The Worker, Homeownership, and Business Assistance Act of 2009 has established a tax credit of up to $6,500 for qualified move-up/repeat home buyers (existing home owners) purchasing a principal residence after November 6, 2009 and on or before April 30, 2010 (or purchased by June 30, 2010 with a binding sales contract signed by April 30, 2010).

The following questions and answers provide basic information about the tax credit. If you have more specific questions, we strongly encourage you to consult a qualified tax advisor or legal professional about your unique situation.

•1. Who is eligible to claim the $6,500 tax credit?
Qualified move-up or repeat home buyers purchasing any kind of home are eligible to claim this credit.

•2. What is the definition of a move-up or repeat home buyer?
The law defines a tax credit qualified move-up home buyer ("long-time resident") as a home owner who has owned and resided in a home for at least five consecutive years of the eight years prior to the purchase date. For married taxpayers, the law tests the homeownership history of both the home buyer and his/her spouse. Repeat home buyers do not have to purchase a home that is more expensive than their previous home to qualify for the tax credit.

•3. How is the amount of the tax credit determined?
The tax credit is equal to 10 percent of the home's purchase price up to a maximum of $6,500. Purchases of homes priced above $800,000 are not eligible for the tax credit.

•4. Are there any income limits for claiming the tax credit?
Yes. The income limit for single taxpayers is $125,000; the limit is $225,000 for married taxpayers filing a joint return. The tax credit amount is reduced for buyers with a modified adjusted gross income (MAGI) above those limits. The phase out range for the tax credit program is equal to $20,000. That is, the tax credit amount is reduced to zero for taxpayers with MAGI of more than $145,000 (single) or $245,000 (married) and is reduced proportionally for taxpayers with MAGIs between these amounts.

•5. What is "modified adjusted gross income"?
Modified adjusted gross income or MAGI is defined by the IRS. To find it, a taxpayer must first determine "adjusted gross income" or AGI. AGI is total income for a year minus certain deductions (known as "adjustments" or "above-the-line deductions"), but before itemized deductions from Schedule A or personal exemptions are subtracted. On Forms 1040 and 1040A, AGI is the last number on page 1 and the first number on page 2 of the form. For Form 1040-EZ, AGI appears on line 4 (as of 2007). Note that AGI includes all forms of income including wages, salaries, interest income, dividends and capital gains.

To determine modified adjusted gross income (MAGI), add to AGI certain amounts of foreign-earned income. See IRS Form 5405 for more details.

•6. If my modified adjusted gross income (MAGI) is above the limit, do I qualify for any tax credit?
Possibly. It depends on your income. Partial credits of less than $6,500 are available for some taxpayers whose MAGI exceeds the phase out limits.

•7. Can you give me an example of how the partial tax credit is determined?
Just as an example, assume that a married couple has a modified adjusted gross income of $235,000. The applicable phase out to qualify for the tax credit is $225,000, and the couple is $10,000 over this amount. Dividing $10,000 by the phase out range of $20,000 yields 0.5. When you subtract 0.5 from 1.0, the result is 0.5. To determine the amount of the partial first-time home buyer tax credit that is available to this couple, multiply $6,500 by 0.5. The result is $3,250.

Here's another example: assume that an individual home buyer has a modified adjusted gross income of $138,000. The buyer's income exceeds $125,000 by $13,000. Dividing $13,000 by the phase out range of $20,000 yields 0.65. When you subtract 0.65 from 1.0, the result is 0.35. Multiplying $6,500 by 0.35 shows that the buyer is eligible for a partial tax credit of $2,275.

Please remember that these examples are intended to provide a general idea of how the tax credit might be applied in different circumstances. You should always consult your tax advisor for information relating to your specific circumstances.

•8. How is this home buyer tax credit different from the tax credit that Congress enacted in July of 2008? How is this different than the rules established in early 2009?
The previous tax credits applied only to first-time home buyers and were for different amounts of money.

•9. How do I claim the tax credit? Do I need to complete a form or application? Are there documentation requirements?
You claim the tax credit on your federal income tax return. Specifically, home buyers should complete IRS Form 5405 to determine their tax credit amount, and then claim this amount on line 67 of the 1040 income tax form for 2009 returns (line 69 of the 1040 income tax form for 2008 returns).

No other applications are required, and no pre-approval is necessary. However, you will want to be sure that you qualify for the credit under the income limits and repeat home buyer tests. Note that you cannot claim the credit on Form 5405 for an intended purchase for some future date; it must be a completed purchase. Home buyers must attach a copy of their HUD-1 settlement form (closing statement) to Form 5405 as proof of the completed home purchase.

