&lt;p class="MsoNormal" style="line-height: 12pt; margin: 0in 0in 0pt;"&gt;&lt;span style=""&gt;&lt;br&gt;WASHINGTON - Jan. 2, 2013 - Yesterday, the House and Senate passed H.R. 8, legislation to avert the so-called "fiscal cliff." Following are real estate-related provisions of the bill, which President Obama plans to sign into law today:&lt;br&gt;&lt;br&gt;&amp;bull; &lt;strong&gt;Mortgage Forgiveness Debt Relief Act extended to January 1, 2014. &lt;/strong&gt;In place since 2007, the act provided a tax break for homeowners who struggled through financial hardship such as a foreclosure, and were granted mortgage debt forgiveness. In the past several months, National Association of Realtors (NAR) issued numerous calls to action urging its million-plus Realtor members to ask lawmakers to extend the tax break for another year. More than a quarter of all transactions involve distressed properties, the NAR said in its plea. "Homeowners shouldn't be forced to pay a tax on money they've already lost with cash they never received."&lt;br&gt;&lt;br&gt;&amp;bull; &lt;strong&gt;Deduction for mortgage insurance premiums&lt;/strong&gt; for filers making below $110,000 is extended through 2013 and made retroactive to cover 2012.&lt;br&gt;&lt;br&gt;&amp;bull; &lt;strong&gt;The 15-year straight-line cost recovery for qualified leasehold&lt;/strong&gt; improvements on commercial properties is extended through 2013 and made retroactive to cover 2012.&lt;br&gt;&lt;br&gt;&amp;bull; &lt;strong&gt;The 10 percent tax credit (up to $500) for homeowners for energy efficiency improvements&lt;/strong&gt; to existing homes is extended through 2013 and made retroactive to cover 2012.&lt;br&gt;&lt;br&gt;&amp;bull; &lt;strong&gt;"Pease limitations" that reduce the value of itemized deductions are permanently repealed&lt;/strong&gt; for most taxpayers but will be reinstituted for high-income filers. "Pease" limitations will only apply to individuals earning more than $250,000 and joint filers earning more than $300,000. The thresholds are indexed for inflation so will rise over time. Under the formula, filers gradually lose the value of their total itemized deductions up to a total of a 20% reduction.&lt;br&gt;&lt;br&gt;First enacted in 1990 and named for Ohio Congressman Don Pease, who proposed the idea, the limitations continued throughout the Clinton years. The limitations were gradually phased out starting in 2003 and eliminated in 2010. Reinstitution of these limits has far less impact on the mortgage interest deduction than a hard dollar deduction cap, percentage deduction cap or reduction of the amount of mortgage interest deduction that can be claimed.&lt;br&gt;&lt;br&gt;&amp;bull; &lt;strong&gt;The capital gains rate&lt;/strong&gt; remains at 15 percent for individuals earning less than $400,000 per year and couples earning less than $450,000.&amp;nbsp; Any gains above these amounts will be taxed at 20 percent. The $250,000/$500,000 exclusion for the sale of principle residence remains. &lt;/span&gt;&lt;/p&gt;

      <title>Weston Florida Facts and Trends for 2012</title>
      <description>&lt;p&gt;If we look back to February 2011, we had 291 single family homes on te market. Moving up to April 2012, we have 237 homes on the market. Conclusion! Weston's inventory is quite low!&lt;/p&gt;
&lt;p&gt;The median price for a home in February 2011 was $350,000.00 and in April 2012 it has increased to $413,000.00. That is an 18% increase in price.&lt;/p&gt;
&lt;p&gt;For Weston homes priced at $300,000.00 and less in February 2011 there were 61 homes on the market. For April 2012, there are 29 active listings. A decrease of 465 is noted.&lt;/p&gt;
&lt;p&gt;For Weston homes priced at 450,000.00 and less, there were 35 pending sales in february 2011 and in April 2012 there were 76 homes. That is an increase of 23%.&lt;/p&gt;
&lt;p&gt;For the million dollar home buyer/seller, Weston homes priced at $1,000,000.00 and less in February 2011 there were 2 pending sales. For April 2012 there were 7 pending sales.&lt;/p&gt;
&lt;p&gt;Weston's distressed single family home sales account for 22% of the inventory and 31% of the sales. In April 2012, there were 52 listings, 39 pending sales and 15 sold properties.&lt;/p&gt;
&lt;p&gt;Weston's condominiums from February 2011 to April 2012 have had a 51% decrease in price. In April 2012 we had 81 units for sale, 25 units sold and 49 units pending. The median price for condominiums is $126,000.00. In April 2011 the median price was $101,000.00. That is a 25% increase in price from last year.&lt;/p&gt;
&lt;p&gt;Weston Florida condominiums $300,000.00 and less for sale in April 2012 was 71, sold 25 and pending was 47.&lt;/p&gt;
&lt;p&gt;Weston's distressed condominiums accounted for 41% of the inventory from February 2011 to April 2012 and 54% of the total sales.&lt;/p&gt;
&lt;p&gt;From our international buyers, 55% are cash buyers.&lt;/p&gt;

