My friend Pacita posted this information for short sale sellers. It's great advice to help yourself avoid foreclosure.

MY DEAR SELLERS

During a short sale, our mutual goal is to get an offer accepted as quickly as possible by your lender to prevent a foreclosure.

And as you already know, the effects of a short sale are far less damaging than a foreclosure or a bankruptcy.

REMEMBER YOUR GOAL: SELL THE PROPERTY!

Please understand that maintaining the home is still your primary responsibility during this selling process, whether you choose to stay or not at the property, remember what it takes to sell.

MAKE IT EASY TO SHOW YOUR PROPERTY

Keep the house looking nice inside and out. You literally only have minutes to make a good impression. Make that first impression count!

If it's messy and smelly, it won't sell. And if it doesn't sell, consider the alternative: foreclosure!

Allow the realtor to put a lockbox that other realtors can use to access the property.

How can we sell it if we can't show it?

Don't insist on unreasonable windows of time to show the property, such as showing only between 12 noon - 1 pm, or requiring 24 hours notice.

If you're serious about selling, you'll do your best to accommodate all interested buyers and their agents.

Keep the utilities on. Buyers, inspectors and appraisers need the utilities on to complete their respective activities.

A dark home is gloomy and uninviting. No power on will also make the home smell musty. Bathrooms and kitchens may show mildew. These are all unappealing and are turn-offs. Why take a chance? You'll only have to turn them back on for inspections later anyway. So just keep them on.

COMMUNICATE

Be accessible. Provide a number to best reach you, and return calls promptly

When you're going out of town, make sure you can still be reached by phone, email, fax.

Complete all required documents, especially your financial information, in a timely manner.

Keep your records current and handy. Don't pack away important information like your most recent tax returns, bank statements, pay stubs.

Keep the lines of communications open. Although doing a short sale transaction will take weeks from the time an offer is submitted, by the time the offer is ratified by the short sale lender, it becomes a race for time especially if the lender insists on a specific date to complete the transaction.

Your role as a seller doesn't end until the transaction closes escrow. What if the buyer backs out? We'll need to regroup quickly.

BE REALISTIC

Accept the possibility that your property may be worth less today than what you owe, or what you paid for.

What your house sells for should not be your primary concern. Protecting your credit and your future ability to buy a home in the near future, is.

Remember that as a condition of a short sale, you as the seller will not receive any funds from escrow.

So does it really matter to you how much it finally sells for? Just aim to get it sold!

You may have to spend a bit of money to spruce up your property , but consider that an investment to accomplish your goal

TAX RELIEF

Yes, these are challenging times. Nonetheless, remember the provisions of the Mortgage Forgiveness Debt Relief Act   "to amend the Internal Revenue Code of 1986 to exclude discharges of indebtedness on principal residences from gross income, and for other purposes."

Key point in a short sale: the difference between what you owe and what it finally sells for was normally considered income, and would have been taxed as such....until the Mortgage Forgiveness Debt Relief Act was passed in December 2007, and applies to debt forgiven in calendar years 2007 through 2012.

As such, because this is not considered income, you may not have to pay taxes on it --- please consult with your CPA to get the complete and right answer.

After a Short Sale, Will I Ever Be Able to Buy a Home Again?

"Will I ever be able to buy a home again?"

Today I received another call from another homeowner in foreclosure. Burning questions that no one could (or would) answer were pouring out like lava, pent up emotions were finally being released in a meltdown of fear, frustration, sorrow, confusion, anger.

I just listened, acknowledged, and took notes, listening to learn if I would be able to help.

Eventually, in sharing with me, there was some relief from the pressure, and the courage to ask a question about the future arose: "Will I ever be able to buy a home again?"

Yes! As long as you can financially afford it with a steady source of income and a downpayment, YES. You will be able to buy another house in the future. Usually in about two years after a short sale, you will be eligible to purchase a home and get a loan.

If you opt for foreclosure, it will be seven years, but you will still be able to buy another home in the future, based on standards of the lending community as we know it.

A short sale will give the fastest return to loan eligibility. But even a foreclosure does not mean you will never be able to buy a home again.

Recently I was sitting at a stop light, checking my email. I glanced up, saw green and took off.

Only my light wasn't green.

It was the turning arrow for the lane to my left. I proceeded to run a redlight from a complete stop...because I was using my phone and went on autopilot. I couldn't believe it happened to me!

I'm careful. I'm a grown-up. I'm aware of how dangerous it is. Yet I did it.

Please do not text or read email when driving. Even if you are careful, one mistake is too many.

Step Right Up Hudson Ohio

Step Right Up in Hudson Ohio is a fun family restaurant - really, two restaurants in one...Donuts in the morning, grilled hot dogs and meals in the afternoon and evening, all affordably priced.

