A new foreclosure starts every 13 seconds, equaling almost 6,500 a day.

The number of new foreclosure starts for the first five months of 2009 has reached one million according to the Center for Responsible Lending. They are projecting 2.4 million foreclosure starts by the end of the year, which it says will reduce property values of some 70 million households by $502 billion, or at an average of $7,200 per homeowner.

This is so unfortunate and hopefully will end soon. I wish we were notified how many of the foreclosures were due to job losses, negative ammortization loans, stated income loans, 100% loans, etc. And, I wish the average loss for the homeowner in our area was $7,200.

Hopefully we will start seeing some sales that are not foreclosure or short sale so home values can be more accurate.

Short Sale closed in 5 weeks

Coordinating the successful closing of a short sale takes talent when you are working with a home that was 100% financed with a first and 2nd mortgage and the lenders are taking a 47% loss. Up until now, I had joined the chorus of realtors that steer clients away from short sales due to the high percentage of offers that never result in hopes and dreams becoming reality. But I must say at this time, that if everyone involved in the transaction is really good at what they do, you can get a great deal. It is an AWESOME time to buy whether it is a first time homebuyer or a move up buyer.

Point and case is my daughter who is a recent college graduate. She wanted to seize the opportunity of buying a home that was a steal, the best interest rates, and a first time hombuyer $8,000 credit too boot. She found townhouses and homes that she wanted to put an offer on but was either too late, or a higher offer was accepted. After a few months of looking, she was about to hang up the house hunting and just rent.

Recently that changed. Here is what we found worked:

When a home is listed for sale, take the time to view it IMMEDIATELY. Drop everything and go, within 24 hours!
If you have done your homework on the community, neighborhood, home values and financing, IMMEDIATELY make an offer if it meets all your criteria and is what you want. You WANT to be the FIRST offer received.
If you would like and can do it in your state, put in for a home inspection. Even though the short sale lender won't make any adjustments for defects, etc. it can give you an "out" if when you go back for a 2nd visit or with an inspector you change your mind. (Oh, please don't think badly of me for this one!)
Have your professional lender contact the listing agent to confirm that a Pre-Qualified Letter is being sent to...have them verify the fax or email address. While they are doing this, have them reiterate that the client is ready to close and a solid buyer. Agents want to work with an offer that will close.
When they accept your offer. Inquire as to the title company they are using for the seller. Let me reiterate that you DO NOT have to use the title company the sellers are using. You can use the one you are comfortable with.
Have your professional lender call the sellers title company and interview the closer that will be handling the transaction. How long has the title company been in business. How long has the closer been in that line of work? How long have they been with the current company? How many short sales have they closed? How many short sales are they currently working with? What is the success ratio of closing their short sale files? Is there a difference in a successful closing if a different title company is used? Is there a difference in allowable fees if you do not use the sellers title company? How soon could we get title work to review? To me this call is critical. In this call I learned: 90% of the transaction closed with this closer doing both sides (more incentive!) and 60% with individual title companies; and, the owner's title policy would be paid by the sellers if we used them. Needless to say, I ignored our realtor urging us to use a title company we were comfortable with, AND I forwarded the title work to my regular title company to have them review.

The listing agent had said that because it was the first offered received, it would have first consideration. We offered full price with 3% seller contribution to closing costs and prepaids. I believe because we made the appropriate professional calls it also gave the listing agent a comfort level that he did not want to jeapardize losing. There ended up being NINE offers, one was $30,000 over the list price. The terms of those offers are unknown to me.

The reason I think this worked without a hitch is PROFESSIONALS in all areas - Realtor, Lender, Title. Good luck to anyone looking to buy in 2009 - what a FABULOUS time to buy!

Debt Forgiveness Caution for your home mortgage.

This is just a heads up that as our lending industry changes, everything is under more scrutiny including Debt Forgiveness. Lenders are now concerned about misleading and possibly illegal practices in the industry associated with debt forgiveness programs and refinance offers.

Be careful if you or your client is offered "debt forgiveness OR settlements with the promise that any negative information will NOT be reported to the credit bureaus related to the settlement or delinquent payments, if the loan is refinanced".

