Florida's New Safety Law is Working - 07/28/09 07:07 PM
I know that Florida is not the only state to enact this legilation, but I am impressed by how well it's working.
The law states that when an emergency vehicle is stopped on the shoulder - for whatever reason - that you must change lanes on a multiple lane roadway or slow down to 20 mph less than the posted speed limit if you can't change lanes.
Today I saw a half-dozen such opportunities for people to ignore the law and remain in their same lane when a police vehicle had stopped on the shoulder with its light on, and car-after-car … (25 comments)

Seeing a pretty moon at night is nice, but we would expect to be able to do that. Seeing one in the afternoon is different - an unexpected pleasure. Likewise, we can add value to others by doing something exceptional or unexpected.

If It's Good Enough For Us - 07/27/09 11:32 AM
Would we sign a sales contract that the customer - or their attorney or Realtor - prepared without reading it? Would we expect them to sign something we prepared without reading it - or at least having us go through it line-by-line and explain it to them? Of course not on both counts.
Why then do we continue to condone and turn a deaf ear to our Members of Congress when they say they can't or won't read a bill before voting on it? It doesn't stop them from voting - just from knowing what is in the bills that they … (16 comments)

How many times do we see politicians or executives or sports figures blame or attribute their poor performance to anything but themselves?
The weather was wrong, the officials made a bad call, the press misinterpreted that remark, the competition got lucky?
I particularly like highly paid athletes complaining about something that did cost them the win that they either caused themselves or didn't foresee and figure a way to overcome it. "Law & Order" And The Real Estate Transaction - 07/25/09 10:26 PM
The TV show "Law & Order" has been on for many years with a very successful premise. In the one-hour format, they have a crime committed (sometimes we see it and sometimes we don't), then they have the investigation leading up to the arrest of the suspects, a trial, and a disposition of the case. It's a condensed version of weeks of police and judicial work in a tidy little one-hour package.

Our Government Can't Even Label Food - And They Want to Do Health Care? - 07/25/09 02:31 PM
As I was looking for the expiration date on a package of hot dogs for lunch - yes, I like hot dogs - and turning the package over and over and then rotating it and almost reaching for the magnifying glass, I finally saw the expiration date. It was printed in faint lettering on the cellophane where it was hardly legible. I think that's part of the point - comply with the letter of the law but not the spirit - don't do the consumer any favors.

Congress and the Administration have been playing with our emotions. That is changing.
Going back to President Bush, it was pass the TARP - don't worry about what's in it, we just need it. It's an emergency.
Then Obama gets a TARP, Stimulus, Omnibus, and Cap and Trade (House only) passed due to the emergency nature of them. They couldn't be read - there wasn't time. They couldn't be discussed - wasn't time. Just get them passed - we'll sort it out later.

Some Warranties Just Give You Piece Of Mind - And That's All - 07/22/09 05:54 PM
There are warranties, and there are warranties.
I like the ones where if something breaks within the coverage period, the item is replaced. Just a simple exchange - no taking it to the shop for a repair or involved troubleshooting over the phone - just an exchange.
There also are ones like the the car warranties or tire warranties where the affected items or parts are replaced or repaired with a small deductible.
Then there are the warranties that are only good until you open the product.

Congress is debating a universal health care plan that will sooner or later apply to nearly every American - regardless of the government's assertion that it's only an alternative plan. Make that every American except labor union members (for now) and Members of Congress.
If - and that is a huge if - this socialized plan that Congress is so eager to impose on all of us, is so great, then why have they chosen to remain exempt from it?

Starting next Thursday, July 30, in Orlando at the Orange County Convention Center, the Southeast Building Conference (SEBC) and Green Building Show get underway for a three-day run.
There will be education programs, designation courses, golf tournaments, social activities, exhibits, awards programs, fun, and fellowship.
Several Rainers are presenting programs on selling and marketing real estate, advertising, social media, blogging, motivation, and business building.

The Tide Might Be Ebbing Just A Little - 07/19/09 10:53 PM
In a bill tacked onto another - the way the House likes to do things when it can't get enough support for a measure on its own (like the Hate Crimes Bill) or fear the President might not sign it, the House stood up to the majority stockholder of government motors, President Obama.

An Even Bigger Phish Story - 07/18/09 03:57 PM
These phishing stories are getting better all the time, I really got a good laugh from this one.
The premise is that this guy who contacted me embezzled (he doesn't call it that) $10.3 million from his company by not depositing or accounting for the revenues and that he has them available to him to make me an accomplice after the fact in his embezzlement scheme - not to mention receiving stolen property - if his premise were true (which we know it isn't).

In a time when we maybe have a little more time to pursue professional education, and in the coming months when professional designations may matter more to consumers, what a perfect time to take some appropriate coursework.

Just got the most amusing email. It said that they had been to my website and wanted to order some of my products (I have eBooks for sale at present). That part was OK although the phrasing was a little awkward, and I'm not sure what they really meant by "products."

