Unemployment Rate Jumps

Investor sentiment about the economic recovery fell this week, and the stock market declined. Expectations for slower economic growth are favorable for bond markets, including mortgage-backed securities (MBS), and mortgage rates ended the week a little lower.

The important monthly Employment report showed mixed results. Against a consensus forecast for a loss of -225K jobs in August, the economy lost -216K jobs. This was the smallest level of monthly job losses since August 2008 and was far below the monthly average of -691K seen during the first quarter of the year. The biggest surprise in the data came from the Unemployment Rate, which jumped from 9.4% to 9.7%, the highest level since 1983. The unexpected increase was mostly due to previously discouraged workers returning to the labor pool to look for jobs. Average Hourly Earnings, a proxy for wage growth, rose at a moderate 2.6% annual rate.

The future of Fannie Mae and Freddie Mac made the headlines this week when the Mortgage Bankers Association (MBA) released its restructuring proposal. While the MBA suggested the elimination of the two agencies, it would replace them with new entities which would perform many of the same functions, with many of the same people. Its plan would maintain a government guarantee of principal and interest for MBS investors. The two agencies have played a pivotal role in keeping mortgage rates low and in expanding homeownership, and the MBA proposal would retain these benefits. It's very early in the process, and the Obama administration indicated that its proposals for Fannie and Freddie may not be revealed until early next year.

Week Ahead

Treasury auctions may have the greatest impact on mortgage rates next week. There will be $70 billion in 3-yr, 10-yr, and 30-yr auctions on Tuesday, Wednesday, and Thursday. It will be a light week for economic data. The Fed's Beige Book will be released on Wednesday, and the Trade Balance will come out on Thursday. Import Prices and Consumer Sentiment are scheduled for Friday. Mortgage markets will be closed on Monday for Labor Day.

Should Short-Sellers Be Required to Post Good Faith Money?

Strange Days Indeed.

There is an ancient Chinese proverb that goes something like this, "May you live in interesting times". Well we certainly are living in "Interesting times" and this true story is proof;

Last year a client of mine without the use of a Realtor entered into a Rent-to-Own agreement with a Sell-Lord. A Sell-Lord for those of you who don't know is someone who has purchased another home or otherwise moved on and now because of both lending and real estate markets can not sell traditionally and so they are now unwilling landlords. Because they couldn't sell and weren't willing to wait to sell, they have decided to rent, rent to own, or any other scheme to generate income from the property.

In my clients case, the seller agreed in a very poorly written agreement which was created by my client to sell for either the then agreed upon price or what the bank appraises the property for at the time of closing. Or at least this was my client's understanding, frankly the document was so poorly written that it is doubtful that it would pass legal muster. The seller additionally agreed to (belive it or not) apply 100% of the rents collected during the rental period towards the buyers/renters down payment. In this case we are talking about nearly $13,000. Making matters worse, the property went into early stages of foreclosure and the bank began making property inspections and even attempted to secure the property prior to legal foreclosure.

Finally, due to many foreclosures in the immediate vicinity the house did not appraise for the agreed upon dollar amount, the deal fell apart and of the course the house subsequently went back to the bank. Ironically, the amount to pay off the loan would have been sufficient to do so with the net proceeds from the sale at the appraised value. According to the agreement the purchaser lost several thousands dollars in un-recouped rent, deposits and the cost to appraise the home.

This same customer went on to purchase another home, this time a short-sale. This house did not appraise for what they agreed upon and so the buyer lost another $900 of inspection fees. In this case the seller did no wrongdoings, the market simply was unstable and the appraiser injected his politics into the report when he described the market as "a victim of the current lending crisis" whatever that is supposed to mean and called it a "declining market" even though technically there are no "declining markets" in Raleigh.

