      <title>Thankful.</title>
      <description>&lt;p&gt;Wow.&amp;nbsp; It feels good to be back in blogging action!&amp;nbsp; It's been a long and short road to my leaving the real estate industry to join State Farm.&amp;nbsp; I'm opening my office in nine days, to be exact.&lt;/p&gt;
&lt;p&gt;I know, I should be thinking about Christmas gifts, mistletoe and all the other stuff that comes along with this season, but I'm just not in the mood, given the enormous responsibility that I have right now.&amp;nbsp; Sometimes I think we can get so overwhelmed by tomorrow that we don't take time to relax in today.&amp;nbsp; So, today, I'm going to be thankful and mindful of today - just today.&lt;/p&gt;
&lt;p&gt;I'm thankful for what Christmas represents to all of us here on earth - peace, love, joy, and a reminder that we're not alone.&lt;/p&gt;
&lt;p&gt;I'm thankful that I've been afforded the opportunity to live in this great country called the USA.&lt;/p&gt;
&lt;p&gt;I'm thankful for children who run to me when I come home every evening.&lt;/p&gt;
&lt;p&gt;I'm thankful for folks who allow me the privilege of calling them friends.&lt;/p&gt;
&lt;p&gt;Merry Christmas - I truly wish everyone peace, love, and joy.&lt;/p&gt;</description>

      <title>After a month sabbatical from Active Rain.</title>
      <description>&lt;p&gt;Today was the first time in over four weeks that I logged on to Active Rain.&amp;nbsp; I stopped participating on Active Rain because it was becoming monotonous for me - and it was taking far too much time away from result producing activities.&lt;/p&gt;&lt;p&gt;&amp;nbsp;As real estate agents, I think we&amp;#39;re fooling ourselves if we think we can spend an inordinate amount of time on the web and expect our sales to improve.&amp;nbsp; So what did I learn after a month of not being on Active Rain?&lt;/p&gt;&lt;p&gt;1. Business takes place on the street, not at home or your office.&lt;/p&gt;&lt;p&gt;2. The real estate business is about B2B (belly to belly).&amp;nbsp; You must get out and talk to people everyday.&amp;nbsp; You may make hundreds of friends online, but offline is where you will grow your business.&lt;/p&gt;&lt;p&gt;3. The internet is not the ultimate place to find buyers.&lt;/p&gt;&lt;p&gt;4. There are many businesses that can be built online - real estate is not one of them.&lt;/p&gt;</description>

      <description>&lt;p&gt;I&amp;#39;m reading a really interesting book by Marcus Buckingham &amp;amp; Donald Clifton, Ph.D., entitled &amp;quot;Now, Discover Your Strengths.&amp;quot;&lt;/p&gt;&lt;p&gt;Have you ever been asked about your strengths and your weaknesses?&amp;nbsp; I&amp;#39;ve heard a lot of people advise you to work on your weakness upon discovering them.&amp;nbsp; The authors have done much research on this subject and advise to focus on your strengths, while recognizing your weaknesses and how you can compensate for those weaknesses by enhancing your strengths.&lt;/p&gt;&lt;p&gt;One of the benefits of buying the book is that it directs you to a strength profile that helps you discover your strengths.&amp;nbsp; Boy, talk about insightful.&lt;/p&gt;&lt;p&gt;I&amp;#39;ll talk about what I discovered about my strengths&amp;nbsp;in another blog.&amp;nbsp; Go get this book!&lt;/p&gt;</description>

