"I just can't make my mortgage payments any longer" - Is this you?

Act now and avoid foreclosure.

Times are really tough. Unemployment rates have reached double digits. More and more families are

struggling to make ends meet. Many of you in Coral Springs and surrounding Broward County cities

need to sell your homes but you owe more than what your home is worth. What do you do?

If you have sufficient income your Lender may qualify you to have your loan modified. Whereas, some of you may not qualify for a loan modification. If you don't qualify for a loan modification, you can consider selling your home as a Short Sale.

Where do you begin in considering a Short Sale? Who can help you? What's involved in a Short Sale?

(a simplified summary follows)

First, you will need to list your home for sale with a Realtor. You will want a Realtor who specializes in Short Sales, like I do. I found a need quite some time ago when many individuals and families were struggling to make ends meet and were facing the devastating possibility of losing their home to foreclosure. I chose to play an active part in helping homeowners avoid foreclosure. I have a very high success rate in gaining Short Sale approval from homeowners Lenders.(Read some of my prior posts here)

Second, your Realtor will find a Buyer for your home.

Third, a complete Short Sale package will be submitted to your Lender to include financials and a hardship letter gathered from you by your Realtor, the Buyer's offer and a market analysis.

Fourth, your Lender will review the Short Sale package submitted

Fifth, an appraisal value (called a BPO; Brokers Price Opinion) will be completed and placed on your home and compared against the Buyers offer.

Sixth, a final review of all will determine an approval or decline of the Short Sale offer. Counter offers may be involved in which case I, as your Realtor, will go back to the Buyer's Realtor to get them to agree to counter offer.

Seventh, once all parties agree to the sale and closing occurs. Closing typically takes place within 30 days.

Eighth, you now move on to better days ahead and know that the possibility exists that within two years you could be in a position to buy again through FHA financing guidelines if you remain in a favorable position going forward with your credit.

Ninth, remember don't lose hope with your situation, act now.

That's our Policy and I'm sticking to it or should I say sticking it to you!

How many times have you heard the popular phrase, "That's our Policy"?

Don't you just love it when they are so willling to please?

Don't you want to just tell them where to take their policy?!

Are policies meant to be cast in stone or do they allow for venturing into a gray area? Sure we all have policies but if I didn't allow for a little gray area I wouldn't get too far.

I'm bringing this up due to recent encounters with Associations and Attorneys. I will say that not all Associations and Attorneys behave in this loathsome way.

On a number of recent short sales that I'm handling, Lenders have requested "proof" of past due association fees.We know that an estoppel letter comes when a Title Company requests it for a cost of $100-$200 prior to closing that will detail the payoff amount to Associations and will include Attorney fees and late fees. However, I have not gained Lender approval to close yet and the Lenders are no longer taking my word for what I put on the estimated HUD that notes the $ amount needed to be paid to an Association at closing. Now, this has always been my policy to put an amount on the estimated HUD; why should I have to venture outside of my policy for Short Sale preparation? Well, I'm going to venture into the gray area because I have an ultimate goal: close sale and save homeowner from foreclosure. Let's move on.

So I've been contacting Associations and Attorneys handling such delinquent accounts to obtain a written statement of past due fees. Immediately, they jump into estoppel letter mode. I explain that "no" we aren't at that point yet as the homeowners Lender is still reviewing to provide an approval on the sale but I will need an estoppel at a later date when we're getting ready to close after the short sale has been approved. Well, we can't give you that without paying for the estoppel letter. I pause, take a deep breathe, and go back to "no" I'm not in need of an estoppel letter as we're not ready to transfer any property yet as the sale has yet to be approved. I just need a statement of the account. They respond,"..no, we cannot provide that without a payment of an estoppel fee..." HELLO.....are you listening? I'm wanting to scream out. They go on, "....well that is our policy..." Back and forth they're sticking with their policy as they have such blinders on that they're not seeing the ultimate goal that benefits everybody; let's do what we can so everybody can collect their monies and close the sale.

