      <title>I had a verbal agreement that went through both the Selling agent to the buyers agent now the seller has accepted another offer that is higher. Is this allowed?</title>
      <description>&lt;p&gt;Unfortunately a verbal offer is not binding in NJ when it comes to real estate, and, even if you had a written offer a seller can change their mind and accept another offer during the review period while &quot;technically&quot; you are not under contract. A house is not under contract until after attorney review has run its course. If this is the house for you you can always offer more. Good luck to you.&lt;/p&gt;</description>

      <title>I found a house I'm interested in but the seller's agent won't present my offer to the seller.</title>
      <description>&lt;p&gt;The seller's agent is obligated to present ANY offer to the seller up to the day of closing. It's NJ real estate law. She cannot refuse even if there are better offers on the table or even under contract. Your agent is correct to ask for a written rejection. I ALWAYS make my sellers sign the contract as &quot;rejected&quot; so the other agent knows it was presented. You or your agent could report the seller's agent to the Board ethics committee but at a minimum her Broker should be contacted so he/she can verify that the offer has been presented. &lt;p&gt;Nov. 5 (Bloomberg) -- The U.S. House may vote as soon as today on a $45 billion plan to expand a tax credit for first- time homebuyers, extend jobless benefits and provide tax refunds to money-losing companies.&lt;/p&gt;
&lt;p&gt;The measure won Senate approval yesterday on a 98-0 vote, and House passage would send it to President &lt;a href=&quot;http://search.bloomberg.com/search?q=Barack+Obama&amp;amp;site=wnews&amp;amp;client=wnews&amp;amp;proxystylesheet=wnews&amp;amp;output=xml_no_dtd&amp;amp;ie=UTF-8&amp;amp;oe=UTF-8&amp;amp;filter=p&amp;amp;getfields=wnnis&amp;amp;sort=date:D:S:d1&quot;&gt;Barack Obama&lt;/a&gt; for his signature into law. That would cost about $10 billion in the fiscal year that began Oct. 1, according to Congress's Joint Committee on Taxation.&lt;/p&gt;
&lt;p&gt;The measure includes $2.4 billion to extend unemployment benefits for as many as 20 weeks, enough to aid the jobless through the holiday season. It would also loosen tax rules for homebuilders and other money-losing companies to allow them to claim this year an estimated $33 billion in tax refunds.&lt;/p&gt;
&lt;p&gt;The legislation had been delayed for weeks in the Senate by Republican demands for votes on amendments to the plan.&lt;/p&gt;

&lt;p&gt;Other Measures&lt;/p&gt;
&lt;p&gt;Lawmakers are still considering whether to extend several other elements of the stimulus package, including subsidies to help the jobless buy health insurance and increased funds for food stamps. Obama has called for sending seniors $250 checks because they won't get a cost-of-living increase next year in their Social Security payments.&lt;/p&gt;

Mundaca told the Senate Finance Committee yesterday the initiative is &quot;too successful to allow to go away.&quot;&lt;/p&gt;
&lt;p&gt;The Treasury Department estimates that more than 1.4 million Americans have taken advantage of the homebuyer credit at a cost so far of about $10 billion.&lt;/p&gt;
&lt;p&gt;Increased Limits&lt;/p&gt;
&lt;p&gt;Couples earning as much as $225,000 a year and individuals earning up to $125,000 would qualify for the credit. That is up from the current $75,000 limit for individuals and $150,000 for couples. The Senate plan also would allow homebuyers who have lived in a residence they own at least five years to receive a $6,500 credit.&lt;/p&gt;
&lt;p&gt;Those buying homes worth more than $800,000 wouldn't be eligible for the credit; those who sell their new home or stop using it as their main residence within three years would have to repay the credit.&lt;/p&gt;

&lt;p&gt;He said expanding the credit to those who already own homes would help create jobs because &quot;the move-up buyer is more inclined and capable of buying that furniture, maybe building a porch, putting a garage on, a new roof&quot; and making the &quot;kinds of investments I think is going to be a job-creator across the country.&quot;&lt;/p&gt;
&lt;p&gt;Waste of Money&lt;/p&gt;

