      <title>LIAR LIAR PANTS ON FIRE</title>
      <description>&lt;p&gt;Why does a&amp;nbsp;listing agent who assured me she had done many short sales before&amp;nbsp;lie?&lt;/p&gt;
&lt;p&gt;As we headed into the process it was evident the listing agent did not know what she was doing. Not only did she fail to be conscientious,&amp;nbsp;her communications were sloppy with me so I can imagine how they were with the lender. I was constantly after HER&amp;nbsp;to check,&amp;nbsp;check, double check and check again with the lender on new developments. On top of this she was overhwelmed with being the&amp;nbsp;major caretaker of her mother, and other times she was in a hospital with her sister who was an addict and another time she was out West admitting her sister into a addiction recovery center. Now you tell me how in the world would a professional real estate agent ever be able to&amp;nbsp;offer her client the best service-especially a short sale. I finally had to get her broker involved. Enough, was enough, and to date because of her&amp;nbsp;mistakes we are&amp;nbsp;still waiting to go to settlement. Thank God, my buyers are very understanding and patient.&amp;nbsp;I recently&amp;nbsp;got an email from her thanking me for all my help and she admitted that&amp;nbsp;I was the driving force to get this short sale to closing. I don't mind helping, and I&amp;nbsp;did sympathize with her family setbacks, but an agent needs to realize when they need help!&amp;nbsp;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Please, please, please Agents- if you are experiencing&amp;nbsp;major life events in your life, please ask for help or&amp;nbsp;alert your broker. This is&amp;nbsp;not fair to everybody involved in a real estate transaction.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&lt;/p&gt;</description>

      <title>FEAR OR $8000 Credit</title>
      <description>&lt;p&gt;Is FEAR keeping you on the fence about buying a home? Realtors hope a stimulus offer from Uncle Sam will help you make the move. But, as I talk to other agents it seems they're starting to notice an increased interest.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;What is holding people back?&lt;/strong&gt;&lt;br /&gt;A big fear. Fear of losing their jobs, fear of the economy in general, fear of what's going on.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;FEAR Is the perfect emotion!&lt;/strong&gt;&lt;br /&gt;Politicians use it all the time. In fact, I have seen special interest groups use it to the &quot;max&quot; to invoke a fear reaction to get an exaggerated response. I am not saying the government is using fear to prevent people from buying homes, but I am saying fear can move mountains.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Is the government helping the housing industry? &lt;/strong&gt;&lt;br /&gt;Yes, I think now, they are trying to stimulate sales for the first time homebuyer. But, it can be so confusing and people who bought before Jan. 1, 2009 are sounding off as being resentful. But they really shouldn't, because if the stimulus wasn't in place at all, their home values could possibly be falling even further. The $8000 credit helps stabilize the home values.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;So who actually qualifies for the $8,000 tax credit?&lt;/strong&gt;&lt;br /&gt;The government is giving first time home buyers or people who haven't owned a home in three years, $8,000 if they buy between January 1 and December 1 of 2009. It certainly does give hope for what's happening in the housing market. It really would have helped if it would have applied to all home buyers.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Here's how the tax credit works:&lt;br /&gt;&lt;/strong&gt;1) The home you buy has to be your primary residence, it can't be a second home&lt;br /&gt;2) It pays $8,000 or 10% of the purchase price, whatever is lower. If you buy a $65,000 home, you'd get $6,500.&lt;br /&gt;3) The credit pays less if you are a single buyer who makes $75,000 or married buyers who make $150,000 or more.&lt;br /&gt;4) You don't have to pay it back if you live there for three years or more.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Did you know you can amend this year's taxes?&lt;/strong&gt;&lt;br /&gt;If you already did your taxes and let's say you bought the home today you can go back and file an amended tax return and get the money now.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Example please..&lt;br /&gt;&lt;/strong&gt;If you owe $3,000 and buy a house, you'd get $5,000 back. If you buy a house and owe nothing on your taxes, you'd get the full amount of money.