Another Moratorium - What Good is it Doing?

Enough already!!! So California is starting yet another moratorium forcing lenders not to foreclose on their borrowers property unless they have programs in place to modify the loans of at risk borrowers. Well really what good is it going to do? Nobody is taking up the loan modification programs, in fact I read recently that last government sponsored program that was supposed to help around 400,000 homeowners actually only helped one, yes one. In the meantime the lenders are stuck with non performing loans and homes that are quite literally being torn apart by unghappy occupants. We are just delaying the inevitable.

If we want the market to have any chance of recovering we have to get the pain over and over quickly. The more delays that are forced on everyone the harder it will be for the market to reset. Who is covering the growing cost to the banks to hold onto the non performing loans? This extra strain just puts more pressure on an already stressed financial market.

The politicians need to let the market take care of itself from this point on.

Foreclosed Bank Owned REO What Does it Mean and Where to Find Bargains

Surely a lot of terminology in todays Foreclosure market can be very confusing and even daunting to some would be real estate investors. So how can we make it simpler? First of all let's explain the terminology and then look at sources for foreclosed bargains.

What is a foreclosure or foreclosedproperty. Well the first important point is that these properties are no longer owned by the resident home owner or borrower and are now owned typically by the lender who made the loan on the property. This has usually come about because the owner failed to keep up with their payments to the lender and the lender enforced their right to take the property back through foreclosure. It is important not to mix these up with homes that are "in foreclosure". These homes are still owned by the borrower and it is far more difficult to negotiate a sale with the owner due to the outstanding loan balance and penalties that the lender is not always to write off. It is far easier to buy FORECLOSED homes. Many such homes are available on sites such as www.repoandforeclosure.com

Bank Owned properties are as they suggest homes that have been foreclosed and are now owned by the lender who made the loan. Again these are the best type of property for would be home owners or investors to buy.

REO is a little harder for the home buyer to understand, but it stands for "Real Estate Owned". Well you may say owned by who? It means owned by the bank or lender. So it is the same as Bank Owned and has come about through the foreclosure process instigated by the lender.

Lender Owned is easier to understand as it really says it its self. Yes you guessed it the lender owns the property and is the same as Bank Owned.

So hopefully this clears up the terminology a little, now where do you find them. Firstly you have to be careful and not get taken in by less than scrupulous scammers out there who try to charge you for lists or access to web sites. Instead find yourself a good local Realtor who specializes in listing and Selling Bank Owned homes. Search such sites as Active Rain or Google for REO Agents and seek references from past clients. Any good Realtor will be only too happy to provide them. After-all if they are reluctant it may tell you that perhaps they either don't make many sales or have a bad reputation.

Fighting the Flu

I have long scoffed at the idea of getting a Flu jab. I am from tougher stock, I am British after-all we just don't get sick.

Well as I lay here in my bed for third straight day I am beginning to think it wasn't such a bad idea. Maybe where my my philosophy went wrong was that I had built immunity to the British forms of Flu, but not the American versions, and of course everything you do is bigger and better.

Well what do I do now? I need to get back on track I just put my 2008 plan into effect and I don't want to lose momentum. Yes my team are working and taking care of everything, but I need to be there.

So it chicken soup, oh and yes I remember form my child hood, "starve a fever and feed a cold" So perhaps I should starve. Well at least that would help my other 2008 goal.

I set out to research it but then I ran out energy, off to bed again.

Ok I am back with a little more energy so what did find? Well to start with I should have had the jab. Yes I know I was wrong, Ok don't rub it in I feel sick enough as it is.

Well here it how to recover form the Flu"

- Get lots of rest and stay away from other people

- Drink at least six cups of clear fluids daily

- Take over-the-counter aspirin, acetaminophen or ibuprofen to relieve fever, headache and muscle aches (Do not give aspirin to children and teens under age 20). Saline nose drops or nasal decongestants are also useful.

- Raise the humidity in your home (use a humidifier or sit in the bathroom with hot shower running)

- Sleep with your head elevated

- Gargle with salt water (1/4 teaspoon salt in eight ounces of warm water) or suck on hard candy to relieve a sore throat

-- See your doctor if

- You are at-risk for serious complications from the flu

- You have a fever of 104 degrees or higher

- Your symptoms get worse after three to five days, especially fever or cough

- You are coughing up blood or thick mucus

- You develop chest pain, facial swelling, earache or severe pain in the face or forehead

- You develop painful or difficult breathing, wheezing or difficulty swallowing

- Your symptoms don't improve after seven days

- Your symptoms are not gone after 14 days

- Your child becomes unresponsive or has a fever lasting longer than 72 hours

-- What about antibiotics? Antibiotics fight bacterial infections; they simply don't work on viral infections like the flu. Two older prescription anti-viral medications stop the virus from multiplying in the body, thus lessening the severity and duration of the flu. But they work only if administered within the first 48 hours of infection.

