Some HOA's Believe that the SB 1062 does not apply to them - Not True says the AZ Supreme Court

Some HOA's still think there CC&R's concerning SB 1062 (The statute that contains language on For Sale signs in an HOA community) supersede state statutes. In Arizona that is not true.

The HOA/Shea Homes in Trilogy dictates what goes on the for sale sign as well as color and placement of the sign. The HOA has not been turned over to the community so it is being governed by the Board of Directors made up of Shea Homes personnel. Their control over what goes on the for sale sign has moved almost all agents that display a for sale sign that meets the HOA's guidelines, non-compliant with state statutes. Penalties for this can be as harsh as fines and loss of license.

When this was brought to the attention of the Director of the HOA and one of the board members (Shea Homes) they took the position that they would fight any changes and sent a letter of non-compliance to the homeowner advising that they would be fined $250/ per day until the agent's sign was removed. This sign was manufactured to comply with the colors that the association wanted but it also complied with state advertising statutes. The HOA/Shea Homes advised that they appreciated the sign colors but the content of the main sign could only contain the words "For Sale". According to the Arizona Department of Real Estate this does not comply with the Arizona statute A.A.C. R4-28-502 on advertising.

On December 12, 2008, the State Supreme Court ruled that SB 1062 is enforceable. In addition, the statutes concerning advertising by Arizona real estate sales people has been tested and prevailed. Therefore, when the HOA/Shea Homes takes this action and the agent complies, the agent is non compliant with state statutes and could lose their license along with their broker. The HOA/Shea Homes has taken the position that they do not care. Signs must comply with the CC&R's with the acception of Shea homes signs as displayed in front of their model homes.

The arrogance of the HOA/Shea Homes is shocking as it places the community and agents serving that community at risk and in violation of state statues. The few people that are at the center of this is also making a good organization look bad. Personally I think it's time for change in Shea Home policy and perhaps personnel within the HOA/Shea organization..

Countrywide Bank Owned Properties & Frustration

We have been working with Countrywide for almost a year now and we have no reservations about why they had to declare bankrupcy. The problem is that the new owner, Bank of America, still has not cleaned house.

That's not to say Countrywide does not have some people working in the realm of excellence, they do, and when we get to work with them it's pure joy. The trouble is that we seem to get stuck with the bad and the ugly.

We are required to send all offers to Countrywide as they will not give a letter establishing benchmarks. As a result we had an offer of $425K on a $790K house. The Asset Manager countered back at $800K which was above the advertised market price. Do I understand the frustration? Yes, we deal with it every day. A simple rejection would have been a professional answer and have negated a lot more work on our part.

We spent thousands of dollars on landscaping, bringing the pool, spa, and fountains back to standards and in the market where like homes are on the market for 301 days, they pulled the listing after 77 days advising it had been on the market to long. The listing agreement that they gave us was well above our Broker Price Opinion. We had received one offer that was at our BPO target price and it was rejected, not countered.

The are many stories like this but the point is I see our tax dollars being poured into the banks without accountability. It's scary and frustration because we do not see enough people working in the realm of excellence to make a difference. We just see the Fed's pouring good money after bad.

Russian billionaire’s purchase of French villa sets new world record for most expensive home -- $750 million!

Most expensive home on the market in the Scottsdale Arizona real estate market -- $ 18 Million

Scottsdale, AZ (PRWEB) August 13, 2008 -- The market for the average priced U.S. residence may be soft, but the über rich (especially the Russians) continue to drive prices up at the very top of the world's luxury market. Case in point -- Villa Léopolda, one of the most historic estates on the French Côte d'Azur, is now under contract by an anonymous Russian billionaire for $750 million (€500m). This three-quarters-of-a-billion dollar sales price sets a new record for the most expensive home sale in the world. The previous record was set earlier this year by Indian billionaire Lakshmi Mittal, with the reported purchase of a London home for his son for an estimated $236 million.

"While the French Villa is a fabulous property, this sale does put into perspective the value U.S. properties represent," said Jeff Daley, a luxury home expert with Keller Williams Arizona Realty Scottsdale in Scottsdale, Arizona. "The most expensive residence on the market locally is listed for just $18 Million. Located in Paradise Valley, AZ, it has 17,000 square feet built in 2008 has 7 bedrooms and 10 baths that rests on over two acres.

