Disclosure - who do you have responsibilities toward?

I have an interesting case in hand! I have a client - Buyer that decided to make an offer on a FSBO property. All went fine with paperwork. Seller was OK with the deal, signed the papers and we are moving along. Here is a little info on the property: double lot, double wide mobile on permanent foundation, outside city limits.

Due to the age of the property and with it being a mobile house, I strongly recommended to my client to get an inspection. She agreed. The lender also did his job by not only sending an appraiser there but also a structural engineer. The structural engineer was the first on site and said the property was sound and looked good. He went under the house and checked everything (or so we thought) and signed off on it.

Appraiser was next! He did the same thing! Everything looks good, appraised for the sales price! OK - Good news, right?

My client decided to skip the inspection based on the word of the structural engineer and the appraiser. She didn't want to spend any more money on the subject. However, I did not feel right about the deal and since I am no expert in house inspecting and even less so in mobile homes, I asked a friend of mine that is a Building Codes Inspector to come as a favor to me and at least take a look at the roof and foundation. Well, he DID! His report: the house is not sitting on a PERMANENT foundation!!! I immediately called my client and let her know about it and of course since the Seller was already present, the inspector and I let him know about it as well! My client decided that she didn't really care about the foundation. She likes the lot and the house and wants to buy it no matter what! OK, as long as she signs off that I did tell her about the facts and recommended that she either back out or lower the offer!!! I also mentioned the fact that the bank might not finance it due to this condition!

I just got word from the Lender and neither the appraiser or the structural engineer reported that the trailer is not on permanent foundation. How could they have missed it??!! Isn't it what they get trained, licensed and paid for???? I was dumbfounded! I know if I tell the lender about what I found out, it will probably blow the chances for my client in getting finanicing, but I feel that I have a responsibility to the lender to let them know! I know we only have an agency agreement with the client only, but I feel that if the bank was to fund the money under false facts, and I was aware of these adverse facts, I would become part of this mess.

I decided to write a letter to the Lender and explained to them my inspector's findings. I recommended that since the inspector's findings were different from the appraiser's and the structural engineer's, the lender should find a third party to do a final and independent investigation before finalizing the paperwork on this deal! I made sure all parties got a copy of it and needless to say both Seller and my client were not happy about it at all. I was not happy to do it either, but I felt that it was the RIGHT thing to do!

New rules from Freddie & Fanny affect Investors

If you are an investor or have clients that are investors, please be advised on the changes from Freddie Mac and Fanny Mae regarding financing for investment properties.

As of a month ago or so, you can no longer finance a residential non-owner occupied property through a regular 15-30 year fixed rate mortgage if you have 4 or more properties already financed, including your own residence and any equity lines of credit! It used to be you couldn't finance more than 4 properties per given year, but now that has changed to 4 properties - TOTAL!

I found that out the hard way! I sold one of my investment properties and was getting ready to do a 1031 Exchange, just to find out that I didn't qualify for a mortgage due to having more than 4 properties financed at this time! I cannot begin to tell you how angry that made me!

You would think that the 700 billion dollars that the banks got for the bail-out, would allow the banks to approve more rather than less mortgages, especially to people with good credit, good payment history, good income and a record of running a profitable business for many years! Or maybe not! After all they need the money to pay for their CEO's Christmas bonus!

Nevertheless, make sure to keep this change in mind and advise your clients as well so they don't initiate any purchases without securing the funds and end up not getting the property and paying taxes on an uncomplete exchange! (Undeveloped land, commercial properties and residential multi-units 5+ are not effected by this change!) Also, you might still be able to secure financing through other sources such as personal loans, hard money loans, commercial loans etc.

Reduce Your Mortgage Obligations to Avoid Foreclosure

I have a client in short sale with a 1st mortgage, a home-equity line of credit, and a third lien. As we've been working through the process of getting his home sold, I've had to help him keep up with whatever he can. I had to do some research and learn a few things myself so I can be there for him and help him find his way again! As I searched different areas, I found this interesting article that I thought would be good to share with you all. Have a great weekend.

You may be able to stop paying some of your home loans without risking foreclosure. Here's how.

If you're like many homeowners, your home may be encumbered with a second or third mortgage (or deed of trust), and perhaps a home equity loan. You may be able to avoid foreclosure if you are having trouble making all your mortgage payments, by paying the right loan and either stoping payments or making reduced payments on the rest. In almost every case, your first mortgage or deed of trust is the right loan to keep current.