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;No Down payment credit&lt;br /&gt;&lt;/strong&gt;Can't be used as a down payment because you can't get it at the closing table but you certainly can get it very soon after purchasing the home.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;This is the time to buy, with historically low interest rates.&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;*Building Your Own, Pre-fab and Mobile Homes&lt;/strong&gt;&lt;br /&gt;If you're going with a pre-fab, or Design home type of purchase, builders say to qualify, you have to be living in the home by December 1, 2009. Mobile homes have to be on a piece of property, not in a park. If you want to build a home, you can get the tax credit, but you have to close on the sale of the home with your contractor by December 1, 2009. If you own land and are acting as a general contractor, I believe you have to be living in the home by Dec. 1, 2009. *&lt;br /&gt;&lt;br /&gt;*Check with your accountant and state laws for building your own,to get the credit.&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Business Experience?&lt;/strong&gt; I have had my own business in the past; so I do have some knowledge and experience of what it is like swimming in the big sea as a goldfish amongst sharks, jellyfish, thieves and crooks. We are in volatile times, and my theory is, if I make it as a broker and can still be standing five years from now- I will have beat the odds!! &lt;br /&gt;&lt;strong&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Do You Plan to Hire Agents?&lt;/strong&gt; Ahhhh, I have seen how other brokerages are set up and I am not keen on the responsibilities and risks involved when agencies have many agents. So, for now I am staying small, I really don't want to take the risks. Although, I am recruiting a couple of my family members to acquire their RE license, so I can offer dual agency. Besides, there are so many benefits to being your own broker, even if it's for your own personal real estate investments. &lt;br /&gt;&lt;strong&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Where's Your Office?&lt;/strong&gt; For now, I have renovated a room in my house as my office in Queenstown, Md. I have a temporary sign designating my agency and can't wait to see the sandblasted sign I am having made. One day, I will move my office to a commercial location, but there are advantages to working at home. And who knows, since the big change in real estate transferred over to the internet, most customers and clients hardly ever go into a real estate office. Everything is done online and I am very comfortable and tech savvy. But, just in case, I will have a satellite office if I need to meet clients for whatever reason.&lt;/p&gt;
&lt;p&gt;&lt;br /&gt;Well, gotta go, I have a settlement in ten days and I am busy working with my buyers on the eastern shore and across the Bay Bridge. Please pass on any comments, suggestions, lessons to be learned and anything else.&amp;nbsp;&lt;/p&gt;

I have a number of buyers and sellers who see things so different. And of course, each and everyone of them have their own justifications. &lt;br /&gt;&lt;br /&gt;For instance, the sellers wholeheatedly believe the market is going to spike this Spring and prices will remain stable (God Bless them). So they are optimistic and believe we need to be patient, stay the track and talk up the good talk, so to speak.&lt;br /&gt;&lt;br /&gt;Here is what has been happening: Sellers will withhold listings from the market or cancel listings that don't sell within 90 days. If they are smart, they will adjust their listing prices and have a good agent that can persuade them. &lt;br /&gt;&lt;br /&gt;Still others will: 1. Ask themselves if they are better off selling their homes on a short sale, absorbing the hit to their credit reports and becoming renters for a few years. Many sellers will turn to a short sale or walk away than try to directly deal with mortgage lenders. 2. Sellers who are unwilling to take a hit on their sales prices will put their homes on the market as rentals&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;What concerns me is the hard data, the unemployment rate reflecting the recession of the 1980's and the bank trouble reflecting the depression of the 1930's. Going alittle big closer to home, our sold stats for Queen Anne's County are down almost by half. Our inventory right now is climbing, the closer we get to the warm weather(which I cannot wait for) the residential properties on the market for sale or rent hover around 700 plus.