When ordering title for your clients - Refer to RESPA Section 9 below: Section 9 of RESPA (12 U.S.C. §2608) states that: 1. No seller of property that will be purchased with the assistance of a federally related mortgage loan shall require directly or indirectly, as a condition to selling the property, that title insurance covering the property be purchased by the buyer from any particular title company. 2. Any seller who violates the provisions of subsection (a) of this section shall be liable to the buyer in an amount equal to three times all charges made for such title insurance. (0 comments)

RESPA has put a lot of new guidelines, changes, updates, etc in place for Mortgage and Real Estate Professionals as well as Title Insurance and Closing Companies across the Country. The GOOD NEWS in all this is not just the fact that all these new regulations will weed out the bad but also that per RESPA - Real Estate and Mortgage Professionals are now to direct their customers to shop for their own title insurance companies! This is GREAT NEWS for the title insurance companies out there competing with the in-house title companies locking down Realtors business from their Brokers. Also, (0 comments)

GREAT NEWS for us title insurance companies still kicking now focused solely on REO / Bank owned properties out there. RESPA has written it into their guidelines for Real Estate and Mortgage Financing Professionals to educate their borrowers / sellers to shop for their own title companies vs. forcing them to use in-house title companies from the days of the past per Brokers. This is great news as the title companies out there providing great customer service, flexability, and pricing have a better chance in competing for the business per RESPA!