Although stopping payment of loans secured by your home is usually a last resort, if you can do so safely (that is, without risk of foreclosure), thereby leaving you with more money to pay the one or two lenders that could foreclose on your house, this strategy could keep you in your home. (To learn about other strategies to deal with the threat of foreclosure, see How to Avoid Foreclosure and How Bankruptcy Can Help With Foreclosure.)

Here's how it works.

Mortgages and Foreclosure: The Basics

When you originally took out the loan to buy your home, you agreed to have the loan (or loans) secured by a mortgage or deed of trust. This gives the lender a lien (legal claim) on the property. If you fail to comply with the payment terms of the loan, the lender can enforce its rights by foreclosing on your home. In foreclosure, the lender sells your home in order to recoup the money you owe under the mortgage.

Short Sales Info!

The last couple of months I've had to work with a new short sale property and it has been an educating process to me. I've had to do a lot of reading and fast learning in the process.

I found out that in many states, lenders can sue homeowners even after the house is foreclosed on or sold, to recover for any remaining deficiency (the difference between the selling and owed amount).

In a "short sale" the homeowner gets permission from the lender to sell the house for an amount that will not cover the entire loan (the sale price falls "short" of the amount owed to the lender).

***A short sale is beneficial if you live in a state that allows lenders to sue for a deficiency -- but only if you get your lender to agree (in writing) to let you off the hook.

How will a short sale help? The main benefit of a short sale is that you get out from under your mortgage without liability for the deficiency. You also avoid having a foreclosure or a bankruptcy on your credit record. The general thinking is that your credit won't suffer as much as it would were you to let the foreclosure proceed or file for bankruptcy.

What are the drawbacks? You've got to have an offer from a buyer before you can find out whether or not the lender will go along with it. In a market where sales are hard to come by, this can be frustrating because you won't know in advance what the lender is willing to settle for. (this is a very frustrating experience - it's like what came first: the chiken or the egg?)

What if you have more than one loan? If you have a second or third mortgage (or home equity loan or line of credit), those lenders must also agree to the short sale. Unfortunately, this is often impossible since those lenders won't stand to gain anything from the short sale. (I found that out with my client's line of credit... still have not received an answer on accepting or not of the offers we got!

Beware of tax consequences. A short sale may generate an unwelcome surprise: Taxable income based on the amount the sale proceeds are short of what you owe (again, called the "deficiency"). The IRS treats forgiven debt as taxable income, subject to regular income tax. You will receive a 1099-MISC showing the deficiency amount as regular income which you will pay taxes on. The good news iare that there are some exceptions for the years 2007 to 2009.

Funny but also sad to think how dependent we've become on other people's (bank's) money and how little most people know about it! I really wish that basic financial education including purchasing a home, a car, personal loans & credit cards would become part of high school education.

Lease Agreement - Get professional Opinion

Did you know that one little word on your lease can cost you a fortune? If you say maintenance vs. damages, you end up collecting nothing form your tenant that just destroyed your property? I found that out the hard way! The judge said if it didn't specifically say: Tenant to pay for any and all damages, any maintenance issues, neglect, damgage to the property will go unaccounted for.

If you have rental property, do yourself a favor and take all your paperwork to a specialized attorney to review it and make sure if you had to ever enforce any item on your lease, you will be able to do so in front of a court judge. And as a backup, check your insurance to make sure it too will be on your side if needed.

Tenants - Pets or no pets

I am a pet owner myself and I try to be tolerant and acceptant of other's pets as well. I have tenants and some of them have pets. I know a lot of landlords do not accept pets and it sounds tough but a lot of times the units get destroyed due to pets.

Unfortunately, my experience has been that the owner of the pet (the tenant) is the one responsible for it. The pet can't help the fact that you didn't not walk them outside to do their business and now they have to go and it ends up on the carpet. And these are the same people that will destroy your property even if they didn't have pets. So, try not to punish the pet. Instead screen your tenants better with proper credit check, employment and references checked.

At last a guy has taken the time to write this all down - My brother-n-law sent this to me. Hmmm, I wonder why?

Finally, the guys' side of the story. ( I must admit, it's pretty good.)
We always hear 'the rules' from the female side. Now here are the rules from the male side. These are our rules!
Please note: these are all numbered '1' ON PURPOSE!

1. Men are NOT mind readers.

1. Learn to work the toilet seat. You're a big girl. If it's up, put it down. We need it up, you need it down. You don't hear us complaining about you leaving it down.

