren't so different.&amp;nbsp; In fact, with lower home prices and interest rates to write your Aunt Susie about, it turned out that buying a home would be a cheaper expedition... at least in regards to monthly payment.&amp;nbsp; Sure, leaky facets, clogged drains, faulty electrical outlets, and a lack of hot water could become an issue down the road, yet a Home Inspection intertwined with Lee's ability to deal with such things left a better taste of what owning a home could become.&lt;/p&gt;
&lt;p&gt;They closed on their home on November 30th, 2009.&amp;nbsp;&lt;/p&gt;

Here are the key issues you should pay attention to so as not to undermine the sale of your home.&lt;/p&gt;
&lt;ol&gt;
&lt;li&gt;&lt;strong&gt;Overpricing.&lt;/strong&gt; The first few weeks on the market are critical to your home's sale. Buyers who've been comparison shopping for a home are eager to see new listings, hoping the home they seek (and can afford) will finally materialize. If your home comes on the market at a too-high price compared with other properties in the area, buyers will simply bypass your home. Days or weeks down the road you'll likely have to lower your price, perhaps even below market, to get any attention from buyers.&lt;br /&gt;&lt;br /&gt;&lt;/li&gt;
&lt;li&gt;&lt;strong&gt;Selling without representation.&lt;/strong&gt; Some home sellers are tempted to try the For Sale By Owner (FSBO) route in order to avoid paying a sales commission. While that is certainly understandable, testing the waters as a FSBO works to your disadvantage in the long run.&lt;br /&gt;&lt;br /&gt;First, buyers expect FSBOs to be priced lower than homes sold through a real estate broker.&lt;br /&gt;&lt;br /&gt;Second, few sellers are able to generate the kind of marketing exposure that brokers and agents (like us!) can give your home. That means a smaller pool of potential buyers and the headaches of marketing your home 24/7 without our professional network to back you up.&lt;br /&gt;&lt;br /&gt;Third, if you find you can't sell your home on your own at a price you can live with, your next choice is to contract for a real estate broker to represent you. The buyers who didn't purchase your home at the price you asked while it was a FSBO will certainly not consider your home at a better price simply because you re-market it with a broker.&lt;br /&gt;&lt;br /&gt;&lt;/li&gt;
&lt;li&gt;&lt;strong&gt;Poor condition.&lt;/strong&gt; With so many homes to choose from, buyers quickly cross a home off their list if it is not in good repair or even if it's simply &quot;showing its age.&quot; Make sure all systems, the roof, appliances, flooring and other components (windows, doors, lights, fans, electrical outlets, etc.) are in good shape and working properly. &lt;p&gt;&lt;br /&gt;&lt;br /&gt;&lt;/p&gt;
It is a tax credit of up to $8,000 for those who&amp;nbsp;settle on&amp;nbsp;a home before November 30th.&amp;nbsp; You can&amp;nbsp;choose to claim the tax credit on either&amp;nbsp;your 2008 or 2009 income tax return.&amp;nbsp;&lt;/strong&gt;&lt;/p&gt;
&lt;/p&gt;
&lt;p&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;The credit is 10% of the purchase price of the home with a maximum of $8,000.&amp;nbsp; Vacation homes and rental property do not qualify, only your primary residence and only to taxpayers who have not owned another principal residence at any time during the 3 years prior to the date of purchase.&lt;/p&gt;
&lt;p&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;There are income limits.&amp;nbsp; The credit is reduced or eliminated for high-income taxpayers.&amp;nbsp; The credit is phased out based on your modified adjusted gross income.&amp;nbsp; For a married couple filing jointly, the range is $150,000 - $170,000.&amp;nbsp; For other taxpayers filing individually, it is $75,000 - $95,000.&amp;nbsp; What this means is that the full credit is available for married couples filing jointly earning $150,000 or less and for individuals earning $75,000 or less.&lt;/p&gt;
