First Time Home Buyers Tax Credit Expanded to Current Homeowners through 2010

Tax Credit up to $8000 available through 2010 for Home Buyers

As part of its plan to stimulate the U.S. housing market and address the economic challenges facing our nation, Congress has passed new legislation that:

Extends the First-Time Home Buyer Tax Credit of up to $8,000 to first-time home buyers until April 30, 2010.
Expands the credit to grant a $6,500 credit to current home owners purchasing a new or existing home between the date the bill is signed by President Obama and April 30, 2010.

Who Qualifies for the Extended Credit?

First-time home buyers who purchase homes between the date the bill is signed by President Obama and April 30, 2010.
Current home owners purchasing a home between the date the bill is signed by President Obama and April 30, 2010, who have used the home being sold or vacated as a principal residence for five consecutive years within the last eight.

To qualify as a "first-time home buyer" the purchaser or his/her spouse may not have owned a residence during the three years prior to the purchase.

Which Properties Are Eligible?

The Extended Home Buyer Tax Credit may be applied to primary residences, including: single-family homes, condos, townhomes, and co-ops.

How Much Is Available?

The maximum allowable credit for first-time home buyers is $8,000.

The maximum credit allowed for current homeowners is $6,500.

How is a Buyer's Credit Amount Determined?

Each home buyer's tax credit is determined by tow additional factors:

The price of the home.
The buyer's income.

Price

Under the Extended Home Buyer Tax Credit, credit may only be awarded on homes purchased for $800,000 or less.

Buyer Income

Under the Extended Home Buyer Tax Credit which is effective on the date the bill is signed by President Obama single buyers with incomes up to $125,000 and married couples with incomes up to $225,000-may receive the maximum tax credit.

These income limits have changed from the 2009 First-Time Home Buyer Tax Credit limits. If you or your client purchased a home between January 1, 2009 and the date the bill is signed by President Obama, please see 2009 First-Time Home Buyer Tax Credit.

If the Buyer(s)' Income Exceeds These Limits, Can He/She Still Get a Credit?

Yes, some buyers may still be eligible for the credit.

The credit decreases for buyers who earn between $125,000 and $145,000 for single buyers and between $225,000 and $245,000 for home buyers filing jointly. The amount of the tax credit decreases as his/her income approaches the maximum limit. Home buyers earning more than the maximum qualifying income-over $145,000 for singles and over $245,000 for couples are not eligible for the credit.

Can a Buyer Still Qualify If He/She Closes After April 30, 2010?

Under the Extended Home Buyer Tax Credit, as long as a written binding contract to purchase is in effect on April 30, 2010, the purchaser will have until July 1, 2010 to close.

Will the Tax Credit Need to Be Repaid?

No. The buyer does not need to repay the tax credit, if he/she occupies the home for three years or more. However, if the property is sold during this three-year period, the full amount credit will be recouped on the sale.

Influx of country club members prompts push for new buyers at subdivision Sunday, September 27, 2009 By KATHY JUMPER Real Estate Editor

Local Realtors are hoping some of the 125 new members of Steelwood Country Club will want to buy a home in the gated residential community on 1,400 acres in Loxley, and are holding a mass open house today from 1 to

4 p.m.

"Having new members should get us new buyers," said Scott Smith, golf pro at Steelwood's Jerry Pate-

designed golf course and owner of Landmark Real Estate.

Last July, Richard and Carol Miller, the developers of Steelwood near the Loxley exit off Interstate 10, sold their ownership in Steelwood Country Club to 40 original club members.

A membership campaign followed. By the time the push ends, there should be an estimated 350 club members, according to Smith.

The club amenities include the golf course, a 200-acre lake, a fish camp, boating, tennis courts, clubhouse dining, swimming pools, a fitness center and land for hunting.

"The neat thing about the development is the diversity in that there are 750-square-foot cabins to 5,000-square-foot homes and everything in between," Smith said. "A lot of owners started small with a cabin and wanted to see how much they would use the amenities, and now they have moved up to larger homes."