      <title>University of Alabama still a party school.</title>
      <description>&lt;p&gt;The local news recently reported that Alabama is no longer in the top ten party schools, according to the Princeton Review.&amp;nbsp; Ah, that&amp;#39;s too bad.&lt;/p&gt;&lt;p&gt;It appears that the UA students may have settled down a bit - Princeton Review ranks University of Alabama at #19 out of 20 schools.&amp;nbsp; Of course, being the competitive college that UA is, I&amp;#39;m sure the student body will get together and try to figure out how to raise their ranking.&amp;nbsp; I&amp;#39;m sure this will make the parents jump for joy.&lt;/p&gt;&lt;p&gt;I can hear the phone conversations now...&amp;quot;ah, Mom, I really need to change schools, we&amp;#39;re down to #19 on the top party school list...&amp;quot;&lt;/p&gt;</description>

      <title>Alien Blogger?</title>
      <description>&lt;p&gt;&lt;img src=&quot;http://activerain.com/image_store/uploads/6/1/9/1/1/ar118756792111916.jpg&quot; height=&quot;135&quot; alt=&quot; &quot; width=&quot;98&quot; /&gt;Okay, so I didn&amp;#39;t mean ALIEN as in U.F.O. alien.&amp;nbsp; I am referring to blogging in other territories, or &amp;quot;worlds&amp;quot; that you aren&amp;#39;t comfortable in, or you simply are new to.&amp;nbsp;&lt;/p&gt;&lt;p&gt;I&amp;#39;ve been so focused on blogging on Active Rain that I haven&amp;#39;t really taken the time to read other blogger stuff outside of the real estate area. &lt;/p&gt;&lt;p&gt;What sparked my curiosity with &amp;quot;outside&amp;quot; bloggers was the fact that I&amp;#39;ve been invited to San Francisco to spend some time with the author of &amp;quot;The Four Hour Work Week,&amp;quot; whose book hit the New York Times bestseller list because of blogging.&amp;nbsp; Yep, you heard me correct.&amp;nbsp; He is not only a blogger, but he hangs out with other bloggers outside his &amp;quot;world,&amp;quot; and blogging helped him nail the bestseller list with his FIRST book! &lt;/p&gt;&lt;p&gt;In fact, I&amp;#39;ll be playing tennis with a well known blogger who blogs about technology.&amp;nbsp; I&amp;#39;m really getting excited about the possibilities that blogging has to offer.&lt;/p&gt;&lt;p&gt;Take some time and travel to other worlds.&amp;nbsp; You just might find some &amp;quot;alien&amp;quot; friends, and in turn, expand your real estate business.&amp;nbsp;&lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;</description>

      <title>My visit with the guys at SimplySold(r)</title>
      <description>&lt;p&gt;&lt;img src=&quot;http://activerain.com/image_store/uploads/8/6/3/9/7/ar118736292579368.gif&quot; height=&quot;95&quot; alt=&quot; &quot; width=&quot;310&quot; /&gt;&lt;/p&gt;&lt;p&gt;I recently made a 2 1/2 hour trip to see the guys over at SimplySold(r) in Douglasville, Georgia.&amp;nbsp; They have a really neat business model for the real estate brokerage business, and it appears that they are growing and expanding at an admirable rate, given the current real estate environment.&lt;/p&gt;&lt;p&gt;I met with Craig McClelland and Scott Dasher, both owners of the franchise company.&amp;nbsp; I was impressed by their energy and enthusiasm for what they are doing.&amp;nbsp; Their &amp;quot;little&amp;quot; office in Douglasville, Georgia has over eighty agents, and apparently they are generating a lot of business.&lt;/p&gt;&lt;p&gt;I had read about this company several years ago, and then I contacted a fellow Active Rain member, Damion Flynn in Gulfport, MS.&amp;nbsp; Damion was kind enough to refer my name to SimplySold&amp;#39;s VP, Craig McClelland.&amp;nbsp; Craig&amp;#39;s a bulldog and invited me to come over and &amp;quot;throw around some possibilities.&amp;quot;&lt;/p&gt;&lt;p&gt;Both of us being &amp;quot;typical entrepreneurs&amp;quot; and probably a little &amp;quot;A.D.D.,&amp;quot; we didn&amp;#39;t shut up for several hours.&amp;nbsp; The ideas were rampant and all over the board, so to speak.&lt;/p&gt;&lt;p&gt;I left my visit with a renewed enthusiasm for creative opportunities in the real estate business.&amp;nbsp; I&amp;#39;m certain that these guys will be successful, and I wish them the best.&lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;</description>