&lt;br /&gt;&lt;br /&gt;And we have some 300 real estate agents who are registered with the Bay Area Association of Realtors and if you ask any of them (agents) they will tell you it is crazy market. Yes, I know we are supposed to say, &quot;Everything is great and Unbelieveable,&quot; to avoid the downtrodden and rotten news about the market. That notion of accentuating the positive does work, but what happens when reality sits in? &lt;br /&gt;&lt;br /&gt;Please do not get me wrong: I think this is a fantastic market and there are some really killer deals out there. But we are dealing with sellers who don't want to be realistic on setting their selling prices, buyers who think the market is a free for all and writing ridiculous low ball offers.&lt;br /&gt;&lt;br /&gt;Then, you have the banks who say they want to sell their homes but, still don't want to budge on the listing prices and think they can get 90 cents on the dollar. You can't help but, ask yourself, &quot;Do the banks really want to sell and do they understand what is going on in the market?&quot; You would think the banks would jump at a reasonable offer and avoid the frog leaping, loop-jumping scenarios. &lt;br /&gt;&lt;br /&gt;Okay buyers, yes it is a wonderful time, on the bright side, employed home buyers with good credit will find 2009 is an excellent time to buy. And of course, cash buyers will win every time over buyers who need financing.&lt;br /&gt;&lt;br /&gt;Please do your homework and realize most properties have already been adjusted for the 20% reduction over the last year, the experts claim. Of course, it's a buyer's market and many think the prices are going to continue to drop, so they wait, and wait and wait some more. &lt;br /&gt;&lt;br /&gt;Well, Mr. &quot;Waiting&quot; Buyer you can just wait, and hope that property does not get snatched up or you may be doomed watching the interest rate go up. And guess what? Not only may the price drop on the home, but if the interest rate goes up you will be paying more for that home. You see, if you would buy now while the interest rates are so low, you will save so much more instead of waiting for the listing price to drop. So don't wait, you're in control. I mean this could make a difference if you walk. Now this doesn't apply to second homes or investment homes.&lt;br /&gt;&lt;br /&gt;The way this works is you and me and your mortgage lender will help divvy up the costs of lowering your payments to 31% of your income. Can you imagine....that means you could have an interest rates as low as 2%. Or you may get the principal reduced. Plus, if you pay your mortgage on time, US taxpayers will pay off as much as $1,000 of your loan each year for five years. If you happen to have a mortgage payment less than 38% of their income - you my friend are out of luck.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;REVERSE MORTGAGE LIMITS RAISED&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;If you are trying to help your parents or any senior citizen feeling the pinch , you may want to explore the reverse mortgage option, The limits for reverse mortgages backed by the Federal Housing Administration have been raised to $625,000 from $417,000.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;HOUSING COLLAPSE WIPED OUT EQUITY &lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;There maybe help for you. If you have been paying your mortgage, but because of the refi market and housing collapse that has wiped out your equity, you may benefit from the new refi assistance. So, the qualifications for the government to help you refinance your mortgage is: if you owe between 80% and 105% of your home's value. The downside is: this will only help those with mortgages owned by Fannie Mae or Freddie Mac get cut in. And it excludes many homeowners in Florida, Nevada, Arizona and California. This really stinks.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;$8,000 TAX CREDIT or Really?&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;This one is an eyeopener or another government tease. You know how the government has been flirting with the $8000 tax credit for new home buyers, well the truth is: Anyone who hasn't owned a home for at least three years is entitled to a helpful tax credit, for up to 10% of the cost, up to $8,000, Did you get that: UP TO 10%. So for many of you who thought you would be getting the $8,000 tax credtit be careful and read the small print. And of course, you have to buy a home this year. &lt;br /&gt;The good parts is it is a refundable credit - so if you don't pay $8,000 in taxes, or indeed any taxes at all, you get the rest as a check. Now, if you make a high income-you again are out of luck - the credit phases out above a modified adjusted gross income of $75,000 for one person.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;CONFORMING LOAN LIMITS RAISED&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;The government just raised the &quot;conforming loan&quot; limits to $729,750 from $625,500, yea for those that can buy those expensive properties AND can qualify.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Now, I am not a mortgage banker or lender, just doing my homework. However, please comment, if you have additional information to the consumers that could help alleviate any concerns.&lt;/p&gt;</description>