•10. What types of homes will qualify for the tax credit?
Any home that will be used as a principal residence will qualify for the credit, provided the home is purchased for a price less than or equal to $800,000. This includes single-family detached homes, attached homes like townhouses and condominiums, manufactured homes (also known as mobile homes) and houseboats. The definition of principal residence is identical to the one used to determine whether you may qualify for the $250,000 / $500,000 capital gain tax exclusion for principal residences.

It is important to note that you cannot purchase a home from, among other family members, your ancestors (parents, grandparents, etc.), your lineal descendants (children, grandchildren, etc.) or your spouse or your spouse's family members. Please consult with your tax advisor for more information. Also see IRS Form 5405.

•11. I read that the tax credit is "refundable." What does that mean?
The fact that the credit is refundable means that the home buyer credit can be claimed even if the taxpayer has little or no federal income tax liability to offset. Typically this involves the government sending the taxpayer a check for a portion or even all of the amount of the refundable tax credit.

For example, if a qualified home buyer expected, notwithstanding the tax credit, federal income tax liability of $5,000 and had tax withholding of $4,000 for the year, then without the tax credit the taxpayer would owe the IRS $1,000 on April 15th. Suppose now that the taxpayer qualified for the $6,500 home buyer tax credit. As a result, the taxpayer would receive a check for $5,500 ($6,500 minus the $1,000 owed).

•12. Instead of buying a new home from a home builder, I hired a contractor to construct a home on a lot that I already own. Do I still qualify for the tax credit?
Yes. For the purposes of the home buyer tax credit, a principal residence that is constructed by the home owner is treated by the tax code as having been "purchased" on the date the owner first occupies the house. In this situation, the date of first occupancy must be after November 6, 2009 and on or before April 30, 2010 (or by June 30, 2010, provided a binding sales contract was in force by April 30, 2010).

In contrast, for newly-constructed homes bought from a home builder, eligibility for the tax credit is determined by the settlement date. Be sure to check with a tax advisor in cases where a HUD-1 form is not used at settlement to be sure you have sufficient documentation to attach to IRS Form 5405.

•13. Can I claim the tax credit if I finance the purchase of my home under a mortgage revenue bond (MRB) program?
Yes. The tax credit can be combined with an MRB home buyer program.

•14. I am not a U.S. citizen. Can I claim the tax credit?
Perhaps. Anyone who is not a nonresident alien (as defined by the IRS) and who has owned and resided in a principal residence in the United States for at least five consecutive years of the eight years prior to the purchase date can claim the tax credit if they meet the income limits. For married taxpayers, the law tests the homeownership history of both the home buyer and his/her spouse. The IRS provides a definition of "nonresident alien" in IRS Publication 519.

•15. Is a tax credit the same as a tax deduction?
No. A tax credit is a dollar-for-dollar reduction in what the taxpayer owes. That means that a taxpayer who owes $6,500 in income taxes and who receives an $6,500 tax credit would owe nothing to the IRS.

A tax deduction is subtracted from the amount of income that is taxed. Using the same example, assume the taxpayer is in the 15 percent tax bracket and owes $6,500 in income taxes. If the taxpayer receives a $6,500 deduction, the taxpayer's tax liability would be reduced by $975 (15 percent of $6,500), or lowered from $6,500 to $5,525.

•16. Is there a way for a home buyer to access the money allocable to the credit sooner than waiting to file their 2009 or 2010 tax return?
Yes. Prospective home buyers who believe they qualify for the tax credit are permitted to reduce their income tax withholding. Reducing tax withholding (up to the amount of the credit) will enable the buyer to accumulate cash by raising his/her take home pay. This money can then be applied to the down payment.

Buyers should adjust the withholding amount on their W-4 via their employer or through their quarterly estimated tax payment. IRS Publication 919 contains rules and guidelines for income tax withholding. Prospective home buyers should note that if income tax withholding is reduced and the tax credit qualified purchase does not occur, then the individual would be liable for repayment to the IRS of income tax and possible interest charges and penalties.

In addition, rule changes made as part of the economic stimulus legislation allow home buyers to claim the tax credit and participate in a program financed by tax-exempt bonds. As a result, some state housing finance agencies have introduced programs that provide short-term second mortgage loans that may be used to fund a down payment. Prospective home buyers should check with their state housing finance agency to see if such a program is available in their community. To date, 18 state agencies have announced tax credit assistance programs, and more are expected to follow suit. The National Council of State Housing Agencies (NCSHA) has compiled a list of such programs, which can be found here.