In the past, it was tough for agents to get in the secluded Steelwood subdivision to show houses, according to Barbara Sims of Dauphin Realty West. She and her colleagues organized today's open house after learning about the number of new club members. "New blood brings more activity," she said.

The homes open for tours range from $335,000 to $985,000 and include Prickett Properties, Landmark Real Estate, Dauphin Realty and Roberts Brothers.

There are 130 homes in Steelwood and about 50 lots available for sale at prices from $67,000 to $365,000.

The new board put together a membership program that was economically feasible even in the current economy, Scott said.

The full initiation fee is $15,000, with annual dues of $1,400 to $4,410, depending on the range of services, according to the Steelwood Web site.

Developer says having portion off market makes 45 remaining condos easier to sell

The owners of 90 units at the 24-story Turquoise Place in Orange Beach have furnished and are now renting the brand-new units, according to Rich Richardson of Spectrum Capital, based in Jackson, Miss.

Spectrum paid about $45 million for 90 of the 181 Gulf-front units, according to court records.

Spectrum is the real estate arm of Yates Cos., the contractor that built Turquoise Place on Ala. 182 in partnership with developer Larry Wireman of Orange Beach, Richardson said

About 46 units have been sold and the owners have moved in, Wireman said. The 90 are in rentals, and the remaining 45 units start at $1.2 million, according to Wireman, who also developed Caribe Resort in Orange Beach.

In 2005, the units presold for an average $1.5 million, with the 6,000-square-foot penthouses averaging $5 million.

Offering the 90 units for rent "is a good thing," Wireman said last week. "They are off the sales market. It makes the rest of the units a lot better. We're not sitting there with 100 units to sell."

"The condo market is changing, and we have to adjust with the times," Richardson said. "You are definitely not going to find ones to rent like this that are brand-new with Sub-Zero refrigerators, high-end appliances and hot tubs. The smallest unit is a three bedroom with 2,300 square feet and private balconies."

"The market is going to be back. This is a way for people to buy some time and go ahead and furnish it for people to enjoy and use," said Chuck Norwood of REMAX of Gulf Shores. "It makes good sense. The rentals will offset some of the expenses."

However, Norwood added, "It doesn't make sense to buy a unit there as a rental."

The units will be operated by Spectrum's resort management division, Spectrum Vacations, which has an on-site rental management team.

The rental prices are competitive for the area rental market, with a three-bedroom, 3cm HALF-bath unit leasing for $290 per night, according to Richardson.

The lushly landscaped tower's amenities include an indoor pool, outdoor pool, a lazy river on the fourth floor, steam room, sauna, 3,000-square-foot gym and high-speed glass-and-tile elevators. Views from the tower stretch from Pensacola Beach to The Beach Club on Fort Morgan.

Obama foreclosure fix open for business

Federal officials release details of $75 billion loan modification and refinancing programs. Borrowers can start contacting loan servicers.

NEW YORK (CNNMoney.com) -- The Obama administration's foreclosure prevention program is open for business.

The multipronged fix calls for companies to help as many 4 million struggling borrowers by modifying loans so monthly housing payments are no more than 31% of monthly gross income. Separately, homeowners who haven't missed a payment can refinance into lower-cost loans even if they have little or no equity. This is expected to help up to 5 million homeowners.

The $75 billion loan modification plan will provide incentives to borrowers and loan servicers and investors to spur mortgage modifications. The government will also subsidize interest rate reductions to get borrowers to affordable monthly payments.

"This plan will help make home ownership more affordable for nine million American families and in doing so, help to stop the damaging impact that declining home prices have on all Americans," said Housing Secretary Shaun Donovan.

Borrowers can now contact their servicers to see whether they are eligible for assistance. Federal officials will promote the program at homeownership events nationwide.

The administration Wednesday released additional eligibility criteria and program guidelines.