Finally, I advise that I'll have the homeowner contact them and they will be required to provide the homeowner with a statement of their account. You could have avoided all of this turmoil by looking outside of your Policy and realize that in life there are gray areas and a gray area isn't a bad thing....it's a good thing really!! Could you imagine if everybody stuck to their policies and exceptions were not made; many such decisions could be a matter of life and death. I hope those who stick to their policies are never put up against the wall when they need somebody to go outside of their policy to help them.

What happens when your Lender denies your Home Loan modification?

Have you been going back and forth with your Lender trying to get your loan modified? Have you sent in all of your required financial documents for them to consider modifying your loan, such as:

Pay stubs, bank statements, tax returns, income & expense statement, hardship letter and any other document that they have requested.

You might have even had to send the above documents several times as they sometimes do not reach the appropriate party. Now, after all the back and forth, your Lender indicates that you don't qualify for a loan modification. Now what? Is the next step foreclosure? HOLD ON....wait a minute.

If you've been trying to get a loan modification that doesn't work out as you so wanted to stay in your home yet your current financial distress simply won't allow you to stay in your home, there is another option that lessens the impact that a foreclosure can have on your well being. Consider a Short Sale when the loan modification won't work.

Short Sales have been helping many individuals and families avoid foreclosure. What should you expect when you sell your home as a Short Sale? Let's go over some things that you may encounter and some things that you want to encounter:

You'll want to work with a professional Real Estate Agent who specializes in Short Sales. This can make all the difference in a successful closing. Ask questions of who you hire to sell your home. Make sure they know their stuff. How many Short Sales have they closed? How many active Short Sale listings do they have?
Your cooperation with your Realtor is critical. When they ask for documentation make sure that you promptly respond.
It can be a lengthy process. A critical component in the Short Sale transaction is that all parties communicate on an ongoing basis particularly with the Buyer. Buyers often lose their patience because nobody tells them what is going on. If they're in the know on the progress they'll be less likely to cancel the sale. When your Realtor speaks with the Buyer's Agent, your Realtor will need to insist that all of the information be relayed to the Buyer.
Even if you have a pending foreclosure having been served with papers, you have time to stop foreclosure. I've been able to stop a foreclosure that had a sale date established at the court house steps when an offer was received just a few weeks before. So don't ever think you don't have time. If you have someone on your side fighting for you, we can fight up to just days before the auction sale date. Never lose hope.
Simplified, your Lender(s) will review your financials, the Buyers offer and an appraisal that they have completed to determine whether they will approve the sale.
Some Buyers will cancel their interest in buying your home and your Realtor will have to find a new Buyer. Unfortunately, this is a casualty of Short Sales when Buyers simply throw in the towel, but don't you throw in the towel. Remember as I said above, Never lose hope.
Expect the possibilities of counter offers to go back and forth between your Lender(s) and the Buyer. Counter offers are not always a given as often your Lender(s) will accept the Buyer's original offer.
Your goal is to have your Lender(s) to approve the sale. Again to reach this goal, #1 plays a very important role.
Once written approval is received, the Buyers will typically have 30 days to gain their financing and close, unless of course if your offer is a cash offer you won't have to worry about the financing, always nice.
You will now need to plan for your move. Hopefully, you will have saved for the cost of making the move to your new home and to your new Chapter in your life. You don't have to be fearful of the change as better days are likely ahead. Again, please Never lose hope.

Why did she cry?

I've been working with a young family who like so many have come across tough times unable to make ends meet to make their mortgage payment. We listed their home for sale and pretty quick we received an offer on their home as their home is lovely. It was a Short Sale and I submitted the Short Sale package to their Lender, Bank of America, at the end of August and on October 27th received written approval from them. I was very pleased with the prompt approval from BOA! I had to go back and forth with BOA to gain approval but no problem as that is part of what I do as being a Realtor who specializes in Short Sales here in South Florida. I go back and forth until I get an approval.

The point of this post however, is that when I called the Seller and told her that her Short Sale was approved, she cried. And.....to top it off it was her Birthday! Goosebumps ran up and down my arms. She said to me that this is probably the best birthday present that she can remember and it was cause for a celebration.