      <description>&lt;p&gt;&lt;img src=&quot;http://activerain.com/image_store/uploads/4/6/8/2/3/ar118736215432864.jpg&quot; height=&quot;226&quot; alt=&quot; &quot; width=&quot;246&quot; /&gt;&lt;/p&gt;&lt;p&gt;The mayor of Tuscaloosa, Walt Maddox said that voluntary water conservation efforts are working to sustain the city of Tuscaloosa&amp;#39;s water reserves, but an equipment failure or major fire could force the city into mandatory water conservation efforts.&lt;/p&gt;&lt;p&gt;So far the water levels are showing some gain.&amp;nbsp; Recently the reserves had been tapped by as much as 25%.&amp;nbsp; The mayor still says that Tuscaloosa&amp;#39;s water system isn&amp;#39;t past the crisis stage yet, but if the present trend continues, he doesn&amp;#39;t think that we&amp;#39;ll have to have stronger conservation efforts.&lt;/p&gt;&lt;p&gt;The Alabama Forestry Commission just issued a no-burn order for 59 counties throughout Alabama, including all counties in West Alabama.&amp;nbsp; Under this order, it is against the law for campfires, fires to burn trash and debris, or any fires for that matter.&amp;nbsp; Severe drought conditions are causing far too many problems on our water supply to have to deal with putting out fires.&lt;/p&gt;</description>

      <title>Proof that I saw Elvis.</title>
      <description>&lt;p&gt;&lt;img src=&quot;http://activerain.com/image_store/uploads/7/3/3/9/4/ar118728028149337.jpg&quot; height=&quot;343&quot; alt=&quot; &quot; width=&quot;237&quot; /&gt;&lt;/p&gt;&lt;p&gt;The year was 1973.&amp;nbsp; It was a warm summer day when we got the call from Uncle Ed and Aunt Marty.&amp;nbsp; Elvis was coming to Houston and Uncle Ed had tickets for us all.&amp;nbsp; It was like Christmas all over again.&amp;nbsp; I could hardly breath upon hearing the news from Mom and Dad that we were going to see Elvis.&amp;nbsp; Mom had&amp;nbsp;barely gotten the words out before I was running outside to go tell my friends.&amp;nbsp; I was five years old.&lt;/p&gt;&lt;p&gt;I don&amp;#39;t really remember how young I was when I first started listening to Elvis Presley records, yes I said records.&amp;nbsp; Mom said from the time I was old enough to talk, I would sing myself to sleep every night.&amp;nbsp; I remember getting the old white, plastic, portable record player for Christmas the year before - and more Elvis Albums.&amp;nbsp; I think I had all of the Elvis records made at the time.&lt;/p&gt;&lt;p&gt;The day finally came for the concert.&amp;nbsp; Uncle Ed had just bought a new camera to capture this great event on film.&amp;nbsp; It must be a gift from God, I thought.&amp;nbsp; Now I will be able to prove to my unbelieving neighborhood friends that I had actually seen Elvis in the flesh.&lt;/p&gt;&lt;p&gt;The concert was incredible.&amp;nbsp; Uncle Ed had also brought his binoculars, and my mom tells me that as I would look through the binoculars I would gleefully scream, &amp;quot;He looked at me, Momma, Elvis looked at me.&amp;quot;&lt;/p&gt;&lt;p&gt;Several days went by and I would check the mailbox everyday awaiting the arrival of my proof to my friends.&amp;nbsp; Then the phone call came.&amp;nbsp; It was Aunt Marty.&amp;nbsp; She had bad news for us.&amp;nbsp; Uncle Ed had forgotten to take the lens cap off of his brand new, expensive camera.&amp;nbsp; &lt;/p&gt;&lt;p&gt;That was over thirty four years ago, and I&amp;#39;m still as dissapointed now as I was then.&lt;/p&gt;&lt;p&gt;So long, Elvis.&amp;nbsp; I still miss you.&lt;/p&gt;</description>

