Today I received an email from my Errors and Omission Insurance Company highlighting the importance of using a Short Sale Addendum in Short Sales, and in any circumstance where a property is over encumbered. Describing the facts of a 2010 California Appellate Court's Finding in the case Holmes vs Summer, the Court stated that when a Real Estate agent or broker is aware that the amount of existing monetary liens exceeds the sales prices of a residential property, the agent or broker has a duty to disclose this state of affairs to the buyer, so that the buyer can inquire (9 comments)