I am going back to bed......

They state:

I. INTRODUCTION

The amount paid for property tax on any particular property is based on two factors: the tax rate and the taxable or assessed value. The tax rate is set by law and is applied equally to all properties and is not subject to appeal. The assessed value is determined by the Assessor, in accordance with the laws of California, and is unique for each property. The assessed value is subject to appeal by the property owner. The appeal is made through the Assessment Appeals Board.

The Assessment Appeals Board is a quasi-judicial body composed of three members appointed by the Board of Supervisors. The Assessment Appeals Board is administered by the Clerk of the Board of Supervisors and is not a part of the Assessor's Office. The members of the Board have professional experience in the fields of real estate, property appraisal, accounting, or law. The Board is an impartial entity established to arbitrate disputes between the Assessor and the property owner regarding the assessed value of property.

Even though you may have filed an appeal, your taxes should be paid on time. If your appeal is not successful, a penalty may be imposed if your taxes have not been paid in a timely manner. If your appeal is successful, an adjustment will be made.

II. WHO SHOULD APPEAL THEIR ASSESSMENT

When a property owner feels the assessed value, as determined by the Assessor, is incorrect, they should contact the Assessor's Office and discuss the matter. The Assessor may help clarify the assessment and explain the assessment process. If a difference of opinion of value still exists, an appeal is necessary to resolve the matter. Assessment information may be obtained by calling the Assessor's district office nearest the location of your property.

III. HOW TO FILE AN APPLICATION

Applications for Changed Assessment may be obtained from this website or by contacting:

IV. FILING DEADLINES

Regular Assessments (Decline in Value) July 2 through November 30

Supplemental Assessments Within 60 days of the mailing of the supplemental assessment notice.

A supplemental assessment occurs when your property was reassessed because of a change in ownership (for example, purchase of a new home) or new construction (for example, you added a bedroom.

Escape Assessment Within 60 days of the mailing of the enrollment of escaped assessment notice.

In general, escape assessments are assessments for events that happened in prior years but were not discovered in a timely manner by the Assessor.

Calamity Reassessment Appeals Within 6 months of the mailing of the supplemental assessment notice.

A calamity reassessment is when the Assessor mailed you a reassessment notice because of a natural disaster or other calamity that damaged your property.

V. PREPARING THE APPLICATION

A separate application must be filed for each parcel of secured (real property) or unsecured property (business, boat or airplane). The application should be printed or typed, fully completed and signed (original signature), with two copies sent to the Clerk of the Board of Supervisors with two copies of any attachments.

While the Assessment Appeals Board is administered through the Clerk of the Board of Supervisors, this office does not have information on how your property was assessed. For more information regarding the valuation of your property, you should contact the Assessor's district office nearest the location of your property.

Well as I write the "STORM" has finally hit SoCal. The news programs have been running full features for days. Yes everyone it is RAINING. Now aside from the danger around burn areas from run off it will probably not result in too much. But it is SoCal and it is RAINING. Now I agree the roads will be very dangerous. Dangerous from what? Oh yes all those SoCal driver who have no idea how to drive in the rain and will spin off the road at the mere mention of sprinkles.

So for all of you in areas of the country that get REAL STORMS, how does our SoCal storm compare. Oh and don't forget it is raining...

Drawing the Line!!

In Lance Winslow'sblog entitled "How Much Should Realtors Be Fined for Their Part in the Subprime Lending Crash?" he wrote that Realtors should burden the blame for fueling the Subprime crash and that we should be jailed, fined etc. Well I like a healthy debate and while I strongly disagree with his view, he is entitled to express them and we are entitled to challenge them. It stirred a lot of emotion and responses flew back and forth.

Well now in his latest, and I hardly dare say blog, more of a rant, he has in my opinion crossed the line. In Are Realtors Inherently Good or Evil? - the Secret Revealedhe asserts that ALL Realtors are evil. No exceptions. This isn't there to encourage healthy debate, it is in my opinion an insult and verbal assault aimed at our profession. His tag line says it all, it is mean't to offend and he is clearly proud of it. Enough is enough.

Germs Are Good For You...

We live in a world obsessed with cleanliness. Every other TV ad is for some form of hand sanitizer, work surface cleaner or some aid to stop contact with, and i can hardly bring myself to say it, GERMS!!

Well have you ever stopped to think that most of the time we are better off with them. I grew up, as most of you did, in a world where we had none of these germ killers, As kids we probably didn't wash our hands before eating, we ate left overs from the day before and our moms cleaned the counters with simple water. And you know we didn't get sick. Do you know why? Because we were exposed to GERMS and our immune system built up tolerance and then next time we were exposed we still didn't get sick.

Now what lies ahead? We are killing all those GERMS that we need to become immune to and never will. So one day when we do meet one we are going to get sick. Why are we more allergic to every possible thing? Because we are not exposed to them while we are young and therefore never build any immunity or tolerance.

