RESPA (Real Estate Settlement Procedures Act) ..waht you need to know to keep your buyer informed 1. If homebuyers are is financing the property, these new regulatory and investor guidelines will impact-and could even dictate-the closing date, to meet the required time frames. 2. Upfront fees cannot be collected by the lender (except for a credit report fee) until the initial disclosures are received. appraisal: NY Attorney General says- Your Appraiser is NOT your Appraiser - 03/05/08 12:32 PM
As of January, 1, 2009, lenders in New York state who want to sell loans to Fannie Mae or Freddie Mac will not be allowed to use in-house appraisers and are forbidden from using appraisals by a subsidiary or an affiliated appraisal management company. This is the result of an agreement between the NY Attorney General's Office, Fannie Mae and Freddie Mac to fight mortgage fraud due to undue influence, through coercion, collusion, intimidation, etc. on appraisers to "make the number".
