I just returned from the Short Sale Expo in Palm Desert, California earlier in the week where I was part of a panel of four top notch short sale experts that were assigned the task of speaking on the top 5 things to avoid when working a short sale transaction.

Here’s what some of the other gurus on the short sale panel had to say on the topic:

Top 5 Things to Avoid When Working Short Sales

Multiple Offers. Short sale lenders prefer to work with one purchase and sale agreement at a time. If the offer is not accepted or the buyer walks, you can submit a backup offer. Never submit multiple offers. Submitting multiple offers slows down the short sale process.

Incomplete short sale packages. In order to assure that your short sale is processed as quickly and efficiently as possible, then it is best to send a complete short sale package—even if you have to wait a few extra days for an additional pay stub or bank statement. When the short sale lender reviews the package, if it is complete, the lender can work towards a quicker decision on the file.

Fuzzy Documentation. Nowadays it is not uncommon to see contracts that are faint due to lots of trips through the fax machine or multiple scans during the process. Make sure that the contract you submit to the short sale lender is clean, clear, and easy to read.

HOA Liens. HOAs have become the latest beast of burden in short sale transactions. High lien amounts can hamper a closing as can an HOA balance sheet that does not appear solvent to the buyer’s lender. To avoid learning right before closing that your deal has gone south, learn about HOA assessments early and make sure that your buyer or seller can deal with any troubles in this area.

Unopened Mail. Just the other day, I heard about a short sale seller that had no idea that her foreclosure date is scheduled in 7 days. That’s probably because she ignored her mail. In order to assure the best possible scenario, it’s a good idea to address and open all mail as soon as you receive it. That way, if you see something problematic, you can address it quickly and efficiently.

A new trend of home remodeling and construction is emerging in older neighborhoods with small-to-medium-sized homes. In many of these neighborhoods, developers and homeowners are tearing down the existing homes and building larger, more extravagant ones. The process, called mansionization, is a response to incredible land costs. In many of the older, built-out communities in California, land is valued as high as $1 million per acre or more.

Via Bill Ladewig Your FHA Guru - FHA and VA Loans Since 1970:

FHA CREDIT

FHA may be the answer for buyers with serious credit issues in their past for loans up to $729,750 is some California Counties. I recently closed a $850,000 purchase with a $697,500 FHA loan (maximum for San Diego County).

Most lenders bump their prices for low credit scores but if the buyer has reestablished their scores after a bankruptcy or foreclosure there is not a price penalty.

Credit scores must meet FHA and Lender guidelines for all FHA mortgages except for a shrinking number of lenders that do not require any credit check on streamline refinances.

Each lender has individual guidelines based on their investor requirements

Generally, credit scores will be in the following ranges:

500 - 579 FHA requires a 10% down payment and absolutely no derogatory credit for the past twelve months on scores below 579. There are very few lenders that will accept scores in this range. I know of only one.

580 - 619 Recently several lenders have added this range to their rate sheets. Those lenders require there be NO derogatory credit for the previous twelve months. Some require a 5% down payment.

620 - 639 A shrinking list of lenders is available for borrowers in this credit range. Generally, there can be no derogatory credit in past twelve months.

640 + 640 is becoming the minimum for a growing list of lenders.

When credit score falls below 640 borrowers should start rebuilding their credit history with a reputable credit repair company. When looking for a credit repair company be very careful and check references.

BANKRUPTCY

Chapter 7 Requires a minimum two-year period since discharge date; minimum one-year lapse period may be acceptable if bankruptcy was caused by extenuating circumstances that are not likely to recur the reason can not be debt caused by uneducated choices. Only extenuating circumstances will be considered and only after one year has passed. In all cases the borrower must have re-established credit and must demonstrate the ability to manage their financial affairs.

Chapter 13 is permitted after twelve months and a credit performance has been satisfactory. The borrower must receive court approval to enter into the mortgage transaction

FORECLOSURES:

Require a minimum of three years since the completion of the action (sale date) and the borrower must have re-established good credit.