Some lenders (others will follow suit) now require the following verifications for Rate/Term and Cash-Out Refinance transactions where the loan payoff amount is considerably less than the amount indicated on the credit report:

Borrowers must explain why the balance is different (did they/you pay additional payments or principal on the loan after the date of the credit report)
12 month payment history that supports the explanation
Copy of all canceled checks or bank statements supporting the on-time payment history.

This is a change that many do not know about or anticipated. I have found that if one lender starts the action, it is only a matter of time before they are all following the same guidelines.

Should or shouldn't you lend money to your grown kids? Tips follow....

The other day I had a parent contact me via ActiveRain from my local community. Their son and daughter-in-law both lost their jobs and the wife was pregnant. Their kids decided to walkaway from the home that the parents co-signed for on the mortgage. Can they do a short sale? Yes, if ALL parties on the mortgage application are in a REAL financial hardship. The hardship will have to be proven with all asset and liability documentation. Will it affect their credit score? It depends on how they report the short sale or if there are mortgage lates. Our conversation also detailed alternative options to consider. I felt really bad for the parents as they just tried to help their son and didn't expect this to happen. She was grateful she had found a non-judgmental and knowledgeable person to assist them through ActiveRain.

But the question remains, should we loan money to our grown kids or co-sign for a mortgage? Have I done it? Absolutely, for all three of my kids - loaning them money and co-signing. But not all kids and situations will procure the same results. Nor are our economic times and the housing market conducive to stability in your loan.

Getting a home loan is more difficult. If your kids do not have much cash or credit history you may be their only option to take advantage of the current buyers market.

Just be careful that you do not lend money to support bad habits or ruin the relationship you have with your kids. If you decide to lend them money, carefully think out a plan and set up the terms.

Things to consider:

The request - is it for a really good reason?
Are they financially responsible? Understand the logistics of whether you will be paid back.
Can you afford to loan them the money?
Can you survive if they do not make the payment or you do not get paid back at all?

If you have doubt about any of the above, consider all other options first:

Co-sign loan - you are still liable and it will affect your credit if the payment is not on time.
Wait to purchase.

Let's say you decide to loan the money for a home purchase or give them a gift - make sure the TERMS are CLEAR. Communicate that you are making a loan not a gift and what the repayment terms are. If it is a mortgage or 2nd mortgage, make sure you have the proper documentation filed and of record at the courthouse.

Are you going to charge interest for the interest earnings you lose because it is not invested? You might charge the same rate the money would be earning if it were in a savings account, or what the bank charges for a similar loan, or perhaps the prime rate. It is up to you and your children as to what you agree to. You will also want to talk to your CPA for tax purposes.

And please, protect yourself and your children - put every last detail in writing with all parties signing to make it official before a notary. This can become a serious transaction if something should happen to one of you, or conflict arises and you risk ruining your relationship.

All that being said, my parents helped me when I bought my first house. They charged me interest. A mortgage and note were filed. Every payment was made. The foundation of financial responsibility was long established for my children as the apple doesn't fall far from the tree.

Foreclosure, Short Sales and your credit, be educated!

Which is the lesser of two evils: foreclosure or short sale when it comes to your credit?

Foreclosure:you lose your home and your credit score drops 200-300 points as it will show mortgage lates resulting in a foreclosure. It will be a few years before you can secure that American dream of home ownership again.

Short Sale: you owe more than your house is worth but the lender, which approves the sale, receives the proceeds from the short sale and the debt is considered settled (sometimes). The tricky part is how you negotiate with your lender as to whether your credit will be tarnished.

Let me state up front that not all short sales go smoothly. And, what happens to your credit depends on how your lender reports the liability to the credit agencies.

It is imperative that you negotiate the reporting terms with your lender. The lender can report your account:

satisfied - credit should be okay, lates will affect your score
unreported - credit should be okay, lates will affect your score
delete it - you are VERY lucky
or settled for less than the full amount - this WILL negatively affect your score

How big a credit score hit also depends on your credit history. Do you have a number of other accounts in good standing with a long credit history? If you do, you will be better off. What will happen though is that your credit profile will make you a higher risk to future lenders or others that may look at your credit score (insurance, credit cards, rentals, etc.)