Villa Léopolda, a cream-colored, turreted mansion with two guest houses, is midway between Monaco and Nice overlooking Cap Ferrat, near Villefranche-sur-Mer. The villa was originally built about 1902 by King Leopold II of Belgium. The grounds are regarded as among the most spectacular on the Côte d'Azur. Fifty full-time gardeners look after 20 acres of gardens and terraces, planted with 1,200 olive, orange, lemon and cypress trees.

The property's new owner is said to be a Russian oil oligarch but not - despite initial rumors - Roman Abramovich, the highly visible owner of Chelsea Football Club, who already owns a €100m mansion near Antibes.

According to the Nice-Matin newspaper, a contract was signed last week to transfer ownership of the villa from Lily Safra, the widow of Edmond Safra, a murdered banking billionaire. Rumor has it that Mrs. Safra held out for months as the persistent mystery buyer kept raising his offering price. The paper also reported that 60 villas or mansions on Cap Ferrat are now owned by wealthy Russians.

The property has a unique history. In 1916, King Leopold's nephew and heir, King Albert I, turned the villa into a hospital for officers wounded during the First World War. It later passed into the hands of the Agnelli family - Fiat automotive tycoons -- and became the scene in the 1960s for legendary jet-set parties attended by Frank Sinatra, Ronald Reagan (in his acting days) and other celebrities.

Working with Banks on Foreclosed Bank Owned Properties

The question has been asked of me many times on what is the responsibilities of the REALTOR® when working with the banks and marketing their properties. The answer is that it depends. Each organization has its own criteria and rules that you must abide to if your going to market their homes. My response will be limited to Countrywide and information shared first hand by some other agents that work with Bank Owned Properties out of my office. This is a look at a very high level.

Once you have been selected and your Broker signs off on the Master Agreement between the seller and broker you will be assigned properties. When the assignment is sent to you there is a choice you can make, and that is accept or reject the assignment.

My counsel is look at the property first and get an idea of what your accepting. If the property is still occupied and it's in Arizona they will expect you to manage the eviction, perhaps offer them cash to leave the property. In Arizona we have experience violence during evictions. Once that's accomplished, if they have left furniture behind, you will be request to post a notice on the door and with the post office (Registered letter) advising the owner has 30 days to contact you, the agent, to remove that property. Oops!, now your name is part of a document associated with an eviction between the former resident and the bank. Does your Broker or you want to be associated with the possible risk of litigation. In addition, you'll be told to move any personal belonging to storage during that hold time. That means finding a mover, a storage place, and the expense and time of managing and coordinating those tasks. When your assigned a property you're expected to be the property runner and coordinator of tasks. Electric, Water, Gas, Sewer, etc. must all be turned on and the utilities placed in the agents name. The home may have been trashed so that will have to be hauled away, the house cleaned and maintained, i.e., yard service, pool service, maid service, until the home sells. All these expenses becomes yours.

Once expenses are paid you follow the procedures of getting reimbursed. For utilities you need the original bill, a copy of the check sent to the vendor, and their summary detailed cover form required by the bank and then send those docs an assigned location for payment. If you miss one detail they'll send it all back to you by way of US Mail showing rejected and the item missing. Even if not rejected you can wait months for your reimbursement. Even though you may be out thousands many of the asset manager don't care, they just advise get it done or we'll take the property away from you and give it to someone else. That means times spent is sunk costs and you'll still wait for reimbursements.

Repairs are done in a similar manner but with more detail, photos before and after, depending on amount, a lien waiver from the vendor is required before the bank will pay, plus more administrivia requrired by the bank.

Once many of the administrative tasks are complete and you have performed your BPO, research on HOA details, and getting their W-9 for bank payments, etc. you will get a listing letter advising that you have the listing and it is ready to market at the price they set. This is usually a price determine by the information you provided in your BPO and the appraisals that was ordered on the property.

It's now that you get to perform the work you know best and that is marketing the home for sale. Along the way you will get a barrage of tasks to perform from the bank. All of these tasks take time and many require trips to the property. There is much more to working with bank owned properties. It's not for the faint of heart or someone that does not have the monetary assets to support the out of pocket expenses. You will need to be comfortable with dealing with detail, detail, and more detail.

The bank people that we have worked with range from excellent to terrible with bad attitudes. It makes a big difference on how the project proceeds based on the skill level and attitude of the Asset Manager. Unfortunately those that work in the realm of excellence are the few so be prepared to work with some asset managers that are having a very bad day and in many cases do not care about what we as a team are charged to do for the bank. If you escalate problems you'll find that it's the same as you move up the management ladder. This is just a quick snapshot of working with the banks on bank owned properties.

You'll have to be the judge as to whether the reward is worth the pain.