Fast forward to our most recent attempt; the buyer is now living in a motel because the bank evicted her from property number 1 and her possessions are in a truck outside. She has entered into another short-sell agreement (because she is obviously a glutton for punishment), paid for inspections and the attorney has discovered in the title search unpaid judgements against the seller which the seller claims the can not pay. Because of this, he can not legally transfer a Warranty Deed to the buyer and is now asking his lender to negotiate settlements with his creditors who have sued him to pay off those debts with the proceeds from the short-sale. Did you get that? He is actually asking his mortgagee who is Wells Fargo who have already agreed to accept less than what is due to pay off the mortgage in the first place to accept even less by paying off his credit cards companies who have sued him and obtained a judgment against him! Can you belive the marbles on this guy?

My reccomendation; if you are a buyer and are planning to purchase a home in short-sale or pre-foreclosure; protect yourself by asking the seller to deposit into escrow an equal amount of Good Faith Money to yours in order to cover your expenses if the seller can't perform due to undisclosed liens and or judgements that could prevent him or her from legally selling you the home! Expect resistance from the seller and or his agent and even from your own agent, but if the seller isn't willing to risk his money then why would you risk yours? Move on and buy the home from the bank in foreclosure if you must have the home.

Mortgage Fraud; Who is really to blame?

Fraud and the Mortgage Broker;

According to Meriam-Websters defenition of FRAUD: : intentional perversion of truth in order to induce another to part with something of value or to surrender a legal right b: an act of deceiving or misrepresenting : trick

Using this commonly accepted defenition of fraud then the most common form of fraud is comitted in and example of when a loan officer who knows that a person who earns $30,000 per year and then signs his/her name to the page three of the Universal Residential Loan Application (URLA/1003) where is states that person makes anything more. In this case both the loan officer and the borrrower are complicit in misrepresentation of material facts to the lender. Because the lender may not have required income documentation from persons who met other lending criteria doesn't make it OK to misrepresent your income, assets or anything else that may impact your lenders perception of your ability to repay the loan you have requested and it doesnt make it the lenders fault either.

Another example of fraud in the mortgage process is when collusion occurs between the loan officer and the real estate appraiser. Because of the rise of the Internet over the past decade, this has become more common and the use of digital cameras and other destop publishing software and so has this has made this form of fraud easier to commit and harder to detecet by lenders and banks. I have personally seen appraisals commissioned by other lenders where a manufactured home was compared to a site-built home. In this case the apprisaer outright lied and called it a modular home when it was not. In another example of fraud the apprasier used genuine sales that were not in the same city of the subject property. The apprasier committed fraud by placing it closer on the map location to the subject property than it actually was! A simple Mapquest check would have revealed this, but underwriters rely on the state licensed real estate apprasier to tell the truth and when trust begins to break down by those who have fidiciary trust relationship like brokers, appraisers and realtors, then we move into our present day quandry and who do you trust?

Photo-shopping of bank statements, creating pay stubs and W2 earning statements is another common type of fraud and it has become easy for someone with a piece of software and 30 minutes can create documents nearly indistinguishable from orginals and with the rise of improved digital color copiers and other destop publishing software, it is nearly impossible to detect fraud with the most accomplished of "tricksters".

Now that we have an understanding of what FRAUD is, let's look at how FRAUD has played a critical role in the current mortgage crisis and why it is causing banks to re-think their relationship with mortgage brokers. It is FRAUD why the secondary marketplace i.e.; it is Fannie Mae and Freddie Mac’s soon will stop purchasing and insuring loans that have been originated by mortgage brokers because according to thse agencies (not the banks) an overwhelming amount of mortgage fraud is occurring in brokered loans. Therefore if banks can’t securituze, insure or otherwise or sell them to the government insured agencies they certainly aren’t going to expose shareholders to further risk of buying brokered loans in this environment. This is happening because the trust relationship with brokers has been viloated!

