Do you accept "gifts" from anyone you share business with? Does an insurance agent or mortgage broker or realtor send you a gift card for each referral? Does a mortgage lender/broker pay for your advertising? Do you have a mortgage lender or an insurance agent or a title company (or anyone you share referrals with) renting space from you for greater than the market rent? Do you provide a "referral fee" to anyone who provides business to you?

If you responded "YES" to any of these questions, you may very well be guilty of RESPA (Real Estate Settlement Procedures Act) violations in this industry.

If you find yourself with a home that's currently on the market, or you're just about to take the plunge and face the property market head on, then it's quite possible that you've at least considered have a good clean out and cutting down on some of your ‘stuff'.

Oh, you won't hear any argument from me; tips on decluttering your home are a dime a dozen. Usually the information is fairly standard. Cleaning, deciding where to start, what to keep, what to throw out, give away, what to put it in and then where to put. You get the picture - don't you? If not here's an article on that side of things you might like.

That's ok. Stick with them; I dare say you'll need them sooner or later. I'm hoping to get you to think about this process from a different angle than you're perhaps used to. We aren't going to be talking about the nuts and bolts (trust me, you'll need a container for those), so much here, but the in's and out's. We'll be talking quite a bit about the relationship you have with your clutter.

I won't promise you that it's going to be pretty; I will promise you that it's going to be completely necessary. Ready?

First things first.

1. Define your clutter (aka clutter physiology)

Clutter means different things to different people. To a real estate buyer, the term generally refers to the years of accumulated ‘odds and ends' that home owners tend to have around them. You can bet that these things are of little use to anyone but the owners themselves. For example; clothing that doesn't fit, collectables of any kind (yes, of any kind), books, magazines, toys, videos, DVD's, craft ‘bits', old birthday cards, presents you have no use for, 100's of photos, old baby clothes, old shoes, tools and so the list goes on and on. Yet, far too many sellers insist on hanging on to this stuff at sale time. The end result is house hunters feel claustrophobic and stressed.

2. What's with the clutter? (aka clutter psychology #1)

Ever wondered why you're hanging on to the things you hang on to? For most people there's some kind of emotional connection. Guilt, perhaps some whimsy. The very thought of throwing something away causes you anxiety as you imagine part of yourself being lost with that 'special' piece. For those things that are very special to you, consider starting up a scrapbook, journal or keepsake box. For things like cards an letters you can paste those straignt into your scrapbook and make a few notes about that time. For things like a favourite sweater, or baby outfit, grab your camera and take a photo, then add your photo to your scrapbook. Again, write a few lines to help you and others to remember that time. For those things you've collected because you think you'll have a use for down the track, ask yourself how long you've had it. If it's more than 2 -3 months it's time to get rid of it.

3. When to Declutter? (aka clutter psychology #2)

We're talking about the ‘P' word - procrastination. Putting off today what should be done tomorrow. Only tomorrow never comes. It's all because you feel overwhelmed. This is where planning comes into it. Break it down into smaller chunks (see our next tip), and then get some help from family or a friend.

4. What will be yours and your buyer's needs?

Think about the rooms you have and your immediate needs while your house is on the market, and what buyers want to see'. Let's take the kitchen as an example. You'll of course need food on hand, and some food preparation and cooking equipment, along with some serving ware. Buyers of an occupied home expect to see these things in a kitchen, and they like to know how they fit into the space. This leaves things like out of date food, 15 different pots and serving dishes, 4 dinner sets, umpteen drinking glasses, personal papers and anything else rarely uses to be packed away until you move, thrown away or donated. Take this similar ‘what are my immediate needs & what do buyers want to see' approach to the other rooms in your house.

5. The time factor - tear through like a hurricane or flow like a gentle breeze?

If you intend to sell, then you may have to prepare yourself for the most frenzied de-cluttering weekend you've ever had. It can feel a bit like a hurricane in that sense; really intense, but thankfully short. Just remember your plan and get all the help you can possibly muster. If you're the procrastinating type, then the ‘gentle breeze' approach may be the best and least painful way to go. Go room by room or even drawer by drawer if it helps. Take your camera with you as you go and try to make the most of it. And put a time limit on the process. Reward yourself at the end, with some scrapbook time.