      <title>Take a Stab at 2009</title>
      <description>&lt;p&gt;Who knows what 2009 will bring? I challenge you all to take a stab of what you can do to strengthen&amp;nbsp;our country? There is&amp;nbsp;frustration and it is growing.&amp;nbsp; Here is how I read this: I saw this coming three years ago and only by the good fortune of my son who had his ear to the heart of this bubble. He was a mortgage banker then&amp;nbsp;and kept trying to tell all of us, while I was bringing in the constant bucks.&amp;nbsp;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;With that said, what do we do, who do we blame and what can we expect?&amp;nbsp; The only good thing is that the bubble did burst and now change has to happen and we are all being forced into change. The government is trying to limit pain, by injecting bailouts and still protecting the major players. Seriously and realistically, we need to have pain inflicted so we can have change. The band aid effect on a deep wound is not going to work...we are all going to have to become creative and resourceful until the market corrects itself. We are going to have be witnesses to a downturn in our economy, We will have to watch on the sidelines as businesses close down and&amp;nbsp;our quality of life is going to suffer.&amp;nbsp; Only then, will we see some stabilization and allow the market&amp;nbsp;to reposition itself- that can take years. There is also an immediate imperative to restore some faith that society can survive the dreadful threats it now faces.&lt;/p&gt;
&lt;p&gt;Am I scared?&amp;nbsp;You bet, but that is where your faith comes into play. I'm not talking about the faith in our policy makers who got us into this mess and who we are expecting to get&amp;nbsp;us out of this - this is absurd! I don't believe they have any great hunch of&amp;nbsp;how to&amp;nbsp;strategically manuever&amp;nbsp;our way out of this deep black hole. Young adults under 30 do not remember a recession, people in their forties slight remember and if you are in your fifties you remember the &quot;poor Great Depression&amp;nbsp;stories&quot; from your parents and grandparents.&amp;nbsp; You could think I am being too much of a pessimistic, but what if it is true? That is why it is so important to become involved in your local and state government. Become involved and ask the&amp;nbsp;questions so you don't sit around asking how did this happen and why this and why that.&lt;/p&gt;
&lt;p&gt;What am I going to do? Utilize my god given skills and &lt;strong&gt;be extremely conscientious of every dollar I spend. i am going to think long and hard&amp;nbsp;about every client I represent.&lt;/strong&gt;&amp;nbsp;&amp;nbsp;All of this is a process and it will take time for the progress.&lt;/p&gt;
&lt;p&gt;To hold out for disclosures will be like holding your breath.&amp;nbsp;From a biblical sense, all of this is supposed to happen, but do not let it&amp;nbsp;shake your faith.&amp;nbsp; You know what you are made of and now you have to prove it.&amp;nbsp; I know the distractions are many, but I believe it is time to take a&amp;nbsp;journey in the unknown&amp;nbsp; if you want the unusual, you have to do what's never been done.&amp;nbsp;I believe,&amp;nbsp;sometimes God takes people&amp;nbsp; and things away from you so you can see things clearer.&lt;/p&gt;
&lt;p&gt;I also believe there are more people like us than like them. That is where&amp;nbsp;I am putting my strength- on the people who show gratitude and appreciation. And there are many!!&amp;nbsp; This country was built from nothing and we can all build it up again. What a lesson we will have to pass on&amp;nbsp;to our children: the privilege of displaying perseverance despite the state of our economy.&amp;nbsp;Through our failures, whether we fess up to it or not, we had warnings we just chose to ignore.&amp;nbsp;Even though we did not have a physical hand in creating the problems we are facing, we do live in a free market capitalism and freedom of speech.&amp;nbsp; Why did I ignore my son's warnings?&amp;nbsp; Could it be we were all living beyond our means? There were plenty of signs and many who knew of what was coming down the pipeline.&lt;/p&gt;

