Johnny Huang of Cross Walk Realty in Walnut Creek, California, has earned the prestigious Certified Distressed Property Expert (CDPE) designation, having completed extensive training in foreclosure avoidance and short sales. Short sales allow the cash-strapped seller to repay the mortgage at the price that the home sells for, even though it is lower than what is owed on the property. Alex Charfen, founder of the Distressed Property Institute in Boca Raton, Fla., said that Realtors® such as Johnny Huang, MBA with the CDPE designation have valuable training in short sales that can offer the homeowner much better alternatives to foreclosure, which virtually destroys the credit rating. These experts also may better understand market conditions and can help sellers through the emotional experience, he said.

It wasn't long ago (actually 20 months ago) since I saw my daughter's first steps. It was such a joy. Today, she did her first potty (although had a huge accident later on) and her first sleep without daddy (she asked me to leave the room). Time flies so fast :-(

What does this have to do with real estate? Not much maybe, but remember your first? Writing your first contract (with sweat palms and crackling voice) to cashing your first check (with a big smile)! It all has to start sometime.

Today is the first day of my life really seeing my daughter grow and become more independant. Hopefully there's more to come. Maybe I'll teach her the business and we can be a family company!

Beware of credit card companies declining or cancelling credit cards with your first time home buying clients!

The reason I write this is that my brother, a first time home buyer since November, has been getting his credit card cancelled and cannot apply for new credit due to him living in a "high regional foreclosure area".

Has anyone experienced this or has a client that experienced this?

He was qualified to buy a $185,000 house, why would he be cancelled on his current card as well as being denied new credit based on where he lives?

Does that mean I need to "steer" my first time home buyer clients away from high foreclosure areas and have them overextend their ability to pay on non-foreclosure areas??

What about all the people that currently live in the areas with high foreclosures, are they going to get cancelled and/or denied as well?

I'm putting this out to the community because I know we have agents with clients looking to buy in the affordable areas of the country. This is a big concern for me as an agent.

This is insane and I can't believe the federal government is allowing type of redlining to be practiced.

Time to fight back on those recorded phone calls! (humorous)

Yesterday, I've made a pact to myself that I'm going to fight back on those recorded phone calls that either say your car warranty is expiring, your insurance is expiring, or your home loan can be refinanced, etc.

I think that these companies prey on people to obtain information and sell it across the globe to others. So I've developed a plan to hopefully fight them back. I consider them all scammers!

First, I'll try to get a live operator to I can talk to them. I'll give a few information like my first name and ask what the call is all about. Then I'll ask for the operators first and last name if possible, company information and where they are located, and what they want me to do. This gives them a feeling that they got me.

My next line will be..."I'm recording our conversation so I can compile a collection of companies that call me without my permission and to possibly use this to make money on TV, is that ok with you?"

Most of my responses have been quick hang ups...if any of my readers do this, please let me know if you get any other responses! I'd love to hear what you have to say about this.

This week, I commented on my own Facebook status that I was expecting a slow and lazy week due to lack of assignments or appointments. I was begging my wife to go golfing the next day as well.

Well lo and behold, I get 7 assignments from Titanium Solutions...I guess I won't be going golfing :-)

Oh by the way...new news from the C.A.R. newsletter...

"C.A.R. achieved a compromise in AB 957, "Choice of Escrow Bill." In multiple discussions with the author, C.A.R. worked with Assemblywoman Galgiani to come up with compromise language that will require fair treatment for real estate owned (REO) buyers in the choice of title and escrow providers.

The new language now protects fair negotiation over settlement services, and has removed C.A.R.'s opposition.

The new language will codify in California law the federal RESPA rules for selection of title insurance, and extend the same rules to protect buyers in the selection of escrow services. In a nutshell, the sellers will have to negotiate the selection of title and escrow. Under the new language, if an REO seller wants to try and direct choice of escrow, the seller will have to pay for the privilege.

AB 957 will also impose new penalties on REO sellers that violate the law, and will empower state regulators to go after both RESPA and "steering" violations."

I fired a client last night

Yes, you heard me...Last night I had my last straw.

Little history about this person is that they had gone through quite a few agents before contacting me. They complained about the other agents not responding fast enough or writing the proper offers. I thought to myself, I can do better, so I took them on as clients.

I explained to them that REO's are not always the best condition and a few of them that are fixed up sell very fast in this area but they insisted on REO's since the marketplace is filled with them.

A few phones calls here and a few emails there and a few showings later (and foul language included in conversations which I don't handle very well)...my conclusion: They are way too picky to be looking at REO's! Unfortunately, they only qualify in the price range that is nearly 99% REO or Short Sales.

