Florida Homeowners Facing Foreclosure - Attorney General is Calling Out Lenders!

The Florida Attorney General, Bill McCollum, who is also running for Florida governor, is now getting involved in the abysmal mortgage crisis in Florida. I can recount story after story of fearful homeowners who have told me their lenders would do nothing to help them save their homes. These borrowers cannot crack through the mortgage system for any intelligent discussion and solution to their personal mortgage crisis .

Apparently, Attorney General McCollum has heard the same cries. Yesterday he issued a press release and copy of letters he sent to the major mortgage servicers.

McCollum cites poor treatment and no assistance to Florida homeowners unable to pay their mortgage and facing foreclosure. He has written letters to executives of Bank of America, JP Morgan/Chase, Wells Fargo and Wachovia. Specifically, McCollum states Florida borrowers are:

· Placed on hold for excessive periods when calling for help

· Transferred from department to department and person to person

· Forced to submit identical paperwork again and again

· Forced to speak to unknowledgeable representatives

· Never informed about the status of their loan modifications

· Provided no avenue for complaints

Bill McCollum says these practices are “irresponsible and unacceptable”.

All I can say, is, “Hurrah, Bill!” Thank you for taking a stand with these monstrous corporations. As a Destin short sale specialist, I deal with them every day. There is no such thing as customer service and courtesy anymore. As you say, the tone is quite different from when these lenders originated these very loans.

I hope your letter brings pause, attention and ACTION from these corporations who are forcing borrowers into foreclosure.

I can't stress enough how important this is. The group should be set up in the name of the short sale lender. How Will You Achieve Your Goals, If You Don't Believe Them?

I was talking with an agent, “Janice” today, and asked if she planned on closing at least two sales a month in 2010. I could tell by the look on her face the answer was no. She could not even imagine that much in sales. She tried to notch up the optimism and said, “I should plan on it, I know….”.

Well, guess what? If you don’t plan on making a certain number of sales-- if that number is not even in your realm of possibility-- then what are your chances? Will someone who never pictures himself in a new home ever own one? Will someone who feels she is undesirable ever attract a mate? Will a father who expects bad behavior from his child ever achieve peace? It is doubtful you will do or receive any better than what you imagine. We must fulfill our beliefs about ourselves.

Read the following “imaginings” and see if you can find the key to achieving your dreams.

Imagine - You develop a system of handling 20 sales per month, but you have a problem, you need to hire another assistant. Where will they sit?

Imagine – You have bought your dream home in the mountains, but the road is difficult in winter. Do you need to buy an SUV?

Don't Get Caught in the Latest Real Estate Scam

Normally, we all recognize scam emails trying to swindle money. Typically, these mass emails claim to be foreign heads-of-state who want to deposit millions of dollars in YOUR bank account. We hit the "delete" button and forget about them. Well, my office was recently targeted for a more sophisticated real estate scam. In this case, it was not just a mass email. The culprit, "Dr. Chang Wong" filled out a detailed property search form that gave us pause:

NameAddress: Dr. Chang Wong

Banshan County, Gongshu Dct, Hangzhou Zhejiang 310022

PriceRange: $500,000.00USD to $900,000.00USD

Comments: Dear Sir/Madam,

I am Dr. Chang Wong The Chief Financial Officer for Cnooc Limited, China. We are currently looking to buy a house in any nice neighborhood for our Retering president of our company.

We are currently looking to buy a four (4) to six bed rooms house with the price ranging from $500,000.00USD to $900,000.00USD and we would want to retain your lawyer in all the process buying the property e.g. documentation and payment. Please if you have properties with similar description please contact me as soon as possible so that we can make arrangement for the payment and all paper work. My client is willing to make a full payment of any choosing property. Please contact me at my email: changwong_cnooclimited@asia.com

I was not sure if this was a fake, so we initially treated the lead as real. One of my team members sent Dr. Wong a list of homes, and he corresponded back by email. He picked an $850,000 house in Santa Rosa Beach, Florida, and asked for names of attorneys to represent him. Again, communicating by email, he picked one of the local law firms and wanted to solidify a contract. All along, we were suspicious this might be a scam, but a bit optimistic. Dr. Wong could be an international jet-setter that just buys homes without viewing them, right?