You see, I&amp;nbsp;buried my mother on Dec. 19th in New Mexico; after her long suffering with Alzheimer's. Many of you know I traveled to Dubai this past summer to bring her back to the US. She was visiting my sister in the middle east.&amp;nbsp;It has been hard. but here's how my return to Maryland started last weekend.&amp;nbsp;I flew home on the 21st and waiting for me via email was an Active Rain invite gathering&amp;nbsp;from &lt;a href=&quot;http://www.homerome.com &quot; target=&quot;_blank&quot;&gt;Margaret Rome&lt;/a&gt;and &lt;a href=&quot;http://activerain.com/blogs/hommelhome&quot; target=&quot;_blank&quot;&gt;Pat Hommel&lt;/a&gt;. &lt;p&gt;As I crossed the Bay Bridge I thought to myself, just turn around as the tears streamed down my cheeks. But somehow, I ended up at Famous Daves. To my surprise, I walked in and instantly was welcomed by some of the greatest AR members in the MD/VA market. Margaret Rome made me so welcome by introducing me one by one andwithout a hitch I was conversing about life, death, mothers, real estate, books, and shopping.&lt;/p&gt;
&lt;p&gt;The thoughtfulness and consideration that shadowed over me was so warm and welcoming. I knew why I was there, I felt the camaraderie, I felt the empathy and I felt friendship especially during this&amp;nbsp;difficult time for me. Yes, i could have stayed home, but I believe an angel put wings on me and whisked me over to be amongst other AR angels.&amp;nbsp; Call me strange, but I do believe in Angels, and I needed the fondness of my new friends.&amp;nbsp;My emotions were charged and fueled as I looked around the table, for a moment I felt the spirit of Christmas&amp;nbsp;-they kept me smiling and I found myself bubbly and a sense of peace was evident.&amp;nbsp; So, even though I am missing my mom terribly, I know I can always count on my new online AR&amp;nbsp;friends.&amp;nbsp; Thank you, thank you and here's wishing you all a&amp;nbsp;Happy and safe&amp;nbsp;New Year!&lt;/p&gt;

While taking a boat ride, we were able to see the old Dubai of years past as the wooden boats and Bedouins lined the creek and old buildings. We visited the tourist attractions like the &quot;Palm Jumeirah&quot; and &quot;The World&quot; man made islands&quot; and we drove past the tallest building in the world, Burj Dubai and Burj Al Arab, the tallest hotel in the world on a man made island. We also went into Ski Dubai an inside ski destination- part of the Mall of the Emirates --- unbelievable!! Unfortunately, my mother became frightened and had a couple of bizarre episodes and started yelling, Help, Help and a few other rantings! She attracted a captive audience (some 500 passengers) in the middle of the Atlantic ocean and I was praying to God for a divine intervention. But it didn't happen right away, my mom royally embarrassed us by causing a scene to the point of having the airline security come and visit us.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;I immediately informed them what her problem was and they tried ever so kindly to calm her down. (She was insisting on wanting to get off the plane and commenting how the people on board looked strange to her.) I was praying for her medicine to kick in and it did after about 15 minutes of appealing to her. We wanted to crawl up into a ball and disappear out of sheer humiliation. We were never so happy when the light switch went off in my mom's brain and she became docile again and returned to her seat. I think for the first time my husband hated me, and I couldn't have blamed him. Thank goodness, we did not know any of the passengers nor do we ever have to see those people again. &lt;br /&gt;&lt;br /&gt;In hindsight, it was a frightening experience for my mom and can't imagine how scared or insecure she was feeling. When parts of the brain stop working, it must be unbearable to comprehend your surroundings and stay calm. Thank God we remained calm and everyone seemed to understand and tolerate her outbreaks.&lt;br /&gt;&lt;br /&gt;I finally ended up taking my mom back to her home in Las Cruces, New Mexico a few weeks ago. For those that have parents with Alzheimer's my heart goes out to you - it is a daily chore.&lt;/p&gt;

I thought since the market had slowed down I would brush up on my marketing, I started showing some of my friends some of the online tools and they were intrigued and asked for me to setup classes. So I did and started a new side venture of conducting Tech&amp;nbsp;Savvy classes (something I have had a passion for the last ten years).&amp;nbsp; The best part is most of the tools are FREE!&lt;/p&gt;