Recall that it was only late last fall that FNMA and FHLMC were taken over by the Treasury department. Had they had been bank holding companies they would have been shuttered, their assets sold off to other banks and likely bankrupt but because they are “too big to fail” GSE’s Shareholder value was wiped out and today both companies stock trade at less than 50 cents per share! Both agencies are responsible for nearly ½ of ALL existing and future mortgages in this country. For the record we are talking about several trillions of dollars! And even though of late our law makers throw figures like hundreds of billions of dollars and trillions like they are usual and customary number, they are not! If Fannie and Freddie fail, then we will see easily another 50% of real estate sales immedialty fall out of the market place becuase that is about the percentage of loans are being originated by both agencies. For the past decade more and more of the retail origination was being done by brokers and they got rich from doing so and have sustained none of the losses borne by the banks and shareholders because they have no vested interest in the success or failure of that loan once the commission check is cashed!

Nothing last forever and when you understand this then you can easily see why it is logical to blame the broker for the fraudulent activity. Even though banks and lenders bought riskier and riskier loans a secondary market for them existed and while admittedly RISK and FRAUD are frequent bedfellows they aren’t interchangeable nouns. Unlike banks, mortgage brokers are regulated by state agencies who each have their own sundry of rules and regulations and even though 14 states to date have voluntarily joined the National Registry of Loan officers, in the past the barriers to entrance for loan officers and brokers were minimal if any at all even existed. In most states it was more difficult to become a cosmetologist! Rogue loan officers and brokers were able to move undetected from state to state unlike loan officers in a bank who must successfully pass state, federal criminal checks along with fiancial responsibilities and they must be bondable too.

Further compounding this problem is the little known fact that not one state has a criminal code for mortgage fraud therefore it is up to the FBI to prosecute and generally will only do so if a federally chartered bank has been defrauded; in other words the broker would have to take money from the bank by not funding loans they received monies for. Even then it is very difficult to determine who is wholly at fault because that type of crime requires a title company or an attorney and generally includes a realtor and a live borrower. Contrast to the bank environment numerous and varying hands and eyes review each loan file and so when fraud is detected regardless of the perpetrator it is reported to the proper authorities and people go to jail. In most broker environments due to cost prohibition and frankly lack of ownership and financial responsibility to buy back fraudulent loans these safeguards simply do not exist.

In many ways Mortgage Brokers have become a victim of their own success. For years they have rejected voluntary licensing, regulation and education requirements. But do not despair; instead of sitting on the sidelines the good brokers or as I like to call them the “Lepers who have the most fingers” have seen the writing on the walls and instead of complaining are happy to see laws tightening which are squeezing out the bad apples and admittedly some good ones too and are becoming lenders because in fact soon there will be no brokers left at all. Maybe the National Association of Mortgage Brokers can lobby congress for a bailout, or become a loan officer at a.....bank.

Is it a "crisis" or just a power grab?

I met a young man today who overheard a conversation I was having in which I was discussing the pink elephant of this "financial crisis" and that was last summers skyrocketing energy prices. It had been costing me nearly $70 to fill my mid-sized Japanese sedan and I couldn't fill my American made full sized SUV without obtaining two credit card authorizations. This young man asked me why I thought low energy prices were good; I explained to him that the horse-power of our modern economy is fueled by oil and not alfalfa and that you can't escape its omnipresence in our lives/economy. To that he said with an authoritative tone something about the "financial crisis" and it was there I asked this this 20-something dread-lock adorned young man exactly what crisis was he was referring to and he admitted couldn't say.

Since September when the alleged financial crisis began 2,000,000 Americans have become unemployed or 2% of the workforce bringing the total unemployed in this country to just over 7%.

98% of Americans who were employed in September are still employed today.

Most economist agree that anything over 90% unemployment is pretty close to FULL EMPLOYMENT meaning all who want to work can find work. Because I graduated from High School when Michael Jackson was still black I am both old and wise enough and possess enough experience to know that there are those among us who are able to work but choose not to. Therefore the 5% of Americans who were already unemployed before this so-called crisis began is likely because they are unemployable and because of their lack of production it is most likely that they weren't actively participating in the economy by purchasing homes and cars and goods and services that cause others to be able to produce a profit in therefore one could only logically deduce that those 5% aren't responsible for the economic slowdown because they weren't producing anyway and therefore they weren't contributing to the overall health of the economy.

