Ageism – Hospital Regulations
Hospital regulations require a wheel chair for patients being discharged. A student nurse found an elderly gentleman dressed and sitting on the bed with a suitcase at his feet. He insisted he didn't need help in leaving the hospital.

After a chat about rules being rules, he reluctantly let the nurse wheel him to the elevator.
On the way down the student nurse asked him if his wife was meeting him.
'I don't know,' he said. 'She's still upstairs in the bathroom changing out of her hospital gown.'
Happy Friday!
Have a Wonderful Weekend!

San Jose Short Sale Agent
Closes HAFA Short Sale with Bank of America on 1-27-2012

Short Sale time frames will most definitely vary depending on the number of loans and who services the loans. Below is an outline of the time frame for closing a short sale. This property qualified for, and was approved as a HAFA short sale. The property is located in Milpitas, California. San Jose short sale agent helps another homeowner avoid foreclosure with a Bank of America HAFA short sale.
- List Date: 8/19/2011
- List Price: $369,000
- Price Reduced: $358,888 on 9/3/2011
- Sale Date: 9/15/2011
- Number of Offers: 3
- Days on Market: 27
- Price Increase 12/2/2011: $370,800 – mandated by AMS Servicing policy
- Conditional Lender Approval 1st Lien with Bank of America: 12/22/2011
- Lender Approval 2nd Lien with Wells Fargo: 1/6/2012
- Final HAFA Approval with Bank of America: 1/23/2012
- Sales Price: $358,888
- Close of Escrow: 1/27/2012
- List to Close: > 5.0 months
- HAFA Incentive to Borrower: $3,000.00
- Bank of America HAFA short sale servicer: AMS-Servicing
Working with AMS Servicing was extremely challenging. Without Bank of America escalation support this file would not be closed today.
A proven strategy for a successful short sale is to require the purchase agreement time line to begin the day following receipt of the the first lien approval. As shown on the short sale time frame above, the file was ready to be closed by the time the final approval letter was issued. The file was closed within 3 days of receiving the final approval.

I'm with Kasey on this. "I understand that the purpose is to give respect and due credit to the original blogger and to encourage people reading the post to go and comment on the original blog. I, however, like to comment on BOTH."
Many of my favorite peeps here disable comments. If you are reading this re-blog ... please consider leaving comments an option on your re-blogs. It's an honor to have a post re-blogged. I personally do not see how it is dis-respectful to allow people to comment on a re-blog. If you feel that it is .. .please share with me.
Leave your comments here ... and please visit the author's post and comment there as well. Thank You.

I wish people didn't disable comments on re-blogs.
I understand that the purpose is to give respect and due credit to the original blogger and to encourage people reading the post to go and comment on the original blog.
I, however, like to comment on BOTH. Often I see the re-blogs through bloggers that I am subscribed to and/or am friends with. I like to comment first on the re-blog post and thank the person for making a great choice on a re-blog and bringing it to my attention. Or, if it is my blog post that they have re-blogged I want to go over to their post and thank them for thinking my post is worthy of a re-blog.
Also, sometimes different conversations will ensue on these post versus the original comment thread.
RE-BLOG
And, after that, I like to head over to the original blog post and comment there as well.
I'm often bummed when I go to make a comment on someone's re-blog and they have disabled the comments.
Is anyone else with me on this?

It seems to me that Dave Keys’ post is in alignment with many posts I have read over the past few days that suggests reviving older blog posts by changing the title, refreshing 30% or so of the content and reposting. Google will look at this as new content … no penalty and the new, fresh/er content will be ranked by Google as fresh. If you are bored looking for something to do … or feel writer’s block and don’t know what to blog about …then follow the tips and ….keep on blogging.
Please visit Dave’s post to leave your comments. Thank you!

