New purchase and sale agreements are going into effect on October 15th, 2007. All agents are required to attend a mandatory training on the new forms and I attended a class taught by Jeff Koop, the "in-house" attorney for the Northwest Multiple Listing service. It was an excellent and informative class about these new statewide sales forms.

This year has seen a couple of major changes in the way real estate must be conducted, out on the street. One major change was enacted at the legislative level, one handed down by the courts. A recent court ruling, in the case of Alejandre V Bull has made it clear that the onus is on the buyer to do due diligence in investigating property purchases, and not to rely solely on sellers's disclosures or poorly qualified inspectors. The case involved a septic system that was going bad, and the seller and the buyer had both had it inspected, with the results saying all was okay. The seller, having had the system inspected, had marked in the Seller's Disclosure Statement that the system had no problems, having relied on the "experts" even though she had called for the  inspections after noticing an extra sogginess and odor on her property in very rainy weather.

The case really turned on the fact that the agreement between the parties was a contractual one, and contractually, there should have been a remedy for her inadvertent possible negligence. There was none, so the case was thrown out on summery judgement. This meant that there needed to be a new form to cover this, and as the state's various multiple listing services were already negotiating for a statewide form, it was decided to go ahead with one. The new form is based primarily on the forms of the Northwest MLS, the largest in the state, with changes made to accommodate the requirements of Alejandre V Bull and several other material changes, including a formal rental agreement for all post-closing occupancy agreements.

It is now more important than ever that you have qualified assistance in the purchase and sales of residential real estate. Please contact me if you want more information about the new statewide forms, including the newly revised Seller's Disclosure Statement that the legislature amended at the end of the 2006-2007 session. There are situations now, whereby even if a buyer is willing to waive receiving a form (not a good idea anyway), they can't waive receipt of the new Environmental section!

1. Levels of Licensing:

Real Estate Salesperson (agent)

  • Be at least 18 years of age
  • Complete WREC approved pre-licensing course
    • 60 hours in a classroom/online
    • Approved course available through Real Estate Express
    • Hours must be completed up to 5 years before applying for the examination
  • Pass the WREC examination
  • Apply to WREC for a salesperson license

Sales Associate License (associate broker)

  •  During first renewal period:
    • Complete 30 hour Practice Course AND
    • Complete 30 hours of approved continuing education which includes 3 hours of core material
    • Approved course available through Real Estate Express

Real Estate Broker

  • Be at least 18 years of age
  • Hold a high school diploma or its equivalent
  • Complete 2 years full time salesperson experience in Washington or another state with equivalent requirements
  • Complete WREC approved pre-licensing course
    • 120 hours in a classroom/online including 30 hours of each of the following
      • Real Estate Law, Brokerage Management, Business Management, and an Elective course
    • Experience and hours must be completed within 5 years prior to applying for the broker examination
  • Pass the WREC examination
  • Apply to WREC for a broker's license

2. Like most professions there are the basics that you will see:

Blog: Short for Web log, a blog is a Web page that serves as a publicly accessible personal journal for an individual. Typically updated daily, blogs often reflect the personality of the author (webopedia.com). Postings on a blog are usually in chronological order.  

Comment spam : Like e-mail spam. Robot "spambots" flood a blog with advertising in the form of bogus comments. A serious problem that requires bloggers and blog platforms to have tools to exclude some users or ban some addresses in comments.
CraigsList : Local community classifieds and forums for finding jobs, housing, goods & services, social activities, a girlfriend or boyfriend, advice, community information, and just about anything else. The free service has about 10 million users a month and 80 topical forums.

Google : is well-known for its web search service, which is a major factor of the company's success.