&lt;p&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Take advantage of this tax credit before it is too late.&amp;nbsp; This opportunity may pass you by forever!&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;After my first post on this topic, I was&amp;nbsp;a little surprised at how many emails and phone calls I received&lt;/strong&gt;, the overwhelming majority of which were in support of what I am trying to accomplish.&amp;nbsp; However, there were also a&amp;nbsp;handful of not-so-nice messages mixed in.&amp;nbsp; One person called me &quot;naive&quot; (I feel like I am probably closer to &quot;hardened&quot; sometimes), and I was told that I shouldn't express a layman's opinion on this topic, but listen to&amp;nbsp;others instead.&amp;nbsp; One person told me that I was ignoring the facts, and another one implied that I was being selfish.&amp;nbsp; I guess my skin got a bit thicker over the past few days, because here is the latest installment.&amp;nbsp; :)&amp;nbsp; I don't expect everyone to agree with me, but at least you will see where I am getting my information.&lt;/p&gt;
&lt;h3 style=&quot;text-align: center;&quot;&gt;Here's what I am actually&amp;nbsp;trying to do:&lt;/h3&gt;
&lt;p&gt;&lt;strong&gt;I want to form an opinion for myself based exclusively on the facts&lt;/strong&gt;, rather than listening to so-called experts on either side.&amp;nbsp; I also hope to spur debate and discussion on this massive piece of proposed legislation. &amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;In my opinion, everyone's ideas are filtered through their experiences and priorities&lt;/strong&gt;.&amp;nbsp; I&amp;nbsp;have already shared&amp;nbsp;what is important to me in my first post.&amp;nbsp; I have an online network of almost 17,000 people who regularly pay attention to what I say (this comes from my involvement on multiple platforms).&amp;nbsp; I am hoping to have at least a small impact on this critical debate.&amp;nbsp; After all, this is one of the few things that will affect everyone in this country.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;The post I wrote a couple of days ago (link above) was forwarded to a U.S. Congressmen&lt;/strong&gt;, a national TV personality, and a link will be included in a newspaper article set to be published next week in a city up north.&amp;nbsp; Additionally, it was re-posted on many blogs, and it was included in a massive email blast by one reader.&amp;nbsp; If you don't yet understand how powerful blogging can be, let that sink in for a moment.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;This is an even longer post than before, and I am only&amp;nbsp;a little over 10% of the way through the bill&lt;/strong&gt;.&amp;nbsp; Without further ado, my observations are below.&lt;/p&gt;
&lt;p style=&quot;text-align: center;&quot;&gt;_________________________________________________________________________&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;SEC. 201. ESTABLISHMENT OF HEALTH INSURANCE EXCHANGE; OUTLINE OF DUTIES; DEFINITIONS.&lt;/strong&gt;&lt;br /&gt;&amp;nbsp;&lt;br /&gt;(b) Outline of Duties of Commissioner- In accordance with this subtitle and in coordination with appropriate Federal and State officials as provided under section 143(b), the Commissioner shall--&lt;/p&gt;
&lt;p&gt;(1) under section 204 establish standards for, accept bids from, and negotiate and enter into contracts with, QHBP offering entities for the offering of health benefits plans through the Health Insurance Exchange, with different levels of benefits required under section 203, and including with respect to oversight and enforcement.&lt;/p&gt;
&lt;p style=&quot;padding-left: 30px;&quot;&gt;&lt;strong&gt;MY NOTE&lt;/strong&gt;: Again, this seems to come back to the point I made in my original post.&amp;nbsp; Isn't the insurance industry already regulated at the state level?&amp;nbsp; I know that we have the Texas Department of Insurance for this stuff.&amp;nbsp; I wonder if this will add another layer of regulation, or if it will shift to the federal level instead.&amp;nbsp; As I mentioned previously, the newly-appointed Commissioner appears to have an amazing amount of responsibility and power.&lt;br /&gt;&amp;nbsp;&lt;/p&gt;
&lt;p style=&quot;padding-left: 30px;&quot;&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;SEC. 202. EXCHANGE-ELIGIBLE INDIVIDUALS AND EMPLOYERS.&lt;br /&gt;&lt;/strong&gt;(a) Access to Coverage- In accordance with this section, all individuals are eligible to obtain coverage through enrollment in an Exchange-participating health benefits plan offered through the Health Insurance Exchange unless such individuals are enrolled in another qualified health benefits plan or other acceptable coverage.&lt;/p&gt;