Nothing was good enough for them. Comments like "I prefer carpeting" after showing a house with brand new hardwood floors or "the bedrooms are too small" or "I don't want to see the neighbors or have them climb over my fence" really irked me. They expected full repairs with REO properties but expect to pay the price of unrepaired REO's! (UGH!)

Sorry, but my patience has run out with them after 3 weeks of previewing houses and showing the most decent ones (if there is in the REO world). OK, my ranting is done...

I took the first step...

Today was my last day at Keller Williams and my first day at my own Cross Walk Realty. I decided to leave Keller Williams for a variety of reasons, but mainly to go independent. I've always dreamed of the independence and working for myself, although KW did allow me to do that as well, but I have no corporate aura around me.

Thank you KW-East Bay for your generous support and I've said it before, if circumstances were different, I would have stayed. However, I'm looking and moving forward despite the economy. Wish good fortune!

To date, I've sold a house a month for myself, started a mortgage product side of the business and am helping clients with a Credit Restoration program that pays me! What a great way to start the year and be on my own boss.

Walk Away foreclosure looking for closure!

The country's two largest sources of mortgage money have a blunt warning for anyone thinking about joining the growing "walkway" trend, where homeowners stop making payments and months later send the house keys back to their lender: you will feel the pain.

In March, Fannie Mae sent out new guidelines to lenders intended for walkaways and other foreclosure situations. Fannie will now prohibit foreclosed borrowers from getting another mortgage through the giant investor for five years, unless there are "documented extenuating circumstances." In those cases, the mortgage prohibition is for three years.

Even after five years, borrowers with foreclosures in their files will be required to make at least a 10 percent down payment, and will need minimum FICO credit scores of 680.

Free Mac, Fannie's rival, counts foreclosures as major credit blots for seven years, and a senior official said the company is now aggressively pursuing some walkaway borrowers "to preserve our deficiency rights" where permitted under state law.

The walkaway trend is particularly noteworthy in former housing boom markets - including California, Florida and Nevada-where many homeowners find themselves upside down on their loans, owing tens of thousands more than the current market value of their houses. If they invested little or nothing in down payments, some owners reason, continuing to make payments -even if they can afford to - may be throwing good money after bad.

A number of websites have popped up claiming to cut the hassles of bailing out of a mortgage. One company promises that clients "will be able to live in the home for up to eight months with no mortgage payments," after paying $995 for a customized plan. The same site says it will provide clients with "legal credit repair" to "improve your FICO scores."

Another website claims that "your credit can be repaired and (you will) be able to purchase a house in as few as two years"-after paying a $495 fee. Still another company says walkaways can expect "up to one year living payment free" as the lender goes about filing for foreclosure. That company charges $995 for its how-to-do-it kit.

Fair Isaac Corp. of Minneapolis, developer of the FICO scores used in mortgage transactions is unhappy at any suggestion that a foreclosure could be minimized or wiped away in a short period of time. Its scoring model counts foreclosure as a long-standing and severe events, nearly comparable with bankruptcy, with negative consequences for all forms of credit that walkaways might seek to obtain. That includes credit card applications, auto loans, student loans - and even insurance and employment.

FICO spokesman Craig Watts said that the impact of a foreclosure on an individual's score depends heavily on the payment history, length and number of credit trade lines in a consumer's file, but "It is always significant."

Robin Stout Migala, consumer outreach manager for Freddie Mac, said in an interview that "there are so many bad reasons for walking away" from a home loan. Not only are borrowers' credit standings wrecked - forcing them into excessively high interest rates on any credit they can manage to obtain -but they also face other potential problems including federal income tax liabilities.

Federal legislation enacted last year allows homeowners who negotiate loan modifications with lenders and have portions of the principle debt eliminated to escape income tax liability for the amount forgiven. Walkways borrowers, by contract, have nothing forgiven and the IRS may demand income taxes on the balance they never paid, according to Migala.

When they apply for a loan from either Freddie Mac or Fannie Mae, she said, the standard application form asks whether they have ever experienced a foreclosure or handed over their deed in lieu of foreclosure. If applicants check "yes" the loan is immediately shifted to manual underwriting. Every piece of information is scrutinized by underwriters, who probe for the fact surrounding the loss of the house.

For borrowers who faced genuine financial hardships leading to foreclosures, underwriters are likely to be more sympathetic a few years down the road. But if you walk away, here's the deal: Don't expect to get a new home loan - certainly not one with favorable terms - for five to seven years.

That's no matter what some promoter promised you online.

That's right!