      <description>&lt;p&gt;The one email that caught my attention is the title of this blog. Living in South Florida, filled with beaches, night life, sporting events, shopping, restaurants, entertainment and plenty of great rays to keep us warm is also the same area of the great United States of America where&amp;nbsp;a multitude&amp;nbsp;of&amp;nbsp;city dwellers&amp;nbsp;are staying in their&amp;nbsp;residential properties&amp;nbsp;and yet they are no longer paying on their mortgages. These are the Broward county and Miami-Dade county upside down&amp;nbsp;homeowners who know their properties are no longer worth what they bought them for.&lt;/p&gt;

      <title>Short Sale Information, Information, Information For South Florida Sellers and Buyers</title>

&lt;p&gt;Most buyers are nervous with the mention of a Short Sale Florida Real Estate&amp;nbsp;Property Listing.&amp;nbsp; They do not fully understand what is involved with this type of property transfer. Short Sales have a longer time to be aquired than a regular sale, and I am thrilled to say this time frame is&amp;nbsp;more reasonable today than what previously was dealt to us. Short Sales were meant to involve only the mortgage or&amp;nbsp;mortgages on a residential property. Short Sales take into consideration the sellers finances and hardship.&lt;/p&gt;
&lt;p&gt;Complications arise when other variables are thrown into the sale of a distressed&amp;nbsp;property, such as&amp;nbsp;unpaid condominium fees, outstanding home owner association fees, liens, unsettling&amp;nbsp;Internal Revenue Service Tax Liens, extra mortgages beyond the first or second&amp;nbsp;and&amp;nbsp;bankruptcy. The&amp;nbsp;seller's time frame ( not the buyers time frame) &amp;nbsp;in selling their home is another matter that can turn a short sale into a foreclosure due to the lagging wait where the home&amp;nbsp;has went &amp;nbsp;into auction status instead of being sold as a short sale in a pre-foreclosure status. These external factors were not to be a consideration with a short sale, as this challenging process was intended soley&amp;nbsp;for the mortgage.&lt;/p&gt;
&lt;p&gt;Yet, here we are with all of these circumstances. According to Paul Ownes from the Sun Sentinel, Short Sales are&amp;nbsp;outnumbering foreclosures. &lt;span style="text-decoration: underline;"&gt;&lt;span style="color: #0066cc;"&gt;&lt;a href="http://articles.sun-sentinel.com/2012-04-22/features/fl-short-sales-20120422_1_short-sales-foreclosure-sales-housing-recovery"&gt;http://articles.sun-sentinel.com/2012-04-22/features/fl-short-sales-20120422_1_short-sales-foreclosure-sales-housing-recovery&lt;/a&gt;&lt;/span&gt;&lt;/span&gt;&amp;nbsp;. Short sales are part of today's market and the new way of selling and buying South Florida properties.&lt;/p&gt;
&lt;p&gt;Buyers cannot look and judge a short sale the way they would&amp;nbsp;a regular sale. They need to understand&amp;nbsp;the&amp;nbsp;contract is usually written as As/Is. &amp;nbsp;The Seller has no money for repairs or replacement of appliances, roof leaks, or other problematic circumstances that the inspection report&amp;nbsp;may discover. The buyer should realize&amp;nbsp;and understand&amp;nbsp;they can opt to have the inspection report performed immediately or after the home is approved. This inspection period&amp;nbsp;is usually dependent &amp;nbsp;on the contingency of walking away if not satisfied with the outcome of this report. This is not the typical regular sale where the seller will repair or replace items inside the home. The buyer needs to be aware of this from the beginning. The seller is walking away from their home&amp;nbsp;due to factors stemming from &amp;nbsp;such matters as divorce, death, insolvency, illness, and unemployment.&lt;/p&gt;