      <title>Bring back the 80's!</title>
      <description>&lt;p&gt;&lt;img src=&quot;http://activerain.com/image_store/uploads/8/0/1/8/9/ar118716998298108.jpg&quot; height=&quot;250&quot; alt=&quot; &quot; width=&quot;250&quot; /&gt;&lt;/p&gt;&lt;p&gt;I went home for lunch yesterday and my wife had the satellite eighties music station playing on the stereo system.&amp;nbsp; The song that was playing was &amp;quot;Stay the Night.&amp;quot;&amp;nbsp; This song hit the charts around 1987 and Benjamin Orr, former singer with the Cars, had this on his album.&amp;nbsp; I hadn&amp;#39;t heard this song in years!!!&lt;/p&gt;&lt;p&gt;Suddenly, I had a flashback.&amp;nbsp; Nostalgia at its finest.&amp;nbsp; I realized that the eighties, at least for me, were absolutely fantastic.&amp;nbsp; It was a time of learning about life, and doing circles around the town while listening to &amp;quot;She&amp;#39;s Got to Be Somebody&amp;#39;s Baby&amp;quot; by Jackson Browne, and &amp;quot;No Parking on The Dance Floor&amp;quot; by Midnight Star.&lt;/p&gt;&lt;p&gt;It was &amp;quot;Fast Times at Ridgemont High,&amp;quot; and drinking beer underage (not that I&amp;#39;m promoting that).&amp;nbsp; Skipping school on Fridays.&amp;nbsp; Cold football nights and warm blankets, and the girl letting you know that she wouldn&amp;#39;t want to be anywhere else but with you.&lt;/p&gt;&lt;p&gt;I remembered the music that was playing on the radio as Leslie (maybe her real name, maybe not)&amp;nbsp;picked me up in her mother&amp;#39;s Buick Park Avenue.&amp;nbsp; She&amp;nbsp;knew a really nice place&amp;nbsp;to &amp;quot;watch the stars.&amp;quot;&amp;nbsp; She was a senior.&amp;nbsp; I was a freshman.&amp;nbsp; Life was good.&lt;/p&gt;&lt;p&gt;I have this dream about re-creating the eighties.&amp;nbsp; One big party.&amp;nbsp; People from all over the country meeting to have the biggest eighties party since the eighties.&amp;nbsp; Maybe the guys and girls won&amp;#39;t look the same, but I guarantee you that we&amp;#39;ll all feel like we used to&amp;nbsp;back then - if only for a fleeting moment.&lt;/p&gt;&lt;p&gt;Bring back the 80&amp;#39;s!&lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;</description>

      <description>&lt;p&gt;&lt;img src=&quot;http://activerain.com/image_store/uploads/9/8/9/2/5/ar118711045052989.JPG&quot; height=&quot;195&quot; alt=&quot; &quot; width=&quot;198&quot; /&gt;&lt;/p&gt;&lt;p&gt;I&amp;#39;m not sure that the title of this blog shouldn&amp;#39;t be, &amp;quot;Another One Bites the Dust.&amp;quot;&amp;nbsp;&amp;nbsp;I just heard about more mortgage lenders &amp;quot;biting the dust,&amp;quot; this week.&lt;/p&gt;&lt;p&gt;It appears that a majority of our nation&amp;#39;s banks have tightened the lending standards on subprime mortgages, again.&amp;nbsp;Will it affect our beloved buyers?&amp;nbsp; Maybe.&lt;/p&gt;&lt;p&gt;Back in 1996, I was in the mortgage business and most of the mortgage lending was conventional (5% - 20% down), FHA, and Veteran Administration lending.&amp;nbsp; They say what comes around goes around, and here we are eleven years later and the mortgage lenders are back to the &amp;quot;old&amp;quot; ways.&amp;nbsp; Traditional lending has always been the foundation of our real estate financing, and believe it or not, only 14% or less of the mortgage lending in the United States is subprime, according to a recent report by economists.&lt;/p&gt;&lt;p&gt;Well, I&amp;#39;m not looking for the sky to fall and I don&amp;#39;t think you should be either.&amp;nbsp; This is a different real estate market, and the cream will rise to the top.&amp;nbsp; Hey, look at it this way, there will be more opportunities for those who work hard.&lt;/p&gt;</description>

