      <title>New Tax Credit Guide</title>
      <description>&lt;p&gt;
&lt;p&gt;Good From Nov. 6, 2009 to April 30, 2010&lt;/p&gt;
&lt;p&gt;Who is Eligible and for What:&lt;br /&gt;&lt;br /&gt;First-Time Homebuyer (defined as a non-homeowner for the last three years)&lt;br /&gt;A first-time homebuyer can obtain a tax credit of up to $8,000 of 10% of the purchase price of a home, whichever is less, depending on their income. For example, a $75,000 sales price would have a maximum credit of $7,500.&lt;br /&gt;&lt;br /&gt;A) Single taxpayer: The income limit is $125,000. A partial tax credit can be given up to a maximum income of $145,000.&lt;br /&gt;&lt;br /&gt;B) Joint filers: The income limit is $225,000. A partial tax credit can be given up to a maximum income of $245,000.&lt;/p&gt;
&lt;p&gt;&amp;middot;&amp;nbsp; If either spouse has owned a home in the last 36 months, neither qualify for the tax credit.&lt;/p&gt;
&lt;p&gt;&amp;middot;&amp;nbsp; A child (18 years or older) buying with a parent as a co-mortgagor is eligible as long as they meet the other requirements.&lt;br /&gt;&lt;br /&gt;Current Owners&lt;/p&gt;
&lt;p&gt;Current homeowners can obtain a tax credit of up to $6,500 if they have owned and occupied a primary residence for a period of five (5) consecutive years during the last eight (8) years. Income limits are the same as for first-time homebuyers.&lt;br /&gt;&lt;br /&gt;Maximum Purchase Price&lt;br /&gt;The maximum sales price of the property being purchased is $800,000.&lt;br /&gt;&lt;br /&gt;New Deadlines&lt;/p&gt;
&lt;p&gt;&amp;middot;&amp;nbsp; In order to qualify for the credit, all contracts need to be in effect no later than April 30, 2010 and must close no later than June 30, 2010.&lt;/p&gt;
&lt;p&gt;&amp;middot;&amp;nbsp; Members of the armed forces stationed outside the U.S. on official duty for 90 days from January 1, 2009 to April 30, 2010 can sign contracts before April 30, 2011 and close before June 30, 2011.&lt;br /&gt;&lt;br /&gt;More Eligibility Restrictions &lt;br /&gt;&lt;br /&gt;No tax credit will be given to borrowers who:&lt;/p&gt;
&lt;p&gt;&amp;middot;&amp;nbsp; Are buying their home from a blood relative (a step-relative is OK);&lt;/p&gt;
&lt;p&gt;&amp;middot;&amp;nbsp; Are not using the home as a primary residence;&lt;/p&gt;
&lt;p&gt;&amp;middot;&amp;nbsp; Are selling the home before the end of the year;&lt;/p&gt;
&lt;p&gt;&amp;middot;&amp;nbsp; Are non-resident aliens;&lt;/p&gt;
&lt;p&gt;&amp;middot;&amp;nbsp; Are getting home financing from tax-exempt mortgage revenue bonds (does not apply for a home purchased in 2009).&lt;/p&gt;

      <title>New FHA Condo Guidelines Are Here</title>
      <description>&lt;p&gt;
&lt;p&gt;FHA has just issued a new Mortgagee Letter spelling out the new guidelines on condominiums. They are as follows:&lt;br /&gt;&lt;br /&gt;SPOT APPROVALS: Due to the volatility of the condo market, FHA will allow spot approvals until February 1, 2010.&lt;br /&gt;&lt;br /&gt;CURRENTLY APPROVED CONDOS: All currently approved projects stay on the list with these future requirements.&lt;br /&gt;&lt;br /&gt;Projects approved before October 1, 2008 will require recertification on or before December 7, 2010.&lt;br /&gt;&lt;br /&gt;Projects approved between 10-1-08 through 12-7-09 will have to be recertified within 2 yrs from the date of placement on the approved list. This will be the case on all projects approved going forward.&lt;br /&gt;&lt;br /&gt;FHA CONCENTRATION: This is temporarily increased to 50% and up to 100% if certain requirements are met.&lt;br /&gt;&lt;br /&gt;OWNER OCCUPANCY: 50% or more must be owner occupied or sold to people who will occupy. Vacant or tenant occupied REOs, including properties that are bank owned, may be excluded from the 50% calculation.&lt;strong&gt;&amp;nbsp;&lt;/strong&gt;&lt;/p&gt;

