The negotiator kept getting information back but the bank couldn't get it together. We have been being promised a decision is withing a couple of weeks for the past two in a half months.</p> <p>Finally the buyer asked if we could just find them something without the uncertanty of a short sale. Within 10 days we found a property and it got signed around today. That was one of the last short sales we have in the pipe. This spring, between two agents on our team, we usually had around six short sales in the pipe but over the past few months it has gotten so rediculous that we just avoid them all together now.</p> <p>What are the banks thinking and why can't they get their act together. I cannot blame the client for saying enough-is-enough after 5+ months.</p> Howard Goff -- Clark County Vancouver Real Estate (Keller Williams Realty) Mon, 05 Oct 2009 02:18:53 -0500 http://activerain.com/blogsview/1269715/banks-drive-me-crazy http://activerain.com/blogsview/1255008/but-my-relative-wants-to-be-my-realtor-so-they-can-make-the-money- <p>That statement should send up red flags for at least a few of you.</p> <p style="padding-left: 30px;"><em>&ldquo;Before taking a client that you are not fully qualified to handle, ask yourself if the few thousand you will make is worth taking a chance of costing the client 10&rsquo;s of thousands of dollars.&rdquo;</em></p> <p><em>I</em> have a family member that needs to sell a house belonging to an estate. There are two people involved in the estate: one with a majority interest and the other with a minority interest.</p> <p>I am a Realtor but not in the state where the house is located.</p> <p>Yesterday, I was told by the first person that the second person's <span style="text-decoration: underline;">spouse was a Realtor</span> and that an uncle had a person living in his basement that he needed to get out. Lucky enough, the <span style="text-decoration: underline;">uncle is also a Realtor</span>. The guy living in the uncle's basement wanted to lease-option the home for a few months until he could purchase it. The uncle was excited to have a way to help the person move out of his basement. He made it known that he would be expecting a 3% agency fee for representing the guy and "bringing the buyer".</p> <p>The statement <em>"genetics makes a good realtor"</em> causes me to start becoming concerned. Your relative may be an awesome Realtor but not just because they are a relative.</p> <p>You might also guess but a lease-option is something that I don't think is always the best option.</p> <p>Over the course of two days, I provided some insight and the conversation changed to a Purchase and Sale agreement with a 90 day closing period and early occupancy. Still makes the hair on the back of my neck crawl but some progress.</p> <p>So I ask the first person if it would be okay if I arrange for them to meet with a Realtor from my franchise who works in the area, no relation and no referral fee just to get a second opinion. She agrees.&nbsp; So I call the market center assistant at the local office and ask for their best listing agent. The meeting is setup for this afternoon.</p> <p>Now understand, at this point no one has hired this other realtor. It is just a meeting to talk about price and services, maybe look at a CMA to see if the suggested price makes sense.</p> <p>If the other agent thinks it is a good deal they will offer to handle contract-to-closing for 1%. If the deal doesn't work out and the property has to be put on the market their fee would be a standard 3%. But again, this meeting is just finding out about options, no contracts have been signed or even promised to be signed.</p> <p><strong>Now here is where it gets interesting.</strong> The second person who is the spouse of a Realtor is suddenly infuriated that her spouse was not getting to sell the property and get the commission.</p> <p>Then the uncle calls the first person and to verbally harasses the her for agreeing to meet with an agent. <span style="text-decoration: underline;">Yes, this is the uncle who has declared he will be representing the potential buyer calling one of the sellers to harass them about wanting to talk with an agent about being represented themselves.</span></p> <p>So far as I can tell, neither of these family Realtors have completed a significant number of transactions for clients other than themselves in the past year or so.</p> <p>It amazes me to think that there was even consideration about letting these two Realtors put together this deal without some third-party sanity check. Maybe the deal is great but if it is so great why all the angst when a suggestion to bring in a neutral third-party for their opinion?</p> <p>My #1 priority as a Realtor is to make sure I can properly represent any client I choose to serve.</p> <p>I usually handle listings but we have buyer agents on our team and they feel exactly the same way.