•17. HUD allows "monetization" of the tax credit. What does that mean?
It means that HUD will allow buyers using FHA-insured mortgages to apply their anticipated tax credit toward their home purchase immediately rather than waiting until they file their 2009 or 2010 income taxes to receive a refund. These funds may be used for certain down payment and closing cost expenses.

Under the guidelines announced by HUD, non-profits and FHA-approved lenders are allowed to give home buyers short-term loans. The guidelines also allow government agencies, such as state housing finance agencies, to facilitate home sales by providing longer term loans secured by second mortgages.

Housing finance agencies and other government entities may also issue tax credit loans, which home buyers may use to satisfy the FHA 3.5 percent down payment requirement.

In addition, approved FHA lenders can purchase a home buyer's anticipated tax credit to pay closing costs and down payment costs above the 3.5 percent down payment that is required for FHA-insured homes.

•18. If I'm qualified for the tax credit and buy a home in 2009 (or 2010), can I apply the tax credit against my 2008 (or 2009) tax return?
Yes. The law allows taxpayers to choose ("elect") to treat qualified home purchases in 2009 (or 2010) as if the purchase occurred on December 31, 2008 (or if in 2010, December 31, 2009). This means that the previous year's income limit (MAGI) applies and the election accelerates when the credit can be claimed. A benefit of this election is that a home buyer in 2009 or 2010 will know their prior year MAGI with certainty, thereby helping the buyer know whether the income limit will reduce their credit amount.

Taxpayers buying a home who wish to claim it on their prior year tax return, but who have already submitted their tax return to the IRS, may file an amended return claiming the tax credit using Form 1040X. You should consult with a tax professional to determine how to arrange this.

•19. For a home purchase in 2009 or 2010, can I choose whether to treat the purchase as occurring in the prior or present year, depending on in which year my credit amount is the largest?
Yes. If the applicable income phase out would reduce your home buyer tax credit amount in the present year and a larger credit would be available using the prior year MAGI amounts, then you can choose the year that yields the largest credit amount.

What You Should Know About Home Inspections

Since obtaining a home inspection is one of the most important steps in purchasing a home, I thought I'd take the opportunity to provide some insight into the home inspection process.

A qualified inspector can point out potential costly problems with the home you are considering buying, and a good inspector will give maintenance advice and ultimately give you peace of mind about your home investment. All home buyers -- whether they are buying an older home or building a new one -- should have the home inspected by a professional after making an offer and before closing.

There are a few things you need to know before hiring a home inspector. First, the home inspection industry is becoming more professional and regulated. There are professional organizations with codes of ethics, like the National Association of Home Inspectors and the American Society of Home Inspectors, but membership is voluntary.

The average home inspection costs $300, which is paid on the day the inspector examines your home. This can be arranged to pay at the closing. Lower or higher fees do not necessarily reflect the expertise of the inspector. Finding an experienced home inspector who provides value for your money is most important.

The American Society of Home Inspectors (www.ashi.com) recommends interviewing at least three professional inspectors in order to find one you trust and with whom you communicate well. I can provide a list of local home inspectors for you to interview, and you should ask friends and family members for recommendations as well.

Ask inspectors about their qualifications. Do they have experience in the construction or engineering industry? Do they have special training or accreditation from a professional organization? How long have they been inspecting homes in the local area? Are they familiar with problems specific to our area like drainage issues, pests or building material failures?

Once you have found a qualified professional, it's important that you attend the inspection with me and your home inspector. Some buyers like to climb into the crawl space and attic with the inspector to look at the home's major systems. At a minimum, be on site to ask questions, examine the problem areas and learn about the ongoing maintenance your home will need.

The standard home inspector's report will review the condition of the home's heating, plumbing and electrical systems. The report will also include information about the structure including the foundation and basement, as well as the roof, attic, walls, ceilings, floors, windows and doors. It may include photos of problem areas or recommendations for repairs.

Real Estate Photos Worth a Thousand Words

Great Real Estate Photos

They say that a picture is worth a thousand words and this holds especially true with real estate photos. Photographs show the viewer a glimpse inside the home, allowing them to determine if they are interested enough to request further information or a viewing. The viewer can see specific details such as; the layout of the home, wall colors, and the materials used on floor coverings and counter tops, dishes in the sink, and clothes on the floor and well kept lawns. Photos and virtual tours are a driving marketing force in the sale of a home and it is important that these photos help, not hinder the sale.