The next clue that Dr. Wong might be a scam-artist came was undeniable. Read his email:

BUYER AND SELLER AGREE TO DEPOSIT $300,000.00 AGAINST THE PROPERTY, CHECK TO BE SENT BY STOCKBROKER. BUYER WILL ADD ADDITIONAL $200,000.00 TOTAL $500,000.00 THIS MONEY WILL BE USE TO BUY A NEW APPLIANCES FOR THE PROPERTY, ALL THE MONEYS IN THE LAWYER COMPANY'S TRUST ACCOUNT BUYER AND SELLER AGREE TO ALLOW THE LAWYERS TO DISPERSE MONEYS AT THE BUYERS REQUEST; A MINIMUM OF $300,000.00 MUST STAY IN THE LAWYERS COMPANY TRUST ACCOUNT UNTIL SAID TRANSACTION CLOSES. BUYER HERE BY REMOVE ANY ALL CONTINGENCIES ON SAID PURCHASE AGREEMENT

$500,000 for new appliances, Dr. Wong? With a "check" from your stockbroker, not wired funds? That some "bank" will verify as authentic? OK, hold on! Dr. Wong, appliances might only cost $10,000! Were you thinking the excess $490,000 would be wired back to you in REAL AMERICAN DOLLARS. BUSTED!!

The local attorney contacted the FBI, and we learned that Dr. Wong is really in Nigeria (where else?). Further, there is nothing the FBI can do, since it is practically untraceable and overseas.

So, be warned. I have since found Dr. Wong on other real estate sites, filling out forms and making inquiries. Don't be the one who sells him a house.

PHH Mortgage is vying for Top Spot in my yearly list- "10 Worst Short Sale Lenders". PHH is a servicer of mortgages for companies such as Merrill Lynch Credit Corporation, Provident Bank, UMB, Bank Atlantic, Banco Popular, etc. Their poor service prompted today's email to the negotiator for a Niceville Florida short sale:

Hello Mr. Negotiator,

I am following up on VA Borrower, John Doe, short sale 0022940…. I was told you are now assigned to this file.

This short sale has been in process for 8 months.

I was told it was “escalated” to you on October 19.

The buyers, waiting since March 20, need to close asap.

On July 17, Joe Smith of PHH, counter offered the contract price and HUD line items, and asked for the closing date to be revised THEN to August 31.

We complied, the buyers agreed to the new price and terms, and the HUD was sent to your company with a closing date of August 31 as requested.

ALMOST THREE MONTHS have passed since that date.

Is the end in sight?

"Day in the Life" of a Destin Short Sale Agent

Just one of my normal days selling real estate and short sales in Destin, Florida...

Buyer agent emails me to say buyer is “walking” if no response from Niceville short sale lender this week.

Another buyer agent calls me to say buyer is “walking” by October 31 if no approval given on Destin short sale condo.

Another buyer agent calls and emails me three times asking when the approved Bank of America Santa Rosa Beach short sale can close.

Another buyer agent calls to ask if my seller will put $7000 in escrow for “as is” short sale for roof repair, HUH?

Bank of America emails me asking for all new financials and a revised settlement statement within two days, or they will close the file on a Sandestin short sale.

Two days before closing on Destin short sale condo, I am trying to obtain junior lien approval letter from Suntrust Bank. They have been promising the letter for a month.

Seller emails me that an agent left the door unlocked after showing his property. Seller is upset.

Buyer agent for Fort Walton Beach short sale calls to ask for status on approval.

On hold 40 minutes with PHH for Niceville Florida short sale. I ask for supervisor of supervisor, as this short sale has been in process seven months. I finally have to hang up after hold music gives me a headache.

Checking on another Suntrust approval, I am told no BPO or appraisal has been ordered after 60 days. I ask “When” is it going to be ordered. The rep tells me she would be a “rich woman” if she could answer that question every time it is asked.

Checking on Aurora Loan Services short sale. They say they have moved back all approval estimates by another 30 days.

