Hello again Active Rain...it's been a while.

I stopped by to check out my blog today, and saw that ALL of the Postlets I have posted are inactive. Reason : They are all SOLD!!! WOW!!! It has been a GREAT SUMMER for Real Estate in Bellingham and Whatcom County Washington! I have quite a number of new listing Postlets that never made it here, because I have been too stinkin' BUSY this summer to update the myriad of sites I belong to.

(It sure would be nice to post to my Active Rain site using the ADD THIS feature. Does anyone know how to do that?)

It's good to be busy. It's good to be a Realtor. It's good to help people buy houses to call "HOME". It's good to remember that Real Estate has and always will move in tides, Buyer's markets, Seller's markets, Buyer's markets, Seller's markets...in and out, and so-on and so-on... And it is GREAT that I am now a Washington State Certified Instructor!!!! Yippee!!! (More blogging on where that is going to take me later....)

It's also good to ride bikes in the rain. Eat sushi. Fall in love. Buy a house and renovate it. And read a book on the kayak while the crab pot sits in the water. Just a few more reasons I have not been by my Active Rain blog lately. :)

I went to my Real Estate Masterminds group yesterday. Real Estate Masterminds is a group of agents from different offices who have decided to come together to form a 'collective', to meet twice a month and share business ideas and inspiration with eachother. What a fantastic, Live good. Be happy...FRESH approach to real estate opportunity! Through being open with each other about what makes our businesses prosper, we make each other better agents, we inspire each other with new ideas, we pump each other up. WOW! I love this business philosphy!

At our meeting yesterday, we took personality profiles. This exercise was meant to give clarity to who we are, what our strengths are...but, also very importantly, to help us understand that all people are different. And, when we go to meet with a client, to not only bring our own "personality" to the table, but to be cognicent of the fact that our client's process information differently than we do, and that we should meet them where THEY are. AWESOME exercise!

What truly came out of the exercise for me, is that, to be successful, truly successful, in all aspects of my life (business, personal, spiritual) I need to not only embrace who I am today, but also embrace some CHANGE. (Yikes! Change!) Yes, if I want a different outcome tomorrow, I need to be willing to take on the 'risk' of being willing to 'change' today. To do something differently than I have done it before. Willing to step out of my comfort zone, try something new that might not immediately 'feel' comfortable. COOL!

So, I am writing down the areas where I am comfortable-vs-those that need change. And in my quest for a better tomorrow, setting goals for change so I can grow.

I had this quote in my Fridge Friendlyⓒ mAds from long ago, and it just fit so perfectly with the message from Masterminds that I thought I might send it out as inspriation for you too.

Hovander Park, A Treasure in Ferndale, Washington

Hovander Homestead Park, steeped in cultural history and rich in natural beauty, has something of interest for everyone. It is a park that was once a family farm and is now a family legacy. Come and picnic on a sunny weekend or plan a large group event. Tour the historic farmhouse and big red barn, and the farmyard full of cows, chickens, rabbits, pigs, peacocks, goats and horses. There are acres of grass and fields to play on and ample parking. Included within the park is the nearby Tennant Lake Interpretive Center and award-winning Fragrance Garden.

The park was named after Swedish architect Hokan Hovander. He and his family of nine immigrated here in 1897. Shortly after arriving in Ferndale he began designing the house and barn. Today the park and Tennant Lake Wildlife Area encompass over 720 acres. The farm was restored by Whatcom County Parks & Recreation in 1971. The site includes over a mile of river frontage along the Nooksack River and 60 acres of fertile farmland that is still used for hay and alfalfa harvesting. The Washington State Department of Fish and Wildlife manages a portion of the Tennant Lake Wildlife Area.

In the Spring, the Highland Games come to the park and fill the barns surrounding fields with bagpipers, Scottish Dancers and Ancient Scottish Highland Games.

Also in the Spring, the Master Gardener's from around Whatcom County bring their 'starts' to the Master Gardener Plant Sale. Where green thumbs line up with their wagons to at the 'starting line' to rush and fill their wagons with sturdy starts for their spring and summer gardens. Such fun!

Holiday Seasons = A great time to re-vamp your business

I decided to stop hanging out with people in my industry who could not see the bright side of any given situation a very long time ago. Just like I stopped watching the evening news. Because, I contend, that there is always a bright side to any given situation, and negativity breeds negativity. I just can't 'buy in' to that.