Your master bedroom is supposed to be a sanctuary, a place to retreat after a stressful day of work. A master bedroom's design cannot be all flair, we also need to consider the room's function. This is a room that can be more personal than most, when it comes to design. Before you start any design process it is important to measure the space carefully and to document the doorways, windows, closets, baseboard heaters, and any other items that could impact your design. The budget is also important, as it will influence all the steps below...

Here are the basis steps to design a master bedroom (or any bedroom):

When starting to design your master bedroom, the easiest place to start is the bed. The bed, after all, will be the focal point of the room. There are many options of headboards and beds that you can choose from ~ a four post bed, a sleigh bed, upholstery headboards, to a simple iron headboard. Here again, your unique tastes and style will come into play.

Next, the selection of luxurious linens occurs. This is a logical step after you select which bed to place in your bedroom. The linen you select can be a design inspiration for the remainder of your bedroom. Decorative pillows are the logical next step after the linens are decided upon. A master bedroom will have a minimum of four pillows and several layers of decorative pillows in similar colors.

Decide on a quality bedroom set that has a classic look. Please remember that you will probably use this set for the next ten years, so verify that the dresser drawers are made of real wood and will stand the test of time. The color of the furniture should be a neutral wood, nothing outlandish that will be out of style by next season.

To keep a consistant color scheme in your master bedroom, your windows need to either have a blind that matches the bedroom furniture or a soft drapery that matches the lines and decorative pillows. (Remember to order your drapes or roman shades with blackout liners, so you can sleep past 5:00 AM.) If you go with a wooden blind, you may want to add the two inch fabric swatch on the blinds in a coordinating color to the linens.

The actual design setup:

The master bedroom setup that looks fantastic is when there is a nightstand on each side of the bed with a matching light on each side. There also needs to be some greenery brought in.

To create a warm feelingin your master bedroom, please decorate with beiges, warm browns, and terracottas.

To create a cool feelingin your master bedroom, please decorate with pale colors such as light blue and lavender.

If you want to create a focal wall, choose the wall behind the bed. The focal wall can be painted a different paint color, fabric, or wallpaper can be used for an even more dramatic look.

Remember to keep your accessories to a minimum as the master bedroom is a place of rest and relaxation. Once the furniture has been setup with the appropriate linens, you should have no trouble selecting the finishing touches such as artwork, candle sticks for romance, and perhaps a rug to keep your feet warm.

"Twitter's of no value to REALTORS®". Really? Try this.

It sounds like an odd thing to say, but in a way, Twitter is a lot like real estate itself in two ways:

Many will try; fewer will "succeed" (and will give up prematurely).

The relative few are lowering the reputation of both.

The fact that most agents and offices do not use twitter as productively as they should does not therefore imply that it is a waste of time! Such logic would lead us to believe that practicing real estate in the first place is of no professional value.

I am willing to bet that the rabble-rousing Twitter malcontents, and even those who understandably see no value in Twitter, have not seen it used in the way I am about to demonstrate. I have written about this before, but it didn't get much traction apparently, and I feel that few took note. Keep in mind that this is one of the easier ways to show just one way that Twitter can aide in effective REALTOR® marketing, but it is by no means the only way. I'll also add that I received the following results on my first try yesterday.

Tis The Season for Giving - Feed It Forward

One of our ActiveRain members just sent me a $10.00 gift certificate to go to any restaurant of my choice in my area. What a nice gesture and what an impression it just made on me. It's not the gift so much as it was the thought that really did count. Now the fact that the gift was for food REALLY counted because I LOVE FOOD!!

It will "Make A Difference" in someones life, maybe yours!

This all reminds me of the time when I paid a $3.00 Bridge Toll for the car driving behind me (a complete stranger) then she ended up paying for the car behind her since she already had her money out, then they paid for the car behind them and so on and so on. This went on for about 10-15 cars before someone finally broke the chain and put their money back in their pocket, said thank you, and then drove on.

The very next day, as I drove through the toll booth again, the toll booth attendant looked at me and shouted, "Have you any idea what you caused yesterday?" For a second, I was shocked, I thought I was in trouble or something.. I had forgotten about paying for the car behind me the day before, and that's when he told me the story about all the people paying each others Bridge Tolls behind me. He said, "You really made an impression on me yesterday, it's something that will live in my heart forever!" Nothing feels better than that folks! Nothing!