Small Businesses Are Being Targeted - 07/16/09 12:50 PM
All of us who run or work for a small business - and I think that's probably all of us - have a bullseye on our back - placed there by the White House.
Virtually everyday, there is a new attack we learn about.
In no particular order, Cap and Trade, Consumer Protection Financing Agency, 30+ csars in charge of everything imaginable (with more surely on the way), takeovers, bailouts, TARP, Stimulus, and health care all tax and regulate the small businesses, reward labor unions, and make it increasingly difficult for entrepreneurs and small businesses to compete against the government.

Once again we're hearing this "too big to fail" mantra from Washington. Unfortunately this concept is built upon a lie - a very expensive one.

Congress Scoffs At Us - 07/09/09 03:07 PM
I have previously proposed that Members of Congress be made to read the bills they are voting on, initial each page, and attest to a reasonable understanding of each page - before being allowed to debate or voye on it.
Furthermore, I have suggested that sponsors of bills must read, edit, and approve in writing that the bills they are proposing accurately represents their ideas and that they attest to their ability to answer questions and verbally defend them.
This was done in response to the "hurry-and-pass" legislation like the TARP, stimulus, and Cap and Trade bills.

I am not an NAR member, but many of you are. However, you might want to think about the following when renewing or maintaining your membership.
First, the provisions in the "ACES" (Cap and Trade" bill) that requires the adoption of a national energy code and a national energy audit of all homes before they are sold was horse-traded out by NAR as part of the last-minute 341-page amendment that was added to the bill at 3:00am on the day of the vote. Apathy Can Be Very Dangerous - And Costly - 07/07/09 05:29 PM
I have posted extensively about the injurious and dangerous "Cap and Trade" bill that was passed with blinding speed in the House on June 26th and arrived in the Senate today.
I use those adjectives to make a point. I am 100% against this bill - but maybe not for the reasons that you might think.

What A Time To Act - 07/05/09 07:24 PM
From now until Labor Day - exactly 2 months away - there are no other holidays or major observances on the calendar.
This doesn't happen very often during the year when we go for more than a month without a holiday that we observe or celebrate.
Oh, there might be a family vacation - and there's the start of football season and back to school. Those don't count.
We need to extremely focused on using these next 2 months to the best advantage possible. Our customers are not going to have as many excuses for waiting.

It's The Little Things That Can Mess Up Your Brand - 07/03/09 05:38 PM
We spend a lot of time, money, and conscious effort designing, creating, giving life to, maintaining our brand.
Yet, it's often the little mental slip-ups that can seriously damage a brand.
Take today for instance today when I went to my local branch of Bank of America. As I walked up to the entrance, I noticed the very substantial flagpole that is mounted to the side of the building.I glanced to the top of the pole to observe how large the American flag was  that could fly from this pole - expecting to be dazzled. Freedom Carries Responsibilities - 07/03/09 11:08 AM
Freedom, as envisioned in the Declaration of Independence and as prescribed in The Constitution of the United States, isn't 100% do-what-we-want. That would be anarchy - no rules, no responsibilities.
We are a nation of laws. We also are a nation built upon self-reliance.
Take a newborn baby. Some would say this child was totally free to do whatever it wants - no worries or cares. It has no responsibilities. I would argue that child is not free at all because it it dependent on others for all of its needs - clothing, shelter, food, health, nuturing, and love. In fact … (10 comments)

Legislators Taking Responsibilty For What They Propose - 07/02/09 12:48 PM
Yesterday I posted about an idea I'd like to see adopted whereby legislators would have to iniital each page in a bill to affirm that they had read it and understood what was being proposed on each page. This is just like we do with sales contracts - no difference - except the stakes.
Taking that idea a step farther, I have another suggestion.
When someone proposes a bill - Waxman, Kennedy, Smith, Jones, or whomever - before they are allowed to have their name associated with the bill as a sponsor, the bill must be typed up in draft form, … (22 comments)

A Contract Approach To Legislative Reform - 07/01/09 10:50 AM
Those of us who sell real estate - of even those who have ever purchased real estate - know that a sales contract of some form (that is often called by various names) is used to spell out the terms and conditions and become a binding, legally enforceable document between the parties.
The recent "Cap and Trade" voting fiasco in the House - the bill is disastrous and needs to be defeated, but I'm only talking about the voting process here - brought to light just how broken the system is.

July Offers Plenty For The Sports Fan - 07/01/09 08:07 AM
In addition to Little League baseball and softball and other youth sports in towns and cities across America, July features some special sporting events and activities.
Going on in England through Sunday is Wimbleton.
Beginning Saturday and running for 2½ weeks is the Tour de France - with Lance Armstrong attempting a comeback.
On the 14th is the MLB All-Star Game from Busch Stadium in St. Louis.
Then there's NASCAR's schedule.
Oh, and we can't forget the start of NFL training camps - that's right football returns!