Located at 5929 Darrow Road in Hudson, Step Right Up offers Sahlen's Hot Dogs made specifically to be charcoal grilled over a hot fire. They also grill hamburgers, chicken and sausage. They have french fries, sweet potato fries, onion rings and an array of fresh condiments that include chili, cheese and sauerkraut.

The service is great, and so is the food! I had a regular sized hot dog with stadium mustard, relish, ketchup and yes, onions! Yum! Add lemonade to drink and potato salad, and what a great grilled lunch! Next time I am going to try the sweet potato fries and sliders - they looked and smelled delicious!

The Lococo family is very proud of their place - from the history, theme and signs...

to the charcoal grill...that's Augie, today's grill master...

to the donut machine...too bad I came at the wrong time...free samples when hot sound delicious!!

Owner August Lococo based the restaurant on an amusement park theme with a mural and memorabilia from Geauga Lake. Old signage and pictures from the old Geauga Lake days hang on the walls. Most guests who come in the restaurant have an old memory to share with Lococo. Lococo's father, Gasper, was one of the owners of Geauga Lake before it was sold to Six Flags. When Gasper Lococo retired, he wrote his memoirs in a book titled "Step Right Up", thus came the name of the restaurant.

I left with a smile as I sipped my lemonade - I think you will enjoy Step Right Up in Hudson - let me know what you think! Tell the owners you read about it here!

Shisler's Cheese House in Copley Ohio

Shisler's Cheese House, home of my favorite wrap in the universe (see below for details)! Actually, it's a great place for the best cheeses, wines and tasty gourmet coffees and treats...but if you don't know about it, you won't notice it. It's off the beaten path, so to speak, on Cleveland Massillon Road, near the railroad tracks, just north of Copley Circle.

The BEST part of stopping at Shisler's is the staff! They are very accessible and helpful - and they know about the cheeses and items offered, so don't be surprised if you can't stump them. Left to right, Dan, Jeryl, Stephanie and Nicci.

The offering of Ohio wines is very appealing, and the employees are great at helping choose the right wines to match your cheese/meal selections. Shisler's also offers wine-tastings, which are great fun! They are very knowledgable about organic wines and have a great selection of beers and ales.

As promised, here is my favorite wrap...turkey, cucumber, tomato, cheese, dab of mayo all on a sundried tomato wrap! With sweet maui onion chips, a deli pickle slice and rootbeer, DELICIOUS!

I always have to take 1/2 home!!!

Shisler's is beautiful inside and out - I recommend that you stop in soon on a sunny day and eat outdoors on the patio. You'll definitely be glad you found it!

After waiting for seven months for an approval from Countrywide now Bank of America, we finally received approval.

What did it? Perhaps it was this email from the listing agent...

Dear Mr. Lewis-

Please forgive the informality of this correspondence, but brevity is warranted and time is of the essence. Our firm has been in contact with your short sales department since January of this year, and we still have received no resolution to our requests to negotiate this loan balance. We have complied with every request made by your company negotiators, only to find that those same individuals have slighted our efforts at every turn. The most recent insult (May I say "injury"?) was at the hands of the negotiator whose correspondence to us appears below.

Although the amount of this loan may be a mere pittance in comparison to the overall managed funds of your Billion-Dollar company, it is the World of Finance to our Client involved. Further delays to the attention of this file will continue to cause suffering and anguish to your customer, (name withheld).

We are asking that you will immediately direct this file to the attention of a management-level individual who is able to make an independent decision on the status of this loan negotiation request.
Again, we again extend our apology to you for the venue with which this message has been delivered, but we hope that you will cause this matter to be resolved with the utmost expediency.

Maybe...but immediately after this tweet:

Ken Lewis, please help!!! BOA Loan #********* has not been resolved after 7 months. (New approach since we are desperate!)

...we were told that the CEO's office would be taking over the case! And they did.

We were promised that we would have an answer in a week. And we did...

Today, we got our approval after 7 torturous months!!!!

Was the email? Was it the tweet? Was it both? What do you think?

I wonder...Does it matter that I am making progress on twitter ranking?

The 2009 Summit County Fair in Tallmadge Ohio! Today was the kickoff of the 2009 Summit County Fair at the fairgrounds on Darrow Road in Tallmadge Ohio!

The displays in the historical museum were entertaining - we laughed at the fashions from pattern books, marveled at the antiques and enjoyed seeing how things have changed!

This mini rex rabbit was so gentle, and he looks just like he hopped out of Peter Cottontail. So soft!

Grant climbed the rock wall...

You could tell by the horse's demeanor if the rider would do well or not. We saw a couple of horses that were pretty sassy and disqualified their riders!

When our son Grant walked in the barn, all the horses came out to say hi - they know a horsey person when they meet one!

This little guy was so intent and serious about raking the floor - very diligent!