      <description>&lt;p&gt;&lt;img src=&quot;http://activerain.com/image_store/uploads/9/5/1/9/8/ar118710985089159.JPG&quot; height=&quot;327&quot; alt=&quot; &quot; width=&quot;300&quot; /&gt;&lt;/p&gt;&lt;p&gt;In case you didn&amp;#39;t recognize the title of this blog, it&amp;#39;s from a Marty Robbin&amp;#39;s song, Water.&amp;nbsp; I really like that song, but if you live in Tuscaloosa, Alabama right now, you might want to turn the old sprinkler off for a while.&lt;/p&gt;&lt;p&gt;The Mayor of Tuscaloosa, Walt Maddox, said the water tank near the North River area had dropped to less than 25% of it&amp;#39;s capacity, prompting the mayor to ask North of the River residents to cut off the water use, or at least curtail it a bit.&lt;/p&gt;&lt;p&gt;If you live north of the Black Warrior River in Tuscaloosa, the city of Tucaloosa has asked that those folks with odd-numbered street addresses to only water their lawns on odd-numbered dates, and residents with even-numbered addresses shouold water their lawns on even-numbered dates.&amp;nbsp; Additionally, the city of Tuscaloosa has also asked that residents only water their lawns between 8 p.m. and 8 a.m.&lt;/p&gt;&lt;p&gt;I kind of like the idea myself.&amp;nbsp; Less grass to cut.&lt;/p&gt;</description>

      <title>The Eighth Commandment - Thou Shall Not Steal...a Blog?</title>
      <description>&lt;p&gt;&lt;img src=&quot;http://activerain.com/image_store/uploads/4/3/0/0/0/ar118696680900034.jpg&quot; height=&quot;506&quot; alt=&quot; &quot; width=&quot;501&quot; /&gt;&lt;/p&gt;&lt;p&gt;Most of us never think of ourselves as thieves.&amp;nbsp; At least I don&amp;#39;t.&amp;nbsp; However, I heard a really good sermon this morning that got me thinking.&amp;nbsp; Stealing doesn&amp;#39;t necessarily mean taking something physical, like a car, away from its rightful owner.&amp;nbsp; We can steal just about anything, including blogs.&lt;/p&gt;&lt;p&gt;Okay, I admit, I&amp;#39;ve cheated in school before, but that was many years ago.&amp;nbsp; In fact, I was quite creative at cheating every now and then.&amp;nbsp; But I can say that I haven&amp;#39;t stolen a blog.&lt;/p&gt;&lt;p&gt;Now I am borrowing this drawing of the ten commandments, and I would gladly give credit to its creator - this drawing, not the actual ten commandments Creator, okay?&amp;nbsp; I tried to find the artist, but to no avail.&lt;/p&gt;&lt;p&gt;Anyway, I&amp;#39;ve heard of some Active Rain members plagiarizing from other members or writers and posting it on their blog.&amp;nbsp; This is stealing, plain and simple, right?&lt;/p&gt;&lt;p&gt;Be original.&amp;nbsp; Be creative.&amp;nbsp; Write your own stuff, even though you may think that it&amp;#39;s dreadfully boring. But don&amp;#39;t steal blogs.&amp;nbsp; You&amp;#39;ll be breaking the eighth commandment.&lt;/p&gt;</description>