I know there is a lot of talk that a Short Sale being approved really isn't time for a celebration yet Sellers who have experienced such hardship and choose to view it as a positive outcome really can celebrate. So I guess you'd say that they're viewing their situation as being thankful, that they can now move forward looking forward to much brighter days. So yes, a Short Sale can be celebrated as my homeowner did that day. They have a lot to be thankful for and will survive. After all, there are a lot of people who have things much worse to contend with.

Are you inept or efficient?

Do you see BPO's as a grand production? Get as many as you can and handle them any way you can..even if it means to hire an unlicensed Agent to go and shoot the interior photos. Hmm, is that in the instructions from the Lender for the BPO? Some might argue that this is being quite efficient and some might argue this is being inept? What say you?

I received a call today for a BPO to be completed on one of my Short Sale Listings.

When I receive I call I always like to find out as much as I can about the Agent doing the BPO, don't you? Well, I come to find out that the Agent doing the photos for the BPO isn't even an Agent. She was hired by an Agent to go to the property and take photos for the Agent who lives an hour away from the subject property. Insane. This is one BPO that I"m sure I'll have to keep on top of and be prepared to unleash an assault if the value comes back totallly out of whack!

Why don't Lenders find out who are completing their BPO's? When do we say enough is enough? Why is so much of what we do surrounded by greed? Can we ever have too much?!

Virtues to practice in Life and Real Estate

A virtue is a character trait or quality valued as being good

(as defined by Wikepedia)

How important is this? Does it really matter? I'd say sure it does. Think about it. Does it mean perfection? No, who is perfect? Yet we certainly can try to do the right thing. What is the right thing?

What are your virtues to live by. Everybody seems to have virtues to live by. Have you ever questioned the virtues that some live by? Or for that matter, those that you live by? Consider a few of these virtues as defined by Wikepedia:

Honesty: Honesty is speaking truth and creating trust in minds of others. The quality or condition of being honest; integrity. Truthfulness; sincerity.

How can this trait make a real difference in your Real Estate business? How many more customers will want to do business with you if you're honest with them? Trust is a must in Real Estate as in life.

Generosity: Generosity is the habit of giving without coercion. Generosity can also be spending time, money, or labour, for others, without being rewarded in return. Consider anothers needs instead of your own.

We're taught that it is better to give than receive. When you're feeling like you have a mountain to climb try giving of yourself.

Patience: Patience is the state of endurance under difficult circumstances, which can mean persevering in the face of delay or provocation without becoming annoyed or upset; or exhibiting forbearance when under strain, especially when faced with longer-term difficulties

Wow, how prevalent is the need for this today? Rather during these tough economic times or while negotiating that ongoing Short Sale.

Update to Post: Alexander Harb of Active Rain and the Group Christianity and Real Estate thought that it would be a good idea to include a Bible verse that includes a virtue that I touched on here. I particularly like this one:

"But the fruit of the Spirit is love, joy, peace, patience, kindness, goodness, faithfulness, gentleness and self-control. Against such things there is no law" Galatians 5:22-23, NIV

What we believe to be the right thing can vary from one person to another. Sometimes when we lose our patience, consider not being totally honest or keeping fortunes all to ourselves, we definitely lose our way. When you wake up again, dust yourself off, you'll feel better being back on track. I know there are times that I've gotten off track and getting back on track brings a greater sense of peace. Is it peace that we seek? I always pray for peace....as there's nothing like it!

When do you quit trying with a Short Sale?

What happens when you receive a Buyer's offer for a home listed as a Short Sale and initially the Lender says "NO"? If I'm representing that Seller, the offer that has been submitted is an offer that I can support, believe in and I will fight for its approval. This case story has topped my experiences of drama for a distressed Sellers property here in South Florida. And the fight goes way beyond that first "No".

Grab a seat and let me tell you the story.

