      <title>CREDIT REPAIR AND THE LAW PART 2</title>
      <description>&lt;p&gt;Hello, my name is Tim J Thrift Independent Agent and Qualified Field Trainer with &lt;strong&gt;United Credit Education Services.&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;With the recent down turn in the economy and the credit crunch there have been many unfortunate cases where consumers have been taken advantage of and wrongly represented by Credit Repair Companies. Rightfully so the FTC (Federal Trade Commission) has began &quot;Operation Clean Sweep&quot; In which some 36 so called credit repair companies have been shut down.&lt;/p&gt;
&lt;p&gt;As a result of this crack down I have come across much resistance from inquiring consumers about &lt;strong&gt;United Credit Education Services&lt;/strong&gt; Credit Restoration and Education Program. The first question they ask. &lt;strong&gt;Is credit repair legal? &lt;/strong&gt;My answer is &lt;strong&gt;YES&lt;/strong&gt; it is legal and then I explain how it is legal. As a consumer you have a legal right to dispute any inaccurate, erroneous and obsolete information that is negatively impacting your credit score under the FCRA (Fair Credit Reporting Act). You may Google the FCRA Fair Credit Reporting Act to read or visit the ftc.gov site. Warning this is an 80 plus page document full of legal jargon that will mostly likely put you to sleep. In addition to that I explain to them that United Credit Education Services is in full compliance with the CROA (Credit Repair Organization Act). The CROA is the act or law that mandates compliance of credit repair companies. The very law that is shutting down these credit repair companies who a wrongfully doing business. Below I have copied from the ftc.gov website to show example of this explanation of the CROA.&lt;/p&gt;

&lt;p&gt;The second question I am getting is. &lt;strong&gt;Is it illegal to charge an upfront fee for credit repair service?&lt;/strong&gt; Folks this is one area of this business that absolutely just makes me want to scream because of this reason. Any place you go on the internet such as ftc.gov and certainly the credit reporting agencies Trans Union, Equifax and Experian you will read that it is illegal to charge upfront fees for credit repair before any services has been provided. And it is illegal under the law to charge upfront fees. But here is what you will not be told or read unless you go directly to the CROA and read the law. I have provided a copy of the law from the ftc.gov site notice highlighted in below. (B) does not include-- &amp;nbsp;&lt;/p&gt;
&lt;p align=&quot;center&quot;&gt;&lt;strong&gt;SEC. 403. DEFINITIONS.&lt;a href=&quot;http://www.ftc.gov/croa.htm#N_4_&quot;&gt;(4)&lt;/a&gt;&lt;/strong&gt;&lt;/p&gt;

      <title>Credit Restoration and the Law</title>
      <description>&lt;p&gt;The credit reporting agencies will never produce accurate credit reports. What? You might be even more surprised to know that congress has acknowledged this fact and created legislation that virtually guarantees a continuation of credit reporting errors and the necessity for vigilant credit restoration. That's Right? This legislation is called the &lt;strong&gt;F&lt;/strong&gt;air &lt;strong&gt;C&lt;/strong&gt;redit &lt;strong&gt;R&lt;/strong&gt;eporting &lt;strong&gt;A&lt;/strong&gt;ct (FCRA). &lt;br /&gt;&lt;br /&gt;&lt;strong&gt;The FCRA Problem&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;You may understand the FCRA as the wonderful federal law that outlines credit repair procedures and allows you to dispute errors on your report. Or maybe you understand it as the law that imposes responsibility and accountability on the credit reporting agencies, and, oh, where would we be without it? Okay, there is no doubt that the FCRA limits the potentially catastrophic damage that the credit reporting agencies would impose on an unwary public, but it also tolerates major errors, and by doing so guarantees that they will exist for the foreseeable future.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;A Big Social Cost&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;The law is a wonderful thing. It protects the innocent and maintains a semblance of social order. But the scales of justice tip two ways, often insulating the offender in a cozy blanket of due process. In the case of the FCRA the law is designed to impose a reasonable degree of responsibility on the subject industry, without overburdening them with excessive and costly guidelines. And this last point turns out to be the problem, at least as far as the one hundred million consumers who are paying premium interest rates because of errors on their credit reports.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;The Credit Repair Balancing Act&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;So what does this all mean? Understand that lawmakers face tough decisions. The credit reporting agencies are &lt;strong&gt;massive&lt;/strong&gt; business entities, and guess what? We can't exist without them. Well, maybe we could, but the business world is completely dependent, totally addicted to credit data. The credit reporting agencies each manage credit files on sum 200 million Americans along with billions of data updates each day. Errors are inevitable. You can't just tell them to adopt a zero-tolerance policy towards errors. It would cost too much and potentially make it impossible for the credit reporting agencies to stay in business.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;What about You?&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;So what about you and the errors on your reports? Congress is not unsympathetic, and wants you to facilitate your credit restoration efforts and fix the mistakes that might keep you from getting a loan, a job, or insurance. Coming soon utilities rates and health insurance rates will be factored by your credit score. That's right. So they mandated the creation of annualcreditreport.com, the website where you may get your credit reports for free once each twelve months. Have you checked your report lately? And by the way your credit score is not included you will have to pay a fee for them. &lt;br /&gt;&lt;br /&gt;&lt;strong&gt;The Plot Thickens&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;The plot thickens. It turns out that those darn credit reports, for most consumers, might as well be written in Greek. And even if you can make sense out of your report do you really know what you are looking at? Credit restoration success requires some reasonable working knowledge of the FCRA and access to FTC Staff Opinion Letters that interpret the law in practical application. You would also be well advised to bone up on the Fair Debt Collection Practices Act. And, oh yeah, make sure you know your state Statutes of Limitation. Credit restoration is tricky. &lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Credit Restoration is here to Stay. &quot;My 30 second commercial&quot;&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;So, who is looking out for you? You can't count on Big Brother. He may be watching, but he's not going to make sure that your credit report is okay. It's time to step up to the plate. Some even carry up to 50. But how many is too many? Experts say that it&amp;#39;s not the number of credit cards you have, but instead how much you spend and how much you can afford to pay off each month.&lt;/p&gt;&lt;p&gt;Be aware that the more credit cards you have, the bigger the risk you pose to yourself to create debt and hurt your credit. Also, each time you open a store credit card 20 points are taken off of your credit score, according to consumer education organizations. Typically this is because store credit cards are available to anyone - even those consumers who otherwise could not get credit.&lt;/p&gt;&lt;p&gt;&lt;strong&gt;Some Tips To Keep In Mind&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;Keep your debt ratio low.&lt;/strong&gt; Your credit card balance should be ideally kept to 30% of your limit.&lt;/p&gt;&lt;p&gt;&lt;strong&gt;Make your payments on time.&lt;/strong&gt; Keep your credit cards current. New late payments can decrease your credit score by up to 100 points.&lt;/p&gt;&lt;p&gt;&lt;strong&gt;Do not close too many credit cards at once.&lt;/strong&gt; When you close several credit cards at once, your debt to available credit ratio will fall.&lt;/p&gt;&lt;p&gt;Credit cards can be a good thing. Credit cards are a safer way to buy goods instead of carrying cash. They offer you the protection against theft because the money you charge is not taken out before you get to dispute the charge.