      <description>&lt;p&gt;&lt;img src=&quot;http://activerain.com/image_store/uploads/7/7/0/7/1/ar118684574517077.jpg&quot; height=&quot;301&quot; alt=&quot; &quot; width=&quot;209&quot; /&gt;&lt;/p&gt;&lt;p&gt;I was recently given a book entitled, &amp;quot;The DaVinci Method&amp;quot; by Garret Loporto.&amp;nbsp;The reason my friend sent me this book is because it seems that DaVinci had the following traits: Impulsive, Risk Taker, Rebel against authority, Intuitive, and on and on.&lt;/p&gt;&lt;p&gt;Oh, and it appears, according to the author, that Leonardo DaVinci had A.D.D.&amp;nbsp; Go figure.&lt;/p&gt;&lt;p&gt;Now I have to admit that I do tend to have the above &amp;quot;qualities,&amp;quot; and maybe A.D.D., but sometimes other people know you better than you know yourself.&amp;nbsp; &lt;/p&gt;&lt;p&gt;Anyway, the book looks enticing and I&amp;#39;m going to start reading it soon, after I finish the other fifteen that are stacked up awaiting my attention.&amp;nbsp; But, when I do finish the book, I&amp;#39;ll blog about it.&lt;/p&gt;</description>

      <description>&lt;p&gt;&lt;img src=&quot;http://activerain.com/image_store/uploads/6/7/6/9/8/ar118678259389676.gif&quot; height=&quot;349&quot; alt=&quot; &quot; width=&quot;321&quot; /&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;July 2007 Market Report&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;The total number of homes sold in Tuscaloosa County for the month of July, 2007 was 252.&amp;nbsp; Twenty seven percent (27%) of the homes sold were new construction.&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;The total number of homes on the market has increased again to 1,969, with the average DOM (days on market) rising to 112.&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;The average selling price was $179,739.&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;Compared to July of 2006, the number of homes for sale is up 29%.&amp;nbsp; There are 451 additional homes for sale than last year at this time.&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;Overall, I&amp;#39;m a little concerned about the number of homes on the market.&amp;nbsp; It doesn&amp;#39;t appear that builders are slowing down any, but yet I don&amp;#39;t see a demand for housing increasing compared to the number of new constructions that are going up.&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;The number of homes sold last year at this time was 241, which is an indication that the number of homes sold this year did not increase that much.&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;</description>