</p> <p><strong> Please,</strong> if you are a Realtor, and have family or friends who need to buy or sell property, before agreeing to represent them please put their interests before yours and ask yourself if you are in a good position to represent this person. <span style="text-decoration: underline;">Do you have the currently needed skills, resources and do you know their <em>local</em> market.</span></p> <p>Especially in this market! Like all of their training, it was incredible!</p> <p>We have closed over 25&nbsp;sales this year so I thought we were pretty on top of our game but Brian Combs showed me how we still have huge potential for growth. Look out ahead, here we come.</p> <p>Here&nbsp;was&nbsp;one of the&nbsp;most important take-away messages.</p> <p>A proper initial&nbsp;buyer consultation can greatly improve the efficiency and smoothness of the home buying process for both the buyer and the agent.</p> <p>Buyers, if your agent is not trained to sit down with you, in their office,&nbsp;and properly consult with you about:</p> <ul> <li>your needs and wants</li> <li>your&nbsp;"must haves"</li> <li>the things you need to know to buy a home in whatever market you happen to be in</li> </ul> <p>...BEFORE LOOKING AT HOMES, switch to an agent who offers this as a standard part of their service.</p> <p>Yes, you will probably end up under contract but who is "under" who. Yes, the buyer agreement talks about how the agent will be paid for their work but it also&nbsp;specifies the duties of the agent to the client so&nbsp;would it be more correct to say you now have the agent under contract to perform the services you need.</p> <p>In that initial consultation, a well trained buyer's agent will help you find out things about your preferences that every you were not consciously aware of. Then they will&nbsp;use the&nbsp;results of&nbsp;your initial consultation to help you quickly narrow down just which homes are worth considering. By doing so you will need to view fewer homes and&nbsp;will end up with more of what you want. In short, this initial consultation is the best investment you can make in your buying process (usually the only cost to you is&nbsp;an hour of your&nbsp;time).</p> <p>Maybe you are someone who really likes looking at homes week after week but really, is that your goal?</p> <p>Something else to think about the next time you call an agent and they say, "let's meet at the house you want to see"...</p> <p>Ask yourself, would a property&nbsp;owner&nbsp;ever hire an agent to&nbsp;sell their home without interviewing the agent and getting that agent under contract? At the listing appointment, the selling agent will consult with the owner for up to two hours about things the agent needs to know to do their job well and things the seller needs to&nbsp;understand about the process.</p> <p>Buyer consultations are usually shorter but no less important. Make sure you are working with an agent who&nbsp;is&nbsp;able&nbsp;to take you through this process and who then offers you a buyer-broker agreement.</p> <p>You don't want to be locked into a contract? The intent of the bill seems to be to prevent equity skimming which is when a property with equity goes into foreclosure because the owner cannot make payments and an unscrupulous investor talks the owner into giving up their equity to avoid the foreclosure.&nbsp; Generally this is bad because the owner could have just sold the property and avoided the foreclosure without having to give away the equity.</p> <p>An unintended consequence of the wording of the bill presents a liability risk for home buyers purchasing homes in Washington.</p> <p>If a buyer closes on a property AND the closing date is within 20 days of a scheduled or docketed auction of that property buyer has a significant liability to the seller.&nbsp; This is true even if the buyer is working through a buyer agent and even if they know nothing about the foreclosure (which would be unlikely).</p> <p>If you are working through a real estate agent, they have already been advised of this new law and may present you with a new buyer agency agreement to sign.&nbsp; This is to protect both you and the agent.</p> <p>When your agent writes a purchase offer for you they should have language in the agreement which will protect you from the effects of this bill in the event the property you are attempting to purchase meets the legal definition of "distressed".</p> <p>If you are currently purchasing a property which is in foreclosure, have your agent make sure the property sale&nbsp;is not scheduled&nbsp;to close&nbsp;AFTER June 12^th AND WITHIN 20 days of an auction date.&nbsp; You may wish to contact an attorney to make sure your deal does not present you with unmanageable legal risks.</p> <p>WARNING</p> <p>If you are attempting to purchase a property on your own, without the representation of a real estate agent or an attorney, especially if that property is a For Sale By Owner property, you need to understand this new law.