      <title>Great News on the New Tax Credit</title>
      <description>&lt;p&gt;&lt;strong&gt;Great News on the New Tax Credit&lt;/strong&gt;.&amp;nbsp; The House passed the &lt;strong&gt;unemployment extension bill&lt;/strong&gt; today after Senate did yesterday which includes the extension and expansion of the tax credit.&amp;nbsp; The President&amp;nbsp;signed the bill today!&amp;nbsp;&amp;nbsp;The &lt;strong&gt;tax credit&lt;/strong&gt; provision remains the same.&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;&lt;strong&gt;First-time home buyers&lt;/strong&gt; will continue at $8,000&lt;/li&gt;
&lt;li&gt;&lt;strong&gt;Tax credit&lt;/strong&gt; for &quot;move up&quot; purchasers will be up to $6,500&lt;/li&gt;
&lt;li&gt;Must have used previous home as a principal residence for 5 consecutive years of the previous 8.&lt;/li&gt;
&lt;li&gt;Income limits increased and are the same for first-time and &quot;move up&quot; purchasers: $125,000 for&amp;nbsp;&amp;nbsp;&amp;nbsp; single filers/$225,000 for joint&amp;nbsp;filers&lt;/li&gt;
&lt;li&gt;Limitation on eligible home prices has been increased to $800,000&lt;/li&gt;
&lt;li&gt;Time Frame:&amp;nbsp; &amp;nbsp; &lt;strong&gt;December 1, 2009 to April 30, 2010&lt;/strong&gt; plus 60 day extension if binding contract is in place&lt;strong&gt; &lt;/strong&gt;by April 30, 2010&lt;/li&gt;
&lt;li&gt;Anti-fraud measures have been added&lt;/li&gt;
&lt;/ul&gt;
&lt;p&gt;Below are the &lt;strong&gt;NAR Frequently Asked Questions&lt;/strong&gt; in regards to the &lt;strong&gt;Home buyer Tax Credit Changes&lt;/strong&gt;:&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;&lt;span style=&quot;text-decoration: underline;&quot;&gt;Question:&lt;/span&gt;&lt;/strong&gt; Existing homeowner credit: Must the new house cost more than the old house?&lt;/p&gt;

&lt;p&gt;As &lt;strong&gt;Realtors&lt;/strong&gt; it is a very powerful outlet to get your name and your services out to those who may be in the &lt;strong&gt;Real Estate Market&lt;/strong&gt;.&amp;nbsp; That said, it is wise not to press a person just because they befriend you or accept your friend request - the last thing a potential client wants in to be spammed by an anxious &lt;strong&gt;Realtor&lt;/strong&gt; and there is really no need to do so.&lt;/p&gt;

      <description>&lt;p&gt;When &lt;strong&gt;shopping for major purchases&lt;/strong&gt; are you more of an impulse buyer or one who conducts hours, days, weeks and even months of research to get the best value or what is the right 'fit' for you (and your Family)?&lt;/p&gt;
&lt;p&gt;I must admit that over the years my tactic has moved from impulse to massive research, especially when it comes to major purchases ($1000 or more in my mind).&amp;nbsp; Pamela Ann will be quick to say that is because I have made some bad purchases in the past due to my impulsiveness and impatience (1988 Mustang GT 5.0 Convertible quickly gets brought up..)&lt;/p&gt;
&lt;p&gt;My latest venture is upgrading my road bicycle as I have found a new hobby that is both enjoyable, addictive, and good for you (hard to find that combination!).&amp;nbsp; Anyhow, 15 or 20 years ago it would have been more difficult to conduct any reasonable research when it comes to durable goods.&amp;nbsp; With the information highway one might say that now there is information overload and I can certainly attest to that.&lt;/p&gt;
&lt;p&gt;Being a &lt;strong&gt;Realtor in Clarksville TN&lt;/strong&gt;, I do my fair share of research via the Internet searching for Buyer Clients and Prospects in the &lt;strong&gt;Clarksville TN Real Estate&lt;/strong&gt; Market.&amp;nbsp; I find this both challenging and enjoyable as there is nothing better than helping clients to find that perfect home.&amp;nbsp; So it is safe to say that the same dedication I place into research for my Families major purchases.&lt;/p&gt;