The loan modification plan focuses on people who are behind in their payments or are at risk of default.

Federal officials clarified the definition of "at risk" as those: suffering serious hardships, declines in income or increase in expenses; facing an interest rate hike; having high mortgage debt compared to income; owing more than their house is worth, or demonstrating other reasons for being close to default.

To participate in the loan modification plan, borrowers must:

have obtained their mortgage before Jan. 1, 2009;
have a primary mortgage of less than $729,500;
live in the property;
fully document their income by providing tax returns and pay stubs;
sign a statement of financial hardship; and
go for counseling if their total household debt - including auto loans, credit cards and alimony - totals more than 55% of their income.

The modification program will be in effect until the end of 2012, but loans can only be adjusted once.

Officials also unveiled more details on how servicers will modify the loans. First, they must reduce interest rates so that borrowers' total house payments are not more than 38% of their monthly income. The government will then subsidize servicers dollar-for-dollar to lower that ratio to 31% - but the interest rate can't go below 2%.

The new interest rate would then remain in place for five years, after which it will increase by 1 percentage point a year until it reaches either the original rate or the prevailing mortgage rate at the time of the modification, whichever is lower.

If rate reductions aren't enough to get payments to 31% of income, a lender can extend the term up to 40 years, or shift part of the principal to the end of the loan at no interest. Servicers also have the option of reducing the loan's balance.

Servicers will receive $1,000 for each loan modified, as well as additional annual bonuses if borrowers keep up with payments. Investors will receive one-time $1,500 incentive payments for restructuring qualifying loans that are not yet delinquent. Finally, borrowers who keep up with their new payments will receive up to $1,000 a year in principal reduction, for up to five years.

The program also includes a new provision to eliminate borrowers' second mortgages. Investors in those mortgages, who at times have blocked modifications because they don't benefit from the adjustments, will receive incentives to eliminate those claims. Servicers that get second-mortgage holders to participate will receive an additional $250.

A Dallas developer is partnering with a local American Indian tribe to build an upscale bingo resort on Perdido Key.

Cy Keefer said Friday that details of the proposed development, including the number of jobs it is expected to generate, will be announced within the next couple of weeks.

"The idea we have is to open a first-class bingo facility the tribe will be proud of and the community will be proud of," Keefer said.

A source close to the deal said Friday night that the Perdido site "will far exceed" the newly opened bingo casino in Atmore, Ala.

"This type of bingo is planned to be only one component in a whole resort package," the source said.

Wind Creek Casino & Hotel in Atmore features 57,000 square feet of gaming floor and 1,600 electronic bingo gaming machines that look, sound and function like standard slot machines. The Wind Creek Casino is operated by the Poarch Band of Creek Indians.

The Perdido project partnership is between Keefer's Key Development of Florida Co. and the Perdido Bay Tribe of Lower Muscogee Creek Indians, led by Chief Bobby Johns Bearheart.

Keefer also quashed rumors that his plans call for a casino on the key, noting that Florida laws prohibit such gaming facilities without a full compact agreement with a federally recognized tribe. There are five Indian casinos in South Florida.

The proposed 15,000-square-foot bingo resort will offer numerous amenities, include a restaurant and separate environments for smokers and nonsmokers, he said.

"We are now in the process of securing a site location," Keefer said. "We are looking at the site where the Best Western motel was formerly located."

That site is owned by Perdido Hospitality Inc., a local company whose partners include hotel developer Julian MacQueen. The Best Western motel was severely damaged by Hurricane Ivan and subsequently razed.

MacQueen said he has no other interest in the bingo project other than being one of the owners of the land.

He declined to comment on the status of the negotiations with Keefer but added that he wants whatever is built on the key to "be a class act" and an economic shot in the arm for the community.

Randy Cudd, a longtime resident of Perdido Key, said he welcomes anything that will help the key and boost its economy.