&nbsp; If you are acting on your own you run a higher risk of being classified as a <strong>Distressed Property Consultant</strong>.&nbsp; If that happens you may be liable to the seller even if the property is not scheduled to be sold at auction.&nbsp; I am not an attorney and it would be improper for me to attempt to interpret for you what that means but in my opinion it presents unacceptable risks.</p> <p>My advice is this: if you are attempting to purchase a property on your own from an owner who is having financial difficulties you should either be represented by a licensed real estate agent or an attorney.&nbsp; It is designed to protect people facing foreclosure WITH&nbsp;positive equity in their property from having the equity stolen.&nbsp; Many states (about 20) now have similar laws and in every other case Real Estate&nbsp;Agents&nbsp;have been exempted so they can&nbsp;offer representation to&nbsp;Distressed Homeowners without facing $100,000 penalties.&nbsp;</p> <p>Only in Washington have Real Estate Agents not been exempted from the law creating a situation where there is significant legal risk for any agent who offers a Distressed Homeowner&nbsp;assistance&nbsp;in attempting to avoid foreclosure through the sale of their property.</p> <p>When I originally read the law I couldn't believe what was there.&nbsp; Still I held my breath that I was overreacting.&nbsp; I have now seen&nbsp; the Washington State Realtors and NWMLS legal analysis and I think the situation is clearly as bad as I had feared.</p> <p>My brokerage is currently using RMLS (WREF)&nbsp;forms and so far as I have seen, the proposed adjustments do not protect agents enough for me to feel comfortable dealing with any property that even smells like&nbsp;a distressed property.</p> <p>I had a long conversation with a broker yesterday that felt the state forms (from NWMLS) did a better job of responding to the new law and I am attempting to get access to them.&nbsp; I am hoping to at least be able to continue to deal with properties that are in distress but have equity.</p> <p>So what about sellers who cannot expect a sale price sufficient to satisfy the mortgage?</p> <p>My brokerage is too small to hire a legal team to provide me with the coverage necessary for me to allow myself to be classified as a Distressed Property Consultant.&nbsp; I suspect many agents will be in the same boat.</p> <p>The only service I could offer a short seller is to bring an offer.&nbsp; Since I cannot contact their lender without putting myself at significant legal risk, and since I have little expectation that an owner could get third party approval on their own, I have no incentive to even take the listing.</p> <p>I doubt I could even safely make the statement "This other agent has a program to help you." As by&nbsp;offering advice on how they can get help, I may end up being classified as responsible to them for whatever outcome happens.&nbsp; If they become dissatisfied with the agent I referred them to they may be able to sue me because I acted as a Distressed Home Consultant by advising them who to contact for help.</p> <p>In a worst case scenario, not only would a home owner who was hoping for a short sale have to navigate lender negotiations by themselves but they would have to sell their property FSBO.&nbsp; Talk about climbing a steep mountain.</p> <p>I think there will be a rude awakening on June 12^th when many short sellers who have been hoping to avoid foreclosure find out that the listing agents are walking away because the transaction will able to be completed without the agent being able to have any contact with the lender.&nbsp; I can imagine the conversation:</p> <p style="padding-left: 30px;">"Dear Short Seller, we have traveled a long way down this road and I really thought we were going to achieve success but from here out you are on your own courtesy of the legislature.&nbsp; I wish I could give you a referral but any advice I offer you could be interpreted as my trying to help you and if I do that I could face a $100,000 penalty and loss of my license.&nbsp; Best of luck."</p> <p>When I found out the 11^th our tactics which were used to cram this legislation down everyone's collective throats I was completely amazed.&nbsp; No, not amazed, angry.&nbsp; The people involved in creating this should be ashamed of themselves.</p> <p>Holding the feet of equity skimmers to the fire is one thing.&nbsp; Using vulnerable home owners who are in a negative equity position as fuel for the fire is... well you judge.</p> <p>I have heard rumors that some of the largest brokerages are working on providing legal support and training to create Distressed Property Consultants within their ranks.&nbsp; Today, I gave up hope.