There has been an increase in burglaries near our neighborhood. Our local Gilbert, AZ Police Department is introducing a program to help us better protect our property and vehicles. The Moore Team does more than just sell real estate, we want to make a difference in people's lives so, I'm sharing this will all of our clients and I wanted to share it with all of you out there. The new Program, known as "Operation S.M.A.R.T. Driver" focuses on the things a driver needs to remember prior to exiting his or her vehicle.

S = Secure your vehicle inside your garage or park in a well lit area.

Your vehicle is more vulnerable out in the open. Try not to park street side. Park in your driveway or near your apartment so that the vehicle can be viewed periodically. If you have a garage, park inside and do not forget to close your garage door once inside.

M = Make sure you have taken all of your personal property out of your vehicle.

It's important to make certain that you take all of the valuables out of the vehicle when exiting. Burglars love to see items that can be easily carried away - such as;

Cash/change in ashtrays or cup holders

CD's

Wallets/purses

Mail

Jewelry

Gym Bags

Tools

A = Always make copies of the documents you leave in your glove compartment and black out your address.

Criminals have electronic garage door decoders and can get into open garage doors quite easily.

T = Take the time to lock your vehicle and set your car alarm.

If you have a vehicle alarm - use it. If you hear a vehicle alarm going off in a parking lot- pay attention and do not hesitate to contact police to report this suspicious activity. We count on you to be the eyes and ears.of your community.

By setting one of my personal goals to get in shape and lose weight, affirming this end result everyday and doing the steps to get there - I (Kelly) have lost 33 pounds since the end of Sep 07 and I only have 4 more pounds to reach my ultimate goal. Now I am incorporating situps, pushups and light weights to build the muscle which will help burn fat.

Here's what worked for me: I walked 1/2 a mile to warm up (less than 1/4 mi warm down) and 2 miles as fast as I could each day (min 6 days a week). I wrote down everything I ate and drank each day including the calories. For me, I needed to stay under 1200 to start dropping pounds. Ask your doctor what a good max calorie intake would be for you and go for it! Below are some ways to keep moving, clear your mind and burn some calories-

Moving your body, whether you are running, jumping, walking or playing equals energy, strengthens your muscles & helps you feel good. 60 minutes a day can be too much to do at one time or maybe you can't find that much time. Do 10 minutes at a time throughout the day. It can clear your head too.

Take a work break, a homework break or even get off the couch and move while you're watching TV.

Here are some ideas
* Dance to your favorite music
* Walk somewhere instead of driving or getting a ride
* Do some yard work
* Help clean the house
* Take out the garbage
* Jumping jacks for one minute
* March in place for one minute
* Walk up and down the stairs
* Play tag with your kids
* Skip rope with your kids
* Walk your dog
* In-line skate
* Exercise
* Play basketball
* Hula-Hoop
* Kick a soccer ball with your kids
* Ride a bike
* Jog

If you and your kids are stuck at home:

Gymnastics or tumbling (make sure you have enough room).
Scavenger hunt.
Play volleyball with a balloon.
Hit a balloon or balled-up sock and see how many times you can hit it before it hits the floor.
Twister.
Nerf basketball
Musical Chairs
Act out your favorite classic story

Affirmations, Goals, Positive attitude, Hope Defeats Fear

Start each day, the same way - It is reported that it takes 30 days to form a habit

To Do List with the first items being permanent and should include

1. Affirmations

2. Focus on Your Vision Board

3. Commit to a Positive Attitude for the Day

4. Journal

5. Review your calendar. (By the way, you should have already done your work out)

6. Add the rest of your activities for the day and prioritize them.

Have goals in every circle of your life and keep them balanced.

Personal, Financial, Spiritual, Business, Family.

Stay in sequence in each circle so that you get out of survival mode into stability mode and move towards success and significance.

Review your goals often and adjust them as necessary.

Don't Let Fear keep you in Survival Mode. There are only 3 Natural Fears: falling, loud noises and abandonment.

A friend said she had been taught that FEAR stood for False Evidence Appearing Real.

Brian Buffini stresses at his Master Mind that Hope will always defeat Fear.

The definition of Hope is a confident EXPECTATION. These are our goals and affirmations.

Brian also says we need to Feed Hope with Vision (goals), a Plan (steps to accomplish goals) and along the whole way - We must be gracious.

