NY Launches "eAccessNY" Online Real Estate System

On Monday April 21, 2008, the New York State Department of State's Division of Licensing Service implemented a new online Real Estate system called: eAccessNY.

eAccessNY is an Occupational Licensing Management System which provides online services for Real Estate Professionals, approved Real Estate Schools, and the general public. The new system is a 24 hour user friendly service which is accessed with a personal identification code and password.

With eAccessNY, Real Estate Professionals can conduct a variety of transactions online including license renewal, change of address, and request of a duplicate license.

With eAccessNY, Real Estate Schools can apply online for approval of continuing education courses, to renew courses, and to add course branch locations.

The new system also allows members of the general public to search for current licensees and approved qualifying courses.

Orange County, NY Helps To Heighten Consumer Awareness

March 2 thru March 8 is National Consumer Protection Week. Orange County, NY Executive Edward A. Diana and Department of Consumer Affairs Commissioner Charles Mitchell marked National Consumer Week with special outreach programs designed to heighten awareness of consumer issues.

The Orange County Department of Consumer Affairs wants to protect the residents of the county and would be residents of Orange County from fraud, deception and unfair business practices. Its goal is to promote an atmosphere of trust for consumers in the marketplace by providing consumer assistance and advice in handling problems encountered with the county's business community.

Staff members from the New York State Attorney General's Office are on hand to assist consumers with issues.

Community Emergency Plan - For Indian Point

Indian Point is a nuclear power energy generation facility on the east bank of the Hudson River in Westchester County, NY. It is owned and operated by Entergy Nuclear. This facility is close to portions of Orange, Rockland and Putnam Counties in New York State. Officials of these counties have developed a comprehensive emergency plan, in cooperation with New York State and Entergy Nuclear. The plan includes information and procedures for protecting the public in a wide range of possible emergencies.

A key component of the plan is the New York State Office of Emergency Management's web site for the Joint Information Center. Westchester, Orange, Rockland and Putnam Counties, New York State and Entergy are partners in this public education web site. The site provides daily information on Indian Point's plant conditions and efforts to protect your health and safety. Should an emergency occur, this web site would give you official information on the emergency response activities undertaken by the counties, New York State and Entergy.

Changes to New York State's Real Property Law in 2008

The Real Estate industry in the State of New York will see changes in licensing law in the year 2008. The upcoming changes to New York Real Property Law are steps in the right direction.

An increase in the number of classroom hours required to become a salesperson will better prepare future agents to function more effectively in the business. And increasing the required time a salesperson spends as an apprentice, under the guidance of a broker, will provide salespersons with more practical experience and on the job training.

Here are highlights of the changes that were made to the New York State Real Property Law, to become effective in July 2008.

Statutory definition of Office Manager - Must hold at least an Associate Real Estate Broker's license.
Educational Requirements for a Real Estate Broker's License is Now 120 hours. Formerly it was 90 hours of approved real estate courses. And the minimum age to become a Broker has been raised to twenty years of age. Formerly it was nineteen years of age.
A Two Year Term as Salesperson, under a Broker, will now be required. The term was formerly One year. Or Three Years of equivalent experience in general real estate business will now be required. Formerly only Two Years of equivalent experience was required.
Educational Requirements for a Real Estate Salesperson License is Now 75 hours. Formerly only 45 hours of approved real estate courses were required.
Elimination of the current exemption from continuing education requirements for those brokers licensed after the effective date (July of 2008) who do not have fifteen years of consecutive licensure by that time.
Real estate license identification cards shall now need to contain a photograph of the licensee.

These changes are a direct result of the passage of Bill A08053, AN ACT to amend the real property law, in relation to Real Estate Brokers and Real Estate Salespersons in New York State.

Confused By Loan Disclosures? You Are Not Alone

The FTC discovered that confusion over details of a loan or refinance is abounding for borrowers across the nation. The agency conducted a study of 800 recent mortgage customers and found the loan disclosure was confusing and ineffective in explaining the costs, terms, and risk of a mortgage or refinance. This was especially true for complicated loan products like the adjustable rate mortgages.