</p> <p>I can appreciate your (the legislatures) wanting to hold some specific types of investors feet to the fire but what has been enacted uses distressed property owners as the wood for the fire.</p> <p>I am trained to assist home owners who are in a short sale situation and I honestly believe that few of these people need to face the damage of a foreclosure.&nbsp; It is bad for their credit and it leaves them in a situation where they have no control or ability to negotiate a way out with the lender.&nbsp; Ultimately they can end up being foreclosed on and still owe more than they started owing in the first place.&nbsp; A properly executed short sale has the possibility to minimize the damage.&nbsp; Since banks can and are willing to accept less than whatever the existing market value of a property is most of these properties are good candidates for being sold.</p> <p>I think that this new law will go a long way toward stopping the "angel investing" or equity skimming or whatever someone wants to call it.&nbsp; For home owners who have equity in their properties, I can still represent them and maybe help them avoid foreclosure so long as I do not let on to them that this is what I am trying to do.&nbsp; If I slip up and ever mention, even verbally, the possibility that what I am doing may save them from "you know what" then the game is over, I have just jeopardized my position, my career and my financial future.</p> <p>For the group of home owners who have negative equity (and I think there are far more of these than there are owners who are at risk of equity skimming) the net effect is:</p> <p style="padding-left: 30px;">a)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; few real estate agents will be willing or able to assist the owner with negotiations with their banks due to the liability which they are now exposed to;</p> <p style="padding-left: 30px;">b)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; as a result of no ability to get the required third party approval most agents will be unwilling to even list such properties; and</p> <p style="padding-left: 30px;">c)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; even if a property gets listed, once a property is within 20 days of a scheduled auction the game will be over and no buyer will be willing to help the seller.</p> <p>There is little chance of a home owner who has no education about the short sale process and no experience in working with lenders successfully getting the required third party approval on their own. &nbsp;&nbsp;If all agents were to take my position that the risks of offering this type of service are just too unmanageable, not only would these homeowners be forced to handle their own lender negotiations but they would also be forced to attempt a "For Sale By Owner" due to the lack of agents willing to work with them.</p> <p>I expect that will be a rude awakening on June 12^th as a number of home owners who now expect that there is some chance to minimize the damage from their financial situation through a short sale find that their real estate agents are quitting.</p> <p>I wouldn't be a bit surprised if an impact of this new law is that foreclosures in Washington rise in the coming months.</p> <p>OK, my wining about it isn't going to change reality and it doesn't even really affect my career because I can focus on other clients but I think it is terrible that a group of sellers who probably need good representation most will find any representation hard to come by.</p> <p>So as soon as the legislature gets back in session that there will be discussions about addressing this situation&nbsp; I wouldn't have thought much about it; in fact I might have even clicked on the link to see what was behind the door if it hadn't been for the icon that guarded the link.&nbsp; A <strong>NO LEFT TURN</strong> sign.&nbsp; Now I think if I had seen a no left turn sign on its own I might not have thought much about that either but the sign in conjunction with the name was enough to give me a feeling this wasn't a place I wanted to go.</p> <p>Yes I am a REALTOR but my ethics do not come from the COE or the Department of Licensing.&nbsp; I seriously doubt that personal ethics can be implemented by legislation.&nbsp; All legislation (by government law, association requirements, or by terms of service) can do is to define a community's agreed upon ethics and weed out the people who do not wish to abide by the ethics of that community.</p> <p>So how did personal ethics affect my decision to avoid the silent majority group even though I knew no more about it than the name and the guarding icon which stated "Don't go Left"?</p> <p>I imagined that used together the title and icon could mean only one thing, the group behind the icon was created to promote the idea that people who were not "Right", by how "The Creator" would like to view the world, were "Wrong".&nbsp; I don't believe people are right or wrong in-and-of themselves; I see them as like me or not like me.