Fear wants the norm so he says,

FHA Downpayment Assistance, Appraiser Selections and FHA Info.

This is the latest information that Metro Arizona Mortgage is reporting from the NAR:

I. FHA Seller Funded Down payment Assistance Programs

The Judge has ruled in favor of the down payment assistance providers in their Court case involving the HUD's final rule that would have prohibited seller participation in these programs. (In addition, AmeriDream has a copy of the Judge's opinion on its website.)

Accordingly, unless the FHA Modernization bill is enacted with the provision precluding seller participation in these programs or the IRS takes action against an individual organization ,it appears seller funded down payment assistance programs remain operational for the foreseeable future.

II. FHA & GSE mortgage limits

FHA has indicated that they will be publishing the new mortgage limits this week. By law, HUD is required to publish new limits by March 14^th.

We understand that the GSEs will also be ready to implement the changes immediately. In addition to the areas that will have higher loan amounts, the key question will be whether additional underwriting requirements will be required for these loans. We understand that Fannie Mae and Freddie Mac may place significant loan-to-value caps on these loans. FHA is considering requiring two appraisals.

III. Fannie Mae & Freddie Mac Appraiser Selection Policy

The New York Attorney General reached agreement yesterday w/ Fannie Mae and Freddie Mac to change appraiser selection criteria. Attached is the Home Valuation Code of Conduct. This policy could have significant ramifications in several areas.

Specifically, starting in January 2009, lenders will no longer be allowed to use staff appraisers or appraisers who work in firms owned by the lender. However, there appears to be an exception for lenders that own 20% or less of the appraisal firm. There is also provision that prohibits the appraisal entity from being owned by a settlement services company. Accordingly, the appraisal company appears to have to be an independent entity.

Mortgage brokers will also no longer be able to select appraisers. An important question outstanding is what is the definition of lender. If the RESPA definition of lender is used (close in the lender's name w/ its own funds), mortgage bankers that do not sell directly to the GSEs would not be affected. However, if the definition of lender applies to the lender that sells the loan to the GSEs, it would appear this provision applies to many mortgage bankers in addition to mortgage brokers.

Below is language from the agreement.

"Fannie Mae (or Freddie Mac) will immediately announce the adoption of the requirements contained in the Code, make appropriate changes to its Guide and, beginning January 1, 2009, will require that lenders represent and warrant that appraisals conducted in connection with single-family mortgage loans, other than government-insured loans, originated on or after January 1, 2009 that are delivered to Fannie Mae (or Freddie Mac) conform to the Code."

This change applies to loans sold to Fannie Mae and Freddie Mac and does not affect government loans.

IV. FHASecure

FHA is expected to announce changes to expand borrower eligibility criteria for FHASecure this week.

V. RESPA

We expect the proposed RESPA rule to be published soon possibly this week.

VI. FHA Modernization Bill

We continue to hear that the Senate and House are close to an agreement on the FHA bill. We understand the Congress is hopeful of passing the final bill by mid-March.

Short Sales - Simplified

There is a lot of talk about "short sales" these days so I thought you would be interested in this information that I've summarized based on a couple articles from different mortgage brokers.

A short sale is an "arrangement" between the owner of a home and their mortgage lender to accept an offer for less than the total amount owed on the home. The "deficiency" is the difference between the amount owed and what the bank collects from the short sale. There may be multiple stipulations within each "arrangement". Each mortgage lender handles their "arrangement" a little differently. Anyone involved in a short sale, the seller or agent, should read and fully understand the bank's written policy.

A seller does not have to be behind on payments to request a short sale from their mortgage company. They just have to provide evidence that the house can't be sold for the amount owed. Initiating a short sale prior to late payments is a better choice than late payments forcing foreclosure or bankruptcy.

A bank owned (foreclosed) house is not a short sale. A seller deciding to lower their price and take less profit is not a short sale. A seller that owns their home free and clear, and decides to sell a home at a price under market value, is not a short sale. A "short sale" does not define a "good deal". For it to be a Short Sale, someone is getting "shorted" - either the seller or the bank.

In foreclosure, the borrower falls way behind on their payments and the bank repossesses the house and sells it. The bank typically will pursue the borrower for the deficiency. This situation typically forces the borrower to file bankruptcy and turn the house over to the bank.

