California Notary Changes 2009 AB 2452

California Notary changes for 2009 AB 2452 has been published. An employee ID card issued by an agency or office of California, or any city and county in California has been added to the list of acceptable ID. Since I reside in Sacramento this is an excellent addition.

Requirements for Subscribing Witness will also change in 2009. This change will require Subscribing Witness to be indentified by one Credible Witness who presents a state approved ID as identification. My comfort level has increased.

AB 2452 did not address an increase in notary fees. I guess based upon the economy this is probably good decision.

Happy stamping!

Where Is Ntsike?

I guess I am just a creature of habit, but I miss Ntsike's (needAnotary.net) informative blogs and post. I was wondering if he is ok. Maybe he is living up to his smart reputation and decided to take a long exotic vacation. Ntsike, check in from time to time, you are greatly missed!

Free Google 411 Information Service

A dear friend of mine forwarded an email to me last week regarding Google's new free 411 information service. I was happy to receive her email, since I pay additional charges to my cell phone provider monthly for using their 411 service. Here it goes:

Here's a number worth putting in your cell phone.
This is an awesome service from Google and its free...great when
you are on the road. Listen to the clip!!

http://www.google.com/goog411/

1-800-466-4411

Thank you Google!

Go FedEx-Kinko's

I would like to commend FedEx-Kinko's for it's dedication to constantly improving operations. Even in a weak economy FedEx-Kinko's continues to open new branches and diversify services. For example, several full service branches have expanded package drop off time from 3:30 or 4:30 to 7:00pm, for deliveries on the west coast. This is a major nugget for me since most of my clients are located in southern California.

I accepted a closing at 2pm yesterday from a new client which was scheduled for 4pm. The client contacted me at 9:45am this morning after receiving the package and wanted to know how I had performed such a miracle. I explained that it was a case where the timing was right. She stated she was impressed and would contact me in the "near" future. For the first time, I was grateful for sticking to my business model of booking each loan signing appointment within a 2 hour block. This potential client is a major one.

Thank you FedEx!

Spending Time In Jail Has Been Lucrative

Spending time in jail can be quite lucrative. Over the last 2 weeks, I have had an increase in calls with request to go to the local jail 20 miles from my home to notarize a single document signature. I have completed 4 of 5 assignments as of date.

Going to jail is quite interesting. I must call in advance and make an appointment to visit the inmate. I was able to schedule 2 appointments back to back during one visit. Notaries are allowed to conduct business outside of regular visiting hours. I am allowed to bring in the form to be notarized, my journal, a pen and my own Id. My notary stamp can not be brought into the facility.

Check in is painless. Wait time is another story. I have waited less than 20 minutes and up to 30 minutes for the inmate to arrive into the little private visiting booth which is reserved for legal consultations. A secure glass separates the visitor and the inmate. The most difficult part is sliding the paper through the thin slot for the inmate to sign. If your pen is thicker than a BIC it may present problems when you slide it through the opening. You must ask the inmate to stand, so that you can copy information from the Id bracelet.

My clients have been very nice people. Each had no problem paying me in advance through paypal since they were not local. ‘The inmates I serviced were quite pleasant and conversation was minimal. The deputy sheriffs are always so nice and accommodating. I am looking forward to spending more of my time in jail, completing assignments.

Oh, by the way, I had no hang ups about leaving my business card at the information desk.

Candylike Almonds

I am a Certified Notary Signing Agent. During peak times I usually do not get enough time to stop for a healthy meal. I am not good at packing a meal for the road. I recently started to make these candylike almonds to keep me feeling satisfied after reading that a study at the University of Toronto had detemined that almonds reduce the risk of diabetes as well as high cholesterol. Participants of the Biggest Loser Reality Show were allowed 1 ounce of these nuts a day, without gaining weight. These almonds are really good!

20 raw almonds

1 tsp ground cinnamon

1 packet sugar subsitute, such as Splenda

Preheat oven to 350 F. Spread almonds in single layer on nonstick baking sheet and roast 7 to 10 mins.

Transfer to small bowl and spritz several times with zero-calorie butter or cooking spray. Sprinkle with cinnamon and sugar substitute and toss well until coated. Cool 5 minutes. Servings: 2

ENJOY!

Proposed Changes To California Notary Law-AB2452

Richard L Silver is the Executive Director of California Professional Notary Association. With permission from Ric, I am posting his letter which explains the proposed changes by Assemblyman Mike Davis (AB2452). His letter is circulating in the California Notary community. Your comments and concerns are greatly appreciated. Ric can be contacted by email address RickSilver@aol.com or phone number 415-370-7479. Your comments are also welcome in this forum (ActiveRain) .