      <title>Hacienda Business Park Land Rezoned for Mixed-Use</title>
      <description>&lt;p&gt;
&lt;p&gt;On Tuesday, October 20 the Pleasanton City Council rezoned three vacant parcels in the Hacienda Business Park near the Pleasanton BART station to allow for mixed-use development. Two of the three parcels are located on Gibraltar Avenue across from the Sienna town home development.&amp;nbsp;The third parcel is located on Owens Drive across from the Dublin/Pleasanton BART station.&lt;/p&gt;
&lt;p&gt;The land is currently zoned for office, R&amp;amp;D, light manufacturing and allows for the development of six-story buildings.&amp;nbsp; The property owners&amp;nbsp;now have the flexibility of building mixed-use developments which could&amp;nbsp;include multi-story buildings with retail and services on the ground floor and residential units above.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;The Council action on Tuesday night&amp;nbsp;only rezones the land -&amp;nbsp;they did not approve any new&amp;nbsp;development.&amp;nbsp;According to our sources, there have been no plans for developing these parcels submitted to the City of Pleasanton.&lt;/p&gt;

      <title>Tax Credit Extention Update</title>

&lt;p&gt;NAR is stepping up pressure on Congress to extend the $8,000 home buyer tax credit. Their strategy includes a nation-wide call-for-action which&amp;nbsp;more than 450,000 REALTORS&amp;reg; have answered by either calling or emailing their elected officials. NAR is also&amp;nbsp;placing ads in Washington D.C. newspapers and&amp;nbsp;on the Wall Street Journal, New York Times, Washington Post and Google websites.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Finally, NAR officials are meeting directly with congressional leaders.       <title>Newark Utility Tax on November Ballot</title>
      <description>&lt;p&gt;Faced with a&amp;nbsp;$4.2 million&amp;nbsp;budget deficit, the Newark City Council will place a 3.9 percent&amp;nbsp;utility tax on the November ballot.&amp;nbsp;If approved by the voters the 3.9 percent&amp;nbsp;tax will be applied to electricity, gas, telephone and cable television services. Revenue from the tax will pay for police and fire protection and other basic city services including street and park maintenance. Newark city staff claim the tax will generate approximately $2.6 million annually. Bay East has not yet taken a position&amp;nbsp;supporting or opposing the tax.&amp;nbsp;&lt;/p&gt;

      <description>&lt;p&gt;On Thursday, July 30, the Federal Reserve Board's Truth in Lending &quot;Regulation Z&quot; took effect and applied new disclosure requirements for both new mortgages and refinancings.&amp;nbsp; Among other things, lenders must now provide good-faith estimates that include loan costs within three business days of receiving a loan application; a loan cannot close until a seven-day waiting period has ended; an updated disclosure must be provided if the loan's&amp;nbsp;interest rate changes by more than 0.125 percent&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Air conditioning-&lt;/strong&gt;It's important to have your air conditioner in perfect working order. Taking care of any issues in the midst of a heat wave can potentially result in an increase in price, as well as an increase in the time it takes for a technician to visit your home. You should also replace any filters now. Simply remove the old one and take it to your local home improvement center. Sales representatives should have no problem finding its replacement.&lt;/p&gt;