It feels good to give! Give to family. Give to friends. Give to neighbors. Give to anyone who has touched your life, but most of all, just give! Who knows, you might be the next one getting an email "meal" from me!?!

"Bad Day" I just love this song. I am looking forward to seeing the new Chipmunk movie. I have such fond childhood memories of the song. I was thrilled when they made the first movie so my grandchildren could enjoy the chipmunks too. This song is a one song hit of the decade. That is neat I think. It is winter and am homebound since breaking my elbow and arm. It has been a reflective time but mostly an hourly therapy time, OT that is. There have been some positives: My husband is cooking, doing laundry, chauffering me around to show properties and to open houses, and holding my arm while he helps me out of the car. I don't mean to say that he is not a gentleman but he doesn't normally help me out of the car. So that part is fun. Family, friends and co-workers, church friends have brought us such wonderful food and visits and cards. I am usually more fast paced at this time of year but it is ok. I am making the best of it but unable to use my hand to type until this week so has been a blessing too. I don't know what all this has to do with the song but that day when I fell and broke all this stuff it was a bad day but everyone was so good to me that day from the EMT's, the emergency room nurses, the doctor, the operating and recovery room staff, my nurses and LPN"s were simply super. I was taken to the Faulkner Hospital in Jamaica Plain, Massachusetts. I am so impressed with my care. It was phenomenal. I would shout that from the roof tops. The OT has been great there too. So I must say "I Had A Bad Day" but it has turned out OK these past 3 weeks. I am blessed and not stressed.

I Need Help with a Zoom Lens

I don't have a lot of time to research what type of lens to buy for my camera. I have a Cannon Digital SLR. Unfortunately, it is at the office and I don't know which version. (I bought it last year)I had an offer from a pilot to take me up in a small plane to take pictures of the shoreline of Calvert Cliffs and surrounding shorelines. We are trying to document shoreline erosion? If any of you ActiveRain experts can offer advice, I would greatly appreciate you expertise and knowledge. I'm guessing that you may need to know exactly which camera I have? I can let you know tomorrow morning!! Thank You!

Beware ~ The Hottest Childrens Toy Could be Harmful

Zhu Zhu pets may pose a health risk

I thought I woudl pass this on to all those parents and adults on the hunt for the popular Zhu Zhu pet!

BUFFALO, N.Y. (WIVB) - This story is causing a firestorm around the nation. Could one of the hottest holiday gifts put your child's health in jeopardy? One consumer advocacy group thinks so and now many parents are in a rush to get them out from under the tree. It's easily considered one of the hottest toys this holiday season. The Zhu Zhu pet is popular to say the least and stores can't keep them on the shelves.

Ben Gregory, Target Store Manager, said, "As soon as they come in, we have a significant demand for them and they sell right out."

Shari Donaldson was one of the lucky ones, getting a Zhu Zhu pet early for her granddaughter for Christmas. She even wrapped it already, but now Donaldson said, "I'm gonna take it back tomorrow."

That's after the consumer advocacy group "GoodGuide" says that the Mr. Squiggles hamster contains high levels of a chemical called "antimony." "Which is a metal which has potential health hazards attached to it which if ingested in high enough levels can lead to cancer, reproductive health and other human health hazards," said Dara O'Rouke of GoodGuide.com

The groups findings show that the federal limit for the chemical is 60 parts per million. The fur on the hamster had 93 and the nose had 103 parts per million, according to GoodGuide.

Target store manager Ben Gregory says he hasn't been told to pull them from the shelves. After all, there is no official recall of the toys.

"Usually the manufacturer notifying anyone that retails their product or a government agency tells us to do that," said Gregory. "I didn't want to take a chance. It wasn't that important to me that they had these toys that would be a determent to them," said Helmin.

Cepia, the company that manufactures the toys based in Missouri, insists that the Mr. Squiggles pet has been tested numerously and is compliant with all U.S. standards.

The holidays are here and spreading cheer and a helping hand are more plentiful during the month of December. How about giving back to the environment? Here are a few ways to preserve the Chesapeake Bay during all the festivities and get togethers.