•1. Tidy up. Your photos are an open house 24/7. Clean up, declutter. As you prepare, go through each room tidying up. Items on counter tops such as the basket of bills in the kitchen the toiletries on the bathroom counter should be removed. Tables and counters will show best with just a few tastefully selected items. Pick up and put away children's toys, clothes, dishes, and all taste specific decorations.

•2. For example, the duck collection in the kitchen or the numerous college football team banners. It is also important to take down family photographs. Prospective buyers need to picture themselves in the home without the distraction of who currently lives there. Don't forget to check for burned out light bulbs, they really stand out in a photographs.

•3. Please do not have other workers such as housekeeping, lawn crews, pool cleaners, or repairmen at the home during photographing. If you desire to have housekeeping or lawn work done ahead of time, as a real estate professional I will be glad to work with you on the best possible time to photograph your home.

•4. Some pets love to pose for the camera. But others are uncomfortable with equipment or strangers. Please plan ahead for pets by placing them in a kennel, or at a friend's home, or a doggy day care. Also, remove all pet bowls or litter pans before the property is photographed.

•5. What's on your fridge? The family photos and children's artwork on the refrigerator are fun to look at, however, it can often appear as clutter to the camera. Please plan to remove these items before your virtual tour. A clean front on the refrigerator always shows best in photographs. You may have a great fridge magnet collection but it won't help sell your home.

•6. If packing has begun, remove the boxes to an area which will not be photographed. Items stacked in the corner or tucked under the bed can show in the photos and this will keep your home from looking its best. Try to have the photos taken before the movers come. They will looked better staged than empty rooms, that is unless you have to much clutter or really old furniture that does not go with the home.

Remember that the airplane doesn't know that it's dark.

On a clear, moonless night, never fly between the tanker's lights.

There are certain aircraft sounds that can only be heard at night.

If you're going to night fly, it might as well be in the weather so you
can double count your exposure to both hazards.

Night formation is really an endless series of near misses in
equilibrium with each other.

You would have to pay a lot of money at a lot of amusement parks and
perhaps add a few drugs, to get the same blend of psychedelic sensations
as a single engine night weather flight.

The medical profession is the natural enemy of the aviation profession.

The job of the chief pilot is to worry incessantly that his career
depends solely on the abilities of his aviators to fly their airplanes
without mishap and that their only minuscule contribution to the effort
is to bet their lives on it.

Ever notice that the only experts who decree that the age of the pilot
is over are people who have never flown anything? Also, in spite of the
intensity of their feelings that the pilot's day is over I know of no
such expert who has volunteered to be a passenger in a non-piloted
aircraft.

It is absolutely imperative that the pilot be unpredictable.
Rebelliousness is very predictable.

In the end, conforming almost all the time is the best way to be
unpredictable.

He who demands everything that his aircraft can give him is a pilot; he
that demands one iota more is a fool.

If you're gonna' fly low, do not fly slow!

It is solely the pilot's responsibility to never let any other thing
touch his aircraft.

If you can learn how to fly as a private pilot and not forget how to fly
by the time you're a seasoned airline transport pilot, you will have

Helicopter Pilot Humor

During a commercial airline flight an Army helicopter pilot was seated next to a young mother with a babe in arms. When her baby began crying during the descent for landing, the mother began nursing her infant as discreetly as possible.

The pilot pretended not to notice and, upon debarking, he gallantly offered his assistance to help with the various baby-related objects.

When the young mother expressed her gratitude, the pilot responded, 'Gosh, that's a good looking baby..and he sure was hungry!'

Somewhat embarrassed, the mother explained that her pediatrician said breast feeding would help alleviate the pressure in the baby's ears.

The Army pilot sadly shook his head, and in true pilot fashion exclaimed....... 'And all these years I've been chewing gum.'

This is something to think about when negative people are doing their best to rain on your parade. So remember this story the next time someone who knows nothing and cares less tries to make your life miserable..

A woman was at her hairdresser's getting her hair styled for a trip to Rome with her husband..

She mentioned the trip to the hairdresser, who responded: "Rome? Why would anyone want to go there? It's crowded and dirty.. You're crazy to go to Rome.

So, how are you getting there?" "We're taking DELTA," was the reply. "We got a great rate!"

"DELTA" ? exclaimed the hairdresser." That's a terrible airline. Their planes are old, their flight attendants are ugly, and they're always late.

So, where are you staying in Rome?" "We'll be at this exclusive little place over on Rome's Tiber River called Teste."

"Don't go any further. I know that place. Everybody thinks its gonna be something special and exclusive, but it's really a dump."