&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Clean out your garage-&lt;/strong&gt;Organizing a garage can be an excruciating experience during the hottest time of summer, so if that's something you need to do, check the upcoming weather reports and plan accordingly. Once you clean out your garage, either donate any unwanted items or sell them.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Paint-&lt;/strong&gt;Summer is an ideal time to paint the interior of your home since the weather best lends itself to keeping your windows open, allowing the fresh air in and the paint fumes out. If you decide to paint the inside of your home, think about lightening the existing color as opposed to darkening it. Lighter colors are not only inviting, they create the illusion of a bigger, more open space.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Buy fans-&lt;/strong&gt;Installing ceiling fans and using portable fans are great methods for cutting the heat inside your home. They are also far less expensive to use than an air conditioner. Using fans of any kind also enables you to keep windows open at night, allowing fresh air to circulate throughout the house.&lt;/p&gt;

&lt;p&gt;The City of San Ramon's Red, White &amp;amp; Blue Picnic &amp;amp; Fireworks is scheduled for Saturday, July 4th in San Ramon's Central Park located at 12501 Alcosta Blvd from 5pm - 10pm. Enjoy our beautiful park setting with a family picnic and music from KKIQ radio being broadcast for your listening enjoyment.&amp;nbsp; There will be a spectacular fireworks display synchronized to music at 9:30 p.m.&amp;nbsp; For those of you not in Central Park, the accompanying music for the fireworks can be heard on KKIQ radio, 101.7.&lt;/p&gt;
&lt;p&gt;Everyone is encouraged to bring a picnic to the park, enjoy time with family and friends and celebrate the birthday of our great nation.       <title>What's New in Washington DC?</title>
      <description>&lt;p&gt;&lt;strong&gt;Bay East Goes to Washington D.C.:&lt;/strong&gt;&amp;nbsp;With the federal government deeply involved in trying to jump-start the real estate market, the timing could not have been better to take our concerns to Washington D.C.&amp;nbsp;A team of Bay East REALTORS&amp;reg; including President Pat Huffman, President-Elect Pam Winterbauer and&amp;nbsp;treasurer Otto Catrina joined federal political coordinators Dorothy Jackson and Kevin Brown as REALTORS&amp;reg; from across the country descended on the nation's capitol as part of NAR's mid-year meeting.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Our&amp;nbsp;visit to&amp;nbsp;Capitol Hill was welcomed by&amp;nbsp;elected&amp;nbsp;officials and their staff&amp;nbsp;looking for ideas to help housing and the economy. The Bay East team was ready to provide the REALTOR&amp;reg; perspective. On Wednesday, May 13, they met with staff members from Congress members Barbara Lee and Pete Stark. On Thursday, they met personally with Congressman Jerry McNerney. Our message focused on federal policies that impact home purchase financing; energy efficiency; commercial lending and health care reform.&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;&lt;strong&gt;Home Purchase Financing:&lt;/strong&gt; Our team urged the East Bay congressional delegation to make the 2008 conforming loan limits permanent, extend the $8,000 Federal Tax Credit and make it available to all home buyers.&amp;nbsp;&amp;nbsp;&lt;/li&gt;
&lt;li&gt;&lt;strong&gt;Energy Efficiency:&lt;/strong&gt; We explained why proposed federal legislation that would require an energy audit at the point-of-sale would not accomplish the goal of making homes more energy efficient. Instead, we're supporting another bill that offers incentives to homeowners to make energy efficiency improvements.&amp;nbsp;&amp;nbsp;&lt;/li&gt;
&lt;li&gt;&lt;strong&gt;Commercial Real Estate Financing:&lt;/strong&gt; While the nation has been dealing with the fallout from sub-prime mortgages and ARMs resetting, commercial real estate financing also is&amp;nbsp;at risk. Specifically, many loans for commercial real estate are based on very short terms and the lack of available credit means limited refinancing options. The Bay East team explained that the short, three-year term of the Term Asset-backed Securities Loans that help secure commercial mortgage-backed securities need to be extended.&amp;nbsp;&amp;nbsp;&lt;/li&gt;
&lt;li&gt;&lt;strong&gt;Health Care Reform:&lt;/strong&gt; The REALTOR&amp;reg; position on health care issues is to make sure small businesses and independent contractors&amp;nbsp;are included in&amp;nbsp;federal plans for making health care available and affordable.&lt;/li&gt;
&lt;/ul&gt;
&lt;p&gt;All of the elected officals and staff we met with were receptive to our concerns and issues.&amp;nbsp; NAR's lobbying team in Washigton D.C. welcomed our participation in their daily activies and encouraged REALTORS at the local level to help make sure Congress is aware that we're paying attention.&lt;/p&gt;