Give the Gift of Trees. If you live in Maryland, help the Maryland Department of Natural Resources (DNR) reach its goal of having 50,000 native trees plantedaround the state by giving a tree in the name of a loved one. You can order the trees online or through the mail. The recipient will get a certificate notifying them of your gift. Trees are $40 each. If you give 10 trees, you can decide where you would like the grove to be planted. DNR has already registered more than 20,000 trees this year, which will help to reduce erosion and prevent pollution throughout the state.

Spread the word Sometimes the best gift you can give someone is knowledge. During the holidays and all throughout the year, inform your friends and family about the issues facing the Chesapeake Bay and the ways they can help it. You don't have to get up on a soapbox and lobby for the cause, but if you can give a party host or hostess a suggestion about how to make their occasion a little more eco-friendly, go for it!

Buy yourself an energy-efficient gift If you've been holding out on purchasing a new washer or dryer, now might be the time to do it. If you invest in an energy-efficient appliance this time of year, you'll not only find some great sale prices, but you'll also save money in the future. Energy Star-rated appliances can save you significant amounts of money on monthly electric and water bills, and you may be eligible for a tax credit. So go ahead and buy yourself that dream appliance! By conserving energy and water, you'll save quite a bit of green by going green.

Wrap your presents the green way Think about how much wrapping paper, tissue paper and cardboard goes to waste each year around the holidays. After the presents are ripped open, most of the paper goes in the trash. This year, consider traveling down a greener path. Use slow-release fertilizer and spot treat problems on an as-needed basis rather than as a preventive measure. Or, make sure your lawn service doesn't use excessive fertilizer or pesticides.

Take One Step at a Time
Walk, bike, carpool or take the bus to work when you can. Auto emissions increase air and water pollution, plus you'll save money and minimize stress.

Preserve Backyard Habitat
You can protect or create a little bit of backyard habitat without living in a jungle or ripping up your entire lawn.

Christmas cards and other holiday greetings Holiday Mail for Heroes program.

I'm up early to being putting together my Christmas card list. This year I plan to add more than new clients and friends.

After receiving several emails from friends encouraging me to send a Christmas greeting to "A Recovering American Soldier" at the Walter Reed Medical Center, I decided that would be one small way to thank those who've sacrificed so much.

Well, after a little research I found that the post office will not accept anything addressed to "Any Service Member" or "A Recovering American Soldier". If it does make it through the USPS, it will not be accepted by Walter Reed.

But, for the third year, the American Red Cross and Pitney Bowes continue the Holiday Mail for Heroes program. Christmas cards and other holiday greetings will be accepted until December 7, 2009, so get them in the mail now.

Cards must use the following address:

Every card received will be screened for hazardous materials by Pitney Bowes and distributed to participating Red Cross Chapters nationwide.
When the Red Cross Chapters receive the cards, they're reviewed, sorted and distributed to service members, their families and veterans. There are some guidelines.

The Red Cross asks that you sign your card and direct it to a Service Member, family or veteran. You can bundle groups of cards in single large envelopes (individual cards in the envelope do not need postage), however limit the number of cards to 15 per person or 50 for a business group or school class.

You can not include a letter, your own personal information or inserts of any kind. You can write on the card your own special message. The Red Cross also asks that glitter not be used because it can aggravate the health issues of wounded recipients.

Pull out those cards, and drop a few in the mail, thank a hero and their family for their sacrifices!

If you can't get your cards out in time, contact your local Red Cross, your church (Temple, Mosque or Ashram) and see if they have a program or some members that might want to hear from you.

Calvert County News - "You Are Beautiful" Volunteers

I read this today and thougth I would share it. Some people are simply beautiful and here is JoAnn Adams, Calvert County Md. We can all take bits and pieces from this and maybe apply it to our own lives and give a helping hand. So many people and pets need help these days. Instead of having that Christmas party, lunch or dinner, take the time or money and donate or volunteer to what ever is dear to your heart!

Volunteer of the Year

JoAnn Adams has made Calvert County her home since 1965 when her family moved to Chesapeake Beach. This is also the area where JoAnn began her career as a volunteer. In 1967, she and her husband started the Twin Beach Youth Group.

Shortly after, with the assistance of Stallings-Williams Post 206 American Legion sponsorship, JoAnn established the Legionettes Majorettes & Drum Corps. She was the backbone of this organization for its entire 25 years. She gave hundreds of youth opportunities that they may have never had. She made sure if a child wanted to be a part of this family, whether they had black shoes or not, there would always be a spot in the performance for him/her. Although the organization discontinued, the memories and friendships continue forever.