Busy? That could be a good thing if you reflect it online. Especially true if you're a blogger who likes to get to the point and get there fast and frequently. Nobody likes a long winded talker and why should they like a long winded writer either?
Have you been struggling to make that magic number- the obligatory 300 or 500 or 600 word post? It may not be as valuable as creating something unique- even a first crack at a listing- a blog post about your property before you put it up on the MLS to be consumed by content aggregators?
Google's Officio-Blog posted 17 algorithm updates for all to see, including us SEOs. Most SEOs pounced on news about Panda, the boogeyman that scares all- and makes for great post fodder. Opinions have been prolific.
Little noticed is that 3 of the 17 mentions touched on freshness and uniqueness. And, in a subtle way, allowable duplicate content if it related to recurring events.
Several decidedly unscientific tests by yours truly have shown consistent results where Google favors and quickly indexes frequent posts if even moderately unique. I had one test post index in Google in under 30 seconds. I think they like it.

Banks Rule – Even with Court Orders Banks Make Their Own Rules
I received a call from an attorney I have worked with for years. I have listed and sold many homes on behalf of his clients, typically administrators or executors of estates.
He was retained by the decedent’s sister who lives out of state. He opened probate with the Santa Clara County Probate Court. Letters of Administration and Orders were issued.
It remains undetermined at this time if the decedent has a Will. The sister went through all the personal belongings at the home and did not find a Will.

The attorney went to Wells Fargo Bank on Friday with the key to the safe deposit box; his driver’s license; bar license; and certified copies of orders and letters from the court expecting to be given access to the safe deposit box.
Nope. No Deal.
Wells Fargo said that he needs a letter from the decedent’s sister, now Administrator of the decedent’s estate, granting the bank permission to provide her attorney access to the safe deposit box.
Of course, my response was “welcome to my world” as I began to laugh so hard my stomach hurt. Working with so many lenders/banks on San Jose short sales, I know bank processes are maniacal and rarely make sense to mere mortals.
No matter how the attorney went about explaining his “authority under the law” and offered proof with all the documentation he had, the bank refused to grant him access without a notarized letter from decedent’s sister and administrator who lives out of state.
This will only cause delays in listing the property and ultimately cost the estate more money. I understand rules are rules even if they don't make sense. We don't even have to like the rules we are expected/required to follow. When dealing with banks their rules are the keys to the kingdom to get what we want. We follow the rules or we get nothing!
In this case, the kingdom is the safe deposit box which holds the key to the question: Does the decedent have a Will?
For this San Jose short sale agent, the keys to the kingdom the banks typically hold are tied to granting a short sale approval. Thankfully, I know it will take far less time to get into the safe deposit box than it does to get a lender to approve a short sale.
In the meantime, I will pick up the keys to the San Jose home and start doing what I do to get homes ready for market and sold! I don't need the banks permission to move forward. My permission to begin preparing the home for sale lies within the attorney for the estate, who has the authority to hire me. Of course I will be working directly with the administrator on the listing and sale agreements and collaborating with the attorney throughout the process.

In December 2011 in the middle of the holidays and several Active Rain challenges, Jeanean Gendron started the Go-Giver Group and challenged the AR community to “Please join the group and make a commitment to buy the book and read it during the Holidays …. “
As much as I adore Jeanean, I passed on her invitation challenge because I could not think of adding another book to my reading list or adding another “to do” on my already endless list! I was feeling stressed out and challenged out!
Life is ever-changing. What a few days or weeks can do to change our perspective!
I committed to reviving a healthier, happy, me in 2012. This resulted in my own personal weight loss challenge (there is that word again!) which begins tomorrow, Sunday, February 5, 2012.
I’m following the Chris Powell Carb Cycling program. While I was online buying the Chris Powell book and workout DVD, I also purchased