1. Sunday sports. It's like the full moon or the changing of the tides. Let it be..

1. Shopping is NOT a sport. And no, we are never going to think of it that way.

1. Crying is blackmail.

1. Ask for what you want. Let us be clear on this one: Subtle hints do not work! Strong hints do not work! Obvious hints do not work! Just say it!

1. Yes and No are perfectly acceptable answers to almost every question.

1. Come to us with a problem only if you want help solving it. That's what we do. Sympathy is what your girlfriends are for.

1. A headache that lasts for 17 months is a Problem.  See a doctor.

1. Anything we said 6 months ago is inadmissible in an argument. In fact, all comments become null and void after 7 Days.

1. If you won't dress like the Victoria 's Secret girls, don't Expect us to act like soap opera guys.

1. If you think you're fat, You probably are. Don't ask us.

10. Sing Along At The Opera.

11. Put Mosquito Netting Around Your Work Area and Play tropical Sounds All Day.

12. Five Days In Advance, Tell Your Friends You Can't Attend Their Party Because You have a headache.

13. When The Money Comes Out The ATM, Scream 'I Won! I Won!'

14 .. When Leaving the Zoo, Start Running towards the Parking lot, Yelling 'Run For Your Lives! They're Loose!'

*77 - it might save your life

I knew about the red light on cars, but not the *77. A friend of mine send me an e-mail the other night. It read:

It was about 1:00 p.m. in the afternoon, and Lauren was driving to visit a friend. An UNMARKED police car pulled up behind her and put his lights on. Lauren's parents had always told her never to pull over for an unmarked car on the side of the road, but rather to wait until they get to a gas station, etc.

Lauren had actually listened to her parents advice, and promptly called *77 on her cell phone to tell the police dispatcher that she would not pull over right away. She proceeded to tell the dispatcher that there was an unmarked police car with a flashing red light on his rooftop behind her. The dispatcher checked to see if there were police cars where she was and there weren't, and he told her to keep driving, remain calm and that he had back up already on the way.

Ten minutes later 4 cop cars surrounded her and the unmarked car behind her. One policeman went to her side and the others surrounded the car behind. They pulled the guy f rom the car and tackled him to the ground. The man was a convicted rapist and wanted for other crimes.

I never knew about the *77 Cell Phone Feature, but especially for a woman alone in a car, (and we realtors are on the road a lot) you should not pull over for an unmarked car. Apparently police have to respect your right to keep going to a safe place.

Speaking to a service representative at Bell Mobility confirmed that *77 was a direct link to State trooper info. Let your friends and loved ones know about this important feature; it may save a life. And remember, this applies to ALL 50 states.

Investor's market or not?

Everywhere I turn people talk about the housing market and how bad this and that is, and also what a great oportunity it is for investors. True? Maybe!

The kind of investors that purchase foreclosures or short sales with CASH, are doing well! But what about the investors that need or want to use borrowed money? The interest rates for investor loans are up; the loan to value ratio has changed for investor loans requiring bigger downpayments;stated loans are a thing of the past even with great credit... you get the picture. There are lots of deals to be made, lots of bargain properties, banks need the investors to take the REOs off their hands, yet the banks are not doing anything to help investors close some of these deals.

So, even with all the possibilities out there, investors are not able to pick up as many deals as they would like! It is a shame because the purchase of these properties also creates job opportunities. Most of these houses have to be cleaned, painted, carpeted... and so on, providing employment for many small local contractors.

Last night I came home with the kids as I do every evening... carrying my bags, kids backpacks and what have you. As we turned on the lights one of my girls pointed at the blinking light on the answering machine and said: "Mommy, there is a message on the machine".

I navigated my way to the answering machine and here is the message:
"We have information about the return of your Soldier. Please, call .... to get the flight information... "
I didn't hear the rest of the message as the kids started jumping up and down screaming to the top of their lungs "Daddy's coming home! Daddy's coming home!"

For those of you that never had to part with your loved one for months and years, you don't know what that means, but for those of you that come from military families and been through this... you know the feeling... YOUR SOLDIER is coming HOME! - The best words I've heard in the last 15 months!

Tomorrow night I'll be staring at the night sky, counting minutes till the flight carrying my husband lands on Ft. Campbell's airfield. And there will be hundreds of mothers, fathers, wives, children, and friends doing the same, looking forward to their loved one's return! May God bless all our men and women in uniform and their families!