&lt;p&gt;During the nineties I was an online editor and learned how to manipulate from the behind the scenes. Now, I am no programmer, but there is alot of tools we should all be using on our blogs or websites. For example, in my class we&amp;nbsp; explore the latest trends in online marketing and advertising, including terminology, features, strategies, business models, tools and technologies. Some of what I will show them will be exciting, some things may overwhelm them, but for the most part you will be exposed to some new technology that will get you ahead of the curve.&amp;nbsp;Just to let you know how fast technology is advancing: some&amp;nbsp; 5000 photos are loaded down per minute to Picaso (an online public/private photo storage service). And according to google CEO, Eric Shidmt,&amp;nbsp;there's over 70 million blogs.&amp;nbsp;&amp;nbsp;&lt;strong&gt;And for a little bit of fun, if you assume the current growth rates... by 2019, you will be &lt;/strong&gt;&lt;strong&gt;able to watch&amp;nbsp;&amp;nbsp;85 years of video on a device&amp;nbsp;in your purse/pocket.&amp;nbsp;&lt;/strong&gt;&lt;/p&gt;

      <description>&lt;p&gt;It seems we have come to a crossroad of two kinds of home sellers--- the ones that are facing the housing market straight up and pricing their homes to sell and the others who are simply ignoring the facts and digging in their heals.&lt;br /&gt;&lt;br /&gt;Now, we can talk about this subject til the cows come home, but I&amp;#39;d rather cut to the chase and make things happen. The problem is everyone in the media is an expert in real estate and whatever position you take, it is human nature to tune into people who say what you want to hear.&lt;br /&gt;&lt;br /&gt;Although, if you are like me, we need to become better informed on how to tell people that their house is not worth alot more than what the market is calling for.&lt;br /&gt;&lt;br /&gt;We need to take a lesson from Walmart, &amp;quot;Low prices are one of the surest ways to beat the competition&amp;quot;. Called ``drama pricing&amp;quot; or ``energy pricing,&amp;quot; it is a drastic measure for difficult times. Although, your clients will be disappointed, we must share the information of other competitive listings and sold inventory that are seen by consumers as a perception of value. That is human nature.&lt;br /&gt;&lt;br /&gt;The experts tell us to lay out the facts on how tough it would be to sell at the suggested owner&amp;#39;s listing price. However, we must adhere to the rules and ethics as Realtors and understand the bottom line is the owner&amp;#39;s decision.&lt;br /&gt;&lt;br /&gt;All, we can and must do is educate them. And I must admit, I need to brush up on my skills.&lt;br /&gt;The point is if you start too high, buyers forget about your property -- it doesn&amp;#39;t matter how beautiful it is. As a home seller, you may prefer to wait out the market, if you don&amp;#39;t really need or want to sell. Sause Jr. laid down the law!&lt;br /&gt;&lt;br /&gt;Judge Sause started out saying, that this case is intensely complex as John Zink, attorney for &lt;a href=&quot;http://www.khov.com/&quot;&gt;K. Hovnanian &lt;/a&gt;challenged the state&amp;#39;s board of public works (BPW) claiming, for the first time the BPW refused a wetlands permit beyond the &lt;a href=&quot;http://www.mde.state.md.us/&quot;&gt;Dept. of the Environment.&lt;/a&gt; Zink added, that the law looks out for the people&amp;#39;s &lt;a href=&quot;http://en.wikipedia.org/wiki/Riparian_water_rights&quot;&gt;riparian rights.&lt;/a&gt;&lt;br /&gt;&lt;br /&gt;Judge Sause stated, &amp;quot;This is unconstitutional and preposterous for the Board of Public Works-the notion that a board may do what they want and is not accountable to anyone is dead wrong and bad law! According to Judge Sause, the BPW blatantly exceeded its authority that was granted by the legislature. They circumvented local planing and zoning departments and several state agencies.&lt;br /&gt;&lt;br /&gt;Judge Sause was referring to the BPW (Gov. O&amp;#39;Malley, Comptroller Franchot and Treasurer, Nancy Kopp who voted 2-1) who denied K. Hovnanian, the developer of the Four Seasons project in QAC, Md. a permit to build a small bridge, a community pier and storm water system on May 23rd, 2007.&lt;br /&gt;&lt;br /&gt;Treasurer Kopp dissented from the majority because she believed K. Hovnanian had met the letter of the law. The two issues under the purview of the BPW was dredging and filling in the wetlands area of which they addressed neither in their ruling, according to Sause.