Idaho Short Sales

Is your state a recourse or non-recourse state when it comes to debt relief and foreclosures?

In a non-recourse mortgage state, borrowers are not held personally liable for more than the home's value at the time that the loan is repaid. The lender may recoup some of its loss through foreclosure. However, the lender may not sue the borrower for additional funds. If the foreclosure sale does not generate enough money to satisfy the loan, the lender must accept the loss.

Each non-recourse state has its own anti-deficiency statutes that prohibit lenders from seeking judgments. In a few cases, anti-deficiency statues do allow lenders to collect a limited amount of money from the borrower (such as the difference between the debt and the fair market value of the property).

Note that in some states (such as California) non-recourse laws apply only to "purchase money" loans (i.e. original home loans that are used to purchase property). Almost all HELOCs and home equity loans are considered recourse loans and lenders for these loans may sue borrowers to recoup loss. (Except in some cases where the second mortgage lender forces the foreclosure). There has been some speculation that mortgage refinances do not constitute "purchase money" loans. However, there have been no cases to determine this issue one way or the other.

One Action States

In some states, lenders are only permitted a single lawsuit to collect mortgage debt. This plays out differently depending on the state's laws. In New York, for example, a lender must choose between the actions of foreclosing on the property or suing to collect the debt. The following states have some type of one action statute:

So, Idaho has both to contend with. If you have only a first mortgage, usually you will be fine without any ramifications. If you have a second mortgage or a HELOC, there may be possibilities that your lender will require some debt payback or a note to be signed prior to releasing the lien.

Excuse Me... Waiter, There's a Hair in My Short Sale...

Have you ever had a short sale that started off good with a first & second lender, then toward the end or maybe even at the closing table, they throw out something like, "We want the borrower to sign a note for the entire deficiency." Or, the primary lender is fine with 6% commission, but the second mortgage holder will only agree to pay 4%...

Wow! How do you handle some of these obstacles?

I wish I could just hale the Waiter and ask him for a new bowl of short sale please...

These are perils that we all face & I believe it's best to communicate with the lenders in advance about how their program works and ask for their guidelines for a short sale.

It's even more important to educate your seller to make them aware of potential pitfalls that may come their way. Provide them with access to good counsel; attorney, tax adviser, financial planner, credit counselor, etc.

Will Banks Just Start Saying "NO"?

With new Short Sale Guidelines coming in the near future and the pressure put on banks to give an answer within 10 days of receiving the short sale request, will they just start saying no?

We all know that third-party lenders are swamped with short sale files, which they are trying to get processed. With all the parties involved, including investors like FNMA or FDMC as well as a multitude of private investors, will the banks actually be able to give an answer within that short amount of time?

There are fears that they may just start to answer "no" and then send the property to foreclosure. This could cause havoc on home sellers and buyers alike! This practice could also potentially flood the market with more foreclosures, causing home prices to drop even more in some regions.

Let's hope the Treasury Dept. will be smart with the new guidelines and help the process rather than hinder the bigger picture.

Nampa Idaho Realtor, Don Wixom, believes the new guidelines are a good thing and very much needed, but will the banks actually be able to process short sales that quickly. It may create new jobs by spreading out the work load to new employees, but the learning curve might be another issue.

Ten Mile Overpass Demolition: Meridian, Idaho

When traveling from your Nampa Home to your Boise job or from your Boise Home to your Canyon County job, there is traffic! Some times of the day are worse than others and the 55 speed limit is certainly a bother as well....

But, they are fixing the roads! YEAH! A nice wider freeway between Nampa and Boise will be great....and a long time needed! A much easier drive home is on its way! See the entire article here.

Please plan ahead for the following traffic changes:

Please plan ahead for Dec. 11, when the Idaho Transportation Department will demolish the Ten Mile Overpass on I-84.

I-84 will be closed overnight between the Garrity and Meridian interchanges for the demolition.
Work will start at 10 p.m. Dec. 11 and end at 7 a.m. Dec. 12.
During this time, flaggers will detour motorists to Franklin Road by way of the Meridian and Garrity interchanges. Click here to see a detour map.
Please expect delays or choose an alternate route.

Starting Dec. 11, Ten Mile Road will be closed from Franklin Road to Overland Road while a new interchange is constructed to replace the overpass. The road will re-open in Summer 2011. Click here for a map of alternate routes across I-84.

Simpler Short Sale Guidelines for Idaho Real Estate

New Short Sale Guidelines

Idaho has a large number of Short Sales as well as foreclosures on the market which, for the most part, is driving the current home values. Many buyers as well as sellers have been disenchanted with the whole short sale process and timeline in which the process takes place.

These new guidelines that are forthcoming will assist your Idaho Realtor in processing a short sale transaction on behalf of both parties (buyer and seller). When investors zero in on short sales, they have more time to wait out the process until the third-party lender approves the file. When a buyer who plans to occupy the home, often has timeline constraints and gets discouraged quicker.

The U.S. Treasury Department on Monday released a plan to speed up and encourage Short Sales as a means to help families avoid foreclosure. RE/MAX International as well as The National Association of Realtors has been offering Short Sale proposals to public officials for over a year, and although the new guidelines aren't everything we were hoping for, they do represent a significant improvement over the current situation.

Short Sales have been difficult to close, and these new measures are a huge step in the right direction. One major highlight: A lender must give a yes or no answer to an offer within 10 days. Also included: a moving allowance, incentives for sellers and lenders, commission rules, and a stipulation that releases sellers from debt liabilities.

As we've said throughout 2009, the key is to become experts in the process. We expect a tremendous increase in Short Sales during the coming year, and it's vital that RE/MAX Associates continue to lead the industry in Distressed Property skills and training.

The National Association of Realtors currently only offers one designation for Realtor members in regards to Distressed Properties.

Top Producing Idaho Realtor

Don Wixom, Broker/Owner of RE/MAX Advantage in Nampa, ID was named as one of Nampa's Top Producers at the most recent general membership meeting of the Nampa Association of Realtors.