I have been involved in this crazy business long enough that I can clearly see (and plan for) the inevitable quiet that comes with the natural the ebb and flow of Real Estate. Yes, it is natural for the buying and selling portion of our business to slow during the holidays. But that certianly does not mean that we should act like we are out of business!

The quiet of the holidays and winter months gives me a beautiful OPPORTUNITY to re-vamp my business and get it 'tuned-up' for the busy spring/summer months ahead. I take this time to set goals for the upcoming year, I revisit all of my marketing and set in place a plan of action for the year ahead...so, when I am busy, I won't have to worry about it. I take this time to touch the lives of the folks I have had the great pleasure of helping over the years. I organize my files, I update my contacts, I put a fresh sparkle on my Buyer and Seller materials, I integrate some of those great ideas that I gleaned from classes along the way. I work on my budgets, my goals, my visions.

There is simply so much to tackle that before I know it, it is February and the phones are ringing, and the buyers are buying and the sellers are listing....and guess what?!!! I am READY!

I encourage you, if the 'buying and selling' portion of your business is quiet right now...get up every day, get dressed for success, go to the office, and LOOK for something to do to make your business HUM next year. Guaranteed...you will find something POSITIVE to tackle today.

So, it has been a while since I have been on Active Rain...and MUCH has changed in the months of my absence.

Let's see...the financial markets are crumbling, the real estate market continues to get pummled, hurricanes are destroying the south (uhhhh, anyone remember that bit of news in the past few weeks?), Freddie and Fanny have been shipped off to a land far, far away...bad news abounds! With the way things seem to be going one might think that swarms of locusts and frogs falling from the sky are right around the corner!!!

Well, guess what? Life is simply only as bad as your perceptions. If today, you find yourself with a roof over your head, clothes on your body and food on the table...count yourself blessed. Try to spend some time looking at your family and friends...if you (and they) are blessed with health and happiness...COUNT IT!

Spend the majority of your time looking at the GOOD THINGS that are right in front of your nose and you will find that you will have a VERY DIFFERENT perception of what is 'real'...and/or what is 'really important'.

I left Active Rain (and all of my other blogging activites) this summer to focus every extra second on my daughter, my family and friends. What a wonderful break! What a wonderful opportunity to put into perspective the truly important aspects of life. How helpful in reminding me to "Live good. Be happy."!

I encourage you...if you are spending too much of your 'free-time' in front of a computer or TV screen to simply turn it off and walk away and start looking for the tangible blessings that are right in front of you.

And with that bit of advice, as I sit back in the blogging saddle again, I will simply say, "Live good. Be happy"!

Joy and peace and prosperity to you my AR friends, it's nice to be back in the 'Rain'..

The Grasshopper and the Ants...or, We REALLY DID learn everything we need to know in Kindergarten!

Yes, we are in troubled financial times based on our own selfish greed. The country as a whole needs to get back on kilter to figure out that it is the work of our hands and our wise choices that create wealth, and that debt is a thief! (Indebted servitude is B-A-D...whether that is to a credit card or you are a share cropper!)

We really need to redefine what 'rich' means, and reprogram the Nation to understand that, eventually, ALL debt has a consequence. I simply don't think that the people of this great nation remember that DEBT is a 'promise' to pay..."I will give you $2 tomorrow for a hamburger today" syndrome...well, guess what?? Tomorrow you will find yourself just as hungry...but now in debt for yesterday's decisions! Always hungry...always owing MORE. We can start with the young people we know who have been inundated from DAY ONE with a daily onslaught of marketing LIES that only tell 1/2 of the story. (SURE!!! You can have the hamburger...and while you are at it...why don't you have 2!!!)

But, there is another side to all of the BAD news...there are a whole lot of Americans who have lived within their means during the lending orgy of the past few years. There are a whole lot of Americans in positive equity positions. These folks are in a powerful position and may not know it. They are in a unique position to capitalize on their wise decisions with new wise decisions.

The smart RE agent, who truly CARES for the clients they have, will be sending information to their client base in this position, to help them see the possibilites...and choices they have. I do not mean encouraging our clients to cash out to saddle themselves with more debt for a bigger home they do not want or need...NO WAY! That would not be taking the Live good. Be happy. approach...I simply mean it is a great time to move up (if you had plans or a need to do so) and maintain a similar mortgage situation for those lucky enough to be in that WISE position.

Helping folks make the most of the $$'s they already put toward their housing costs is the JOB we have. I encourage my fellow Realtors to help their WISE clients benefit from the unique market we are in.