In the '80s, JoAnn completed training at the Abused Person Program. She volunteered as an advocate for APP and would accompany clients to court and respond to calls for an advocate in the middle of the night. She volunteered as an advocate for about five years.

In 1997, JoAnn began working with the ARC and became very attached to the people she served. She often would have planned parties and take trips, a lot of which were at her own expense. While working with ARC, she began visiting the "On Our Own" Drop-In Center.

After some time, JoAnn was asked to be on the board as a volunteer. During this time, she planned parties, trips, picnics, and other special events. Like the other periods of volunteering, JoAnn's main objective was to make sure she provided others with as many opportunities as possible.

Jo, as some call her, has been president of the board for the last two years. Since she has taken this position, she has provided many others with opportunities and experiences with events such as the Annual Luau. About 150-200 clients and staff of ARC and On Our Own enjoy an evening of good food, Hawaiian atmosphere, music and door prizes.

Two years ago, the attendees also enjoyed a surprise appearance by "Elvis." Much of the event is provided by donations such as food, prizes and especially time. Many of Jo's lifelong volunteer friends help with the cooking, decorating, serving and cleanup.

On a daily basis, Jo has does much for the On Our Own clients such as taking them to workshops, trips to Ocean City, camping, picnics, movies, into the community. She also schedules speakers to talk to them about issues of health, safety and their feelings.

In addition to the On Our Own family, Jo tries to stay active in the American Original Fife and Drum Corps. She has marched with them since 1991, but due to health and injuries her appearances have become limited. The group performs in Washington, Maryland and Virginia. They also travel and perform across the United States and even out of the country. During this time, she has provided many communities with opportunities and experiences while doing what she loves.

RUM & EGGNOG MUSSELS - YUM

Via Susan Emo in Kingston/Brockville/Gananoque ( RE/MAX Riverview Realty Ltd - Brokerage 1000 Islands Canada):

RUM & EGGNOG MUSSELS

5 lb mussels - wash and remove the beard*
½ onion diced
½ cinnamon stick

2 ounces rum, dark or white
½ Litre eggnog
½ Litre 35% whipping cream
salt and pepper

* the hairy bit found between the two shells. Use a dry kitchen towel to grab the beard and pull.

Place a pot large enough to hold the mussels on medium heat on the stove. (If you do not have a pot large enough this can be done in separate batches, just make sure you divide the remaining ingredients as well). Wait until the pot is hot, and then add the oil, then the onions and cinnamon stick. Stir and quickly add the mussels. Remove from heat and add the rum, then the eggnog and cream. Return to the stove at medium-high heat and cover. After four minutes give the mussels a quick stir and leave uncovered until all the shells have opened. Remove mussels with a slotted spoon and let the liquid simmer to concentrate. Season the sauce with salt and pepper and pour the finished sauce over the mussels. Serve with crusty bread.

- Whether your tree is live or ornamental, both kinds of needles are sharp and indigestible.

- Keep the tree in a room that can be blocked off or have a barrier so the pets cannot get to the tree..

-Tinsel is dangerous -- so if used, keep it up high. It may obstruct circulation and, if swallowed, block the intestines.

- Chocolate and alcohol are toxic for pets. Keep eggnog, sweet treats and other seasonal goodies out of reach.

     Holly, mistletoe and poinsettia plants are pet poisons! Keep them out of reach!

     Inspect all holiday gifts for dogs or cats to ensure they are safe and not toxic. Items such as vinyl, plastic and small rawhide sticks may be dangerous.

     Keep lights away from lower tree branches. They may get very hot and burn dogs, cats (or toddlers)

     Be careful with electic cords. Pets may chew them -- or they can get shocked or electrocuted.

WINTER CONCERNS

WINTER COLD CAN BE HARMFUL TO YOUR PETS                                         Carley

Never leave your pet outside in the cold for long periods of time. Wind-chill makes the air colder than actual temperature readings.

Check on your pet's body temperature and limit time outdoors.

Provide adequate shelter. Keep your dog or cat warm, dry and away from drafts.