The Midway at the fair - I think the best vendors end up on the main midway - maybe they have to pay more for placement, but they are the best, pricewise and quality wise as for our experience.

These little goats just wanted to get out and play with all the visitors...they couldn't get any closer unless they climbed out!

That is a LIONHEAD RABBIT - yes, I said rabbit. Wow.

Now you are seeing my favorite part of the fair...nighttime and the lights!

Looks like Laura & Tori enjoyed the rides!

Our kids did not love the barn smells, but Jay and I grew up in the country, and it's not a big deal to us.

I guess we are raising city slickers!

This ram was ready to charge - I guess he didn't like the attention...

If you are interested in working as a traveling concession attendant, they are hiring!! Just have to be able to travel!

Don’t Wait-Only 138 Days to Claim Your Share of the Tax Credit

My friend Cindy Jones explains it very well - if you want to take part in the $8,000 tax credit - the time is now. Take a look at what she says...

The rush is on. The deadline for purchasing a home using the $8000 tax credit is November 30, 2009. You might be surprised to find out how quickly the remaining days left to take advantage of the "free" money from the government will click away.

Let's take a look at how you might use up your time remaining.

Before you even head out the door to look at houses you need to have made contact with a lender and start the pre-approval process. The further you get along in this process before you get in a car to look at a home the better. For timing we will say that this process will take you a week because you are super organized and have all of the documents on hand that your lender needs. (7 Days Gone)

Now you are ready to actually head out and look. With lower inventory (below $250,000) than a year ago, it would be realistic to think that it will take you 30 days to find a house. Then there is the contract ratification process. If you are lucky and you have focused on seller owned properties you may be able to get a ratified within 7 days. (37 Days Gone)

With the new appraisal rules (HVCC) and the new lender rules (HERA) going into effect you can expect that getting your final loan approval will be 30-45 days. For our calendar we will take the longest number just to be safe. (45 days Gone).

How are we doing so far? Looks like we have knocked 89 days off the calendar leaving 49 days left until the deadline. Whew looks like you have plenty of time to get this done.

Wait we forgot to add in the days that FHA is going to require for a second appraisal (it is happening more and more) or the processing time at the settlement company. So let's pad those 89 days with an extra 7 to be on the safe side. Now we have taken a total 96 days off the calendar. Leaving you 42 days to move in and enjoy your new home.

If you take longer to find a home, if the lender takes longer to approve your loan or you think you want to buy a short sale....then you may have waited to long!

Are you still thinking about whether the market might decline a bit more making your dream home just a bit more affordable? Or are you waiting for the interest rates to come down to 4.5% again? If you are then every day you wait is one less day that you have to deal with any issues in your schedule. If you are serious about buying a new home this year and are eligible for the $8000 tax credit then time is of the essence. Don't sit on the fence much longer or you may find yourself looking at the calendar on December 1st and wondering what you were waiting for.

I Beat GPS (or A Funny Thing Happened on the Way to Akron's Towpath Trail!)

Coincidence? Interesting event? Small world?

On Friday, my daughter was with a friend at Waterworks Park by the Cuyahoga River in Cuyahoga Falls.

A woman and her husband who had used their GPS tool were looking for the Towpath Trail in Akron, and it had led them to this spot along the Cuyahoga River. It was definitely not on the Towpath Trail, which runs along the Ohio Erie Canal.

They were at point A, and needed to be at point B. Thanks GPS! Who said computers are always right?

For some reason, they decided to talk to my daughter to see if she could help out. When they mentioned the Towpath Trail, her eyes lit up. I had just been telling her about my new group of homes at Hickory along the historic Towpath Trail, living in the Metro Park, and how people could bike to Peninsula and ride the Cuyahoga Valley Scenic Railroad back for $2.

"I know my mom knows about this place, she was telling me all about it,"said my daughter. "I'll let you talk to her!"

I was out for lunch with my husband, but in my car, I keep a copy of the Towpath Map and the Cuyahoga Valley from the Metro Parks! I was able to give her clear directions on how to get to the trailhead, the numbers for the Cuyahoga Valley Scenic Railroad, and the Metro Park. I explained where they could park, and where they would be able to catch the train back for the $2 return trip with their bikes.

I completely beat their GPS system!

However, the icing on the cake was when she told me that they were from Beaver Falls, PA, very close to Beaver, PA. Many people don't know that Akron has a Beaver, PA connection...the treaty that formed the beginning boundary of what we know as Akron was created at the fort right where Beaver, PA stands today.

Who knows why their GPS sent them to Waterworks in Cuyahoga Falls, along the Cuyahoga River...

Who knows why my daughter was there on that day, chilling with a buddy...

And, who knows, maybe one day they will tell someone about this really great agent who helped them get around in Akron, doing a better job that their GPS that day...

Maybe it was just a funny thing that happened on the way to the Towpath Trail in Akron...or was that all it was?