1st Buyer's offer:

This first offer submitted was rejected by the Lender. I went back to the Lender with my analysis of why they should accept the Buyer's offer and finally I got them to see it my way. Great, I said. Oh, the fun was just beginning. This was a Buyer who wanted everything her way, no give and take through the whole process. The closing was scheduled and a walk through was performed. At the walk through the Buyer determined that there was some furniture left behind and it must be removed by tomorrow as the closing was scheduled for the following day. . A day that the Seller had tried to get them to extend by two weeks to allow for her to have more time to get out her being a distressed widowed woman. The Buyer said, absolutely not..."....I want in the house on such and such date...." Okay now what? They demanded that the furniture be removed. The furniture had to be out by the next day. Well, I got my husband and son to agree to come with me to move the furniture out to curbside. We thought it was going to be an easy job...just move some furniture out of the house. Not this furniture. It was huge and couldn't be carried through the front door. My husband had to actually tear it apart with a hammer breaking and prying the wood and glass apart. What a job! A few hours later we were done, went home and I looked forward to a closing in a few days or so I thought.

Yes, you guessed it, the closing never happened. The Buyer's financing fell through at the last moment. In fact, the Seller was rewarded the Buyer's deposit for being in default of the contract. In fact, the request to cut the check has just been forwarded to the Title company this week.

2nd Buyer's offer:

Oh, finally a new Buyer...yes, let's close. New offer approved by Lender All went well until we got to the inspection and the Buyer wasn't willing to pay for what was necessary with the needed repairs. Good bye Buyer.

3rd Buyer's offer:

I'm sure this Buyer will follow through. New reduced offering price approved by Lender. Again, we got to the inspection and the excess repairs ultimately scared this Buyer too.

4th Buyer's offer:

By now, I"m really getting tired and thinking about giving up. But then I think, how could I give up on my Seller who's counting on me, who has faith in me. So I don't give up. I try again. A lot of time has lapsed by now, you can imagine. New increased offering price approved by Lender. This Buyer came up against the same situation as the other Buyers did; that of needed repairs. The difference? This Buyer's business was qualified to make the repairs himself and wasn't concerned at all with the needed repairs and said, "....sure I'll make the repairs...." This was to be done before closing as this was a FHA financing. What needed to be done?:

algae filled pool needed to be cleaned and functioning
wood rot on exterior of home needed repair

The Buyers made repairs but oh no, now the closing date was nearing as was the Auction sale date. The Lender wasn't ready and expressed doubt in being able to close. You've got to be kidding. HELP ME!

Quickly, I suggested to the Buyer's Agent that they find a new Lender and referred them to a Mortgage Broker that had saved the day for me on a Short Sale from a few months ago when a Buyer's Agent and their Buyer couldn't get approval at the last moment and went to this new efficient Mortgage Broker.

Now back to the Lender. I expressed I needed two more weeks to get the Buyer closed. "...NO..." was their response. This file had been postponed through all of these Buyers and they weren't going to budge another day. We were three days from the Auction Sale date. And back and forth and they weren't budging saying that they're going to foreclose...forget the Short Sale.

Here it comes again, that gnawing feeling of giving up and throwing in the towel. No, I just can't do it....we're so close. Back and forth conversations via email with the VP of loss mitigation. We're now at the day before the Auction Sale date,

"....Okay, if the Buyers deposit a non-refundable deposit of $4000 to us we'll delay the Auction sale date and extend closing until Sept 30th.
I got them down to accept $2000. The Buyer wired the money. This Buyer wanted that house! If they closed the $2000 went towards home. If they couldn't get approved, they'd lose the money.
The new miracle worker Mortgage Broker got Buyers approved to close, having completed it all in just two weeks
And we closed this past Monday.
Yes, you heard me....WE CLOSED!

So the next time someone asks you When do you quit trying on a Short Sale? Tell 'em....we don't!

New pricing strategy; It will work for you!

It's everywhere you look, this pricing strategy. It's guaranteed to send your homeowner right into the tailspin of foreclosure; List a property and freeze the price.

I see it all the time whether I'm working with Sellers or Buyers. How are Buyers and Sellers affected:

It can be a great thing if I'm looking for Buyers who want to purchase a fabulous new home as this property whose price hasn't been touched is probably overpriced thereby overlooked by most Buyers and allows my Buyer to uncover it. Yet, it hurts the Seller of this property as a Buyer who could be buying the home if it was priced correctly, reduced that is, will never stumble across it
It can be tragic for a distressed Seller who needs to sell their home.

