      <description>&lt;p&gt;For anyone visiting or living in New Orleans, one of the treasures to discover is Algiers Point. Algiers Point is the one part of New Orleans that's over on the West Bank of the Mississippi River and it's a historical gem. So many are afraid that now that tourist attraction Mardi Gras World's move to the East Bank will have dire effects on this unique and beautiful spot.       <title>She Got Sued For WHAT???</title>
      <description>&lt;p&gt;A colleague of mine told our office a horrifying story yesterday. She brought a buyer to a home for a second look, paperwork in tow, as they were going to submit an offer on the spot. One of the home buyers went into the attic while his agent, the listing agent, and the rest of the party were in the kitchen area. Then CRASH! The guy in the attic fell through the garage ceiling and injured himself badly.&lt;/p&gt;
&lt;p&gt;As the weeks followed, my colleague visited and checked in on her client as he healed. I think he spent something like 13 weeks in the hospital. Anyway, following the recovery, the homeowner, the listing agent, the buyers' agent, and both brokers were sued over the incident.&amp;nbsp; When the dust settled, all but the homeowner were dismissed from the suit, but my colleague has a $6000 legal bill sitting on her desk that E&amp;amp;O doesn't cover. We've yet to find any insurance coverage for an event like this, even a personal umbrella policy.       <description>&lt;p&gt;Way to go Marigny! I'm so excited to read this and to know that positive word is getting out about (at least parts) of the city. The American Planning Association just released its annual &quot;Great Places&quot; lists, including this one of the top 10 neighborhoods in America.&lt;/p&gt;
&lt;p&gt;For those who don't know, this is a charming, historic neighborhood adjacent to and just downriver from the French Quarter. Most of the structures are 100+ years old and it's where the artisits and bohemian scene went when the Quarter got to expensive. Of course, now, the Marigny has certainly climbed in value, so the young, vibrant group who made this area so special are pushing even further down river into the next neighborhood called the Bywayter.&lt;/p&gt;

      <description>&lt;p&gt;Race fans rejoice, neighbors be warned. The New Orleans Fairgrounds Racecourse announced recently that it will start its 138th season of horse racing on November 6. It will run, as usual, through the end of March in plenty of time to prepare the Fairgrounds for the New Orleans Jazz &amp;amp; Heritage Festival (&quot;Jazz Fest&quot;).&lt;/p&gt;

It will be rebuilt and reopened as Nickelodeon's first stand alone theme park, called Nickelodeon Universe New Orleans, and&amp;nbsp;will include a water park. The park is shceduled to go under construction in the fall of 2009, and open late 2010. &lt;p&gt;Of course with characters in tow like Spongebob and Dora, we'll also add to attractions like the Audubon Zoo, Acquarium of the Americas, City Park, and several other intitiatives aimed at families. Let's face it...our most famous assets, Bourbon Street and Mardi Gras, are largely not kid friendly.&lt;/p&gt;

      <title>Back in the Office!</title>
      <description>&lt;p&gt;I'm back in the office after a VERY relaxing and much needed vacation to our home in New Smyrna Beach, Florida. I even went to Disney World, which I haven't been to in nearly 20 years!&lt;/p&gt;
&lt;p&gt;The real estate situation there seems almost dire in some areas. Our house is in a small, quiet neighborhood that has its share for &quot;For Sale&quot; signs, but we saw several where there were more properties for sale than not...and the &quot;foreclosure&quot; riders were on many of them.       <description>&lt;p&gt;An Internet based company&amp;nbsp;that sells its services to help Realtors and lenders in various capacities has launched a petition campaign asking for a reversal of the Home Valuation Code of Conduct (HVCC). Though Representatives Childers (D-MS) and Miller (R-CA) have introduced a bill that will place an 18 month moratorium on HVCC, this petition seeks to end the mess altogether.&lt;/p&gt;
&lt;p&gt;If you're not familiar with that the HVCC is, Google it and find out. It will affect us all. The idea is nice, but as with most rushed things, it's&amp;nbsp;having unintended consequences&amp;nbsp;in practice.       <title>Don't want your short sale commission cut? Make sure the numbers are right!</title>
      <description>&lt;p&gt;In my experience and training with short sales, the lenders ALWAYS ask for a reduction in commission, but if the numbers on the contract are right, just tell them no. Don't be intimidated. They want the deal to happen, too.&lt;/p&gt;
&lt;p&gt;It all depends on just how &quot;short&quot; the short sale is. Every bank has a very set bottom line that they can accept in a short sale. If it is crossed, the property than becomes a financially viable contender for repossession and resale. Remember, their purpose in accepting a short sale is to&amp;nbsp;recover more money&amp;nbsp;than they otherwise would if they had to foreclose. If the deal crosses that line, then cuts start coming to make the bank's &quot;walk away&quot; figure go above that line. And also remember, the bottom line can vary both by foreclosing bank and by type of loan (VA, FHA, etc.). For example if the bank can only accept a deal for 80%&amp;nbsp;of what is owed on the loan, then you must back out closing costs, commissions, etc. from your contract price, and make sure it doesn't cross that magic line. If you stay on the good side of that figure, then of course you'll still be asked to cut your commission, but just say no. It's never failed as long as the commission is not over 6%.&lt;/p&gt;
&lt;p&gt;As a listing agent for short sale properties, you should get to know your seller's particular bank's rules on short sales. These numbers will telll you if you have a short sale offer that the bank can even entertain. It is not a random decision, but rather a calculated one. Additionally, they all have a certain collection of paperwork (referred to as a short sale package) that should all be turned in together, not piecemeal...unless you want the response to take 4 months, and then have that response be: &quot;the package is not complete, we can't make a decision.&quot;&lt;/p&gt;