Most short sales arise when a seller is "upside down" in their mortgage - they owe more on their house than it is worth. The owner of the home then attempts to make an "arrangement" with their lender to sell the house for less than is owed.

A short sale is not an easy alternative to foreclosure. The money owed does not just disappear. The "deficiency" will be accounted for. Some institutions may be willing to extend a 100% loan in the form of a promissory note with the seller or they may report the amount as 1099 income to the seller or may enter a judgment against the seller. All of these have their own set of issues. If the borrower couldn't make the payments in the first place, they may not be able to repay a note. If this 1099 income puts the borrower in a different tax bracket, now they have taxes to pay. Judgments are full of issues and have a long-lasting affect on credit.

The statute of limitations (SOL) on judgments is long -- usually 10 to 20 years and many are renewable (a judgment may be renewed if the creditor files a new suit seeking to renew the judgment prior to the expiration of the original judgment). This means a judgment could follow you around forever. Even if you pay a judgment you then have a 'satisfied judgment" on your record for 7 years from the date it was satisfied, not filed.

You should never let a "default" judgment be entered. Always attempt to dispute the validity or settle out of court. All efforts should be made to keep this off of your credit reports. Even if the debt is there, you have no way to clear it and it's still within the SOL timeframe, you should attempt to settle it out of court prior to the court date. The alternatives are not the best: wage levy or asset liens and huge damage to your credit.

A short sale is a long drawn out process for everyone involved, including a buyer. The bank is looking for the most that they can get back out of the property and will not accept just any offer. If there are two separate institutions involved, in the case of a first and a second on the property, the institution carrying the first will not be concerned with helping the seller pay off the second. Both must be addressed separately.

Many banks will not agree to a short sale in writing until you have a formal offer. Before your short sale is approved, the mortgage company will require a long list of documentation: an application, a hardship letter, financial statements, tax returns, pay stubs, the purchase agreement from the buyer, a HUD statement from the pending transaction, payoff letters from all lenders involved, and several other things depending on the lender. This documentation should be ready prior to submitting any offers for approval. Approval could take as long as 4-6 weeks, depending on the lender.

The lender's negotiators are not fiduciary advocates for the seller. Their only goal is to collect as much money possible for their institution and may be compensated accordingly. There are situations where it might not be a bad idea for the seller to seek legal counsel as to a least harmful path. Again, all parties involved should be fully aware of the lending institution's written policies.

It should be clear why a short sale may not necessarily be a good path for a buyer or an investor. The home may not be listed for a price at or under market value and the banks may not be willing to negotiate very much. There may be better ways to obtain undervalued homes for both investors and buyers. With a large inventory on the market, the odds are high that there may be a better alternative, but not always.

Why do we let ourselves be held back?

Brian Buffini defines our lives into 5 areas : Personal, Financial, Spiritual, Business, Family. If you have one of the five areas out of balance, it will affect the others.

We should have written goals in each of these areas. We should continuously review, refine and check them off when we accomplish them.

Our affirmations should reflect those goals. Affirmations are written as if the goal is accomplished:

- I am on time to every appointment I have.

- I easily fit into a size __?

- I tell my kids that I love them everyday and I show them everyday.

- I have a net worth of $1,000,000

- I have no debt and stick to my budget

Brian Buffini also describes a specific order within each area that we must go through to reach the highest level - SIGNIFICANCE. This is when you are able to give back.

Our goals within each circle will lead us from a level of survival to stability to success to a level of Significance. There is great importance to following the order. In other words, if you aren't paying your bills, you might not belong at the Charity Ball.

Example:

Personal Goal - lose 15 pounds.

Affirmation: I weigh 125 lbs and easily fit into a size 6.

Survival Mode -

You haven't even had the courage to get on the scale and it's a good thing it's winter cause those sweats still fit. So far, your blood pressure is still within a normal range. You've started using Splenda in your Starbuck's each day instead of whipped cream and caramel topping so you haven't gained any more weight.

Stability - You are actually getting out of your car to go into Stabucks in your sweat pants because your jeans (well let's not go there).You've limited yourself to only 1 Starbucks a week and you've started a work out program. You actually are starting to drop a few pounds.