I let Navarre short sale seller know we cannot sell her property if we cannot show it. Tenant-occupied and every showing is denied.

My computer starts typing on its own, repeating the same character ,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,, for ten minutes. This is the third time in two weeks. I am shut down! I replace the mouse and it starts working again.

I create a ten-point counter-offer addendum for Destin short sale seller to respond to an offer.

Another buyer agent emails me buyer is walking if my Santa Rosa Beach short sale seller won’t agree to his bank’s demands for deficiency balance to be paid.

Good email- Boeing relocation for Destin buyer (wow, non-short sale work)

Get pre-approval letter for buyer for Fort Walton Beach commercial property. Letter is dated 1999. My seller is concerned.

At the end of the day, I tell my husband I am exhausted, as it was a bit stressful. He says, “You wouldn’t have it any other way.”

He is right.

Do You Deliver "Knock Your Socks Off Service"?

You walk into a place of business. The receptionist does not look up. She is on the phone. No matter what you do, you get no eye contact. You stomp around and she finally hangs up. No smile. “How can I help you?”, she spurts out. You tell her you are there for an appointment. “Just a minute”, she instructs you. After ten minutes, you are ushered in.

Has that ever happened to you? Or worse? How often do you check the “courtesy” systems for your own real estate business? Here is a refresher:

1. Answer the phone after two to three rings. Anything more, and they might wonder if you are still in business.

2. When taking a transferred call, don’t make the party repeat everything they already said to the first person!

3. Ask, “May I place you on hold for a moment?”

4. When you telephone someone, don’t start into your conversation. Ask if they have time to take your call.

5. When emailing, repeat the subject line in the content of your email. Many people gloss over the subject line, and they might not realize you are talking about "unit 2B, Marbella condominiums"!

6. Are you on time? If you are going to be late, do you call, even it is only five minutes?

7. Do you make eye contact when they enter your office or during a conversation?

8. Do you address people by name, but not so much that it sounds contrived?

9. Do you thank people for their time, even a bank negotiator?

10. Gentlemen, do you open the door for your female customer?

11. When dealing with an angry client, after assisting, do you ask “Is there anything else I may help you with?”

12. If you cannot give someone your full attention on the phone, do you ask if you can call them back so you can?

13. If you cannot help someone, do you refer them to someone who can?

14. Do you tell the truth? For example, it may be more than a minute wait!

15. Do you respect others?

16. When you make a mistake, do you confess, apologize and say you will correct the problem and do better?

17. Finally, do you treat everyone, not just your buyers and sellers, but vendors, agents, repair persons, employees, short sale negotiators, salespeople, etc., like your best customer?

Some of these ideas I've learned over the years. Some I've found in my favorite customer service book, “Delivering Knock Your Socks Off Service" by Kristin Anderson and Ron Zemke. I highly recommend you read it and perhaps you might elevate your business.

Will Destin Short Sale Lender "Pay" For The Privilege?

This is a first for me. As a short sale listing agent in Destin Florida, I have a parcel of land for sale in a ritzy golf course community. It is in a newer gated neighborhood where building lots used to fetch over $200,000. When I took the short sale listing at $90,000, it seemed realistic. But the lot market near Destin has steadily declined, fluctuating between a 3 and 15 year inventory in the past two years. That means it would take at least three years to sell out all the lots for sale at the current rate of sales. A normal market is six to seven months inventory.

After a year and a continued down market, we eventually lowered the price to $23,000. When I got a contract this week the offer was for $19,000. The most recent comparable sale, a foreclosure, had commanded a whopping $18,000. So the offer was fair.

The problem came after I ordered the HUD settlement statement to provide the short sale lender, Federal Trust Bank. Of course, I had done preliminary title work a year ago, but things had changed, including the price by 75%. Not only were there past due taxes of $12,000, there were thousands of dollars in unpaid homeowner association fees. In fact, the closing costs on the HUD would pay zero to the short sale lender, and would require cash to close of several thousand dollars! You see the closing costs were well over the sale price!

The seller has no money to bring to closing and the buyer will not. The short sale lender probably won’t pay for the privilege of allowing the short sale to get not a single dollar.

My question is, "What would YOU Do?"