&lt;br /&gt;&lt;br /&gt;Zink continued saying, &amp;quot;The denial is unprecedented on the basis of approval far beyond delegated authority and never before in the history had a Board of Public Works utilized judicial powers. K. Hovnanian have fought this battle nearly a decade to win regulatory approval.&lt;br /&gt;&lt;br /&gt;According to Zink, they have gained the approval of the state Critical Area Commission and the Army Corps of Engineers -and have agreed to restore 24 acres back to working wetlands. The project meets all current environmental standards. Both Secretary of the Environment Shari T. Wilson and Secretary of Planning Richard Hall said the development met state guidelines.&lt;br /&gt;&lt;br /&gt;Sause sounded off stating, &amp;quot;It&amp;#39;s a cruel hoax that a landowner can spend millions of dollars to develop a plan, but in the end you are found to be completely ignored as a matter of law. BPW made it their business and this is bad common sense!&amp;quot; Sause continued, &amp;quot;There is nothing to suggest there&amp;#39;s some super powers over all the rest of the agencies and without considering any of the criteria which would be necessary to do so. What is the purpose of zoning? The BPW can only act in boundary by the general assembly.&amp;quot;&lt;br /&gt;&lt;br /&gt;The lawyers from the attorney general&amp;#39;s office argued that the BPW ruled in the best interests of the state, and the BPW has exclusive authority to the project to meet environmental standards.&lt;br /&gt;&lt;br /&gt;Judge Sause shot back stating, &amp;quot;Are you telling me that an administrative agency has authority to make legislation? I am not going to sit here and listen to you try and tell me that advancing a regulation somehow becomes a valid regulation and expect me to turn a blind eye to the interpretation of the law.&amp;quot; &lt;br /&gt;&lt;br /&gt;The lawyers of the attorney general&amp;#39;s office reminded the court that it is not solely a wetlands issue and the BPW is the screening legislature to maintain a balance for society and to look out for the detrimental effects to society.&lt;br /&gt;&lt;br /&gt;Judge Sause interjected, &amp;quot;Ahhhh, they did not weigh it-they don&amp;#39;t tell us why or what isn&amp;#39;t aesthetically pleasing over Cox Creek.&amp;quot;&lt;br /&gt;&lt;br /&gt;The state argued that it&amp;#39;s the only agency (BPW) to decide whether the project gets to utilize state wetlands. Judge Sause added, &amp;quot;They have to operate as a government power, not as individuals.&amp;quot;&lt;br /&gt;&lt;br /&gt;The state argued, &amp;quot;We are not persuaded that it is the best interest of the state.&amp;quot; Sause concluded, that the BPW did not address one of the four issues that affect the wetlands.&lt;br /&gt;&lt;br /&gt;The state asked if the court would entertain the rights of the BPW and requested to submit a statue of regulations of the BPW. Judge Sause granted their wish and asked that a five page response be submitted by January 15th.       <title>Fear of the Unknown</title>
      <description>&lt;p&gt;People sitting on the fence&amp;nbsp;is evident from the east coast to the west coast. The negative publicity about real estate has made the reluctant buyer a nationwide phenomenon.&lt;br /&gt;&lt;br /&gt;Although prices around the country have slumped, here in QAC the average (sold) price of $450,202 in October 2007 sold 11.3% less than October 2006 while the median (sold) price of $352,000 in October 2007 sold 5.35% less than October of 2006, albeit at a slower rate. That means that people holding out for bargains here may be disappointed.&lt;br /&gt;&lt;br /&gt;People are trying to time the market, with the mindset: &amp;quot;If I buy now, the price could decline in the short run.&amp;quot; It seems that a major factor in this housing market is fear.&lt;br /&gt;&lt;/p&gt;&lt;ul&gt;&lt;li&gt;Fear of the unknown, fear of making a mistake of buying too high, only to find the exact home is dropped another $10,000. &lt;/li&gt;&lt;li&gt;Fear of not buying now, and missing the low interest rate. &lt;/li&gt;&lt;li&gt;Fear of buying today thinking they won&amp;#39;t qualify for a mortgage and afraid the builder will lower the price so they may &amp;quot;lose&amp;quot; their down payment because their house is worth less. &lt;/li&gt;&lt;li&gt;Fear felt by the contingency buyer. If their home does not sell, they will surely miss out on some of the best deals in years!&lt;/li&gt;&lt;/ul&gt;&lt;p&gt;And as far as that goes, many buyers who won&amp;#39;t get off the fence will surely miss out on perhaps a chance of a lifetime. &lt;/p&gt;&lt;p&gt;Some builders have raised the bar around here, by offering cars as incentives! That will get somebodys attention, you would think?