&nbsp; Am I the definition of <em><span style="text-decoration: underline;">Right</span></em>?&nbsp; Probably (in fact most certainly) not always.</p> <p>We all live within layers of communities and each community's ethics needs to be in line with the ethics of the parent community.&nbsp; The ethics of a group within Active Rain needs to conform to the ethics of the Active Rain community just as the ethics of Active Rain itself needs to conform to the ethics of our society.</p> <p>It was no surprise to me when I found out that the founder of the group had been removed from the Active Rain community for comments which were seen as in conflict with the adopted, agreed upon, ethics of the Active Rain community.</p> <p>When I read that the member which had been sanctioned had a history of making comments which demeaned entire classes of people I was sad and concerned that such a member would be in a group I associate with.&nbsp; I certainly do not want to be seen as endorsing such statements in any way.&nbsp; It is my concern that if Active Rain became a place which tolerated such statements and I was a member of Active Rain that I would be giving my tacit approval to this type of behavior.</p> <p>After reading many comments regarding this issue, I see that the "Silent Majority" group is not silent and I doubt they are the majority.&nbsp; Is deception in line with other values of this group?&nbsp; Are members of Active Rain who have subscribed to and participate in this group endorsing the behavior of members of the group?&nbsp; Is the group's ethics represented by what I have heard about the founder who has&nbsp;been removed from the Active Rain community?&nbsp; What about members of Active Rain who are explicitly defending the behavior alleged to the person who was removed, are they endorsing&nbsp;the behavior?</p> <p>As I said, the Active Rain community lives within a greater community and along with my agreeing with the values of the greater community it is imperative to the success of my career that I not be seen as endorsing activity such as demeaning or treating people unfairly based on their race or cultural heritage.&nbsp; Let me state that again, it is not enough that I simply live my life treating people equally and fairly.&nbsp; I feel must avoid even the perception that I endorse activity inconsistent with treating people equally and fairly.</p> <p>I will continue to watch issues such as this&nbsp;and if I find that there is any doubt that my participating in the Active Rain community could be seen as my endorsing comments or behavior which are not in-line with my personal ethics I will delete my posts and take my comments elsewhere.</p> <p>Many of you may not feel nearly so passionate about this issue and be shaking your head at my post.&nbsp; Some will probably think I am over reacting but I would ask you to extrapolate this event in your mind.&nbsp; If people who are intolerant of differences are allowed to grow and prosper their arguments in the Active Rain community; Would it be a good idea to even encourage it?</p> <p>On some level, I have an aversion to letting the opposing party or their representatives anywhere near <strong>MY</strong> clients.&nbsp; Not sure why really but it is my gut feeling.</p> <p>Why might I think about doing this?</p> <p>First, it allows the offer to be presented to my clients without my biasing their reaction to it (let's face it, most offers are not full of roses these days and despite my attempts to present something without my opinion, if&nbsp;an offer is 15% under asking, it is hard for me to not indicate&nbsp;something.)</p> <p>After the buyer's agent has made the presentation and been thanked and dismissed,&nbsp;the sellers and I&nbsp;could then analyze the offer and make whatever judgment&nbsp;seemed prudent.</p> <p>Second, it allows the sellers and the buyer's agent to meet.&nbsp; It puts a face to our side of the transaction.&nbsp; I know, I said I have an aversion to this but it is just a gut feeling.&nbsp; Pointless fear or wise intuition?</p> <p>Third, I could then ask to be allowed to present any counter offer needed directly to the interested buyers.&nbsp; Good or bad?&nbsp; I have no idea; I have never seen this done.&nbsp; If dealing with a bottom feeding investor, probably not worth the time but if it is someone looking for their next home and they have an emotional attachment to the property, maybe the two sides could be brought together.</p> <p>Those of you who stumble upon my post, what do you think?&nbsp; Even if you have never had direct experience with this I would be interested in your speculation.</p> <p>I usually have not been posting to localism but I am going to put this out there as I would&nbsp;be interested in how individual buyers and sellers feel about who presents the offer as well if they are willing to comment.</p> <p>Thanks,<br />Howard</p> <p>PS.&nbsp;