"We're going to go to see the Vatican and maybe get to see the Pope.."

"That's rich," laughed the hairdresser. You and a million other people trying to see him. He'll look the size of an ant. Boy, good luck on this lousy trip of yours. You're going to need it."

A month later, the woman again came in for a hairdo.

The hairdresser asked her about her trip to Rome. "It was wonderful," explained the woman, "not only were we on time in one of DELTA's brand new planes, but it was overbooked, and they bumped us up to first class. The food and wine were wonderful, and I had a handsome 28-year-old steward who waited on me hand and foot.

And the hotel was great! They'd just finished a $5 million remodeling job, and now it's a jewel, the finest hotel in the city. They, too, were overbooked, so they apologized and gave us their owner's suite at no extra charge!"

"Well," muttered the hairdresser, "that's all well and good, but I know you didn't get to see the Pope."

"Actually, we were quite lucky, because as we toured the Vatican, a Swiss Guard tapped me on the shoulder, and explained that the Pope likes to meet some of the visitors, and if I'd be so kind as to step into his private room and wait, the Pope would personally greet me.

Sure enough, five minutes later, the Pope walked through the door and shook my hand! I knelt down and he spoke a few words to me."

"Oh, really! What'd he say?" He said: "Who screwed up your hair?"

When you decide to sell your home, you want the highest possible return from its sale. Determining price is the most critical step in preparing your home for sale in the wiregrass area.

Playing In The Garden.

A father watched his young daughter playing in the garden.

Tears formed in his eyes as he thought about her seeing the wonders of nature through such innocent eyes.
Suddenly she just stopped and stared at the ground.

He noticed she was looking at two spiders mating.

'Daddy, what are those two spiders doing?' she asked.

'They're mating,' her father replied.

'What do you call the spider on top?' she asked.

'That's a Daddy Longlegs,' her father answered.

'So, the other one is a Mommy Longlegs?' the little girl asked.

As his heart soared with the joy of such a cute and innocent question he replied, 'No dear. Both of them are Daddy Longlegs.'

'The little girl, looking a little puzzled, thought for a moment, then lifted her foot and stomped them flat.

'Well, we're not having any of that gay shit in our garden' she said.

These four problems all can lead to foreclosure of a home.

Drugs:

A drug, broadly speaking, is any substance that, when absorbed into the body of a living organism, alters normal bodily function. Get caught up in doing drugs, or selling drugs, all of your time and money will go to drugs and paying bills will be the last thing you do, which in turn will lead to losing your home.

Death:

No will, no insurance, loss of a bread winner, without a backup plan can also lead to not being able to afford your home and paying for it. Death is celebrated, embraced and feared. Can cause major financial problems if not prepared. Besides taxes the only other guarantee in life.

Divorce:

The big D and I don't mean Dallas. Never goes good with owning a home. Divorce or dissolution of marriage is the final termination of a marriage, canceling the legal duties and responsibilities of marriage and dissolving the bond o matrimoney...
Don't count on an Ex to always make the payments on time. Even when court ordered lots of foreclosures are due to this problem.

Disaster:

The tragedy of a natural or human-made hazard (a hazard is a situation which poses a level of threat to life, health, property. Losing your job counts also, could be a natural disaster such as Flood, Hurricane, or Tornado which all could cause money to be short and payments to be made late or not at all.

B17 Bomber escorted by a German ME109 fighter

Look carefully at the B-17 and note how shot up it is - one engine dead, tail, horizontal stabilizer and nose shot up.. It was ready to fall out of the sky. (This is a painting done by an artist from the description of both pilots many years later.) Then realize that there is a German ME-109 fighter flying next to it. Now read the story below. I think you'll be surprised.....

Charlie Brown was a B-17 Flying Fortress pilot with the 379th Bomber Group at Kimbolton, England. His B-17 was called 'Ye Old Pub' and was in a terrible state, having been hit by flak and fighters. The compass was damaged and they were flying deeper over enemy territory instead of heading home to Kimbolton.

After flying the B-17 over an enemy airfield, a German pilot named Franz Steigler was ordered to take off and shoot down the B-17. When he got near the B-17, he could not believe his eyes. In his words, he 'had never seen a plane in such a bad state'. The tail and rear section was severely damaged, and the tail gunner wounded. The top gunner was all over the top of the fuselage. The nose was smashed and there were holes everywhere.

Despite having ammunition, Franz flew to the side of the B-17 and looked at Charlie Brown, the pilot. Brown was scared and struggling to control his damaged and blood-stained plane.

