&lt;p&gt;I've been contacted by the client.&amp;nbsp; The lender had been accepting the mortgage payments, cashing them in and, oh yes.....reporting to the credit bureaus that they hadn't made a payment for nine months and therefore the big box lender began the foreclosure process.&lt;/p&gt;
&lt;p&gt;I've spent &lt;em&gt;&lt;strong&gt;hours upon hours with the client getting disconnected repeatedly&lt;/strong&gt;&lt;/em&gt;.&amp;nbsp; I'm an attorney looking to help my client, but many disconnections....we called again and again and the bank representative gave us their name and number.&amp;nbsp; Each time we'd&amp;nbsp;call back and invariably each extension was invalid, or surprisingly enough, &quot;Crystal doesn't work at this extension.&quot;....can you say....&lt;/p&gt;

&lt;p&gt;I call the president of our company and told him of the fiasco.&amp;nbsp; He found a high up contact in that&amp;nbsp;top three fortune 500 mortgage company to investigate the my client's allegations.&amp;nbsp; What's such an paradox is that they're suing a client for foreclosure&amp;nbsp;claiming that she's failed to make payments.&amp;nbsp; In the mean time she's provided all the statements and cancelled checks to prove that she's never been late with them.&amp;nbsp; As an attorney, I've told her that she has a cause of action against this mortgage company since they they're destroying her credit by reporting he not only as late, but also in foreclosure when the proof is contrary.&amp;nbsp;&lt;/p&gt;

&lt;p&gt;&lt;big&gt;&lt;big&gt;&lt;strong&gt;Are You Friggin Kidding Me!!!!!&amp;nbsp;&lt;/strong&gt;&lt;/big&gt;&lt;/big&gt;That's one caring mortgage company.&amp;nbsp;&lt;/p&gt;

&lt;p&gt;Mortgage Companies are shooting up the list of the top 100 even in a market when big box lenders are collapsing and more are poised to collapse, great companies are rising to the top.&amp;nbsp; Why?&amp;nbsp; Because consumers are begging for someone to care about them.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;It used to be that consumers wanted the lowest rate on the block.&amp;nbsp; Now they want a good rate, a really good rate, but for the biggest financial transaction of their lives, they'll trade a little rate to have qualified people investing in their families.&amp;nbsp; They want a relationship.&amp;nbsp; They don't want crappy service for a lower rate.&amp;nbsp;&lt;/p&gt;