California Professional Notary Association
1017 L St-217, Sacramento, CA 95814
916-833-4218

Dear Friends:

I am writing to ask that you support AB2452, by Assemblyman Mike Davis, presently before the California State legislature. AB2452 would increase the fees a California notary can charge, generally from the current fee per signature of $10 to a new fee of $25, and increase the length of refresher course work from 3 to 6 hours before a notary commission can be renewed.

Both of these items will increase notary professionalism. We have also suggested to the author that additional provisions be added. Specifically:

That at least 1 of the 6 hours discuss ethics. With the growth of the notary profession, we have seen an increase in the number of people who "skirt" the laws or regulations that govern notaries. A regular instruction of an hour of ethics teaching could go a long way to reduce problems.

Also, that a system be established, similar to the one used for California Process Servers, to create an I.D. card program for notaries. Most government officials (which is what a notary public is) must carry some type of government issued identification. A properly issued I.D. card will help insure that a person claiming to be a notary is, in fact, a notary.

I have enclosed a copy of AB2452 for you to review. If you feel like that AB252 is a good idea and will benefit the notary profession, then please take a minute to write Assembly member Davis of your support. His address is: Assembly member Mike Davis, California State Assembly, State Capitol, Sacramento, CA 95814.

If you decide to support AB 2452, please take a minute to let your own state assembly member and state senator. Their addresses can be found in the front of the local phone book in the white page.

If you have any questions, or if you have any comments, please feel free to give me a call at 916-833-4218. Thank you for your time and support. I look forward to hearing from you soon.

Sincerely,
Richard L. Silver, Executive Director
California Professional Notary Association

BILL NUMBER: AB 2452 INTRODUCED BY Assembly Member Davis

                        FEBRUARY 21, 2008

An act to amend Sections 8201, 8211, and 8223 of the Government
Code, relating to notaries public.

LEGISLATIVE COUNSEL'S DIGEST

AB 2452, as introduced, Davis. Notaries public.
Existing law requires a notary public to complete 3 hours of refresher coursework before being reappointed as a notary, and limits the amounts a notary public can charge for certain services.
This bill would increase the length of refresher coursework from 3 to 6 hours, and increase the limits on the amounts a notary public can charge for certain services, as specified.

Vote: majority. Appropriation: no. Fiscal committee: no. State-mandated local program: no.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

SECTION 1. Section 8201 of the Government Code is amended to read:

8201. (a) Every person appointed as notary public shall meet all
of the following requirements:

   (1) Be at the time of appointment a legal resident of this state,
except as otherwise provided in Section 8203.1.
   (2) Be not less than 18 years of age.
   (3) For appointments made on or after July 1, 2005, have
Have satisfactorily completed a six-hour course
of study approved by the Secretary of State pursuant to Section
8201.2 concerning the functions and duties of a notary public.
   (4) Have satisfactorily completed a written examination prescribed
by the Secretary of State to determine the fitness of the person to
exercise the functions and duties of the office of notary public. All
questions shall be based on the law of this state as set forth in
the booklet of the laws of California relating to notaries public
distributed by the Secretary of State.

   (b) (1) Commencing July 1, 2005, each Each
applicant for notary public shall provide satisfactory proof
that he or she has completed the course of study required pursuant to
paragraph (3) of subdivision (a) prior to approval of his or her
appointment as a notary public by the Secretary of State.

refresher course of study prior to reappointment as a
notary public by the Secretary of State.

SEC. 2. Section 8211 of the Government Code is amended to read:
8211. Fees charged by a notary public for the following services
shall not exceed the fees prescribed by this section . :

Zero Tolerance Policy

I am appealing to ActiveRain professionals to band together. I have performed closings for a couple of signing services who have taken several months to pay or not pay for my service at all. I have contacted the title/escrow company and have confirmed the signing service was paid.

The topic of non-payment is a popular discussion across many professional forums. Real Estate Agents, Loan Officers and Title/Escrow Officers can assist by implementing a zero tolerance policy. If you are contacted by the Notary or any other vendor regarding valid non-payment issues, refuse to continue doing business with the signing service. Include your zero tolerance policy in your contract with the signing service or vendor. This measure sounds drastic but the middle man should be held accountable.

I am also appealing to ActiveRain professionals to value the service of each other. Since I am a Notary, I would like to recommend that you refer to the priceless information Leon Austin, LaShon James-Major and Needanotary provides almost on a daily basis on ActiveRain regarding the notary profession.