As discussed here before by many who would agree, we have Listing Agents listing properties simply to get a listing and then forgetting about it. Set a price and basically walk away from any chances of success. Why would anyone want a listing just to have a listing? That will get you as the Listing Agent absolutely nowhere; no respect and no livelihood. So why do it then? It befuddles me.

However, Agents lack of concern for these distressed Sellers is truly alarming in today's real estate market when listing a Short Sale property. It is more than simply not getting a home sold because it isn't priced accurately, it's adding to a homeowners stress by forcing them into foreclosure. Not something to ever be taken so casually by so many that do.

I've run across listings for Short Sales that haven't been reduced for months. Who taught these Agents this strategy? It's criminal. That is just a lawsuit waiting to happen. How would you say that this is putting the Sellers interests in mind when you service them?

The pricing on Short Sales cannot sit at one set price. I've seen Agents who even have listed a Short Sale priced at what the Seller needs to cover his mortgage- oh my gosh! That is just ignorance.

If you take on something new, like a Short Sale, either set out to learn what you should do or refer it out to someone who has taken the initiative to learn the right way to conduct an ethical business. After all isn't earning a referral fee better than no closing or better yet the fine or criminal suit you'll be slapped with for negligence? Wake up!

Is Your Short Sale or Loan Modification Being Turned Down?

Has your short sale or loan modification been turned down and you have no idea why? Let's examine some of the reasons. These reasons may not make you feel any better or maybe they are just excuses by your lender, however there are a few things you may not even know about your loan.

Let's say that you make your mortgage payment to Wells Fargo. You can no longer handle your payments so you ask Wells Fargo to modify your loan- to do a loan modification for you. You are behind in your payments. You are in fact, in foreclosure but you are still living in your home and the judge in your case has not ordered the sale of your home at auction yet. You are scared. You see your neighbors losing their homes all around you. You are hopeful because you see on the news and in the newspapers that the Federal Making Homes Affordable Program has been helping some folks keep their home and get a loan modification.

You are no longer making your mortgage payment because your adjustable rate has been applied and your mortgage payment has gone from $1600 a month to $2300 per month. You just can not make these payments. You have been trying for almost 2 years now to get Wells Fargo to approve your loan modification. You even hired an attorney to help you with your foreclosure defense.

Wells Fargo turns down your loan modification request. You wonder, how could this be? After all, Wells Fargo is one of the large lenders and is participating in the government's Federal Making Homes Affordable program.

But Wells Fargo tells you that the investor is the one that will not allow you to get a loan modification. What in the world is an investor doing making decisions on your loan you wonder. Well, you are not alone in your confusion. Every day we are explaining the whole mortgage note owner thing to buyers agents, real estate agents and homeowners.

Just because you make your house payments to Wells Fargo does not mean they own that note that you are paying on. They are the servicer. Other words you will hear them called are asset management companies.

The very first thing you need to do before you ask for a loan modification is to find out who actually owns your note. You can do this by calling who you make your mortgage payments to and asking them.

If it is Freddie Mac or Fannie Mae that own your note- you have a much better chance at getting your loan modification approved if you qualify. If it is a private group of investors, your chances go way down. Why would this happen?

One in eight homeowners' loans were sold to investors on Wall Street. What happens is that a bunch of loans are packaged together. These are called mortgage-backed securities. They are then sold off to investors. Homeowners who have mortgage-backed securitized loan are five times more likely to be late on their house payments. Many of these borrowers were given loans they were not qualified for from the beginning. Many of the homeowners getting these loans did not read the fine print and did not realize how high their mortgage payments might go when adjusted.

The rules to allow modifications, short sales and terms of foreclosures and deficiencies are ambiguous at best. Homeowners who are told no by the investor have little recourse.

The federal Making Homes Affordable program lenders who participate in the program must modify all homeowners that qualify. The exception is when the investor has a rule that they do not allow modifications.

The Federal Housing Finance Agency reported to Congress on June 3rd that these securitized mortgages are a "hurdle" to the success of the Making Homes Affordable program. The treasury department has not disclosed why the modifications are denied so there are little to no facts to go on.