So if only two percent of the population of this country who were employed and producing have become unemployed and stopped spending, then where is the crisis? Shouldn't all of us have a 2% margin of error in our finances? Think about it for a minute, that's only 2 cents retained from each dollar earned! I cant think of a single business that operates on less than a 2% profit margin. So what has happened? If only 2% of the producing population have stopped producing and spending, where's the crisis?

The crisis is confidence. All summer long Americans witnessed exorbitant energy prices erode our disposable incomes and they in Congress did nothing about it, remember the slogan "Drill Baby Drill", it wasn't the newest vernacular for male/female copulation, it was because Americans were being drained at the pumps.

For the first time in history we have a president who has used his bully pulpit not to inspire but to tell us that there is a crisis and looming catastrophe and that he and his congress are the only ones who can fix it for us. Then they tell us the only way to do so is to expand governments role in our lives by of all things...spending money we don't have oh yeah we better do it now!

I don't believe it, do you?

Last night I drove my family of 5 more than 20 miles round-trip to our new favorite burger joint (shout out to Five-Guys) in Knightdale, as I approached the restaurant I passed a number of national chain restaurants whose parking lots were jammed tight, on a Thursday night! I spent $20 on burgers and fries because I wasn't soaked at the pump earlier when I filled the tank of my SUV and I think many who jammed those restaurants were feeling the same way about their financial circumstance too which is why they were dining out and not slumped over a sink eating a can of beans.

Can anyone really spend their way out of a reduction of income?

Now think about that for a moment. If you could spend your way out of a financial crisis you and I could avert any financial catastrophe and wouldnt need government to do it for us. But we know that isn't true and we know that we can't spend our way out of a financial problem anymore than government can because that only leads to bankruptcy. In our lives it means something has to go, new car, bigger house, clothes and dining out. So what do they know in Washington that we don't?

Americans were hurting at the pumps this summer because for decades our congress has limited energy exploration and refining capacity since the Carter Administration. As a result, Americans stopped spending as a result the world economy has slowed down..yes the American economy IS the center of the economic universe, other countries followed into recession and guess what? Demand for oil fell globally causing the the price to fall along with it. Even after numerous failed attempts by OPEC to artificially raise the price of oil by cutting output, oil closed today at $37 per barrel from its high of more than $150 last summer.

One last thought; if it is only the 2% who have caused this problem, couldn't we just give each of those two million people say 1/2 of the $789 Billion dollars which looks like say $190,000 per unemployed person and let them spend their way back into financial health? Heck may be one or two of them would start a business and hire one or two people while they are at it dare I say; make a profit to which they might pay a tax? . Regardless it would save us nearly $400 Billion dollars.

So I ask you, how do you feel today compared to last summer and is this a real crisis or is it just a power-grab? You decide and let me know.

the Clinton Budget Surplus; Fact or Fiction?

Because 2008 has come to an end I am getting my financial house in order and creating my budget for 2009 and with our nations economy and our industry in turmoil for the past 2 years - 3 if you lived in Michigan like I did, my income and assets have taken a beating while my debts have risen far greater than I ever could have imagined.

The US National Public Debt has soared to more than 10 Trillion Dollars and I am more than a little concerned and you should be too. In addition to 1/2 Trillion dollars our fearless leaders in both executive and legislative branches of our government (Democrats & Republicans both are to blame) have borrowed since the new fiscal year began in October they have also guaranteed an additional 7 Trillion Dollars in loans for private sector.

Inflaming the issue is that you cant discuss it anywhere whether it be here, in congress or your local pub over a beer without a Democrat claiming that this Republican president had a surplus when he took office and that this is all his fault. Let me be clear, this isn't a partisan issue, this is an American issue so I don't want to hear from people blaming Republicans or Democrats because if you make those comments they will be deleted from this thread, period. I have written this post because our way of life is dangerously close to collapsing upon itself as a result of this debt. And this is a national security threat like terrorism, border security and the like because a weak fiancial house will bring down any nation just like it will bring down your family and mine if we aren't fiscally responsible!