      <description>&lt;p&gt;&lt;img src=&quot;http://activerain.com/image_store/uploads/9/3/1/2/1/ar118641108012139.gif&quot; height=&quot;337&quot; alt=&quot; &quot; width=&quot;427&quot; /&gt;&lt;/p&gt;&lt;p&gt;I&amp;#39;m fiercely protective of my sellers and am always looking out for their best interest, even if it means voiding a contract by abiding by the contract.&lt;/p&gt;&lt;p&gt;Here&amp;#39;s the story.&amp;nbsp; I have a listing that I received a contract on two months ago.&amp;nbsp; The contract, submitted by another agent, had a few contingent clauses in the offer, one of which was that the offer was contingent upon the buyer&amp;#39;s home selling.&amp;nbsp; The contract also had a forty-eight hour first right of refusal attached to it.&lt;/p&gt;&lt;p&gt;The buyer had a home inspection done, and the home inspector found some items to be repaired - duh, go figure, that&amp;#39;s what they&amp;#39;re getting paid for right?&amp;nbsp; Well anyway, I simply informed the buyer&amp;#39;s agent that we would be happy to make the repairs if her buyer would remove the contingencies about her home selling first.&amp;nbsp; The agent said that her buyer would not do that, so we haven&amp;#39;t made repairs.&lt;/p&gt;&lt;p&gt;Fast forward two weeks.&amp;nbsp; I have a buyer who wants to buy this listing with no contingencies.&amp;nbsp; I call the other agent and tell them that we will honor the 48 hour first right of refusal, but are making no repairs, i.e., take it as is.&lt;/p&gt;&lt;p&gt;Now bear in mind that my contract clearly states that if a written agreement about repairs isn&amp;#39;t agreed to within 3 days after making the repair request to the sellers, the contract can be cancelled by either parties.&lt;/p&gt;&lt;p&gt;Conversation ensues...&lt;/p&gt;&lt;p&gt;Buyer Agent:&amp;nbsp; Well, I&amp;#39;m going to call my seller and see if she will remove the home sale contingency.&lt;/p&gt;&lt;p&gt;Me:&amp;nbsp; Didn&amp;#39;t you already try that once before?&lt;/p&gt;&lt;p&gt;Buyer Agent: Yes, but now it&amp;#39;s critical.&lt;/p&gt;&lt;p&gt;Me: Hmm, I see.&lt;/p&gt;&lt;p&gt;Buyer Agent calls me back: &amp;quot;My buyer said that she would remove the contingency but wants the repairs done.&lt;/p&gt;&lt;p&gt;Me: Well isn&amp;#39;t that interesting.&amp;nbsp; Now that I have a better contract she wants to deal, but still wants the repairs.&lt;/p&gt;&lt;p&gt;Buyer Agent: That&amp;#39;s right.&lt;/p&gt;&lt;p&gt;Me: No way, Hosea.&amp;nbsp; As is or nothing.&lt;/p&gt;&lt;p&gt;Buyer Agent: I guess I need to call my attorney then.&lt;/p&gt;&lt;p&gt;Me: Please have him call me.&lt;/p&gt;&lt;p&gt;Ring. Ring.&lt;/p&gt;&lt;p&gt;Dumbass, er, I mean Attorney (DAA): Mr. Murphy.&lt;/p&gt;&lt;p&gt;Me: Speaking.&lt;/p&gt;&lt;p&gt;DAA: We seem to have a problem with the contract for Agent Blah, Blah.&lt;/p&gt;&lt;p&gt;Me: What&amp;#39;s the problem?&lt;/p&gt;&lt;p&gt;DAA: Well, you can&amp;#39;t give a notice and not do the repairs.&lt;/p&gt;&lt;p&gt;Me: I can&amp;#39;t?&lt;/p&gt;&lt;p&gt;DAA: Nope&lt;/p&gt;&lt;p&gt;Me: Have you read the contract?&lt;/p&gt;&lt;p&gt;DAA: (stutters) I don&amp;#39;t have it in front of me.&lt;/p&gt;&lt;p&gt;Me: Well, I do and please allow me to read this to you.&amp;nbsp; &amp;quot;If Seller(s) does not give notice to Buyer(s) within the time period specified (3 days after receipt of the repair request), or parties do not agree, in writing, with regard to repairs, this Agreement shall be deemed voided and earnest money shall be returned to Buyer(s) in accordance with Alabama Real Estate License Law Rule #790-x-3-03(4)((5), unless otherwise agreed to in writ8ing by both parties.&amp;quot;&lt;/p&gt;&lt;p&gt;DAA: I&amp;#39;ll have to read the contract once I get it in my hands.&amp;nbsp; I&amp;#39;m kind of going blindly.&lt;/p&gt;&lt;p&gt;Me: Well, what I just read you is just what you will read once you get your hands on the contract.&lt;/p&gt;&lt;p&gt;DAA: It looks like I&amp;#39;m going to need to talk to your attorney.&lt;/p&gt;&lt;p&gt;Me: That would be great.&amp;nbsp; I&amp;#39;ve run this by him, oh, and by the way, he&amp;#39;s been the corporate counsel for a $40 million dollar a real estate closing and title insurance company and he&amp;#39;s in agreement with me on this.&lt;/p&gt;&lt;p&gt;DAA: Yeah, well we&amp;#39;ll see.&lt;/p&gt;&lt;p&gt;Me: You must have a lot of money.&lt;/p&gt;&lt;p&gt;DAA: What do you mean?&lt;/p&gt;&lt;p&gt;Me: Your obviously going to change the Alabama statute and tell the Alabama Real Estate Commission&amp;#39;s attorney&amp;#39;s that they are idiots.&amp;nbsp; That&amp;#39;s gonna cost you a lot of money.&lt;/p&gt;&lt;p&gt;..........buzz.....line goes dead.....DAA&amp;#39;s connection must have gone bad...&lt;/p&gt;&lt;p&gt;Fast forward, next day....&lt;/p&gt;&lt;p&gt;Broker of the agent who called the attorney (BOAWCA): Todd&lt;/p&gt;&lt;p&gt;Me: Yes&lt;/p&gt;&lt;p&gt;BOAWCA: I just found out that you got called by an attorney.&amp;nbsp; I&amp;#39;m so sorry.&amp;nbsp; This matter should not have been handled this way.&lt;/p&gt;&lt;p&gt;Me: I agree.&lt;/p&gt;&lt;p&gt;BOAWCA: I will take care of this.&amp;nbsp; Don&amp;#39;t worry about any more attorneys.&lt;/p&gt;&lt;p&gt;Me: Thanks, you&amp;#39;re the best.&lt;/p&gt;&lt;p&gt;Fast forward to this morning....&lt;/p&gt;&lt;p&gt;Me, calling the attorney...ring, ring....&lt;/p&gt;&lt;p&gt;DAA: DAA speaking.&lt;/p&gt;&lt;p&gt;Me: Hey, DAA, I just have one thing to say to you.&lt;/p&gt;&lt;p&gt;DAA: And that would be?&lt;/p&gt;&lt;p&gt;Me:&amp;nbsp; Bite me.&amp;nbsp; (click)&lt;/p&gt;&lt;p&gt;(Okay, this mornings conversation really didn&amp;#39;t take place, but I imagined what it would be like if it had. )&lt;/p&gt;</description>