While, yes, the grasshoppers will get what they have earned (nothing)...the ants will rule the day.

The glass is 1/2 FULL for many, many, many home owners out there. (Can I put anymore parables in this post??? Probably!!!)

Washington State's new "Distressed Property Act" ... A RANT! AARGH!

Ok, I have been writing all creampuff and sweet for some time now. Posting my Live good. Be happy. quotes, spreading sunshine around the blog-o-sphere. It has been a little while since I have felt the need to RANT! Well...

Within the past month or so the Washington State Legislature passed a consumer protection act called the "Distressed Property Act", it will become active on June 12th, 2008.

Hmmm...sounds like a good idea, huh?

With all of the fraud being perpetrated throughout the US by some truly 'bad apples' toward unsuspecting and already hurting homeowners, I ABSOLUTELY agree that something needed to be done and pronto! Washington is State #13 or #14 to adopt this type of legislation to provide much needed legal teeth to thwart the attempts of thieves and liars to steal homes out from unwitting homeowners. But, as far as I have heard, Washington was the ONLY STATE to fail to EXEMPT Realtors/RE Agents from being subject to the definitions supplied in the act!!! (Even LAWYERS were made exempt in Washington's new law! Hmmmm...Go figure!)

Problem is, the quick movement on this act made it a pretty poorly thought-out bit of legislation and while it does significantly increase the protections for the borrower/homeowner, it gave no thought to the professional, ETHICAL Realtors working diligently to try to help consumers out of their 'distress'. Instead, it put ALL Agents in the position of becoming "Distressed Property Consultants" when dealing with a "Distressed Property".

What is the definition of a "Distressed Property" you might wonder....

One portion of the definition is, [Any property/owner that might or believes they will become financially distressed within 4 months]....HUH? Who can possibly look into the future and know for certain what it will bring???!!! (I suspect that definition makes every Real Estate agent and Loan Officer working for a commission in the current Real Estate Market a "Distressed Homeowner"!)

A LAUNDRY LIST of new rules, regs, and protocol come into play when suddenly (or not so suddenly) you find you are representing a "Distressed Home/Homeowner" and have now had your title changed from "Realtor" to "Distressed Property Consultant". Pages is what it would take to write it all out and I will not bore you with the gory details. Suffice to say, the Realtors and the MLS are in a tizzy trying to figure out how to find some contractural safety for their members from the fallout of poorly written legislation. (ie; EVERY LISTING in WASHINGTON STATE under the NWMLS will have to add a "Distressed Property Addendum" to the listing, signed by the seller, between June 5th, 2008 and June 12th, 2008...I guess that is ONE WAY to get all of the Agents communicating with their sellers!)

I did not become a Realtor to be a "Distressed Property Consultant", I became a Realtor to help folks buy and sell homes. We have always dealt with "Distressed Properties" occassionally in our profession. People get divorced, loose jobs, get sick, have financial woes of all kinds and get behind on payments. That has never before changed the definition of the service I provide for them, or my "Title", or the expectiations of the duties I owe that client as their Agent.

Whether I am defined as a "Distressed Property Consultant" or not, I will continue to abide by the Duties of Agency Law and The Realtor Code of Ethics, and will hope that by dealing honestly, ethically and in a caring manner with ALL OF THE CLIENTS I have the great honor of working for that I will avoid all of the pitfalls and problems the "Distressed Property Act" is riddled with.

If you are in a state that has not yet adopted this piece of legislation, contact your Realtor Association to find out if your legislature is working on it and get up to speed on it prior to it being passed into law.

Once again, the acts of a few bad apples (the theives and con-artists out to prey on other's misfortune and financial crisis) have spoiled the bushel and created a real mess for all of the "Good Apples" out there doing their best to HELP. SHAME ON THEM!

A tid-bit on Short Sales...

This is a portion of a response to a Short Sale question sent into the Washington Association of Realtors Legal Hotline sent out in a weekly update I get called "Friday Facts".

It offers another oft overlooked perspective on the importance regarding pricing/buying Short Sales at, or as close as possible to, market value.

"When a short sale lender agrees to take back less money than it loaned, it does so, in part, based on an affidavit from the seller that the buyer's offer represents the highest price for which the property can be sold. If that is not a true statement the seller cannot truthfully sign that affidavit. When an artificially low price is designed to induce the lender to lose even more money, that is called "loan fraud"."

This is yet another crucial reminder to step wisely around either selling or buying Short Sale properties.