&lt;p&gt;Here is a scenario -- &amp;nbsp;for sellers to avoid. You contact a real estate agent to list your home and the agent suggests that you &lt;strong&gt;might get more for your house than comparable homes on the market.&lt;/strong&gt; The agent assures you that it only takes finding one person who is willing to pay your price!&amp;nbsp; (And in our current market - I don't know where that sort of person is???)&lt;/p&gt;
&lt;p&gt;&lt;br /&gt;Some agents approach a listing appointment as if they are bidding for your home. The unfortunate result is that you start out with an &lt;strong&gt;unrealistic opinion of your home's value.&lt;/strong&gt; There is often a strong temptation to work with a person who says what you want to hear. An experienced, reputable real estate agent will back up their opinion of your home's value with hard &lt;strong&gt;data.&lt;/strong&gt; The agent should give you information about the listing price of homes that are currently on the market, and recent selling prices of similar properties in your immediate area. &lt;br /&gt;&lt;br /&gt;Even the most heroic marketing efforts won't work on a property that is obviously overpriced, (except in the most exaggerated of seller's markets.) &lt;strong&gt;Even if&lt;/strong&gt; you find a buyer who is willing to pay more than your home is worth, the sale could fall apart when the appraisal comes in lower than the agreed-upon price. Listen to everything, but &lt;strong&gt;be careful!&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;By EDWARD GATELY TRIBUNE &lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;The national mortgage delinquency rate rose to a seasonally adjusted 9.24 percent of all loans in the second quarter, while Arizona continued to lead most states in distressed mortgages, according to the Mortgage Bankers Association's National Delinquent Survey. &lt;br /&gt;&lt;br /&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;The national rate was up 12 basis points from the first quarter and 283 basis points from a year ago. &lt;br /&gt;&lt;br /&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;The new rate breaks the record set last quarter. &lt;br /&gt;&lt;br /&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;The rate includes loans that are at least one payment past due, but does not include loans somewhere in the foreclosure process. The percentage of loans in the foreclosure process was 4.30 percent at the end of the second quarter, an increase of 45 basis points from the first quarter and 155 basis points from a year ago. &lt;br /&gt;&lt;br /&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&quot;The states of California, Florida, &lt;strong&gt;Arizona&lt;/strong&gt; and Nevada continue to have a disproportionately high share of foreclosure starts, although the share has fallen slightly from last quarter,&quot; Jay Brinkmann, the association's chief economist, said in a statement. &quot;Those four states had 44 percent of all the nation's new foreclosures during the second quarter of this year, down from 46 percent in the first quarter.&quot; &lt;br /&gt;&lt;br /&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;The percentage of loans 90 or more days past due and loans in foreclosure both set new record highs, breaking records set last quarter. &lt;br /&gt;&lt;br /&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&lt;strong&gt;&amp;nbsp;Sheryl Robinson&lt;/strong&gt;, associate broker at East Valley-based Home Key Realty, said the evidence is everywhere that more homeowners are in financial duress and looking for help. All of her time is spent &lt;strong&gt;helping distressed homeowners avoid foreclosure through short-sales.&lt;/strong&gt; &lt;br /&gt;&lt;br /&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&lt;strong&gt;&quot;There are a lot of good people in bad situations that are facing this and are having to make some tough decisions on what to do to avoid foreclosure, and one of the options they can take is a short-sale,&quot; &lt;/strong&gt;she said. &quot;The lender wants to see that the people have tried to get a loan modification and exhausted that option. The banks want to see that they've attempted to do a short-sale as opposed to a deed-in-lieu (give the property back to the lender).&quot; &lt;br /&gt;&lt;br /&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;In a short-sale, the homeowner sells the mortgaged property for less than the outstanding balance of the loan and turns over the proceeds to the lender(s), usually in full satisfaction of the debt. &lt;br /&gt;&lt;br /&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&quot;A lot of people are calling sooner to say, &amp;lsquo;Look, I think I need to short-sale so I don't have to have a foreclosure,' because a lot of people would rather avoid that at all costs,&quot; Robinson said. &lt;br /&gt;&lt;br /&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;More people are choosing to walk away from homes, and not because they can no longer afford them, said &lt;strong&gt;Tara Bianco&lt;/strong&gt;, senior loan officer at AmeriFirst Financial in Mesa. &lt;br /&gt;&lt;br /&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&quot;There's individuals in neighborhoods who are looking around and they're $125,000 upside down and they're trying to make that decision of &amp;lsquo;Why am I going to continue to make payments on a house that I'm so far upside down in? My neighbors have been able to renegotiate their mortgage or have allowed their home to go into delinquency in hopes of a modification of some sort,'&quot; she said. &lt;br /&gt;&lt;br /&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;Homeowners who bought their homes in 2003-04 in the outlying areas of the East Valley are significantly upside down, and they're calling to find out what the adverse effects are if they choose to walk away, Bianco said. &lt;br /&gt;&lt;br /&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&quot;There's still a lot of people trying to figure out if there's an opportunity to leverage the market if they are upside down in their home,&quot; she said. &quot;Can they afford to buy another home and hopefully make some money on that house to offset the loss they're going to suffer on the house they're in,&quot; she said. &lt;br /&gt;&lt;br /&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&quot;But it's becoming increasingly difficult to do that. &lt;p&gt;Some believe pricing alone will sell a home when listed as a short sale, and this is the foundation of their marketing plan.&amp;nbsp; Many times it's the only thing done and nothing can be further from the truth.&amp;nbsp; I believe in advertising a home all the &amp;lsquo;usual&amp;rsquo; steps need to be followed in selling a home regardless of what type of listing it is.&amp;nbsp; I believe a home should be marketed to the widest possible pool of buyers. &lt;strong&gt;When I list a home as a short sale &amp;ndash; I focus on the home, not the fact that it is a short sale.&lt;/strong&gt;&amp;nbsp; I will ask homeowners to do what they can to make the home &amp;lsquo;sparkle&amp;rsquo; and take as many pictures as possible with my wide angle lens camera.&amp;nbsp; A virtual tour will be created to show case the home.&amp;nbsp; The property will be &quot;showcased&quot; on Realtor.com as well as all the major websites including the direct email marketing plan I run.&amp;nbsp; The home will be featured on my website along with other agent websites - that I have &amp;lsquo;handshake&amp;rsquo; agreements with to feature my listings. I pay particular attention to providing the best remarks about the home in the Multiple Listing Service. I will state the home is a short sale in the area prescribed per the Multiple Listing Service rules and regulations; however I refuse to make that the only aspect of my description of the home.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Too many times I see the verbiage &amp;lsquo;short sale opportunity or &amp;lsquo;take advantage of this short sale.&amp;nbsp; I feel that is doing an injustice to the home.&amp;nbsp; I believe the price should be reasonable and the home deserves the same type of treatment as any other listing, after all the bank will be looking for the most amount of money possible and if the home is presented in a &quot;good light&quot; then it will attract more buyers to it who see value in the place.&lt;/p&gt;
&lt;p&gt;Once the paperwork is all together for the short sale &amp;ndash; my clients home will be put in to my marketing machine which is to get the news of their home to potential buyers.&amp;nbsp; Because when it is all said and done we need the buyers purchase offer so I can begin dealing with the banks to work towards getting an answer on the short sale approval of their house. Yes we can and will lower the price of the home to procure a contract in a &quot;reasonable amount of time&quot; if required and get the process started with the bank, however with the correct marketing and presentation of the home we may not have to wind list price back to far in order to find a buyer.&lt;br /&gt;&lt;/p&gt;</description>