"We have plenty of rooms out here and nobody to put them in," Cudd said. "I hope (the bingo hall) will attract people to the key," he continued. "We are not talking about Las Vegas here, but it's a reason to come to the key and spend money. In the end it's all about jobs, jobs, jobs."

Keefer said proposed development got under way when he was invited by members of the state recognized Lower Muscogee Creek Indians to explore the possibility of building the bingo facility on the key.

After researching various locations throughout the county, Keefer said he selected the Perdido Key site based on favorable demographics.

"We feel the population base is there, and we view this as a very viable project for ourselves and for the tribe," Keefer said.

Keefer owns a company that specializes in working with state and federally recognized Indian tribes to develop bingo resorts and other gaming facilities.

Florida laws are very specific, he noted, when it comes to setting up bingo facilities.

Under state statutes, a percentage of the profits of bingo facilities must be distributed to local charities.

"This is not a deal where the tribe will get rich or the developers will get rich," Keefer said.

He said if the project goes forward and the bingo facility is built, he will hire a professional management team to run the resort.

There is a much more "local feel" when vacationing in the area. There are far more beach homes than condos, but there are some very nice condos in the area such as the Indies Condos.

Also, there are plenty of places to eat for the area. A lot of people think there are little to no restaurants but that could not be further from the truth! There are plenty of great places to eat within 3-5 minutes of our Fort Morgan Rentals. Many of our Indies condo rentors love to rent one of our golf carts and ride the family over to Tacky Jacks 2 on the Bay for dinner or drinks. The same can be said for our rentors in the beach houses at the Dunes and Bay to Breakers.

The great thing about going out to eat in this area is that you don't have to fight the crowds like you do in Gulf Shores. Of Course, Gulf Shores is only 15 minutes away if you want to visit the area.

Vacation Update: Orange Beach Alabama is an Affordable & Luxurious Destination

Let me preface this blog with the fact that I just returned from a week trip to the famous Atlantis resort in the Bahamas. Believe it or not, I enjoy traveling to other beach destinations and take notes from my trip to enhance the services and rentals we offer at Prickett Properties in Orange Beach Alabama.

The Atlantis amenities are over the top. There are shark tanks, an aquarium that beats the New Orleans aquarium hands down, huge water slides, a 30 minute lazy river ride with white water rapids, a casino, and of course those turquoise waters.

However, the Atlantis is lacking affordability. I guess that I have gotten use to good ole Orange Beach Alabama because I was shocked. A domestic beer was $7.50 and a kids hot dog was $10.00 by the pool. I shutter to think about the dinner menu prices. $16.00 for a grilled cheese....really? The adult entrees were a standard of $30-$40 and sides were extra.

"Extra" was actually the word of the week for our family because everything was "Extra." For example, it cost $15.00 a day per person to go to the gym. Rock climbing anyone? Extra! I might have stomached all the extras better had the Bahamian people sold it with a smile. Nah...who needs to be nice? You can afford it right?

I welcomed good ole Alabama prices as I returned home today and reflected on how affordable and nice of a destination we have right here at our back door in Orange Beach. Not to mention, our southern hospitality will make anyone feel at home.

A family of 8 can stay at Turquoise Place, a beachfront 3 bedroom luxury condo, for only $255.00 a night in Feb and $3800 a week in the peak season. The tower we stayed at the Atlantis runs about $800 a night for a HOTEL room. Not to mention, Turquoise Place has high-end amenities such as private hot tubs on each balcony, wolf gas ranges, outdoor gas grills, jacuzzi tubs with flat screens in the master bath and ipod docking station with surround sound. At the Atlantis, I got a dated bed and a tiny tub/shower combo and there was no balcony.

I am not undermining the beauty of the bahamian waters or the fabulous water-park amenities that the Atlantis had to offer. I am however noting how much our area has to offer at such a VERY affordable price.

Not to mention, Orange Beach is becoming quite the destination itself. Has everyone heard that Kenny Chesney is coming to the Wharf ????? Enough said :)