      <description>&lt;p&gt;&lt;img src=&quot;http://activerain.com/image_store/uploads/8/8/1/1/6/ar118622924261188.jpg&quot; height=&quot;240&quot; alt=&quot; &quot; width=&quot;267&quot; /&gt;&lt;/p&gt;&lt;p&gt;If you are signing a mortgage and you are responsble for the mortgage and note, and your spouse or significant other is on the title, your spouse or significant other could be responsible for the bill, should something happen to you.&amp;nbsp; Always avoid having someone sign the mortgage who is not responsible for the debt.&lt;/p&gt;&lt;p&gt;Several years ago, I experienced a certain situation where a builder client had borrowed from a certain bank and he thought he was solely responsible for the debt.&amp;nbsp; This builder went bankrupt, and the bank tried to go after his spouse because of a small, unnoticeable clause within the mortgage legal jargon.&amp;nbsp; His spouse was not on the loan but had signed the mortgage, NOT the note.&lt;/p&gt;&lt;p&gt;I was recently at a closing where the buyer was getting his girfriend on the title.&amp;nbsp; I made reference to this rule and the closing attorney looked flabbergasted.&amp;nbsp; He said I was right and changed the way the closing was handled.&lt;/p&gt;&lt;p&gt;BE VERY CAREFUL WHEN SIGNING MORTGAGE DOCUMENTS AT CLOSING.&amp;nbsp; ASK YOUR CLOSING ATTORNEY ABOUT &amp;quot;FISH NET CLAUSE&amp;quot; OR &amp;quot;DRAG NET CLAUSE&amp;quot; WITHIN THE LEGAL DOCUMENTS.&lt;/p&gt;</description>