&lt;p style=&quot;padding-left: 30px;&quot;&gt;&lt;strong&gt;MY NOTE&lt;/strong&gt;: Does this mean that only people with no insurance coverage at all are eligible, or does it mean that you have to cancel your current coverage if you are accepted into one of the health exchange plans?&amp;nbsp; I think it probably means the latter, but the meaning is certainly not clear at this point.&amp;nbsp; I hope this section is edited later.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;(3) FAR NOT APPLICABLE- The provisions of the Federal Acquisition Regulation shall not apply to contracts between the Commissioner and QHBP offering entities for the offering of Exchange-participating health benefits plans under this title.&lt;/p&gt;
&lt;p style=&quot;padding-left: 30px;&quot;&gt;&lt;strong&gt;MY NOTE&lt;/strong&gt;: I had to look this up to understand what the Federal Acquisition Regulation (FAR) actually does.&amp;nbsp; Basically, this is in place to regulate the purchase of good and services by the federal government.&amp;nbsp; Why is the Commissioner allowed to enter contracts without the normal safeguards in place for other agencies?&amp;nbsp;&lt;/p&gt;
&lt;p style=&quot;padding-left: 30px;&quot;&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;SEC 204 (b)(4)&amp;nbsp; ENROLLMENT&lt;/strong&gt;- The entity shall accept all enrollments under this subtitle, subject to such exceptions (such as capacity limitations) in accordance with the requirements under title I for a qualified health benefits plan. The entity shall notify the Commissioner if the entity projects or anticipates reaching such a capacity limitation that would result in a limitation in enrollment.&lt;/p&gt;
&lt;p style=&quot;padding-left: 30px;&quot;&gt;&lt;strong&gt;MY NOTE:&lt;/strong&gt; Could someone explain to me why an insurance company would be limited to a specific number of enrollees?&amp;nbsp; This seems like a bad business plan to me.&amp;nbsp; I am just a real estate broker, but I think I would call this &quot;a good problem to have&quot;, meaning that I would hire the necessary help to handle all of the clients that we have.&amp;nbsp;&lt;/p&gt;
&lt;p style=&quot;padding-left: 30px;&quot;&gt;I don't think a provision should be included to allow companies to invoke this &quot;capacity limitation&quot; to avoid covering specific people.&amp;nbsp; &lt;em&gt;It seems like the type of thing that could easily lead to abuse.&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;SEC. 205. OUTREACH AND ENROLLMENT OF EXCHANGE-ELIGIBLE INDIVIDUALS AND EMPLOYERS IN EXCHANGE-PARTICIPATING HEALTH BENEFITS PLAN.&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;(b)(2)(B) SPECIAL ENROLLMENT- The Commissioner shall also provide for special enrollment periods to take into account special circumstances of individuals and employers, such as an individual who--&lt;/p&gt;
&lt;p&gt;(i) loses acceptable coverage;&lt;/p&gt;
&lt;p&gt;(ii) experiences a change in marital or other dependent status;&lt;/p&gt;
&lt;p&gt;(iii) moves outside the service area of the Exchange-participating health benefits plan in which the individual is enrolled; or&lt;/p&gt;
&lt;p&gt;(iv) experiences a significant change in income&lt;/p&gt;
&lt;p style=&quot;padding-left: 30px;&quot;&gt;&lt;br /&gt;&lt;strong&gt;MY NOTE:&lt;/strong&gt; It's hard to argue with that section, but I'm sure someone will find a way to do so.&amp;nbsp; :)&amp;nbsp; Clearly, they are trying to make allowances for the current economic climate., which I can appreciate.&lt;/p&gt;
&lt;p style=&quot;padding-left: 30px;&quot;&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;SEC. 205 (c)(2)(D)&amp;nbsp;&lt;/strong&gt;ensure that the Internet website described in subparagraph (A) and the information described in subparagraph (B) is developed using plain language (as defined in section 133(a)(2)).&lt;/p&gt;
&lt;p style=&quot;padding-left: 30px;&quot;&gt;&lt;strong&gt;MY NOTE:&lt;/strong&gt; This section is one of several that allude to using &quot;plain language&quot; to describe benefits, etc. to the public.&amp;nbsp; Why is it not possible to do this with the bill itself?&amp;nbsp; I realize that this stuff is written by teams of attorneys, but this is something that will all of us, at least to some degree.&amp;nbsp; I guess it just seems ironic to me.&lt;/p&gt;