&lt;p&gt;As if researching suitable properties isn't enough of a challenge, now we have to deal with &lt;strong&gt;listing agents who don't bother posting at least one photo to show us what the property looks like.&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;While going through a list of properties using certain criteria, I identified 127 that may be suitable. But going through the list, I was dumbfounded at seeing that &lt;strong&gt;30% of these listings do not have a single photo&lt;/strong&gt; of the property.&lt;/p&gt;
&lt;p&gt;And of the 38 that do not have pictures 31 of them were short sales.&lt;/p&gt;

&lt;p&gt;For gosh sakes, when people are selling their homes as short sales, they are obviously in distress.&amp;nbsp; And what they need is for someone to write an offer so that the short sale negotiator can review the file and hopefully accept and approve the offer to prevent foreclosure or bankruptcy. Right?&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;SHORT SALE LISTING AGENTS: Are you doing everything you can to sell this property?&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;We know the importance of pictures, visual tours, staging, etc in marketing a property for sale.&lt;/p&gt;
&lt;p&gt;But if the listing agent doesn't take a single picture of the property, how does that reflect on that agent's ability to market, &amp;nbsp;much less aggressively push the short sale process?&lt;/p&gt;

&lt;p&gt;Yes, we know. It takes a lot of work and a long time to get a short sale approved and accepted, if a all. But these property owners entrusted us to help them sell their property to save them from a more financially disastrous situation.&lt;/p&gt;
&lt;p&gt;If you can't give these folks the same care and respect as your regular listing, then for goodness sakes, &lt;strong&gt;don't take the listing. &lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Give it to someone who truly gives a damn!&lt;/strong&gt;&lt;/p&gt;

And while this opportunity to collect cash has had a very positive effect on sales in the lower price ranges, it really hasn't meant much to sellers with homes valued in excess of $200,000.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;My preference is to let this credit just go away&lt;/strong&gt;. The expiration of the credit could actually lead us back to a true fair market, where buyers buy because they need a house rather than just trying snag a great deal with future profit potential.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;I would like to propose an alternative remedy to help sale in all price ranges.&lt;/strong&gt; My proposal would really create interest in buyers that could really stimulate the market, and it is the only remedy that I have even seen proposed that would actually correct the mistakes of the past.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;The solution I am proposing is to make all down payment monies&lt;/strong&gt; for a personal residence up to and including a cash sale an &lt;strong&gt;income tax deduction.&lt;/strong&gt; Not a refundable credit, just a deduction against income.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;This also would encourage buyers with both cash and significant incomes&lt;/strong&gt; to get back into the market. It would lead us back to the days when more down payment was better, and smaller mortgages would prevent the short position debacle that we are experiencing today.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;The higher end market would see an extensive boost in sales,&lt;/strong&gt; and prices would stabilize. And once again, homeowners will be encouraged to have equity in their homes to cushion them against negative market forces.&lt;/p&gt;