Why would the investors say no to your loan modification? Well, Wells Fargo's response is that the investors need their money. Wells Fargo has one situation where the borrowers ( the homeowners) are trying to get their loan modified but Goldman Sachs is the issuer and Deutsche Bank is the trustee. But when you go and talk to these investors and we have on several occasions when doing short sale negotiations for our sellers; the investor passes the buck back to the servicer. For instance, Deutsche Bank says that Wells Fargo is solely responsible for the decision to modify a loan or not.

Some people say that the investors are the scapegoats. Everything can easily be blamed on them. Since you rarely get to speak to anyone at the investors' group it is hard to tell who is telling the truth. In this particular situation Wells Fargo is saying that the investor is not forgiving the past due debt and that makes the payment go up on a loan modification because then Wells Fargo would have to put that past due balance along with all the penalties and fees into the loan modification which then may cause the homeowner to not qualify financially for the loan modification.

Servicers have agreements, contracts that they sign with investors. These agreements contain the rules for modifications. These agreements are called Pooling and Servicing Agreements which is known as PSA's. The PSA is most often what the servicer says is the reason for them not being able to do the loan modification or release the deficiency on a short sale.

But when you talk to other people in the management areas or to the investors they claim that there is nothing in the PSA's that would prevent the servicer from approving loan modifications, short sales and releases. There is a new study coming out from a law school wherein they state that only 8% of these mortgage-backed securities agreements contain any language that says the servicer is not allowed to do a loan modification for these notes. That means that about 92% of all the NO's; could actually be YES's. So why would that even happen?

Fear of law suits! The language in the PSA in question here, Wells Fargo and Deutsche Bank- it says that Wells Fargo can "waive, modify or vary any term" as long as Wells Fargo as the servicer makes a "reasonable and prudent determination" that the modification is in the investor's best interest. Attorneys examining these agreements say there is quite a bit of room for servicers to make these decisions. But the language itself in this agreement is enough for the servicers legal counsel to be concerned with the investor suing them for not acting in the best interest of the investor. They can not, no matter how inhumane this sounds, put the homeowner ahead of the investor. This is about business and if they want business from investors they need to make sure they are looking out for the interests of the investors.

The treasury department has stated that the fear of law suits is the biggest deterrent to getting the servicers to approve loan modifications and short sales. So doing little or simply turning down the loan modifications are the answer many servicers choose. This is not personal and this is not against you, the homeowner. The position of the servicers is to watch their own backs and to protect the assets to which they have been entrusted with, your mortgage-backed security. The Treasury Department says they can relieve some of the pressure of the fear of lawsuits by standardizing requirements for loan modifications and also provide some type of calculation to figure out if the investor will make more money by the loan modification or by the foreclosure.

We need to keep in mind one big thing in all of this and that is that these investors end up being regular people because most of these mortgage-backed securities were bought by pension funds and retirement plans of folks like your parents or even yourselves. You may well be one of the shareholders of the very loan you can not pay.

I want your valuation system

Some will claim that they can put a value on a property within 15 minutes, some take a few hours and some know right away. I'm floored with the last one who claims to know right away.

I ran into this today when I followed up on a Short Sale package that I submitted to a Lender and 1 minute into the call they came back at me that my offer will never work because they value the property at twice as much - Gosh, how did they do that? Wow, they're fast!

Of course, I reserved my impulse to attack and calmly implied that they'll see the true values as per my market analysis that I provided. These properties haven't had a sale for twice as much since two years ago. Sure there are properties sitting on the market priced at twice as much that have been on the market close to a year and many more than a year. Hmmmmm.....I wonder why they haven't been sold?

With remarks like this from lenders indicating such exagerrated values, are they thinking that we are going to be in agreement?

First thing, when I submit a Short Sale, I'm comfortable in knowing that I have a solid offer as I've done my homework and have analyzed the market and know my values. I will not submit a Short Sale offer unless I can support it with facts.

I sure wish that I could know my values in an instant as that would make my job much easier but then anyone would be able to do my job now wouldn't they?!

What happens when you specialize in Short Sales?

I've been reading here on AR the why's of why we participate in Short Sales. I just read Broker Bryants post and it moved me to elaborate here myself.

