How do you know if it is a sellers market in your area? Well here in Reno, NV we know we are in a sellers market when and if we receive the following email that was sent to 96 Reno Real Estate agents yesterday:

"Listing Announcement:

I wanted to extend my humble appreciation for your interest in my client's home and quite frankly, we had a lengthy 4 hour review last night of all of the 97 offers that were presented. Unfortunately, only "one" could be chosen and my client's have identified that buyer, whose terms were the cleanest, most stable, and not just the "highest" price. All my best to you and your clients and if you wish to call me to discus; please understand, I may not have the physical ability to handle everyone's questions immediately. Thanks!"

Yep folks, it appears it's a sellers market here in Northern Nevada! 97 offers on just one HAFA approved short sale listing in Reno, NV that was listed for sale on the MLS for one week. Whether or not the listing agent received a full 97 offers has not been verified, but I am sure there were plenty that the agent and the client had to go over before choosing the best one.

Good times! It is no wonder we are all tired at the end of each day.

Wild Island To Host Job Fair This Weekend ~ March 2013 Sparks, NV

Wild Island Family Adventure Park is hosting a job fair later this week for seasonal and entry level positions.

The job fair is scheduled Saturday from 10am-4pm at the Wild Island Waterpark and Sunday from 4pm to 8pm at the Mini Golf and Go-Kart Building, both located at 250 Wild Island Circle in Sparks, NV. There is plenty of parking for both areas.

The park is hiring for all departments including Coconut Bowl and Wild Island Waterpark. Jobs include food and beverage, cashiers, lifeguards, operational services, golf and raceway. New HUD Guideline For Determining Housing Discrimination

Connecticut Mortgage lender George Souta read the new FHA guidelines that went into effect on Friday, February 15. Here is what if found in the new guidelines. Very interesting...

I read an article last week on the New HUD Guideline For Determining Housing Discrimination, which went into effect this past Friday, February 15, 2013. Preventing discrimination in housing is a good thing, but the criteria that HUD is using left me almost speechless.

Let me explain. The new HUD rule is based on a three-part-test, and is designed to whether or not a housing practice is discriminatory even if it is neutral on the surface. According to HUD Secretary Shaun Donovan, “housing discrimination comes in many forms. Discrimination doesn’t have to be intentional in order to have a damaging effect,” also according to Donovan “HUD, which has the responsibility and authority to interpret and enforce the Fair Housing Act, has long interpreted the Act to prohibit housing practices with an unjustified discriminatory effect, if those acts actually or predictably result in a disparate impact on a group of persons, or create, increase, reinforce or perpetuate segregated housing patterns.”

Donovan's second statement is what left me almost speechless. If this is going to be the standard, then who more than HUD fits their own definition of discrimination, with the implementation of their new changes this year, and with their new Debt-To-Income Ratio requirements. OH wait maybe The Consumer Financial Protection Bureau (CFPB) and the Dodd/Frank Act. Both of them have also reduced the ability of lower income Borrowers to purchase a home. The CFPB wants to set across the board a 43% Debt-To-Income Ratio on all Mortgage Programs, and both the CFPB and Dodd/Frank would welcome a requirement for Borrowers to have a 20% minimum Downpayment in order to purchase a home. Here again it would be the lower income Borrower that would be once again most affected. Let me repeat a portion of Donovan's last statement "Act to prohibit housing practices with an unjustified discriminatory effect, if those acts actually or predictably result in a disparate impact on a group of persons, or create, increase, reinforce or perpetuate segregated housing patterns.”

However, “HUD does not believe that the rule will have a chilling effect on lending in lower income communities or that it will encourage lawsuits challenging credit scores, other credit assessment standards, or the requirements of the Dodd-Frank Act … " This leaves me wondering what world do they live in. HUD wants to apply the New HUD Guideline For Determining Housing Discrimination on Lender, but HUD, CFPB, and Dodd/Frank are the biggest violators of the above statement made by Donovan, yet the New HUD Guideline For Determining Housing Discrimination will not apply to them. This is an excellent example of "Do as I say, but not as I do". Is this a double standard or what?

Bank of America’s New MLS Requirement for Short Sales

Kathleen Daniels of San Jose, CA wrote the post below about Bank of America's new MLS short sale requirements. This is an attempt by BofA to help control certain/bad behavior that is on the rise from some real estate agents. Please read the information provided and decide for yourself if the banks should have a say in how short sale transactions are handled.

Bank of America’s New MLS Requirement for Short Sales

On February 11, 2013 Bank of America announced a new MLS requirement for short sale transactions.