&lt;p&gt;I am thrilled that I was chosen to be one of the top 12!&amp;nbsp; Last year we had a Night Stalker in the competition and this year we have a Lady Night Stalker! Me!&lt;/p&gt;
&lt;p&gt;The competition will be taking place on November 14-20th in Ft. Belvoir, VA.&amp;nbsp; It will be on the Pentagon Channel if you are living on base.&amp;nbsp; If not, I will be getting more information on where you can watch the show.&amp;nbsp; It will be just like American Idol, where the viewing audience can call in to vote for their favorite performer.&amp;nbsp; I believe you will be able to vote online also.&lt;/p&gt;
&lt;p&gt;This is the 2nd year in a row that Ft. Campbell, KY has had a contestant be in the top 12.&amp;nbsp; Last year our very own, Fatima McElveen, made it to 2nd place in the final competition. I hope to do Ft. Campbell proud this year too!&amp;nbsp; One of the important roles of this competition is the fans and their calling in or getting online to vote.&amp;nbsp; So, more information will be coming your way on how you can do this.&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;WHO IS THE CLIENT OF THE LISTING BROKER?&lt;/strong&gt;&amp;nbsp;&amp;nbsp;The client is &lt;strong&gt;NOT&lt;/strong&gt;&amp;nbsp;the owner's mortgage company.&amp;nbsp; The client of the listing broker is the owner of the property listed for sale.&amp;nbsp; When interviewing for the listing agreement, did the agent advise the owner/seller that they would not&lt;strong&gt; SPEAK OR OTHERWISE COMMUNICATE WITH BUYERS' AGENTS who needed help sending an offer???&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;From personal experience,&lt;/strong&gt; when the instructions to making an offer are limited to &lt;strong&gt;&quot;FAX OFFERS TO:&quot;,&lt;/strong&gt; I know that it sometimes just does not work as intended.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;THE FAX WON'T GO THROUGH.&lt;/strong&gt;&amp;nbsp; The fax is interrupted after a mere 21 of 27 pages.&amp;nbsp; What do you do.&amp;nbsp; If you can't call the listing agent, whom do you call?&amp;nbsp; &amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;WHAT EVER HAPPENED TO PRESENTING OFFERS IN PERSON.&lt;/strong&gt;&amp;nbsp; Perhaps I'm old fashioned but I still prefer to present an offer to buy real property&amp;nbsp;often&amp;nbsp;for&lt;strong&gt; $Hundreds of Thousands of Dollars&lt;/strong&gt; in person.&amp;nbsp; Yet, with instructions limited to &lt;strong&gt;&quot;Fax offers to. . . . . . &quot;&lt;/strong&gt; there's no opportunity for information that &lt;strong&gt;may not be included&lt;/strong&gt; in the limited instructions in the MLS listing report.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;DO NOT CALL LISTING AGENT.&amp;nbsp; WHAT????&lt;/strong&gt;&amp;nbsp;&amp;nbsp; I have found over the years that agent instructions vis-a-vis submitting offers by electronic means, while easy for the listing agent to understand when they include these limited instructions in the Agent Remarks, may not be so easy for the buyer's agent to understand.&amp;nbsp; In fact, some listings are so incomplete, i.e., liens on the property for sale, other offers in hand, type of buyer financing, etc., all legitimate questions, yet rarely included in the listing instructions.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;THE BEST OFFER FOR THE SELLER&lt;/strong&gt;may be thwarted by limited access or no access to the&amp;nbsp;&lt;strong&gt;agent&amp;nbsp;for the seller.&amp;nbsp;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;WHAT IS THE GOAL???&lt;/strong&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Is it to limit communication?&lt;/strong&gt;&amp;nbsp; &lt;strong&gt;Communication is the essence of negotiation&lt;/strong&gt; of price, terms and condition of properties for sale.&amp;nbsp; Without communication, errors are made, confusion is rampant, frustration is promised, questions are not answered and the SELLER may be deprived of the best offer.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Is it to limit offers?&lt;/strong&gt;&amp;nbsp; If that's the goal, it is a monumental success, but does it produce the best result?&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Is it to show superior technical ability?&lt;/strong&gt;&amp;nbsp; By limiting representation of a seller to &lt;strong&gt;&quot;FAX OFFERS TO:&quot;,&lt;/strong&gt; the&lt;strong&gt;&amp;nbsp;seller&lt;/strong&gt; may be deprived of the best offer/contract/sale.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Is refusing to communicate with buyers' agents a power play??&lt;/strong&gt;&amp;nbsp; Well of course.&amp;nbsp; O.K.&amp;nbsp; So listing agents have the power, but are they doing the best job for the seller whom they represent???&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Conspicuiously absent in this post is any reference to the Code of Ethics.&amp;nbsp; I cannot believe that any listing agent has not read and does not understand &lt;strong&gt;Standard of Practice 1-15, Standard of Practice 3-6, Standard of Practice 3-8.&lt;br /&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Is it to save the listing agent time?&lt;/strong&gt;&amp;nbsp; I submit that by answering questions in the beginning, serious misunderstandings can be avoided later.&amp;nbsp; Buying a short sale is by it's nature, buying a resale property.&amp;nbsp; Agent to agent communication is often the best way to&amp;nbsp;achieve the goal to&amp;nbsp;get the property sold . . . . .&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;IN THE SHORTEST AMOUNT OF TIME FOR THE BEST PRICE, TERMS AND CONDITIONS FOR THE SELLER.&lt;/strong&gt;&lt;/p&gt;