What will One Trillion Dollars Buy?

For posterity you and I can't get our heads around those numbers because no one except for the US Gov't uses numbers that big but let me share with you what 10 Trillion dollars looks like written out;

OK - now that we know the Total Public Debt is 10.5 Trillion what will it buy you?

According to Andrew Davis, Libertarian Party;

One trillion dollars ($1,000,000,000,000) is enough money:

To buy everybody living in Los Angeles at least one Lamborghini Gallardo.

To buy 88,052, 394' custom mega yachts; enough to stretch around ¼ of the world.

To buy everyone living in Belize and Malta a Manhattan apartment.

To get half of the Democratic Party into a fundraiser for Barack Obama at the $28,500 admission price.

To give one out of every two men in the United States a Men’s Presidential Rolex watch.

To buy every woman in the United States a Tiffany Diamond Starfish Pendant.

To get two Mitsubishi 73? HDTVs for every household in America.

To buy four copies of The Office: Season Four on DVD, to every person on earth.

To send everybody in America on an all-inclusive vacation to Tahiti (and some people can stay a few extra days).

$1 trillion is enough money for everyone in Buffalo, NY to buy their own 65-acre island in Panama.

This is how much the government is going to cost you (roughly $3,278 for every man, woman and child in the United States) so multiply that by 10.5 and there you have it, its an enormous sum of money to to anything with.

Where was the surplus?

The claim was made by Clinton himself that his administration had a surplus of $69 billion in FY1998, $123 billion in FY1999 and $230 billion in FY2000 . In that same link, Clinton claimed that the national debt had been reduced by $360 billion in the last three years, presumably FY1998, FY1999, and FY2000 however no matter how you add it, $360 billion is not the sum of the alleged surpluses of the three years in question ($69B + $123B + $230B = $422B, not $360B).

I am not defending the increase of the federal debt under President Bush, but it is disingenuous at the very least to say of promoting Clinton's record as having generated a surplus. It never happened. There was never a surplus and the cold hard facts support that statement. In fact, far from a $360 billion reduction in the national debt in FY1998-FY2000, there was an increase of $281 billion and so there is a gap in those numbers is 600 Billion Dollars!

You can verify these figures by accessing the U.S. Treasury website where the national debt is updated daily and a history of the debt since January 1993 can be obtained.
Because the government's fiscal year ends on the last day of September each year, and because Clinton's budget proposal in 1993 took effect in October 1993 and
concluded September 1994 (FY1994), here's the national debt at the end of each year of Clinton Budgets:

As you can see, not once during the Clinton Administration did the national debt go down, nor did Clinton leave President Bush with a budget surplus that he spent at a frat party kegger. Yes, the budget was almost balanced in FY2000 (ending in September 2000 with a deficit of "only" $17.9 billion), but it never reached zero--let alone a positive number. Clinton's last budget proposal for FY2001, which ended in September 2001, generated a $133.29 billion deficit. The growing deficits started in the year of the last Clinton budget, not in the first year of the Bush administration.

President Bush assumed the office of presidency January 2001 and his first budget took effect October 1, 2001 for the year ending September 30, 2002 (FY2002). Therefore the $133.29 billion deficit in the year ending September 2001 was Clinton's. To be fair to Clinton, Bush supported a tax refund where taxpayers received checks in 2001 the cost was $38 billion, So even if we assume that $38 billion of the FY2001 deficit was due to Bush's tax refunds and not part of Clinton's last budget, that still means that Clinton's last budget produced a deficit of 133.29 - 38 = $95.29 billion.

Clinton did not achieve a surplus and he didn't leave President Bush with a surplus. Only in Washington can you use these accounting principles and not be convicted of accounting fraud under Sarbanes- Oxley aka; also known as the Public Company Accounting Reform and Investor Protection Act of 2002. Just ask Bernie Evers from World Com and his buddies from Enron and Tyco!