Success - You're eating healthy, continuing to exercise, you're at 125 and those jeans are looking mighty fine.

Significance - You're helping others by teaching a class, working out with them, etc.

Financial

Survival Mode - Paying minimum credit card payments.

Significance - I don't know about you but I'm writing my $10,000 check to House of Refuge East in Mesa.

No matter what book you pick up that talks about Success and Successful People, they all had clearly written goals. Goals are essential to success. If you don't have goals written down, you'll never know when or if you have succeeded.

Brian Buffini says you need to have SMART goals.

Realistic in Time and Skill

Time-based Achievement (By what date, etc)

It takes less than a minute - Just Do It!

How many of you have created a visualization board and put in a place where you can be constantly reminded of what you are Grateful for on one side and what you want (Vision) on the other side. The Vision side answers the Big "Why?'. Why you are willing to do what it takes to get those things you want. Maybe a new car, a trip to see relatives you haven't seen, etc. My Grateful side has a picture of Tony, Me and our 4 kids, a picture of my parents, a Cross and various other things that I'm grateful for. My Vision side has my picture driving a new Buick Enclave, court side season tickets to the Suns, a $10,000 check to The House of Refuge East in Mesa, a cruise with my family in 2009.

Have your kids do one too. If they are grateful for the things on the left and really want the things on the right, maybe they'll work harder to clean their room more often. Try creating one as a family too. Let your kids see what you're working hard for as a family.

Start each day with a Daily To Do list with each item prioritized (A+, A, A-, B+, etc.). This will ensure you get the most important things done each day. Don't quit using it, or at least something like it. If you only finish 1 - A+ To-Do, you have accomplished so much more than finishing 10 small B- things that don't bring in revenue or get you closer to one of those things on the Vision side of your board. The first couple items on your ToDo List should be permanent and should include 1. Affirmations 2. Focus on Your Vision Board 3. Commit to a Positive Attitude for the Day 4. Journal 5. Review your calendar

6. Review your tasks Fill In Your To Dos for the Day and Prioritize them. Then shut down your email and get to work.

I listened in on a coaching call yesterday that focused on Mind Set and I want to share my key notes.

Success is based on 2 things:

Hard Work and
Determination to be excellent

We are all in sales, whether we are selling products or services and 90% of selling is mental.

Success is determined by your Attitude and your Attitude is determined by your Thoughts.

Statistics reported by the National Association of Realtors shows that 2007 was still the fifth best year in the history of real estate for number of homes sold (5.5 million) with the average sales price at $224,500. Even in the event a seller has to lower their asking price to sell their property, the reinvestment will, typically, prove to be financially beneficial. Of course, this does not include short sale type situations.

We've had quite a few investors (transacting 1031 exchanges) and second home buyers come in from Canada and some of the northern states and purchase some great properties for use as rentals or winter get-aways. There's lots to chose from here in Arizona and in many parts of the nation.

Interest rates are still very low (anyone remember 18% or more). There are still great programs available allowing renters to turn into owners with a similar, or even lower, monthly payment here in AZ. We have always provided our buyers with a list of prime lenders to talk to when they are looking for a referral. These prime lenders are more selective but it keeps people out of trouble in the long run. Let us know if you need a referral for a lender here in the greater Phoenix area.

Another market that is seeing activity is the Second Home market. We see quite a bit of that here in the "greatest place to be in the winter" state. Auto Theft Prevention - Free VIN Etching in Gilbert, AZ

If you're anywhere near Gilbert, AZ on March 1, 2008, come on over to the Target store at 1515 E Warner Road from 10 am to 1 pm for a free Vehicle Identification Number etching by the Gilbert Police Department.

The Gilbert Police Department is offering free clinics on prevention of vehicle theft and offering free VIN etching as part of the Auto Theft Prevention Day.

Other clinics will be held on March 25th at the Dillards at 2151 Santan Village Parkway from 4-6 and on April 10th at Bashas on 4874 S Val Vista Dr.

Etching your vehicle makes it harder to re-sell and helps the police identify the car if found. The police department also recommends locking your car, not leaving valuables in your car, parking in a garage vs the street or driveway and parking in well-lit areas. They say to Never leave your car running to go into a store when running errands. Ignition kill switches, wheel locking devices and fuel switches are also deterrents.