I'm having fun in today's market. I've made contacts, met new people, doing more golfing! Having fun! If you can't have fun in what you do, then it's not worth doing it.

Today, I saw some agents in a sales meeting, they aren't having fun working their job. I tried to encourage them, it's about mindset and positive thinking. Have fun at it, make new friends and contacts, and keep them in your database. Go out and talk to them, not about real estate, but about life, family, work, so on. They already know you're in real estate so have fun with them instead!

Most of all, you get to know them better and when the time comes, it'll all be worth knowing them.

Get out there, go do what you like to do. I like to golf, play softball, EAT FOOD!

I'm noticing that the activity level of the AR sponsors are increasing and changing to grab the attention of "the agents who blog here". Anyone have any stories behind these clicks?

Rather, I'm looking for positive or negative testimonials.

They look tempting to jump right in, but like people say, "if it's too good to be true..."

My thoughts...

Depending on where your marketing dollars, this may NOT be the right thing for you. As a Keller Williams agent, they teach Lead with Revenue meaning that every marketing dollar needs to be tracked. If you're starting out and have a small budget, start with prospecting. This is by far the cheapest way for you to get your name out. Once you've started to close deals, look for other sources of lead generation methods.

BUT always track your results. For instance, if you decide to buy leads, see where these leads "lead" you. If it makes financial sense, then keep the lead coming. If not, try something different. Not everyone will have the same results.

Motivation in regards to Buying and Selling

Yesterday, in our team meeting, alot agents expressed concerns about the motivation on their clients whether to buy or sell their homes.

Some concerns are (for both listing and buying issues):

Will short sales be a good idea for me if I'm selling my home?
Where will the market be in a year, what can I expect to happen?
Homes aren't selling because there's too many, How can I sell my house?
I want to wait till the prices go back up (or down)
I want to time the market so I have the best price possible.

These concerns really boiled down to two key issues:

MOTIVATION OR PRICE (or we can call it pleasure or pain?)

If a seller needs to sell, why? Is it because of job loss? Divorce? Job transfer?

If a buyer wants to buy, why? Upgrade to new home? Investment? First home?

Do you REALLY know clients are interested in buying or selling???? People move away from pain or towards pleasure. What is the dream of your client? What pain are they experiencing that is driving them to go through the process of buying or selling?

Moving is not so much fun...why are they doing it? If you have a very clear picture of their motivation, then every discussion become easier because you understand Their Big Why.

This week, has been an interesting week.

I hosted a birthday party for my daugther and it was chilly, but people are grateful and we had a good time! I got to strengthen my relationship with people.

I received a lead on my phone from someone that had sent me an email through my website, now I'm on an email relationship with him.

I received another lead from a church member who wants to invest.

However...

Most importantly, my lesson this week was that if you don't tell people you are in real estate, you lose out!

To clarify, I've known my neighbors for over a year, granted I started practicing 3 months ago, I failed to mention that I was in real estate for those 3 months to this particular neighbor. Needless to say, they are selling their home with another agent and when they found out I was in real estate, They said, "I DIDN'T KNOW YOU ARE A REAL ESTATE AGENT, I would have listed with you!" /facepalm, /kickself...

Don't let this happen to you, let EVERYONE KNOW you're in real estate, you just never know...

Do you comment beyond 250?

As I look at my commenting habit, I tend to over comment and go beyond the threshold of the "10 comments" a day.

Do you comment beyond your points?

I do, because as a community, I don't believe we should stop at 10 if time allows. Its the feedback that people seek when they ask for help, and I generally like to help. Also, there are posts that are simply inspiring and/or educating, and being a student of this industry, AR is a great place to absorb them. Some of you might say...why waste your time, you won't get any points.

I submit to you stop looking at points and look for pointers where you can grow as a professional.

Yawn!

As I log on at 12:42am, I noticed there's 628 people online, including myself. I can't sleep because I let my baby nap way too long today and she can't sleep either :-( We have a big party tomorrow to set up and now we're up late and most likely won't be up till around 10am tomorrow. The party preparations are supposed to start at 11am!

So you 628 AR people, why are you up? Is your deal closing soon? Can't sleep thinking about your next marketing efforts or lead generation process? Do you dream about negotiations, talks, even running your scripts while you sleep?

I do that! All of it, it's the jitters and it sucks energy from me in the morning. Tomorrow is the big day where I get to meet my database (and more) in one day's event! I'm thinking how can I connect with them, how will things turn out, will people eat too much, or will they get sick?

Who knows, only the Good Lord knows what's in store for me and my family tomorrow. In the meantime, for those 628 members that are up reading posts, let it go. It can wait till tomorrow. Get some sleep.