      <description>&lt;p&gt;I have now seen this twice and I have a sinking feeling I will see this more...Banks charging the homeowner for the BPO and or appraisals being preformed when homeowner is short selling their house.&amp;nbsp; The latest I have seen comes from First Bank of Tennesse advising the homeowner that thier account will be charged fro any necessary current valuations to a maximum of $750 dollars --- has anyone heard of a case where a homeowner has been able to dispute this successfully and not be charged or be reimbursed? Curious of other people's experience on this...&lt;/p&gt;</description>

&lt;p&gt;There is a process with short sales and I have a system that I follow with all my short sale clients.&amp;nbsp; I provide my sellers with step by step detail of what can and does sometimes transpire throughout the process. As an experienced agent working in the short sale arena I can share with my client what most lenders require from the homeowner, what sort of documentation they will expect a homeowner to provide. It is also important to share with my clients that many times there may be extraordinary and frustrating circumstances related to working with the lender on short sale.&amp;nbsp; They can expect to continue to receive calls from the lender as we move forward in the process, even after the lenders have received the short sale package and it has been assigned.&amp;nbsp; I then create a web page for each person I help so they can see status updates on my progress with the lender at any time as we move towards an answer from the lender.&amp;nbsp;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;The &quot;short sale package&quot; that is submitted to the bank is extremely important.&lt;/strong&gt;&amp;nbsp; This must be professional and organized in a way that makes sense to the lender and person the file is assigned within the short sale department of banks.&amp;nbsp; When I sit down with my clients on that first meeting &amp;ndash; we usually spend at least 1 to 2 hours together to ensure I have a clear understanding of their situation, because each one is unique and different.&amp;nbsp; It is my goal that my clients know that I am here for them throughout the whole process and I will make every diligent effort to obtain a short sale approval from the lender on their behalf.