One thing is for absolute certain. The principles of the book are not foreign to me. It’s like a kick-in-the butt refresher course about all I know about life, living, loving, and giving.
I must confess, I allowed myself to slip from the level of giving consciousness that makes me happiest. I’m already feeling a shift back home to who and how I want to be in this world.
Pindar’s “Five Laws to Stratospheric Success” are no secret. I feel many of us over-think life. We tend to make life hard when it is really very simple.
The First Law – The Law of Value: “Your true worth is determined by how much more you give in value than you take in payment.”
The Second Law – The Law of Compensation: “Your income is determined by how many people you serve and how well you serve them.”
The Third Law – The Law of Influence: “Your influence is determined by how abundantly you place other people’s interests first.”
The Fourth Law – The Law of Authenticity: “The most valuable gift you have to offer is yourself.”
The Fifth Law – The Law of Receptivity: “The key to effective giving is to say open to receiving.”
My gift to you is to encourage you to read the book, The Go-Giver. I can't do it for you. Join the Circle and together we will create ultimate happiness and miracles.
"Wealth can be achieved in many ways. It's our birthright to be prosperous. True prosperity is achieved through giving." Kathleen Daniels
Note to Jeanean: You may now send me the Go-Giver Companion book you so graciously offered to give me. I am ready to receive your gift!

A couple in their nineties is both having problems remembering things. During a checkup, the doctor tells them that they're physically okay, but they might want to start writing things down to help them remember things.

Later that night, while watching TV, the old man gets up from his chair. 'Want anything while I'm in the kitchen?' he asks.
'Will you get me a bowl of ice cream?'
'Sure.'
'Don't you think you should write it down so you can remember it?' she asks.
'No, I can remember it.'
'Well, I'd like some strawberries on top, too. Maybe you should write it down, so as not to forget it?'
He says, 'I can remember that. You want a bowl of ice cream with strawberries.'
'I'd also like whipped cream. I'm certain you'll forget that, write it down?' she asks.
Irritated, he says, 'I don't need to write it down, I can remember it! Ice cream with strawberries and whipped cream - I got it, for goodness sake!'
Then he toddles into the kitchen. After about 20 minutes, the old man returns from the kitchen and hands his wife a plate of bacon and eggs... She stares at the plate for a moment.
'Where's my toast?’
Happy Friday!!!
Don't forget to have a great weekend!

For those of you considering buying an ASUS Zenbook, I want to share my experience to save you the pain I've been through. I paid $1,550 for the ASUS Zenbook UX31E (their top of the line model) on 11/21/11 from New Egg.com. On 11/28/11 I received the computer and began using it. It worked fine for the first four weeks and then began having problems starting up. On 1/14/12 it didn't start at all and on 1/17/12 I sent it in to be serviced as instructed by ASUS (it was now just beyond NewEgg's 30 day guarantee). They received the computer on 1/20/12.
I have had no phone calls or e-mails from ASUS at all. I have to call their Customer Service hotline, which consists of people in Malaysia or some other foreign land peering at a computer screen reading back to me the exact same information I obtain from the ASUS Service website. It is now almost two weeks and there is no indication on when my computer will be returned. The ASUS Service site states, "Waiting [WB-1] Wait for Material/Spare Parts".
Well, I've had it! I'm starting a social media campaign to put pressure on ASUS to either fix my machine or send me a new one! My client files are on that computer and it is very difficult to work without my files. Please reblog this post and Tweet it with the hashtags #ASUS #GailRobinson. Let's see if social media can work to get this arrogant giant's attention.
Thanks,
Gail

Thank you Pacita Dimacali, Oakland Realtor for bringing the Petition to extent the Mortgage Debt Forgiveness Act of 2007 to our attention. While I cannot imagine this will not be extended for several years, we don’t want to take a chance by not signing the petition.
The San Jose real estate market is relatively stable now. We risk seeing another crash if homeowners are not given the help they need. I recommend signing the petition.
Please visit Pacita’s post to comment. Thank you!

Petition to extend Mortgage Debt Forgiveness Act
As many of us may already know, the Mortgage Debt Forgiveness Act of 2007 is expiring December 31 2012. However, we also know that we expect more property owners will explore going through a short sale. But will they have enough time? Will the lenders act quicker to approve/reject/counter short sale applications?
According to the IRS, "The Mortgage Debt Relief Act of 2007 generally allows taxpayers to exclude income from the discharge of debt on their principal residence. Debt reduced through mortgage restructuring, as well as mortgage debt forgiven in connection with a foreclosure, qualifies for the relief."
Will it help to sign a petition to extend?
If you’re one of those in favor of an extension, consider signing this petition