Aware that they had no idea where they were going, Franz waved at Charlie to turn 180 degrees. Franz escorted and guided the stricken plane to, and slightly over, the North Sea towards England. He then saluted Charlie Brown and turned away, back to Europe. When Franz landed he told the CO that the plane had been shot down over the sea, and never told the truth to anybody. Charlie Brown and the remains of his crew told all at their briefing, but were ordered never to talk about it.

More than 40 years later, Charlie Brown wanted to find the Luftwaffe pilot who saved the crew. After years of research, Franz was found. He had never talked about the incident, not even at post-war reunions.

They met in the USA at a 379th Bomber Group reunion, together with 25 people who are alive now - all because Franz never fired his guns that day.

When asked why he didn't shoot them down, Stigler later said, "I didn't have the heart to finish those brave men. I flew beside them for a long time. They were trying desperately to get home and I was going to let them do that. I could not have shot at them. It would have been the same as shooting at a man in a parachute."

Both men died in 2008.

Montana Gun Law

Executive Summary - The USA state of Montana has signed into power a revolutionary gun law. I mean REVOLUTIONARY.

The State of Montana has defied the federal government and their gun laws. This will prompt a showdown between the federal government and the State of Montana . The federal government fears citizens owning guns. They try to curtail what types of guns they can own. The gun control laws all have one common goal - confiscation of privately owned firearms.

Montana has gone beyond drawing a line in the sand. They have challenged the Federal Government. The fed now either takes them on and risks them saying the federal agents have no right to violate their state gun laws and arrest the federal agents that try to enforce the federal firearms acts. This will be a world-class event to watch. Montana could go to voting for secession from the union, which is really throwing the gauntlet in Obamas face. If the federal government does nothing they lose face. Gotta love it.

Important Points - If guns and ammunition are manufactured inside the State of Montana for sale and use inside that state then the federal firearms laws have no applicability since the federal government only has the power to control commerce across state lines. Montana has the law on their side. Since when did the USA start following their own laws especially the constitution of the USA , the very document that empowers the USA .

Silencers made in Montana and sold in Montana would be fully legal and not registered. As a note silencers were first used before the 007 movies as a device to enable one to hunt without disturbing neighbors and scaring game. They were also useful as devices to control noise when practicing so as to not disturb the neighbors.

Silencers work best with a bolt-action rifle. There is a long barrel and the chamber is closed tight so as to direct all the gases though the silencer at the tip of the barrel. Semi-auto pistols and revolvers do not really muffle the sound very well except on the silver screen. The revolvers bleed gas out with the sound all over the place. The semi-auto pistols bleed the gases out when the slide recoils back.

Silencers are maybe nice for snipers picking off enemy soldiers even though they reduce velocity but not very practical for hit men shooting pistols in crowded places. Silencers were useful tools for gun enthusiasts and hunters.

There would be no firearm registration, serial numbers, criminal records check, waiting periods or paperwork required. So in a short period of time there would be millions and millions of unregistered untraceable guns in Montana . Way to go Montana .

Discussion - Let us see what Obama does. If he hits Montana hard they will probably vote to secede from the USA . The governor of Texas has already been refusing Federal money because he does not want to agree to the conditions that go with it and he has been saying secession is a right they have as sort of a threat. Things are no longer the same with the USA . Do not be deceived by Obama acting as if all is the same, it is not.

INTRODUCED BY J. BONIEK, BENNETT, BUTCHER, CURTISS, RANDALL, WARBURTON

AN ACT EXEMPTING FROM FEDERAL REGULATION UNDER THE COMMERCE CLAUSE OF THE CONSTITUTION OF THE UNITED STATES A FIREARM, A FIREARM ACCESSORY, OR AMMUNITION MANUFACTURED AND RETAINED IN MONTANA ; AND PROVIDING AN APPLICABILITY DATE.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA :

Section 1. Short title. [Sections 1 through 6] may be cited as the " Montana Firearms Freedom Act".