      <description>&lt;p&gt;I just wanted to take a minute to thank all my clients and colleagues who contracted us about Michael Jackson's untimely death. For those who didn't know I had tickets to one of the shows in London in July and was looking forward not only to the show, but my first time in the UK.       <title>FANO $ Still Available for Your New Orleans Clients, but...</title>
      <description>&lt;p&gt;The Finance Authority of New Orleans (FANO) still has tons of money to give to first time home buyers to help them get into the New Orleans&amp;nbsp;real estate market and&amp;nbsp;out of the&amp;nbsp;high-priced rental market. There are so many incentives for the program in addition to the&amp;nbsp;federal housing tax credit.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;However, as I have begun working deals&amp;nbsp;with the FANO program (and watching some of them fall apart), I am realizing that the program's restrictions make it a tough road for the Realtor and lender who deal with it. Here's a few of the challenges that, if you can get through them,&amp;nbsp;will lead your qualifying clients to a dream come true.&lt;/p&gt;
&lt;p&gt;1. The income qualification&amp;nbsp;are quite low, though they have been raised recently. When a client does qualify using those numbers, then that extrapolates into a very inexpensive house for the New Orleans market. Often, those homes get snapped up since we are not experiencing quite the down turn here&amp;nbsp;as so many other markets are.&lt;/p&gt;
&lt;p&gt;2. The time to close one of these deals can be 8 weeks and&amp;nbsp;that by itself often makes an offer less attractive. The positive side to relate to sellers is that to qualify for the program, the buyer has to be pretty solid on their first mortgage application.&lt;/p&gt;
&lt;p&gt;3. Preference is given to buying a home in &quot;opportunity zones&quot;. These zones are often areas that clients do not want to live in, or where this is widespread blight (and some of the blight pre-dates Katrina). There is a silver lining in that there is a smaller pool of money available for homes outside the zones that can prove a requires minimum in Katrina damage.&lt;/p&gt;
&lt;p&gt;4. The documentation required is staggering. While we all know that the whole &quot;no-doc&quot; thing was a serious mistake, but this program is a step toward the other extreme.&lt;/p&gt;
&lt;p&gt;5. There are a limited number of lenders who are approved to apply on behalf of the client for the program. Be kind to those lenders, remembering that it is an even worse experience for them than it is for the Realtors or even the clients. The lenders&amp;nbsp;make their money on the FIRST mortgage, which can be $65k plus down payment&amp;nbsp;less than than the asking price&amp;nbsp;used to calculate commission for the Realtors,&amp;nbsp;and the price of these houses are pretty low to start. Understandably, some of my preferred referrals in the lending world will not touch these.&lt;/p&gt;
&lt;p&gt;Prepare your buyers beforehand. Prepare the seller and listing agent beforehand. As long as the program is not a surprise to anyone involved in the deal, there's not been a problem negotiating acceptance of these offers. The key is to educate yourself, then educate the other players and keep the lines of communication open.&lt;/p&gt;

      <title>Attended My First Twilight Open House...with Clients</title>
      <description>&lt;p&gt;This evening I attended my first twilight open house. I've heard about this catching on in the New Orleans market, but had been previously engaged every time one came up. It was a beautiful house on Marengo Street in Uptown, Linda Babineaux of Prudential Gardner the host.&lt;/p&gt;
&lt;p&gt;On the positive side I could see that folks were coming after work to be there, which I'm sure was more convenient than taking time off during business hours. It's also been blazing hot here in New Orleans and the sun was waning by time we got there. The evening light showed off the house beautifully, and Linda had it well lit. I'd seen the property before in the middle of the day, and definately thought it had a more roantic and homey feel than my previous visit.&lt;/p&gt;
&lt;p&gt;On the other hand, it was the end of a long day for me and for the clients I brought over. These folks normally take quite awhile to get the feel of a home, but this time they moved through quicker than usual, and had tonight's dinner plans on their mind. The traffic was quite light and I saw as many brokers as clients there.&lt;/p&gt;