As many have said it's not just about earning a living. It is oh so much more. To play an active part in making a genuine difference in someone's life who is suffering from finanical and emotional stress is truly rewarding. When you know that what you are doing daily in your job can make a real difference in the life of others, this is what we're here for; this is so important in leading a fulfilling life.

Short Sales aren't easy;

they require a lot of preparation on the part of the Realtor, particularly when you handle the Short Sale yourself, as I do.
It's constant follow up and dealing with others who punch a clock that don't have the same passion in helping another.
It's biting your tongue when what you would like to do is scream at the Lender representative on the other end of the phone
It's sending documentation again and again if need be.
It's sometimes settling for less commission than what you earned.

But primarily, it's about the husband, the wife, the single man, the single woman, the family, the extended family that just needs somebody to help them save their home from foreclosure and to really go to bat for them and never give up even when "no" has been thrown at you. Never, ever quit. Because when you're guided by such you'll be able to experience the true gratitude that your customers express when they always may not know where to begin with their expression of appreciation. Just reliving the moments here makes me excited about tackling the next Short Sale Listing, the next Lender call, the next Short Sale contract offer and the next Short Sale closing.

So you're desperate to sell a home? Give me my key back!

I received a call today from a Realtor showing one of my Listings: ".....I couldn't show your listing today because when I got there the key wasn't in the lock box..." WHAT? It was there for the last Realtor, or was it?

The activity on the property has picked up due to a recent price reduction and there was another showing scheduled in two hours. I promptly phoned the next Realtor to let him know about the missing key. He told me that he actually had a chance to go by earlier and when he got there he too couldn't show it either. He said the entire front face of the lock box was removed and the dead bolt was locked so no front key pad could have been laying on a counter inside the home.

This Realtor told me it happens to him all the time. (This is only the 2nd time it has happened to me.) He is a REO Agent We're amazed at the audacity of some of these low life Agents who will stoop at nothing to sell a home. Perhaps a showing Agent will show a property, like it, and wants to save it for him to sell. So how can he ensure that he can have a good chance at selling it?

JUST TAKE THE KEY from the lock box!

In this case, I must now go out and replace the lock box with a new lock box as I can't re code it without a numerical face pad. And what is to stop this crazy loon Agent from coming back and doing it all over again? I will now change my locks to the dial type where you can't remove the face pad but I still can have the problem of the key being stolen. I could replace my many listings with Supra but that would be a huge expense and most Agents don't even have a Supra key. I'm going to try and figure out a way to place a coil in the box that will hold the key not allowing the key to be removed from the box yet allow it to reach the lock on the door - hmmm, is this at all possible? That's a task my husband will try and figure out for me.

Is this an economic driven problem? We know in tough times people will result to extreme measures for money. Just as we can see crime increase when so many are without jobs and need money to live; robberies are on the rise. Is this depressed economy affecting Agents the same way? Resulting in desperate measures to sell a home?

Anybody with an effective strategy for keeping your keys, please share!

"Humor is Reason gone Mad"

Hmmm......I can certainly relate to this involving a Short Sale that I'm currently working on. This has been the case of all cases. A year working to get a Buyer, been through 3 buyers; one of which defaulted, one changed their mind and one didn't want to deal with the "As Is" of the property.

Now enter the Dream 4th Buyer; Dream as right up front having been given a solid pre approval right out of the gates; not a flimsy pre qualification. Yep, you heard me...we're on the 4th Buyer.

I've gained Lender approval on this property 4 times! This 4th Buyer was to be the last Buyer that the Lender would approve. (the madness begins here)

Now a week before closing, the Buyer's Lender isn't ready and will need two more weeks to be ready as they're waiting on valid issues that can definitely be taken care ... just need a bit more time. Common right, closing dates get extended.

Enter the reasoning of the Seller's Lender. "....NOPE, we're not giving any extension and we'll go ahead with the auction sale date on the 10th of September..." Is this sound reasoning? Have they gone mad? Is it to the point of being humorous? The property even has a city code violation lien placed on the property for $2106 and will be added to the property should the Lender decide to own it. However, if the Lender were to allow an extension, the lien would be released as I was able to work to get the lien released.