Is the debt settled upon a Short Sale?

In most cases, the remaining unpaid debt is forgiven by the lender and written off as a loss. The Mortgage Forgiveness Debt Relief Act of 2007 removes the tax liability from $1 million or less of debt forgiven on a primary residence during 2007, 2008, and 2009. Prior to this Relief Act the forgiven debt was taxable as regular income. Now, the tricky part is that most homeowners will qualify for the tax break IF the lender chooses to write off the debt.

So, when negotiating with the lender, make sure the debt will be forgiven. The lender can sue after the short sale for the unpaid balance. If you do not receive a written promise to forgive the debt you will still be liable for the remainder of the loan.

And, to wrap it all up remember a short sale is not for everyone - the lender will request proof there is a real financial hardship, and probably won't agree to a short sale unless you are behind on your mortgage payment.

Unfortunately, a short sale may be the option you need - just make sure you are getting professional assistance.

Have you considered your vine and branches in the housing market business? How healthy is your vine? Have you trimmed the branches to have a healthy and prosperous business? "I am the Vine; you are the Branches". Have you ever heard that before? Yes, it's in the Bible, John 15:5. It is a very thought provoking verse, but it can be taken beyond the realms of religion.

The vine and branches can be taken into every aspect of our lives - business, personal, and community. Where do you gain the richness that your lives desires? What makes you feel fulfilled? Successful? Are you pleased with yourself?

Yes, our market is struggling. But, I work with some pretty awesome and successful people; who don't know this market is in a downturn. There business is flourishing! I have learned it is only in a downturn if we allow ourselves to believe it is.

What we need to do is have a healthy vine - a healthy business plan. We need to trim the branches that are holding us down:

Is it a client that makes you feel like you are playing the childhood game, "Ring around the Rosy"? Do you need to trim them from your vine?
Is it a business partner that is always accepting but never giving referrals? Do you need to...?
Is it a personal friend that is draining the life out of you so that you have nothing to give at the office? Yes, you need to trim them...

Are you sitting in your office spinning your wheels and wondering where to go next for your paycheck to pay your bills?

There are many good mentors out there talk to one of them to see what they are doing to make a difference.
Continue to educate yourself for the newest programs (that can be delivered and closed!).
Expand your network(s) - social & business.
Make sure you are staying in touch with past clients.
What about your Spheres of Influence - do you stay in contact with them?
There are also many good books - "Who Moved My Cheese", "Raving Fans", "In Search of Excellence" this is such an old but GREAT book, and the book I've heard is good is "The Success Principles".

Work smarter, not harder. Don't give up, but trim the branches that are weighing you down. If you finish trimming your branches at work, there might also be some in your yard at home!

Life is not about money (but does help pay the bills). Today is the first day of the rest of your life - in business and personally. It is a gift - make sure you use it wisely. And, I believe this is the best blog I have ever written because the most powerful person in the universe has made me see reality and has stood by me when I have faltered and failed. I am glad he is strong and has, and can, carry me!

Yesterday I was extremely busy answering two cell phones, when my direct dial office line rang. I answered it. It was a reporter with USA Today. She clearly and professionally introduced herself to me. I was like "wow"!

She was searching the Internet regarding HELOC's (Home Equity Line of Mortgage) and found my "interesting" and "knowledgeable blogs" on ActiveRain. She wanted to discuss some of the points of the blogs. Now I have to tell you, I've been called before from smaller publications in California and Florida, but not USA Today! It scared me just a bit... what if it is against company policy? What is company policy? (We sold our business and joined a federally insured company in January.) What if....what if they fire me?

Well, just a little bit of that media buzz word "Maverick", "Change", and Sara Paltin entered my mind and demeanor. I decided to be an advocate and deal with any potential consequences when, and if, the time came.

Would you have been willing to risk your career for the sake of citizens across the U.S.A. who have systematically had their HELOC's frozen without just cause? Would you be willing to make a difference? Would you have said "I need to check with our corporate office if I can be quoted?" Are you willing to make a difference for your clients and people you do not know? I am and I did!