If you gave an outdoor kennel... place blankets and pads on floors and/or in a plastic swimming pool for shelter and warmth.

Be Careful walking or playing with your dog near frozen lakes, ponds or rivers. Your dog could slip or jump in and get seriously injured (so could you).

Groom your pet regularly. A well-groomed coat keeps your pet insulated. Short and/or coarse haired dogs and short haired cats may get extra cold so consider a sweater or coat.

Long-haired dogs should have their nails clipped to ease snow removal and the cleaning of feet. Musher's wax is one product that safely and effectively coats the dogs pads, protecting them from ice, cold and cracking.

Blow-dry or towel dry your pet if the pet gets wet from rain or snow. It is important to dry and clean their paws.

Don't leave your dog or cat alone in a car. It gets too cold and carbon monoxide from an engine left running is dangerous.

Careful with rock salt; it may irritate footpads. Be sure to rinse and dry your pet's feet after a walk.

Provide plenty of water. Your dog or cat is just as likely to get dehydrated in the winter as in the summer.   Remember snow is not a satisfactory substitute for water.

Frostbite is a winter hazard. To prevent frostbite on ears, tail and feet, don't leave your dog or cat outdoors for too long.

Be very careful of supplemental heat sources. Fireplaces and portable heaters can severely burn your pet. Keep portable heaters out of reach and make sure screens are in front of the fireplace.

WINTER EXERCISE - STRESS REDUCTION

The stressful holiday season is NOT the best time to start training your pet.

Puppies, dogs, kittens and cats get stressed during the holidays. Allow them time-outs if you cannot supervise interactions between visitors and your pet.

Pets need to be exercised regularly for optimum health and well-being.

Just like humans, dogs need to be "conditioned" for specific sports or winter exercise. Be sure to have your pet do a warmup.



Different breeds are better coated for harsh winter weather. Short coated breeds, need protection!

If you have an energetic pet but it is too cold to be outside, consider a healthy outlet like indoor dog sports/agility - or indoor play with your cat.

To alleviate winter boredom around the home, create games that simulate outdoor activity. What does your dog or cat enjoy doing: digging, chewing, chasing things down? Hide a biscuit or favorite toy or find a local indoor agility facility.

Active Rain Gathering on 12/11 in Southern Maryland...Woo Hoo!!

Hi Southern Maryland Realtor's and affiliates! (ActiveRain) I introduced Cheryl to ActiveRain and Cheryl has taken it to the next level. So, I hope to see you all! It will be a great meeting and experience! See You!

Last year I went to my first Active Rain Gathering that was held in Annapolis. What fun!! I got to meet..in person.. Jeff Bolonger, Margaret Rome, Peg Silloway, Pat Kennedy, Audrey-June Forshey, John McArthur and Lewis Portez before I had to leave for family obligations. It was absolutely awesome to see and talk to these bloggers I had been following here on the Rain.

So why Southern Maryland this time around?? Well, a few weeks ago I met via email an Active Rainer from Southern Maryland, Cheryl Ritchie, quite by accident. The next thing I knew we were on the phone chatting away. Well since then we have chatted many times and this week she told me about an Active Rainer who is coming up from Miami to spend time with her family in Northern Virginia for the holidays. This is not just any Active Rainer but one of our Ambassadors of Active Rain and she and Cheryl had made plans to get together and meet at Stoney's Restaurant. Oh my, this is a perfect Active Rain Gathering opportunity I said so.... Woo Hoo!!

Now if you have not followed Janie Coffey you will now. I hadn't until Cheryl introduced me to her and like all Ambassadors in the Rain she is wonderful so what a delight it is going to be to meet her in person on the 11th.

The party starts at 11am on Friday December 11th. Stoney's Prince Frederick location is where we are meeting. Cheryl has reserved the fireplace room, perfect for a December day in Maryland. It's going to be baby crabcakes for the eats (Stoney's are famous for them) and we will be putting cash in the pot to divvy up the bill.

So now I not only get to meet Cheryl for the first time but I get to meet a Miami blogger and Ambassador too. Woo Hoo Hoo!!.

There's nothing better than meeting up with fellow bloggers in the Rain so I sure hope you can make it. If you can, just let Cheryl or me know so we can let Stoney's have an idea of how many Active Rainers will be whooping it up in the Fireside Room.