      <title>Hayward Vacant Property Ordinance Update</title>
      <description>&lt;p&gt;The City of Hayward wants to do something about blighted vacant residential properties.&amp;nbsp; Last month a group of Bay East REALTORS&amp;reg; and Bay East staff met with City officials to educate them about the realities of dealing with vacant foreclosed properties.&amp;nbsp; We suggested several alternatives, however the City seems intent on developing an ordinance&amp;nbsp;that will&amp;nbsp;ultimately do little to address the problems associated with vacant foreclosed properties.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Earlier this week, City staff released a draft version of a vacant property ordnance.&amp;nbsp; This ordinance could require owners to register their property with the City of Hayward upon receiving a notice of default. Once registered these properties could be subject to inspection and a $1,000 per day fee if the property is not maintained.&amp;nbsp;&lt;/p&gt;

      <title>So How Do I Get a Larger Tax Refund?</title>

&lt;p&gt;&lt;strong&gt;No one ever wants to pay more taxes than necessary, but this year it's even more important to save every penny you can. Here are some tips that can help you get a larger refund: &lt;/strong&gt;

&lt;strong&gt;Property Tax Deduction for Non-Itemizers:&lt;/strong&gt; Before 2008, only people who itemized their deductions could deduct property taxes. For 2008, individuals who do not itemize can deduct up to $1,000 of property tax on a joint return or $500 on a single return.&lt;/p&gt;
&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Driving Deductions:&lt;/strong&gt; The IRS increased the cents-per-mile deduction for business-related driving expenses from 50.5 cents to 58.5 cents from July 1, 2008 through December 31, 2008. They also increased the rate for deducting medical and moving driving-related expenses from 19 cents to 27 cents for that same time period.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Disaster Losses:&lt;/strong&gt; Casualty losses (i.e. like those from storm or fire damage) are normally deductible only to the extent they exceed 10% of AGI. For 2008, casualties in federally declared disaster areas can be deducted without having to abide by the 10%-of-AGI rule, which raises the amount that is deductible.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Capital Losses:&lt;/strong&gt; Review your portfolio and note all your realized losses for 2008. You can write these off against capital gains and you can have a net loss of up to $3,000 deductible against your salary and other ordinary income. What's more, any excess can be used to offset gains or can be deducted in 2009 or later years.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Retirement Plan Contributions:&lt;/strong&gt; You can make tax-saving contributions to retirement plans for 2008 through April 15, 2009.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Charitable Donations:&lt;/strong&gt; Not only can you claim deductions for money and items you donate to a charity, you can also claim deductions for expenses you incur on a charity's behalf (i.e. driving costs, printing costs, long distance phone call costs, etc.).&lt;/p&gt;

&lt;p&gt;On Wednesday, April 2, the California Association of REALTORS&amp;reg; announced the Housing Affordability Fund Mortgage Protection Program (MPP) for first-time home buyers.&amp;nbsp;The MPP will provide up to $1,500 in mortgage payment assistance per month for six months to qualified first-time home buyers who lose their jobs due to a layoff.&amp;nbsp; The program is supported by&amp;nbsp;a $1 million allocation&amp;nbsp;from the the C.A.R. Housing Affordability Fund.&amp;nbsp;C.A.R. anticipates it can serve up to 3,000 homeowners in 2009.&lt;/p&gt;

&lt;p&gt;To qualify for the Mortgage Protection Program, applicants must:&lt;/p&gt;

&lt;li&gt;Be a first-time home buyer - someone who has not owned a home in three or more years;&amp;nbsp; &lt;/li&gt;