Which leads me to - the award my marketing director received last Friday. I was out of the office at a closing and received an email from him stating "Wow, what did you do to receive this? Congratulations." Then the forwarded email read...I am pleased to announce that Joyce Windschitl has been selected for the 2008 Best of Chaska Award in the Mortgages category by the U.S. Local Business Association (USLBA)." It went on to explain the award... of course, I believe it is a marketing company with a unique twist in marketing!

But the greatest honor is notably the soldier in Iraq. He is coming back to Minnesota. He is buying a home. He found me through ActiveRain. He likes that I am not a cookie cutter lender but a professional mortgage consultant that will get all the information and present a coaching plan as to what options he has to choose from and the different impacts each will have on his short and long term needs and goals. I would never be able to walk a mile in his shoes in Iraq. My goal is for him to enjoy walking every mile of freedom he has defended for us here in the U.S.A. I hope every one of us appreciate all our enlisted men and women and their valiant efforts in protecting our freedom.

Needless to say ActiveRain HAS made a definite difference in my business, now it is up to me to make a difference in the lives of others - whenever and where ever I can.

I have to be honest and say I have been shaking my head a lot lately and asking "why"? Wondering "why"? When will it end? When will my head quit spinning from all the lending changes? When will we (or should I say our politicians) be smart enough to remedy the situation before it is completely out of control?

Who is to blame for the housing mess? Realtors - because homes were a hot commodity and buyers were often in a bidding war and paying an overinflated price to get the home of their dreams? Loan consultants -because they had buyers that qualified for mortgages that had loosy goosey qualifying standards? Mortgage Fraud - scammers increasing their efforts - UNBELIEVABLE.

FRAUD, FRAUD, FRAUD - I hope all of you guilty of felony fraud go to prison! I'd like to send Sarah Palin after you with a nuzzle in your back to shape you up after all that would be better than what you may face in prison from what I hear. Yes, I feel as though I woke up on the wrong side of the bed, but I didn't - these people are hurting our industry, the housing market, and our reputations that we work so hard for. It has to be STOPPED.

MARI's (Mortgage Asset Research Institute) released a report 8/25 stating that the number of fraud cases jumped 42% between the second quarter of 2007 and the same period this year. The internet is a KEY facilitator with many sites hawking fake income, employment verifications, tax filings, credit scores, deposit verifications, and other forms of deception.

The highest numbers of fraud reports came from Florida, California, Maryland, Illinois and Michigan. I don't know for sure the foreclosure rates in those states but I believe Florida and California rank toward the top.

Mortgage consultants: if you have received a blitzed email "pay stub and job verifications - show the income you need on paper" and you responded and used it, shame on you. I hope you are caught and go to jail or prison.

If you are buying or refinancing: WORK WITH A MORTGAGE PROFESSIONAL IN PERSON! If you provide or take part in any fraudulent documentation to qualify for a mortgage because you found a way to cheat the system, DON'T. Take the time to fix your problems, remedy the situation and keep yourself out of prison or jail!

Anyone in the real estate profession: if you knowingly use a straw buyer (being paid $7,500 per transaction for their financial identities and then later claim identity theft, shame on you. I hope you are caught and go to jail or prison.

If you are creating fake lien-release from a bank or mortgage company indicating that the debt against a property has been paid, and there is no further lien against the house, you can join the other crooks in this business in prison.

If you are hijacking law-abiding professionals - appraisers, in particular - then submit bloated valuations squeezing higher mortgage amounts, shame on you - you can go to prison too. Can you imagine finding out its letterhead and documentation identical to yours and you had not performed any of the work? Scammers scam everyone.

These online crooked websites are opened, closed, and re-opened under another name before the FBI or state financial crime investigators can zone in on them. They call these web-based crooks nimble, creative and technically savvy. I call them what they are crooks that need to be caught and sent to prison for felony fraud.

If you can't do business the legitimate way, get out now. I am tired of regulations imposed when a small percentage of the industry is screwing it up. Take responsibility for your life, your business, and your...oh, that's right you have no scruples, values, or reasons; you can just get by with it - but only for so long.