In addition to requiring all properties be listed on the MLS which has been the case as long as I have been doing short sales, the announcement also stated:

“Ensure the listing status is current and active on the MLS until a short sale approval letter is issued”

Bank of America went too far with this one. As a San Jose short sale agent, it is my opinion that Bank of America knows little to nothing about selling homes. With this announcement they prove they know nothing about board and MLS rules either. It is clear with that statement that they expect short sale agents to violate MLS rules.

I cannot speak for all MLS rules because I don’t know them. I only know my MLS rules which require us to change the MLS status from “active” to pending once the property has a ratified contract.

Bank of America claimed it is “aware of the MLS rules and would be clarifying the matter soon.”

Yesterday, February 14, 2013 Bank of America distributed a Short Sale Agent Update which, among other things, clarified the MLS requirement as follows:

“The listing requirement demonstrates that the property was listed on the open market and the offer received represents an open market transaction. We recognize that listing status classifications may differ by locale and are subject to local or regional MLS requirements. Brokers should follow MLS requirements at all times. MLS statuses such as Back Up, Contingent or Pending may be acceptable. Ensuring that the listing remains on the MLS until an approval letter is issued will help you show that the property was on the open market.”

I realize there are some shall we say “shady” short sale transactions managed by agents who behave badly by not adhering to lender requirements and/or following their own Board and MLS rules.

Bank of America, as well as other lenders, has always required that the MLS printout be submitted with the short sale package. This has been the case at least as long as I have been doing short sales.

I have to say that I find it disturbing that Bank of America made the MLS active status requirement statement in the first place. Clearly Bank of America does not understand that “active status” or any other status on the MLS does not prove the “offer received represents an open market transaction.” The only thing it proves is that the property was listed on the MLS.

Agents representing buyers in a highly competitive sellers’ market like we are experiencing today know that some agents keep their own short sale listing inventory in their own pockets, so to speak, even though the property is listed on the MLS.

Good luck Bank of America with your efforts to control agents behaving badly. You can’t do that anymore than people can protect their self from the banks behaving badly.

Beware of Foreclosure Rescue and Loan Modification Scams

Homeowenrs should always be wary of promises for loan modification, mortgage relief, and foreclosure rescue as scammers continue to prey on consumers who are vulnerable and financially stressed . In most states, it is illegal for any person, including lawyer and real estate licensees, to demand, charge, or collect any advance, up-front, yet scammers continue to prey on homeowners!

Beware of Foreclosure Rescue and Loan Modification Scams

Con artists still work the 'foreclosure rescue' game Because some homeowners are unable to make their mortgage payments, they may grasp for any plan they think will help them avoid foreclosure. They might even come up with thousands of dollars to pay unscrupulous con men. Here's how the frauds work.

Scammers set themselves up with an official-sounding name, one similar to a legitimate organization, and claim to be approved to make loan modifications. After taking $4,000 of the homeowner's money, they disappear.

In another fraud, scammer companies send a salesperson to call on homeowners and say they can audit their mortgage documents and use the violations to force their lender to approve a loan modification. They tell people they have found violations 90 percent of the time. These types of scams typically ask for $1,000 to $5,000 from the homeowner.

One con man collected $2.8 million from various homeowners by promising them he could guarantee a loan modification under the Home Affordable Modification Program (HAMP). He told them to stop making their payments and to avoid contact with their lenders. Some of his victims would have been able to modify their mortgages if they hadn't stopped making the payments.

Three scammers were arrested on charges of fraud against California homeowners. In addition to requiring up-front fees in exchange for loan modification assistance, they told one homeowner to reject his lender's offer of a loan modification because they could get a better deal. Instead, the home was lost to foreclosure within four months.

The attorneys general settlement with the five largest mortgage lenders brought out a new group of people who call homeowners and tell them they represent the lender. They request $500 or more to facilitate the homeowners getting money from the settlement. The homeowner never gets anything.

The Reno Sparks Association of Realtors latest monthly "To The Point" market analyses is here. November marks the fifth straight month of low inventory in the Reno/Sparks areas. The drop in distressed properties continues to play a huge rule in our low inventory situation. The banks are putting fewer foreclosed homes on the market causing a shrinkage in available homes for sale.

Northern Nevadan home sellers continue to receive multiple offers on their homes, often times at higher than asking prices. Continuous low inventory here in Reno and Sparks has kept buyers scrambling to find a home to buy.

Bank of America Principal Reduction Program

So many home owners who have negative equity/are upside down in their homes are always looking and hoping banks are going to step up and help them with principle reductions. The latest buzz that many of us keep hearing about is from Bank of America. The have a new "Principle Reduction Program" that are suppose to reduce principles for home owners.

Below is a post written by Melissa Zavala Realtor® North San Diego County Homes that helps explain how this program works, who it should help and who it doesn't. At a recent event, I was asked about principal reductions at Bank of America. (By the way, I was also asked about whether the Mortgage Forgiveness Debt Relief Act of 2007 has been extended yet, and the answer is ‘no, not yet.’)