Section 2. Legislative declarations of authority. The legislature declares that the authority for [sections 1 through 6] is the following:
(1) The 10th amendment to the United States constitution guarantees to the states and their people all powers not granted to the federal government elsewhere in the constitution and reserves to the state and people of Montana certain powers as they were understood at the time that Montana was admitted to statehood in 1889. The guaranty of those powers is a matter of contract between the state and people of Montana and the United States as of the time that the compact with the United States was agreed upon and adopted by Montana and the United States in 1889.
(2) The ninth amendment to the United States constitution guarantees to the people rights not granted in the constitution and reserves to the people of Montana certain rights, as they were understood at the time that Montana was admitted to statehood in 1889. The guaranty of those rights is a matter of contract between the state and people of Montana and the United States as of the time that the compact with the United States was agreed upon and adopted by Montana and the United States in 1889.
(3) The regulation of intrastate commerce is vested in the states under the 9th and 10th amendments to the United States constitution, particularly if not expressly preempted by federal law. Congress has not expressly preempted state regulation of intrastate commerce pertaining to the manufacture on an intrastate basis of firearms, firearms accessories, and ammunition.
(4) The second amendment to the United States constitution reserves to the people the right to keep and bear arms as that right was understood at the time that Montana was admitted to statehood in 1889, and the guaranty of the right is a matter of contract between the state and people of Montana and the United States as of the time that the compact with the United States was agreed upon and adopted by Montana and the United States in 1889.(5) Article II, section 12, of the Montana constitution clearly secures to Montana citizens, and prohibits government interference with, the right of individual Montana citizens to keep and bear arms. This constitutional protection is unchanged from the 1889 Montana constitution, which was approved by congress and the people of Montana , and the right exists, as it was understood at the time that the compact with the United States was agreed upon and adopted by Montana and the United States in 1889.

Section 3. Definitions. As used in [sections 1 through 6], the following definitions apply:
(1) "Borders of Montana " means the boundaries of Montana described in Article I, section 1, of the 1889 Montana constitution.
(2) "Firearms accessories" means items that are used in conjunction with or mounted upon a firearm but are not essential to the basic function of a firearm, including but not limited to telescopic or laser sights, magazines, flash or sound suppressors, folding or aftermarket stocks and grips, speedloaders, ammunition carriers, and lights for target illumination.
(3) "Generic and insignificant parts" includes but is not limited to springs, screws, nuts, and pins.
(4) "Manufactured" means that a firearm, a firearm accessory, or ammunition has been created from basic materials for functional usefulness, including but not limited to forging, casting, machining, or other processes for working materials.

Section 4. Prohibitions. A personal firearm, a firearm accessory, or ammunition that is manufactured commercially or privately in Montana and that remains within the borders of Montana is not subject to federal law or federal regulation, including registration, under the authority of congress to regulate interstate commerce. It is declared by the legislature that those items have not traveled in interstate commerce. This section applies to a firearm, a firearm accessory, or ammunition that is manufactured in Montana from basic materials and that can be manufactured without the inclusion of any significant parts imported from another state. Generic and insignificant parts that have other manufacturing or consumer product applications are not firearms, firearms accessories, or ammunition, and their importation into Montana and incorporation into a firearm, a firearm accessory, or ammunition manufactured in Montana does not subject the firearm, firearm accessory, or ammunition to federal regulation. It is declared by the legislature that basic materials, such as unmachined steel and unshaped wood, are not firearms, firearms accessories, or ammunition and are not subject to congressional authority to regulate firearms, firearms accessories, and ammunition under interstate commerce as if they were actually firearms, firearms accessories, or ammunition. The authority of congress to regulate interstate commerce in basic materials does not include authority to regulate firearms, firearms accessories, and ammunition made in Montana from those materials. Firearms accessories that are imported into Montana from another state and that are subject to federal regulation as being in interstate commerce do not subject a firearm to federal regulation under interstate commerce because they are attached to or used in conjunction with a firearm in Montana .

Section 5. Exceptions. [Section 4] does not apply to:
(1) A firearm that cannot be carried and used by one person;
(2) A firearm that has a bore diameter greater than 1 1/2 inches and that uses smokeless powder, not black powder, as a propellant;
(3) ammunition with a projectile that explodes using an explosion of chemical energy after the projectile leaves the firearm; or
(4) a firearm that discharges two or more projectiles with one activation of the trigger or other firing device.

Section 6. Marketing of firearms. A firearm manufactured or sold in Montana under [sections 1 through 6] must have the words "Made in Montana " clearly stamped on a central metallic part, such as the receiver or frame.

Section 7. Codification instruction. [Sections 1 through 6] are intended to be codified as an integral part of Title 30, and the provisions of Title 30 apply to [sections 1 through 6].

Section 8. Applicability. [This act] applies to firearms, firearms accessories, and ammunition that are manufactured, as defined in [section 3], and retained in Montana after October 1, 2009.

As I came out of the supermarket that sunny day, pushing my Cart of
groceries towards my car, I saw an old man with the hood of His car up
and a lady sitting inside the car, with the door open.