&lt;br /&gt;&lt;/p&gt;&lt;p&gt;The National Association of Home Builders said that until a year ago, customers used to make two visits to sales offices before buying.       <description>&lt;p&gt;&lt;strong&gt;QAC Sewer Increase Hearing&lt;/strong&gt; &lt;strong&gt;Talking Points for the Sewer Rate Increase&lt;br /&gt;&lt;/strong&gt;&lt;em&gt;Below are some ideas and talking points to address the County Commissioners prior to the Nov. 12th Monday evening public hearing at Kent Island High school in Stevensville at 7 pm, or if you decide to make public comment at the hearing.&lt;br /&gt;&lt;/em&gt;&lt;br /&gt;The hearing has been set for the public to address the Queen Anne&amp;#39;s County commissioners on why the users are facing a possible sewer rate increase.&lt;br /&gt;&lt;br /&gt;1.&lt;strong&gt;Where&amp;#39;s the $10 million dollars going to come from to pay for the new Kent Narrows, Stevensville, Grasonville wastewater treatment plant (KNSG)?&lt;/strong&gt; No one knows for sure? &lt;br /&gt;&lt;br /&gt;&lt;br /&gt;2. &lt;strong&gt;How did we arrive at this dilemma? &lt;/strong&gt;Originally, back in the fall of 2002, the new KNSG sewer plant was going to cost approximately $28 million dollars. It was to be secured by a $10 million dollar grant from the state and approximately $10 million from K. Hovnanian and the balance to be bonded and paid for by new customers. &lt;strong&gt;&lt;em&gt;(See History below)&lt;/em&gt;&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;3. &lt;strong&gt;What will happen if Four Seasons doesn&amp;#39;t go through?&lt;/strong&gt; If Four Seasons (K. Hovnanian) does not go through, the customers of the sanitary district will have to foot a $10 million dollar bill.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;4. &lt;strong&gt;How will this affect the homeowners who are hooked up to public sewer in the Stevensville, Chester and Grasonville areas?&lt;/strong&gt; Homeowners in Stevensville, Chester and Grasonville could be faced with an increase of approximately 28% on their quarterly county user fee bills for years to come. The scenario could play out like this: To pay for the wastewater sewer plant, the commissioners will have to secure a bond and the citizens will have to bear the debt service on the bond. Now, if there isn&amp;#39;t enough money generated on Kent Island, Grasonville, and Chester, the worst case scenario would mean the money would come from the general fund and every citizen in QAC will be paying for this service. THIS IS NOT FAIR! Why should you have to pay for a service that you are not using!&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;5. &lt;strong&gt;Why are the commissioners asking homeowners (users) to pay for the new sewer plant construction costs?&lt;/strong&gt; Typically, an enterprise styled account is paid for by the users (customers) of the sanitary district. But, NEVER in the history of this County have user fees gone to pay for capital costs in regards to the sanitary district. &lt;br /&gt;&lt;br /&gt;&lt;br /&gt;6.&lt;strong&gt;Why did we need a new wastewater treatment plant?&lt;/strong&gt; The Kent Narrow, Stevensville, Grasonville (KNSG) wastewater treatment plant was desperately needed since the nitrogen had never been treated since the former plant was built in 1981. Keep in mind, the County would run out of sewer allocations if we did not upgrade.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;em&gt;History&lt;br /&gt;&lt;/em&gt;&lt;/strong&gt;How did we get here? Today, the KNSG sewer plant costs the county $32 million.--&lt;strong&gt; FOUR MILLION DOLLARS more than the original bid after eliminating $6 million dollars worth of efficiency upgrades.&lt;br /&gt;Why?&lt;/strong&gt; The last set of commissioners overlooked and disregarded the original bid/plan in 2002 and appealed the discharge permit to halt the progress. In the meantime, pollution continued to flow into the Bay for 2 years while the last set of commissioners sought out other ways to build the wastewater treatment plant. Including two additional engineering studies costing the taxpayers. &lt;br /&gt;&lt;br /&gt;&lt;br /&gt;There are two costs associated with the wastewater treatment plant: 1. The Capital improvements--- the construction costs to build the plant. 2. The operational-labor costs of hiring men and women to maintain the plant. Quarterly fees have only been used to pay for operational costs NOT capital costs.&lt;br /&gt;&lt;br /&gt;What are the solutions? &lt;br /&gt;&lt;/p&gt;</description>