It’s possible that your clients may have heard about principal reduction on television, and are thinking that their $500,000 mortgage will be reduced to $250,000 in just a few weeks. Unfortunately, it does not work quite that way.

Starting earlier this year, Bank of America announced that they are offering principal reductions of up to $100,000. Sounds great, right? But, just like every advertisement or announcement, it is important to read the fine print. And, here are the details that you really need to know.

According to the Los Angeles Times, these principal reductions will be made on loans that were originated by Countrywide Financial and packaged into securities. Bank of America acquired Countrywide in 2008, along with their good and bad assets.

As stated by Reuters, qualified borrowers are expected to receive principal reductions averaging over $100,000. Those receiving the reductions are be over sixty days late on their payments and they may see their mortgage balance cut to their home’s current market value.

Click here to go to the Bank of America site and learn more about this program and how the principal reduction will be calculated. (Pay careful attention to the calculations; unless you took Advanced Calculus in graduate school, you may have to read and reread several times.)

If you take nothing else away from this article, please remember these points:

This is not for Fannie Mae or Freddie Mac loans. You and your loan (or your client and his or her loan) must be eligible based on very specific requirements.

Only loans owned by Bank of America or private investors are eligible, and those include mortgages originated by Countrywide Financial Corp.

In order to qualify, the client must be 60 days delinquent as of January 31, 2012.

If you meet a prospective short sale seller, and he or she is interested in exploring principal reduction at Bank of America, head on over to the website. In just a few clicks, your client will learn whether or not he or she qualifies this program. I’m betting ‘not’—but it is worth a shot. Good luck!

The Reno Sparks Association of Realtor's latest monthly "To The Point" market analyses is here. This month of October 2012 topics of discussion includes a progress report from Nevada's Attorney General, Catherine Cortez Masto regarding AB284.

What is AB284? AB stands for assembly bill. This new state law took effect on October 1, 2011. The new law requires that any notices of default include an affidavit that also includes information regarding the deed of trust, the amounts due, the possession of the note and deed of trust, and the authority to foreclose. Lenders who fail to comply are subject to civil penalties. Anyone making false representations concerning property title are also subject to a class C felony. In this video the attorney general explains how this bill is affecting the Northern Nevada real estate market!

Northern Nevadan home sellers continue to receive multiple offers on their homes, often times at higher than asking prices. Continues low inventory here in Reno and Sparks has kept buyers scrambling to find a home to buy.

Reno NV Market Report September 2012 To The Point Series

The Reno Sparks Association of Realtor's latest monthly "To The Point" market analyses is here. This month topics of discussion includes the extension of the Mortgage Forgiveness Relielf Tax Act that is set to expire at the end of 2012. A one year extension is now being considered but has yet to be approved and passsed.

Northern Nevadan home sellers continue to receive multiple offers on their homes, often times at higher than asking prices. Low inventory here in Reno and Sparks has kept buyers scrambling to find a home to buy.

"Why I love Reno" is a video put together by Tim Ruffin, a local Reno businessman who wanted to educate out-of-towners why Reno is so special. This 10-minute video is produced by Tim Ruffin with money right out of his own pocket and was launched on YouTube in December 2011. Hosted by newsman Joe Hart of KRNV News 4, the professionally produced video blends interviews with Reno residents with images ranging from the Truckee River as it flows through downtown to golf courses nestled against snow-covered mountains.

New Monthly Mortgage Insurance For USDA Loans October 1, 2012

Not a huge change in the USDA loan program but a change none the less. But only 1% change so it should not effect your monthly payment to much. The best part of the USDA loan is not changing ~ the USDA loan provides 100% financing to qualified buyers!!

New USDA Mortgage Insurance

As of October 1, 2012 the annual MI on all USDA loans is increasing from .3% to .4%. This should not be a huge concern as the rate is still relatively low especially compared to FHA which is at 1.25%.

On a 200k loan the usda monthly mortgage insurance will go from $50 per month to $66.67 per month a difference of $16.67. The up front MI will stay the same at 2% for new purchase.

USDA Refinance

On USDA Refinances (which are currently out of funds until at least October 2012) will also incur an annual MI increase from .3% to .4%. The up front will increase from 1.5% to 2% to match the structure of new purchase.

The way the annual rate is calculated is to take the original loan amount and multiply it by .004 (this will give you the annual) then divide it by 12 which will give you the monthly cost. 200,000 x .004 = 800 / 12 = 66.66

USDA Loans are still an extremely strong loan compared to FHA and Conventional and with no down payment requirement its a no brainer for most people who qualify.
