Some Contract Verbage To Protect Homebuyers In This Current Market

We are living in extraordinary times to say the least. Dealing in Foreclosure homes is what I have been doing for the last 20 months and from time to time, I like to share with other agents and homebuyers ways that they can protect themselves when dealing with noncompliant sellers.

A favorite clause I have been using lately is this one:

1.*Respectfully, Should buyer decide during the "Due Diligence Period" that he in his sole discretion does not want to close this escrow, then the buyer may cancel this escrow by giving his notice to escrow agent and escrow agent without any further notification or authorization from either buyer or seller will promptly return all earnest money to the buyer and this escrow shall automatically be deemed cancelled. Escrow Company shall be released of any responsibilities.

Recently, I was in contract and the seller decided they did not want to give my client his money back.
The above phrase worked wonderfully and saved my customer $3,000.00!

1st Time Buyers Are Driving This Market - A Recent Inquiry

Recently, we recieved an email from a prospect looking for more information on buying a home and asking about the tax incentives for this year. this was our reply:

With regards to your tax questions please seek the advise of your accountant. Respectfully, we work with ready to purchase already approved buyers as this market is crazy and a waste of time if your are not approved for a loan. With the market the way it is if you were looking at homes today anything you would like to purchase would be sold in less than a week with multi offiers. I would recommend you contact us about a month before you decide to purchase. In the mean time I would recommend that you put your credit house in order. Know your credit scores, work off any negatives, save some CASH for the down payment 3.5% of the purchase price, stay employed. When you are ready Steve and I could put you in front of one of our lenders and help to get you pre qualified for a home loan.

In this article by Diana Olick, she goes on to say they are seeing a significant increase in the number of people calling for help from the Consumer Credit Counseling Service of Greater Atlanta who have interest-only mortgage loans and are going delinquent. Last year at this time they counseled about 100 per month. Now they're doing about 800 per month.

So as realtors, if people ask you if homes are a great investment, you may want to be careful with your answer. My answer is this: your home is an investment in living.