Buyers, however, can sometimes forget with all the excitement surrounding the buying of their new home. In the past couple of weeks, I have heard of two separate buyers who saw their home loan turned down, and their dream shattered, a few days before closing because they had bought furniture for their new home before it actually became their home. Both of them now have beautiful furniture with no home to put them in.&lt;/p&gt;
&lt;p&gt;These two buyers were not my clients but it always hurts when I hear of transactions falling apart for reasons that could have been avoided. These 10 commandments are part of the buyer packet I give all my clients when we first meet and I always stress that once they get pre-approved and the process is started, they can't do anything that might affect their credit.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;1.&lt;/strong&gt; Thou shalt not change jobs, become self-employed or quit your job.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;2.&lt;/strong&gt; Thou shalt not buy a car, truck or van (or you may be living in it)!&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.&lt;/strong&gt; Thou shalt not use credit cards excessively or let your accounts fall behind.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;4.&lt;/strong&gt; Thou shalt not spend money you have set aside for closing.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;5.&lt;/strong&gt; Thou shalt not omit debts or liabilities from your loan application.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;6.&lt;/strong&gt; Thou shalt not buy furniture.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;7.&lt;/strong&gt; Thou shalt not originate any inquiries into your credit.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;8.&lt;/strong&gt; Thou shalt not make large deposits without first checking with your loan officer.&lt;/p&gt;

&lt;p&gt;If you are in the process of buying a home, remember that your credit must not change or be affected in any way until you actually sign the paperwork and get possession of your new home. Lenders will not only look into your credit when you first get pre-approved, they will check it again (and sometimes again and again) before they let you sign the mortgage. If you want to buy new furniture for your home or change jobs, just be patient. There will always be time to do it &lt;strong&gt;after the closing&lt;/strong&gt;.&lt;/p&gt;

      <description>&lt;p&gt;The Clarksville-Montgomery County Veterans Day Parade will take place on Saturday, Nov. 7, with pre-parade ceremonies set for 9 a.m. at 1 Public Square in downtown Clarksville.&lt;/p&gt;

      <title>New Housing Bill Will Force Loan Modification</title>

&lt;p&gt;I will join the dissenters on this one.&amp;nbsp; This would be a bad thing for America.&amp;nbsp; I see this as a process that could blow up in many Honest Americans faces.&amp;nbsp; We have enough government in the middle of 'free enterprise'.&amp;nbsp; As someone above mentioned - Barney Frank is one of the key authors that got us in this mess in the first place.&amp;nbsp; Should this pass, WE will be on the hook for billions more that we simply cannot afford.&lt;/p&gt;
&lt;p&gt;Look at the billions already handed out that we will never see a dime back on to the various financial institutions (to include Freddie and Fannie) and the auto industry.&amp;nbsp; Enough is simply enough.&lt;/p&gt;
&lt;p&gt;When does it end?&amp;nbsp; Do we retro this?&amp;nbsp; Do we give Honest Folks who lost everything their homes and their 401K's back?&amp;nbsp; Who is the judge and jury on who is Honest and who is not? Acorn? (Sorry, couldn't help myself on that one).&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Under this bill, lenders will be forced to the negotiating table under the threat of stiff fines and other legal penalties.&amp;nbsp;&amp;nbsp;&lt;/strong&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;All lenders will be required to perform what the bill terms as a &quot;net present value&quot; test for all seriously delinquent borrowers.&amp;nbsp; The test would be a financial analysis weighing the benefits of a modification of loan terms against the benefits of foreclosure.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;For borrowers who do not fit into this program, the bill would create a multi-billion national fund for states to make loans or grants in order to prevent foreclosures.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;The senators' rationale behind the creation of this bill is that they are frustrated with the slow pace of current &lt;a href=&quot;http://www.linexlegal.com/content.php?content_id=117902&quot; target=&quot;_blank&quot;&gt;loan modification programs&lt;/a&gt; and feel that they are not keeping up with the record numbers of foreclosures this year.&lt;/strong&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&quot;Voluntary efforts to keep families in their homes have failed,&quot; said Durbin. &quot;This bill will force lenders to modify qualified mortgages rather than letting them move quickly to foreclosure, which destroys households and neighborhoods.&quot;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;The act will also set up a mortgage payment assistance program&lt;/strong&gt; to provide money to state housing agencies to assist people who have lost income and face the prospect of foreclosure.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;The most significant aspect of this bill would be to create &quot;mandatory mediation&quot; requirements&lt;/strong&gt; &lt;strong&gt;forcing lenders to allow some mediation efforts between them and their borrowers before being able to file foreclosures against home owners.&lt;/strong&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;This proposal will, no doubt, be met with opposition by banking and mortgage lending groups.&amp;nbsp; It is, however,&amp;nbsp;currently favored to be supported in the House.&amp;nbsp;&lt;/p&gt;