&lt;p&gt;&quot;For the vast majority of cases, the homebuyer credit amounted to a free gift since it did not affect their decision to purchase,&quot; he said on the floor this week. &quot;The homebuyer tax credit is a terribly inefficient, irresponsible and poor use of scarce taxpayer resources.&quot;&lt;/p&gt;
&lt;p&gt;&lt;a href=&quot;http://www.bloomberg.com/apps/quote?ticker=GS%3AUS&quot;&gt;Goldman Sachs Group Inc.&lt;/a&gt; said in a Nov. 3 research note that the credit probably spurred 200,000 home sales that otherwise wouldn't have occurred.&lt;/p&gt;
&lt;p&gt;Extending the credit to people who own homes wouldn't reduce the excess housing blamed for the slump because &quot;every buyer taking advantage of the move-up credit would necessarily be a seller,&quot; Goldman Sachs said. It said the plan may increase housing prices by 1 percent because &quot;sellers are likely to incorporate a fraction of the credit amount in their sale prices.&quot;&lt;/p&gt;
&lt;p&gt;Unemployment Extension&lt;/p&gt;
&lt;p&gt;The bill would provide 14 additional weeks of &lt;a href=&quot;http://www.bloomberg.com/apps/quote?ticker=USURTOT%3AIND&quot;&gt;unemployment&lt;/a&gt; benefits in all states, plus another six weeks in states with the highest jobless rates. The extension would be the fourth since the recession began. The share of unemployed people who have been out of work at least six months has reached the highest level in at least a half-century, according to the Labor Department.&lt;/p&gt;

&lt;p&gt;The legislation also would expand provisions in the stimulus package allowing companies to apply their losses to previous years' income, thereby reducing their tax bills and allowing them to claim refunds. Banks and other institutions receiving assistance from the Treasury Department's TARP program wouldn't be eligible.&lt;/p&gt;
&lt;p&gt;The legislation wouldn't add to the government's budget deficit, according to congressional estimates, because its cost would be financed in part by a delaying a tax break for multinational companies. It would also extend an employer payroll surtax that would otherwise expire at the end of this year.&lt;/p&gt;

We aren't interested in moving back to Chicago but we both very much miss city life! We have children now so we are more interested in a suburban type setting. We settled on New Jersey as a whole because it would be close to New York (for me) and close to Atlantic City/gambling/poker (for him)...we are very interested in Hoboken but have had a lot of friends suggest that we look into other places such as Morristown and Montclair.       <title>Is home-buying a 21st century form of torture? </title>
      <description>&lt;p&gt;&lt;em&gt;&lt;strong&gt;Are the aesthetics as important as we make them out to be?&amp;nbsp; Does the size of the yard or the number of rooms really matter to the quality of your life all that much? I guess what I'm asking is, what does owning a home, or a house, do for us?&lt;/strong&gt;&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;A home should be a safe haven and anything else you can dream about. The dream is different for everyone but I can tell you if you are not absolutely LOVING the home when you see it...it's not the right home for you.&amp;nbsp; I've been selling homes since 1998 and one thing I know is when a home is right for someone their faces light up like a torch when they walk in the door.&amp;nbsp; Too many times people try to talk themselves into liking a home...Don't Do It! Your agent should know your likes and your dislikes and be able to show you homes you can love. My advice is, don't settle for anything less then everything you want. You'll know when it right...keep looking, even if it takes 100 homes.&lt;/p&gt;

      <description>&lt;p&gt;&lt;em&gt;Recently I signed a purchase contract for a house. The seller came back saying per NJ law there is a grace period of closing dates up to 10 days, which gives them the right to postpone the closing date.&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;Yes, it true. &quot;on or about&quot; is interpreted as 10 days in either direction. Ask your attorney about your options to recoup your additional costs. At times a buyer can do a &quot;use &amp;amp; occupancy&quot; so they can move in early but not close on the home to help with moving/storage costs. As long as your mortgage extends through the cost date the seller is proposing it is reasonable to postpone under Jersey law.&lt;/p&gt;</description>

      <description>&lt;p&gt;Don't close without documentation. You are responsible for the permit once you own the house, and the increased taxes should it have been missed in the asssesment. One thing you could do is call the town yourself so you have first hand knowledge of what the town officials say. Hopefully you also had the home inspected and nothing was discovered in the basement. Don't sweat it. Just don't close with out seeing the permit.&lt;/p&gt;</description>

You can withdraw your listing from the market by having your agent fill out a listing change form and it is effective immediately. If your asking for an unconditional release so that you may list with someone else well...that a whole different subject. Even if you cancel your current contract as stated above, you may not sell your home yourself without owing a commission to the listing agent until 90 days after the expiration date of the contract. This is to prevent unethical sellers from using an agent to market the home and then attracting a buyer and dropping the agent. To get an unconditional withdraw (so no commission is owed should you sell) you would need to speak with the office Broker but it is not likely one will be granted.&lt;/p&gt;</description>

&lt;p&gt;Since it's not your primary residence you can't take a deduction for it anyway, so there is no difference if you sell it today or 6 months from now. The only way it would make a difference is if you lived in the home as a primary residence for 2+ years. Then you could deduct $250,000 (as a single)&amp;nbsp;on the tax of&amp;nbsp;capital gain you would be claiming.&lt;/p&gt;
&lt;p&gt;You will also need to pay a realty transfer fee in New JErsey.