Stop sanitizing, live sensibly and live happier.

Every 13 seconds the US population grows by 1 and as of January 1st this year the population topped 303 million up nearly one percent on the year. This will break down in 2008 will be the result of one birth every 8 seconds and one death every 11 seconds and one immigrant arriving every 30 seconds.

Do Homeowners Have Money to Remodel?

Usually when the housing market slows down those who do not need to move will turn to home improvements and the DIY stores do well. With the current situation I was sure this would not be the case as I was sensing a general lack of money among most of the population.

Well the good news is that this seems not to be the case. A report today by the popular home-repair referral service, Angie's List, says its annual poll indicates that home owners will spend an average of $11,250 on home improvement and maintenance projects in 2008, up 13 percent over the average they reported spending in 2007.

Angei Hicks, Angies list founder was quoted as saying "Building experts tell us they're getting calls for work from home owners who would otherwise move and put their current home on the market, but are afraid they can't sell it quickly enough to afford the newer, bigger house".

Is The Market Stabilizing?

So as the year draws to a close we get a really good piece of news from Lawrence Yun at the National Association of Realtors pointing to signs of the market stabilizing.

Yun's figures show total existing-home sales - including single-family, town-homes, condominiums and co-ops - rising 0.4 percent to a seasonally adjusted annual rate of 5 million units in November. This represents an increase although slight, from an upwardly revised pace of 4.98 million in October. Yun said "Near term, existing-home sales should continue to hover in a narrow range, just as they have since September, and that's good news because it'll be a further sign that the housing market is stabilizing"

It is Going to be a Happy New Year .... I Think.

Lost Property!!

We all travel from time to time and pass through airports without out a problem. However just spare a few moments to read what happens when circumstance conspire against you.

My wife Diane travels for her business and recently had a bizarre and infuriating incident while travelling home from New York. You see when Diane goes away, like most business travellers she has to take her laptop with her. Now Diane is quite small and having to lug her luggage, laptop bag and purse through an airport terminal is quite a challenge for her. The real challenge comes when she has to get everything through security screening.

Well on this occasion she was going through Terminal 8 of JFK airport (American Airlines terminal) she lugged all her bags to the little conveyor that passes all your worldly possessions through the scanner. She had removed her shoes, taken her coat off, removed her laptop from its bag and fed it all into the machine (you know the drill). After collecting all her belongings back together, getting dressed again she boarded her flight and headed home.

As she only uses her laptop for travelling it was another two weeks before she got it out to use. To her horror when she turned it on it was asking for strangers log in information. You can only imagine what was going through her head. The computer looked the same but it wasn't hers. What she didn't know was that when she was in line for screening at JFK a Brazilian national was in line next to her with ths same laptop. He was pulled out for further screening and the TSA removed what they thought was his laptop from the line. Only it wasn't it was Diane's. Fortunately he had the forethought to stick his business card to the bottom and Diane was able to track him down to his office in Brazil. After a few e-mails he confirmed what had happened and told Diane that the TSA had taken the laptop away after he disclosed it wasn't his. He also had the presence of mind to photograph it, primarily to show proof to his boss what had happened. This was to prove vital later.

Diane's task now was to find her laptop. Her first call was to the TSA at T8 in JFK Airport. Immediate success the TSA officer had a record of receiving it and confirmed he handed it to American Airlines lost property in the terminal and told her to call them. OK this is where her troubles started. The number on AA's web site was either continually busy or nobody ever answered. After two weeks of calling and even getting their office intern to spend the whole day continually pressing re-dial she had got nowhere. I then got involved and tried to contact American Airlines customer service. As there is not a phone contact listed on their web site I filled in the appropriate on-line form and waited. Less than 24 hours later a reply. Wow not bad. I read eagerly only to be disappointed with the response. I had simply asked for some help in contacting the lost property department. I was told in reply that they took no responsibility for lost property and did not have the resources to deal with matters such as this. OK!! No not OK. They in my mind did have responsibility. A government agency (TSA) had handed them valuable property and recorded it. After another couple of exchanges via their on-line forms (They do not give you the ability to reply to their e-mails. I guess to hide from contact from their customers) I eventually extracted another couple of phone numbers for Lost property. Now this time at least we got an answering service which promised a call back within 24 hours if they had the property we were looking for. Now this is going to surprise you..... we didn't get a call back. Ok you weren't surprised.

After several more messages and no returned calls Diane called the TSA again and explained that we had a photo of a TSA officer holding her computer. Amazingly they again remembered it and offered to connect Diane directly to the person in American Airlines lost property who had received it. Wow..... she got to speak to her and amazingly yes they had it and arranged to ship it back next day.

Why had it been so difficult? Why were American Airlines not a little more helpful? Why did the lost property line never answer? Why when she called the other number did nobody ever call back? American Airlines claim "We Care" I beg to differ.