&lt;p style=&quot;padding-left: 30px;&quot;&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;br /&gt;&lt;strong&gt;SEC 205 (d)(1) COVERAGE FOR CERTAIN NEWBORNS&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;(A) IN GENERAL- In the case of a child born in the United States who at the time of birth is not otherwise covered under acceptable coverage, for the period of time beginning on the date of birth and ending on the date the child otherwise is covered under acceptable coverage (or, if earlier, the end of the month in which the 60-day period, beginning on the date of birth, ends), the child shall be deemed&lt;/p&gt;
&lt;p&gt;(i) to be a non-traditional Medicaid eligible individual (as defined in subsection (e)(5)) for purposes of this division and Medicaid; and&lt;/p&gt;
&lt;p&gt;(ii) to have elected to enroll in Medicaid through the application of paragraph (3).&lt;/p&gt;
&lt;p&gt;2(B) EXTENDED TREATMENT AS TRADITIONAL MEDICAID ELIGIBLE INDIVIDUAL- In the case of a child described in subparagraph (A) who at the end of the period referred to in such subparagraph is not otherwise covered under acceptable coverage, the child shall be deemed (until such time as the child obtains such coverage or the State otherwise makes a determination of the child's eligibility for medical assistance under its Medicaid plan pursuant to section 1943(c)(1) of the Social Security Act) to be a traditional Medicaid eligible individual described in section 1902(l)(1)(B) of such Act&lt;/p&gt;
&lt;p style=&quot;padding-left: 30px;&quot;&gt;&lt;strong&gt;MY NOTE:&lt;/strong&gt; As I read this last night, I saw a lot of potential for major political disagreement over these paragraphs.&amp;nbsp; Since no distinction is made about the parents of the child born here in the U.S., this section would clearly cover newborns with parents who are here illegally, for at least the first 2 months.&amp;nbsp; As it stands right now, no one can be denied care if they are admitted into an emergency room in the U.S.&amp;nbsp; This is under the &lt;strong&gt;Emergency Medical Treatment and Active Labor Act (EMTALA), &lt;/strong&gt;which requires&amp;nbsp;hospitals and ambulance services to provide care to anyone needing emergency treatment regardless of citizenship, legal status or ability to pay.&amp;nbsp; This section of the bill seems to grant even more benefits, providing for automatic coverage for anyone born on U.S. soil to be eligible for Medicare immediately.&amp;nbsp; Please note that it doesn't provide this for anyone who already has insurance in place.&lt;/p&gt;
&lt;p style=&quot;padding-left: 30px;&quot;&gt;As a father of four,&amp;nbsp;I am obviously&amp;nbsp;in favor of taking care of babies, who are utterly helpless.&amp;nbsp; However,&amp;nbsp;I think this section has the potential to cause a huge influx of immigrants who want to take advantage of this loophole, once the word begins to spread.&amp;nbsp; This is bothersome to me, and I hope this is clarified further as the bill progresses into committee discussion.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;SEC. 206 (c)(1) (1) ESTABLISHMENT; APPOINTMENT.--&lt;/strong&gt;There is hereby established the Office of the Special Inspector General for the Health Insurance Exchange, to be headed by a Special Inspector General for the Health Insurance Exchange (in this subsection referred to as the ''Special Inspector General'') to be appointed by the President, by and with the advice and consent of the Senate.&lt;/p&gt;
&lt;p&gt;(2) DUTIES- The Special Inspector General shall--&lt;/p&gt;
&lt;p&gt;(A) conduct, supervise, and coordinate audits, evaluations and investigations of the Health Insurance Exchange to protect the integrity of the Health Insurance Exchange, as well as the health and welfare of participants in the Exchange;&lt;/p&gt;
&lt;p&gt;(B) report both to the Commissioner and to the Congress regarding program and management problems and recommendations to correct them;&lt;/p&gt;
&lt;p&gt;(C) have other duties (described in paragraphs (2) and (3) of section 121 of division A of Public Law 110-343) in relation to the duties described in the previous subparagraphs; and&lt;/p&gt;