I'm even in direct email and voice communication with a VP of this Seller's Lender and I'm working hard to get them to at least postpone the auction date and if the Buyer doesn't get his final approval, then go ahead and issue an auction date. We're all going forward in trying to see if the Buyer's Lender can get a miraculous approval before Sept 10th....and hoping that the mad reasoning of the Seller's Lender will see the light so indeed I can look back and find the humor in the process. Otherwise, next week will prove to be a very sad day as this would be the first homeowner that I wasn't able to save from foreclosure. Oh, the stories I could tell on this property.

Here's a Quick Way to sell your home as a Short Sale

First and Foremost, Hire a Professional who is experienced in selling Short Sales.This is not always so obvious but oh so true. Years and years of Real Estate experience is great for the general practitioner but not if you need to save your home from foreclosure. This is what can happen when you don't hire a professional Short Sale Realtor:

The home will be priced inaccurately. I've seen many listings when I'm searching for a Buyer who is looking at Short Sales and the List price is either too high, perhaps trying to cover a mortgage (clueless in their attempts) or priced too low as using the bait and switch tactic or worse yet, the home has been on the market for months with no adjustment in price. Clearly an uneducated Agent. I'm not trying to bash other Agents but they should stick with what they know or at least educate themselves on the Short Sale process
Multiple offers will be accepted. Madness when it comes to Short Sales. This only muddies up the process with the Sellers Lender who will really mess up the file and perhaps be more inclined to delay the approval in hopes of a better offer if they see so many offers flying in on the fax.
The Buyers offer will be denied by the Seller's Lender and the Agent won't know how to negotiate for Lender acceptance, resulting in foreclosure.

Second, make sure your situation can be documented. Tell the truth of your particular circumstances.

If you have a Hardship, make sure that you can support it with documentation. If you don't have a genuine hardship don't try and fudge one to gain approval; your Lender may still agree to a Short Sale if you present your circumstances.

Third, be prepared to supply documentation when needed. Your timely participation in providing the required supporting documents is critical.Do not expect the Realtor to have to chase down the required documents. Without documents there will be no approval.

Fourth, if you're living in your home that is being sold as a Short Sale, keep it neat! If a home needs to be sold, the better light it appears in the quicker the Buyer's offer will come.

Lastly, think positive! If you've done the above, there's a fabulous chance of avoiding foreclosure!

Steps to overcome Short Sale Anxiety

Did you know that Anxieties plague roughly 19.1 million Americans? There are many types of anxieties and levels of severity. This discussion will be on a less severe form, yet prevalent in today's Real Estate market with the growing number of foreclosures affecting millions nationwide.

Anxiety defined by Wiktionary: An unpleasant state of mental uneasiness or concern about some uncertain event; An uneasy or distressing desire (for something); A state of restlessness and agitation, often accompanied by a distressing sense of oppression or tightness in the stomach

Let's take a closer look at Short Sale Anxiety. Most of us have heard of it and some of us find it easier to handle head on. Here are some of the steps to overcome Short Sale Anxiety:

First and foremost, do not believe everything you read stating the negative of a Short Sale. We were taught that at a very young age, weren't we? So why do we need to be reminded? Is it stress perhaps that keeps us out of sorts?
Take deep breaths to analyze your particular situation. Imagine a Happy place!
Determine your goals:
1. Avoid Foreclosure
2. Be qualified to purchase again in a few years as FHA guidelines suggest in a Short Sale
Find a Professional to assist you.
1. When you need Heart Surgery do you seek the advice of a General Practitioner or a Specialist? Seek out a Realtor who has had success with Short Sales, just like you would with your Heart Specialist.
When something causes anxiety we tend to avoid it. Do not avoid a Short Sale if it can make a positive difference in your life. Seek help and guidance.
If you're interested in a Short Sale and your current Realtor will not help you, seek out someone who will. Remember it's your decision. Do not let another's anxiety get in your way.
Have hope, be committed to a successful outcome and all can work out.

So the next time someone tells you to run from a Short Sale due to their anxieties, remember to take a deep breath and follow the steps above. Happy healing!