Non-Traditional Credit:

Non-Traditional Credit is acceptable to some lenders if the borrower does not have any prior credit history or if that length of credit history is too short to qualify. Borrowers must have three credit sources with at least a twelve month credit history of rent, utilities, local store accounts that do not report credit, cell phone accounts, and/or any other acceptable sources.

Judgments:

Court ordered judgments must be paid completely, unless the borrower has been making regular and timely payments and the creditor is willing to subordinate that judgment to the new insured mortgage. The borrower must provide a satisfactory written explanation. For specific lender requirements check with the Lender's AE.

Collections:

Lenders handle Collections on a case by case basis but generally, collections exceeding $1,000 must be paid or have payment plans. It is a good idea to work with a credit consultant when paying collections because paying them off can sometimes actually hurt the borrower's credit score.

Delinquency or Default on Federal Debt:

If the borrower is presently delinquent on any federal debt or is obligated on any type of federal lien, he or she is not eligible for an FHA loan until the delinquent account is brought current, paid, or otherwise satisfied, or a satisfactory repayment plan is made between the borrower and the federal agency owed and is verified in writing.

I took a home tour of Lincoln Hills Sun City Retirement Community!
Sun City Lincoln Hills is an active Retirment community located in Lincoln California.

It has 6703 homes with 80 condos. The population is approximately 11,000 active adults.

It boasts of two club houses, two gyms, many clubs, golf courses, sports center...

It was build in 1999 and has many models to choose from.

I took a tour of some yeaterday and here is what I found:

This one is the Shasta Model with 3/2.5 and 2277 sq.ft.

Priced at $479,000. It is open and airy with a huge kitchen.

Next I went to a beautiful Sausolito Model...This one was fabulous!

Overlooking the natural area this home has a partial gold course view.

With 3 bedrooms and2 bathrooms and 2176 sq. ft. Priced at: $549,000

Then I went to see this Springcrest Model. Located on a large lot

It boast a 16ft. turret in the office, one of Del Webbs most loved models.

Three Ways to Split the House in Divorce

This is an older blog on Divorce and splitting up property. It is even more difficult in 2012 because many folks do not have equity to split or ability to refinance. There is the Harp program but that may not be a good option. There is also the option of a short sale. That could be a solution for homeowners who are quite a bit upside down and it does not make sense to try and keep the home. I know that some people are choosing to just wait it out and hold the property as investments until the market returns.

Here in Northern California we are in a shift and prices are starting to rise. May be at a slower pace than the past but Real Estate is still a good investment and when the market is in this state of flux you might just choose to not split but hold.

Three Ways to Split the House in Divorce

1. Sell the house and divide the profits that remain after sales costs and the mortgage is paid off. It is important to consider the basis in the house and possible capital gains. Also, if your client wants to buy another home, determine if he/she will be able to qualify for a new loan

2. One spouse buys out the other spouse's interest in the house. This can be done by trading another asset for the interest in the house.

The first step is to determine the value of the home. An appraisal should be done. The fair market value of the house minus the mortgage will show the equity in the house.

What if the wife decides to keep the house and she finds within a short time that she cannot afford to keep it and she puts it up for sale? Should you consider subtracting selling costs and capital gains taxes from the value in the beginning? These are issues that definitely should be considered.

What if the wife wants to keep the house and there is not another asset to offset the value? She could refinance the house to withdraw enough cash to pay off her ex-husband. But that means she now has a higher mortgage payment. Can she afford a higher payment?

Instead of refinancing the house, she could owe a sum to her ex-husband, which is paid off over time (a property settlement note). A note should include reasonable interest, and it should be collateralized with a deed of trust on the property. A problem with this arrangement is that it keeps the ex-spouses in an uncomfortable debtor-creditor relationship.

Another problem with buying out the other spouse's interest is that the non-owner spouse's name stays on the mortgage. Even though the husband may quit-claim the deed to the wife, his name remains on the mortgage. If she decides to stop making the payments, he is still liable. This may impact his credit.

3. One spouse keeps the house for a certain time period, say until the children are out of school, and then the house is to be sold and the proceeds divided. This creates a tie between the ex-spouses that they may not want. But is does allow for the "out-spouse" to be able to also take a $250,000 exclusion from capital gain.