&lt;p&gt;(D) have the authorities provided in section 6 of the Inspector General Act of 1978 in carrying out duties under this paragraph.&lt;/p&gt;
&lt;p style=&quot;padding-left: 30px;&quot;&gt;&lt;strong&gt;MY NOTE:&lt;/strong&gt; I got excited while reading this section, because I thought it was finally going to provide for some accountability for the Commissioner, too.&amp;nbsp; Unfortunately, this extra position that the bill seeks to create would REPORT to the Commissioner.&amp;nbsp; Darn.&amp;nbsp; This attempt at accountability is also controlled by the Commissioner, it seems.&amp;nbsp;&lt;/p&gt;
&lt;p style=&quot;padding-left: 30px;&quot;&gt;Furthermore, the Inspector General position terminates completely after five years.&amp;nbsp; And yes, I am sure.&amp;nbsp; It doesn't say that it's a five-year term.&amp;nbsp; It states, &quot;(5) TERMINATION- The Office of the Special Inspector General shall terminate five years after the date of the enactment of this Act.&quot;&amp;nbsp; Why is that?&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;SEC. 207. HEALTH INSURANCE EXCHANGE TRUST FUND&lt;/strong&gt;.&lt;/p&gt;
&lt;p&gt;(b) Payments From Trust Fund- The Commissioner shall pay from time to time from the Trust Fund such amounts as the Commissioner determines are necessary to make payments to operate the Health Insurance Exchange, including payments under subtitle C (relating to affordability credits).&lt;/p&gt;
&lt;p&gt;NOTE: Again, this appears to give one person carte blanche to determine how much money is needed to run the exchange.&lt;/p&gt;
&lt;p&gt;(c) Transfers to Trust Fund-&lt;/p&gt;
&lt;p&gt;&lt;br /&gt;(1) DEDICATED PAYMENTS- There is hereby appropriated to the Trust Fund amounts equivalent to the following:&lt;/p&gt;
&lt;p&gt;(A) TAXES ON INDIVIDUALS NOT OBTAINING ACCEPTABLE COVERAGE- The amounts received in the Treasury under section 59B of the Internal Revenue Code of 1986 (relating to requirement of health insurance coverage for individuals).&lt;/p&gt;
&lt;p&gt;(B) EMPLOYMENT TAXES ON EMPLOYERS NOT PROVIDING ACCEPTABLE COVERAGE- The amounts received in the Treasury under section 3111(c) of the Internal Revenue Code of 1986 (relating to employers electing to not provide health benefits).&lt;/p&gt;
&lt;p&gt;(C) EXCISE TAX ON FAILURES TO MEET CERTAIN HEALTH COVERAGE REQUIREMENTS- The amounts received in the Treasury under section 4980H(b) (relating to excise tax with respect to failure to meet health coverage participation requirements).&lt;/p&gt;
&lt;p style=&quot;padding-left: 30px;&quot;&gt;&lt;strong&gt;MY NOTES&lt;/strong&gt;: Where do I start with this one?&amp;nbsp; In a nutshell, each subparagraph here appears to refer to something that is either repealed or that they are hoping to create with the bill itself.&amp;nbsp; Frankly, this seems to be lifted from a previous document, since some of the reference points are outdated.&lt;/p&gt;

&lt;p&gt;(5) Such other requirements as the Commissioner may specify.&lt;/p&gt;
&lt;p&gt;(2) TERMINATION; HEALTH INSURANCE EXCHANGE RESUMPTION OF FUNCTIONS- The Commissioner may terminate the approval (for some or all functions) of a State-based Health Insurance Exchange under this section if the Commissioner determines that such Exchange no longer meets the requirements of subsection (b) or is no longer capable of carrying out such functions in accordance with the requirements of this subtitle. In lieu of terminating such approval, the Commissioner may temporarily assume some or all functions of the State-based Health Insurance Exchange until such time as the Commissioner determines the State-based Health Insurance Exchange meets such requirements of subsection (b) and is capable of carrying out such functions in accordance with the requirements of this subtitle.&lt;/p&gt;
&lt;ul&gt;
&lt;strong&gt;MY NOTE&lt;/strong&gt;: I think I am detecting a theme here.&amp;nbsp; What do you think?&amp;nbsp; This basically says that the Health Commissioner can dictate whatever requirements he/she feels are necessary for a state-based health insurance exchange to operate.&amp;nbsp; Then, it goes on in section (2) to state that the Commissioner can terminate an exchange with the same amount of unilateral power.&amp;nbsp; Basically,&amp;nbsp;if this bill is passed, states will only be allowed to operate programs if the Health Commissioner approves the program.