Where was the Myth Started?

That is very easy to answer; Bill Clinton himself;

surplus for fiscal year 2000 amounted to at least $230 billion, making it the largest in U.S.
history and topping last year's record surplus of $122.7 billion.

WHY WOULD A POLITICIAN LIE ABOUT HIS ACHIEVEMENTS?

The reasons are limitless but it could be as simple as why anyone lies on their resumes; to artificially inflate their successes. Either way the point is moot because he categorically lied and to make matters worse, no one in the media challenged it and it was clear from this statement that he was endorsing the Vice President in his bid for the presidency and eveidently so was the media, even way back in 2000.

HOW DID HE LIE?

Stay with me because this is where it gets bold; He did it with Washington doublespeak and half truths. To understand what happened requires you to know what makes up the national debt.

The national debt is made up of public debt and intergovernmental holdings.

The public debt is debt held by the public, normally including things such as treasury bills, savings bonds, and other instruments the public can purchase from the government.

Intergovernmental holdings, on the other hand, is when the government borrows money from itself--mostly borrowing money from social security.

The national debt and the bogus surpluses for the last 4 Clinton fiscal years gives the following table:

While the public debt went down in each of those four years, the intergovernmental holdings went up each year by a far greater amount--and, in turn, the total national debt (which is public debt + intergovernmental holdings) went up. Therein lies the lie.

When Clinton (and others) said that he had paid down the national debt, he was lying. As you can see the national debt went up every single year. What Clinton did do was pay down the public debt--notice that the claimed surplus is relatively close to the decrease in the public debt for those years. But he paid down the public
debt by borrowing far more money in the form of intergovernmental holdings while still running budget deficits year after year!

Most likely it was not even a conscious decision by Clinton to lie or take credit for reduction of the Public Debt because the Social Security Administration is legally required to take all surpluses and buy U.S. Government securities which automatically and immediately become intergovernmental holdings. Because the economy was doing well due to the dot-com bubble and people were earning a lot of money and paying a lot into Social Security more money was coming in than it had to pay in benefits to retired persons, all that extra money was used to buy U.S. Government securities. The government was still running deficits, but since there was so much money coming from excess Social Security contributions there was no need to borrow more money directly from the public. As such, the public debt went down while intergovernmental holdings continued to skyrocket.

The net effect was that the national debt most definitely did not get paid down because we did not have a surplus. The government just covered its deficit by borrowing money from Social Security rather than the public. But do not forget that Social Security will begin cashing in those notes in 2017 in order to fund promises made to baby-boomers and then those intergovernmental-debts are going to come due in a very big way.

Let's Recap;

There was no Surplus - it was all a lie made up to put a nice bow on the administration of the outgoing impeached president whose administration was rife with personal scandal in order to make it appear better than it really was and to encourage you to vote for his Veep for president and that is evidenced in the same statement below;

"Like our Olympic athletes in Sydney, the American people are breaking all kinds of records these days. This is the first year we've balanced the budget without using the Medicare trust fund since Medicare was created in 1965. I think we should follow Al Gore's advice and lock those trust funds away for the future,"

OK so now that we know he lied about the budget where do we go from here? Since then the national debt has skyrocketed, like it or not due to two wars, unprecedented expansion of the federal government in reposnse to 9/11 and stunning government bailouts of Private sector businesses that probably won't post a profit for years as a result. The answer is simple;

A Balance transfer from one credit card to another doesn't equal debt reduction it just means you owe someone different.

Just say no to more entitlement and government bailout.

Cut taxes across the board to stimulate capital investment and put people to work.

And for heavens sake stop claiming that there was a surplus of any type when Clinton left office but it is patently false!

Countrywide Mortgage settled a claim today with the North Carolina Commisioners of Banks without admitting wrongdoing. The claim alledged that the California lender had overcharged mostly First Time Home Buyers who obtained Home Equity Lines and charged fees that were disallowed in North Carolina.
