   Sometimes Buyers do choose you as an agent because you are the listing agent.  The "argument" from a listing agent is often that the listing agent is working for the Seller so the Buyer should choose someone else to represent them.
   The reasoning from a consumer may be...that the listing agent knows the house better...though a selling agent can certainly learn through observation and inspection by professionals all that they can about a house.  There are those buyers who believe too that they will undoubtedly (?)get a "better deal" if they deal directly with the listing agent.

  Why DO you do Short Sales ?  That has to be a question that every agent who does them....has to ask some days....the days that the file is "lost"....the "negotiator" wants to add one more word to an already signed legal offer to purchase...the Selling agent "knows" you can close in 30 days.....and the list continues. Yes...there are days when you wonder why you have chosen that niche as a part of your practice.

  “Pass”….in our view, home inspections…especially those done for Short Sale homes are not a Pass/Fail issue. There may be conditions seen or unseen during an inspection that a buyer can choose to accept or not accept.
   An appliance that may not be fully functioning is one thing…while tearing off a roof, installing/replacing drain tile, a failed septic system or well may be quite another.
   A buyer who accepts a home in an “as is” condition takes on the responsibility for repair and replacement of things found in the inspection.

   Recently we have encountered a new attitude with Short Sale Sellers...some not behind in their mortgage...some who are...who are very "busy" and the lender should understand the importance in other things in their life rather than filling our forms, supplying updated income documentation, etc. etc. etc.  Compliance is required on a timely basis....and that may not be the time that best fits the distressed Seller's schedule. 
       We all have obligations to family...our jobs....to other activities and people.  For Sellers in a short sale....the production of documents and the response time required has to be a priority.

   We often get the question from both Agents and Buyers..."Who is the lender on this short sale listing?" 
We were working with an attorney on short saling a property and her response to that question was: "Any agent who can't easily find out who the lender is probably shouldn't be showing a short sale."   Maybe not...try enough, it isn't difficult. The reason agents and consumers ask is the constant well fed rumor mill.....and more importantly.....that regardless of the market, there are lots of agents who "Do" short sales....that do not have the training or experience to get them closed.

  We got a call from a depressed and distressed homeowner,......her friend had listed the home that she had shared with her husband and children. A divorce and unemployment made it impossible for them to maintain mortgage payments and the "friend" took charge of the short sale....sort of..,,,
     I reviewed the listing...the commission was reduced from what the "normal percentage" is on our market....and the terms for occupancy were stated as "immediate".....oh yicks.......with the basics not done correctly ...no telling what the rest of the procedural and other errors may have been.

           "I don't know if my buyers will FALL  for your short sale."
       Bite tongue...bite lip.....count to 10....leave room for "misinterpret"....new expression I had not heard applied to this area of our practice.   Short sales  come in all kinds of homes...new construction...partially finished construction...condos, resale of homes...it is circumstance and not condition that defines a short sale....a legitimate hardship on the part of the Seller inclusive of the condition of the market.

   Short sales can be a challenge...it is one that you choose to pursue....or not. Even when you do lots of them...and get the  training and continual education that enables  you  to close them....there are still days  in the life  of  every short sale agent when you question of the wisdom,  ultimate goal and....hmmmm...less than common sense approach to the  process from the lending side of the transaction  table.

   We explain short sales and answer the questions for potential sellers many times in long phone or personal conversations...often more than once with divorcing couples.  They have read on the internet...their friend told them...they knew someone that....and the stories go on and the confusion and anxiety builds.  We do our best to explain both in conversation and in writing all that the process entails and what they can expect as a Seller.

  With Short sales and Divorce as two of our dedicated areas of practice there is often a lot of conflict "in the air". This is more easily dealt with since there are two of us...and one of us can be "the realtor" for each member of the couple and it works as well as it can.
