Blossom Valley San Jose Short Sale Success!

Real Estate is about people, family and the relationships we build along the way. It's not about the house or the condo, it's about helping people reach their goals and dreams. That may sound cliche and yet it is true, for me.

I met the parents of my clients at a bank-owned open house February 21, 2009. After speaking with them for at least one hour they thanked me for my time and said they would have their son give me a call. About one week later, I received a call ..."My parents met you at an open house ...." The rest they say, is history.

We searched for five to six weeks ... I lost count of the number of offers we wrote ... however on April 20, 2009 we wrote an offer on a Blossom Valley San Jose home and short sale ... the offer was accepted. The home had been on the market 238 days at that point and three previous buyers "walked."

Rather than writing a book about all the things that went wrong and all the things the Listing Agent did not do ... which caused delays and resulted in three extensions from the bank ... the final extension was granted after the Notice of Default was filed ... this blog is about celebrating what did happen.

California Governor Schwarzenegger takes Action for Californian’s facing Foreclosure

An emergency measure taken this week, Senate Bill 94 is effective immediately and will remain in effect through January 1, 2013. The action taken by California Governor Arnold Schwarzenegger was designed to prevent distressed homeowners from being taken by companies charging upfront fees for loan modifications and then abandoning them.

Senate Bill 94 prohibits foreclosure consultants, which includes attorneys who specialize in loan modifications and loan modification companies, from taking any compensation or fees before completing the service.

This new law may likely cause many law firms and individual legal practitioners previously engaged in providing loan modifications services to close their doors. The same may be true for loan modification companies which have historically provided services only with payment of upfront fees regardless of whether the loan modification was approved or denied by the servicer.

Only time will tell how many individuals and companies will remain committed to helping distressed homeowners facing foreclosure now that upfront payment for providing such services are prohibited.

Many truly dedicated real estate professionals provide loan modifications services at no cost to the homeowners with the understanding that if the loan modification is not approved, the homeowner will list the property with the agent and attempt to complete a short sale.

Senate Bill 94 is a big win for California homeowners facing foreclosure. It is now against the law to charge before completing a loan modification service.

Scam Alert - Secty of State of California

Don't get tied up in this scam!

There is a scam propagated by an entity called “Business Filings Division” who is sending letters out to corporations of any size to file the company’s Statement of Information with the Sec. of State of California. Normally, there is a $20 or $25 fee that has to be paid when filling out this form. These guys want you to pay $235, they pay the $20 and you get taken.

The form is deceptive, has a fake seal that looks like it is coming from the State of California, but attempts to look like a real form. Do not sign this and pay money.

The real form and instructions (which is mailed to you by the State of California) can be found at the California Sec. of State’s Website.

With unemployment on the rise, 7.6% of homeowners fell more than 30 days late on their mortgage payments in August 2009. Statistical data suggests that the current month over month rise in mortgage delinquencies is increasing. The numbers are staggering.

Many homeowners feel overwhelmed and simply do not know what to do. The natural tendency for many is to do nothing. No matter the circumstances hiding is not a viable solution. The longer a homeowner waits the worse the situation gets. Taking action early and understanding your options may likely prevent foreclosure or bankruptcy.

If the value of your home has declined and you now owe more on your loan than your home is worth, you may qualify for a loan modification. If you can reduce the monthly payment on your loan and manage to keep your home then the natural choice is to call a professional who can help.

Saturday, September 26, 2009 – Save the Date!

The Willow Glen Founder's Day Parade begins at 10:30am along Lincoln Avenue between Coe and Minnesota.

Of course the streets will look a lot different than the photo above which was taken January 2009.

The Intero Willow Glen Office is participating in the Parade and of course, I will be participating in the parade as well.We will have several vintage cars, balloons, and candy for the little ones. It is great fun and a wonderful celebration of Willow Glen!