FTC Chair Deborah Platt Majoras said, "Mortgage disclosures designed more than 30 years ago can be confusing even for simple loans, and they do not address the variety and complexity of today's mortgage products." Two other federal agencies, The Federal Reserve and the US Department of Housing and Urban Development, have reviewed the FTC report and both agree loan disclosures were too complex.

It is unfortunate that this study was not done prior to the recent subprime mortgage fiasco that allowed many borrowers to get in over their heads. Hopefully, solutions to simplify the loan disclosure process are under consideration. Borrowers need loan disclosure documents written in language that is easily understood.

Walkability - A New Category For Evaluating Neighborhoods

A Seattle-based nonprofit research organization, The Sightline Institute, has developed a web site which enables buyers to locate homes in communities which offer walking accessibility to shopping areas, restaurants, schools and parks.

The service utilizes patent pending algorithms and Google Maps to analyze and rate addresses with a Walk Score between 0 and 100, with 100 being the best walk-ability area. The Sightline Institute points out that the Walk Score is an approximation and cannot account for everything such as: crime, bodies of water, hills and weather.

Port Authority of NY/NJ Takes Over Stewart Airport in Orange County NY

Starting this week, the operations of Stewart Airport in Orange County NY will be under the control of the Port Authority of New York and New Jersey.

The Port Authority plans to budget $17 million dollars to expand the airport's parking facilities and to accommodate for an increase in passengers.

The move was made by the Port Authority to address and ease the overcrowding conditions for passengers at JFK, La Guardia and Newark airports.

If you are a homeowner who is starting to experience financial difficulty, contact your lender. Do Not Avoid your lender. Although it may be embarrassing to discuss your money problems, it is best to discuss your situation with your lender before payments are too far in arrears. If you find that you are unable to make your mortgage payments, you may qualify for one of several loan workout options. But you must check with your lender to find out which of these options may be available. The further behind you fall in payments, the fewer options will be available to you.

In general, lenders do not want to foreclosure on homeowners. The foreclosure process is an expense that lenders would much rather not incur. Lenders would much rather work with you to work out a solution to help you keep your home. Lenders are required by mortgage insurers, HUD/FHA, Freddie Mac and Fannie Mae to work with homeowners who are facing money problems. Counseling is also available. Free Counseling is provided by HUD Approved Counselors who will work with you and your lender in an attempt to avoid foreclosure.

Is a FSBO Worth Your Time..Look At The Numbers

Initially, a seller will go the FSBO route to avoid paying a commission. Many think the process of selling a home is easy until the reality of how difficult it really is sets in. When the house does not sell, the FSBO has second thoughts.

According to the National Association of Realtors, only about 12% of all home sale transactions are completed without a real estate professional. This means approximately 88% of homes sold did use a Realtor.

I like those numbers. The numbers present a great opportunity for Realtors to convey to a FSBO. And with numbers like that, I'd say a FSBO is definitely worth investment of my time.

HUD Awards 17.1 Million In Grant Money

The Department of Housing and Urban Development awarded a total of $17.1 million in grants to recipients in 37 different states and the District of Columbia.

The grants were funded through HUD's Fair Housing Initiatives Program and will be used to educate the public about their rights under the Fair Housing Act and to investigate allegations of housing discrimination.

This year's grants were awarded under one of two initiatives:

Private Enforcement Initiative grants (PEI) - HUD awarded $14 million to help groups investigate alleged housing discrimination, and to enforce the Fair Housing Act and state and local laws that are substantially equivalent to the Act.
Education and Outreach Initiative grants (EOI) - HUD awarded $3.1 million to groups that educate the public and housing providers about their rights and obligations under federal, state, and local fair housing laws.

HUD also awarded $1 million to New America Media to coordinate a national media campaign to educate the public on behalf of The Department.

Autumn On The Hudson Cruises - From Yonkers Pier - Starts October 20, 2007