The old man was looking at the engine. I put my Groceries away in my
car and continued to watch the old gentleman from About twenty five
feet away.

I saw a young man in his early twenties with a grocery Bag in his arm,
walking towards the old man. The old gentleman saw him Coming too and
took a few steps towards him. I saw the old Gentleman point to his open
hood and say something.

The young man put his grocery bag into what looked Like a brand new
Cadillac Escalade and then turn back to the old man And I heard him
yell at the old gentleman saying, 'You shouldn't Even be allowed to
drive a car at your age.' And then with a wave of his Hand, he got in
his car and peeled rubber out of the parking lot.

I saw the old gentleman pull out his handkerchief and Mop his brow as
he went back to his car and again looked at the engine. He then went to
his wife and spoke with her and appeared to tell Her it would be
okay.

I had seen enough and I approached the Old man. He saw me coming and
stood straight and as I got near him I said, 'Looks like you're having
a problem.'

He smiled sheepishly and quietly nodded his head. I looked Under the
hood myself and knew that whatever the problem was, it was beyond Me.
Looking around I saw a gas station up the road and told the old man That
I would be right back. I drove to the station and went inside and Saw
three attendants working on cars. I approached one of them and Related
the problem the old man had with his car and offered to pay them if They
could follow me back down and help him.

The old man had pushed the heavy car under the shade of a Tree and
appeared to be comforting his wife. When he saw us he straightened up
And thanked me for my help. As the mechanics diagnosed the problem
(overheated Engine) I spoke with the old gentleman.

When I shook hands with him earlier, he had noticed my Marine Corps ring
and had commented about it, telling me that he had been a Marine too. I
nodded and asked the usual question, 'What outfit did you serve With?'
He had mentioned that he served with the first Marine Division at
Tarawa, Saipan, Iwo Jima and Guadalcanal . He had hit All the big ones
and retired from the Corps after the war was over.

As we Talked we heard the car engine come on and saw the mechanics lower
the Hood. They came over to us as the old man reached for his wallet,
but was Stopped by me and I told him I would just put the bill on my
AAA card... He still reached for the wallet and handed me a card that I
Assumed had his name and address on it and I stuck it in my pocket.. We
all Shook hands all around again and I said my goodbye's to his wife.

I then told the two mechanics that I would follow them back Up to the
station. Once at the station I told them that they had Interrupted
their own jobs to come along with me and help the old man. I Said I
wanted to pay for the help, but they refused to charge me.

One of them pulled out a card from his pocket looking exactly like the
card the Old man had given to me. Both of the men told me then, that
they were Marine Corps Reserves. Once again we shook hands all around
and as I was leaving, one Of them told me I should look at the card the
old man had given to me. I said I Would and drove off.

For some reason I had gone about two blocks when I pulled over And took
the card out of my pocket and looked at it for a long, long time. The
Name of the old gentleman was on the card in golden leaf and under his
Name....... 'Congressional Medal of Honor Society.'

I sat there motionless looking at the card and reading It over and
over. I looked up from the card and smiled to no one but Myself and
marveled that on this day, four Marines had all come together, Because
one of us needed help. He was an old man all right, but it Felt good
to have stood next to greatness and courage and an honor to have been in
his presence. Remember, OLD men like him gave you FREEDOM for America .
Thanks to those who served...& those who supported them.

America is not at war. The U.S. Military is at war. America is at

This is only one State...............If this doesn't open your eyes nothing will !

1. 40% of all workers in L. A. County ( L. A. County has 10.2 million people)are working for cash and not paying taxes. This is because they are predominantly illegal immigrants working without a green card.

2. 95% of warrants for murder in Los Angeles are for illegal aliens

3. 75% of people on the most wanted list in Los Angeles are illegal aliens.

4. Over 2/3 of all births in Los Angeles County are to illegal alien Mexicans on Medi-Cal , whose births were paid for by taxpayers.

5. Nearly 35% of all inmates in California detention centers are Mexican nationals here illegally

6. Over 300,000 illegal aliens in Los Angeles County are living in garages.

7. The FBI reports half of all gang members in Los Angeles are most likely illegal aliens from south of the border.

8. Nearly 60% of all occupants of HUD properties are illegal.

9. 21 radio stations in L A. are Spanish speaking.

10. In L. A. County 5.1 million people speak English, 3.9 million speak Spanish.

Less than 2% of illegal aliens are picking our crops, but 29% are on welfare. Over 70% of the United States ' annual population growth (and over 90% of California , Florida , and New York ) results from immigration. 29% of inmates in federal prisons are illegal aliens.
