A timely post from Elizabeth Weintraub about buyer agents advising their clients that a short sale offer is just a formality and some of them are also being encouraged to write dozens of offers to see if one of them will stick. .
The ramification for the seller in a short sale is serious and the time will come when someone will be the example when they get sued and punished.
Sometime around mid-October, I received an offer on one of my Sacramento short sales. The buyer's agent swore that the buyers loved the home. On top of that, the agent promised in writing not to write any more offers for those buyers as everyone waited for short sale approval. We received approval from one lender and were working on gaining cooperation from the second lender when a cancellation of purchase agreement appeared in my email inbox.
The explanation was the buyers decided they could not afford the improvements they wanted to make. They had not gone back to the home since the day they wrote the offer. This epiphany seemed to have come to them right after they received the approval letter, when reality sunk in. The agent didn't have the guts to pick up the phone and call me. For all I know, that agent had been out showing these buyers other homes and writing other offers.
If that was the case, this agent could possibly be held liable for breaking the REALTOR Code of Ethics. Article 1 says agents must be honest with each other. On top of that, though, buyers who walk away from a short sale after signing a contract could be held liable for breaching the good faith covenant inherent in contracts. A lawyer could argue in court that those types of buyers probably had no intention of following through on the purchase should a better opportunity present itself along the way.
Moreover, what if the seller was already in foreclosure, facing a trustee's sale, and relying on this particular buyer to perform? Is it possible that the seller could hold the buyer personally liable if the seller lost the home to foreclosure as a result of the cancellation? I'm not a lawyer, and I can't give legal advice, but it seems to me that it's possible a seller in that situation might have legal recourse against such a buyer.
After all, by ratifying the contract, the buyers prevented the seller from selling to a serious buyer -- a buyer who may have been able to perform during the allotted time frame. Buyers who are writing multiple purchase offers on Sacramento short sales may want to rethink that kind of strategy. What do you think? Have you heard of Dave Ramsey? The money managing guru from radio talk shows and Fox (comedy)channel.
I had the privilege to be in attendance of his 2 day annual Realtor conference last week in Tennessee.
As part of the 2 days, we were the audience in a special live radio show. He'd say, "I'm here with 300 of the top real estate agents in the nation." and he had a show devoted to Real Estate. It was quite an eye opener to see in the flesh.
One thing that really took me aback was his open hostility to BOA. Twice did he mention negative things about them.
One just said they had a loan with BOA, and he said there you are you made a bad decision. and words leaving the listener in no doubt that he did not like BOA. I was very interested to find out why this almost hatred openly on air. It can't be just the poor short sale track record surely.
We heard from another potential buyer who had waited 5 months for a short sale in Michigan. When the listener admitted it was a BOA short, there was a loud sign of disapproval from the audience and another very derogatory statement from DR. Bluntly said give up and find another house.

All the talk about short sales this blog outlines how to get ready to sell.
If you've decided to go ahead and sell your house, it's important to have a sales strategy planned out before you even put your house on the market if it's short or not; your agent can tell you or just call me. 772-579-1981 It's also important to have a strategy that both you and your agent agree on, right down to the last detail. With all the details of your plan firmly in place, you'll have a strategy that will help your sale go more quickly and more smoothly when you start receiving offers from buyers.
What Should a Good Strategy Include?
Your sales strategy should incorporate two mini-plans, one for marketing your property, and the other for financial considerations and interacting with buyers.
Marketing your house effectively is a crucial part of the sales process. Marketing is designed to get as many people as possible through your front door, because the more interest you create in your property, the better your ability to negotiate a good sale price. This section of the plan should include things such as:
Advertising, photographs, and signage.
Whether or not you decide to hold open homes.
How you're going to "stage" your property to increase its appeal.
Ways to emphasize the strengths and downplay the weaknesses of your property and neighborhood
The second part of the plan should include the following considerations:
Your initial asking price. Do you want to consider a range pricing strategy?
If the market is slow, how long will you wait before making a price reduction, and how much will the reduction be?
Negotiation with potential buyers.
Range Pricing Strategies
Range pricing is a way of getting more buyers through your front door. Using a range pricing strategy means listing your house at a price range you find acceptable, rather than a firm price. For example, if your home is valued at $275,000, you might list your range as $250,000-$275,000. This way, you get more buyers coming through your home, and while they may offer bids that are lower than you want to accept, you have the option to negotiate a price that's more to your liking. Range pricing strategies are an excellent way of generating interest in your property in a slow market, but are less useful when the market is strong.
Negotiating with Buyers
During the offer and counter-offer process, what do you want to stand firm on, and where are you willing to compromise? Consider such things as:
The length of the closing period.
Who pays closing costs?
Who pays for repairs that might be needed. Will you pay for the repairs yourself or negotiate a reduced sale price to compensate the buyer for repair costs?
Beware of so-called "open-ended contingencies" when negotiating with potential buyers. An example is a buyer who makes an offer subject to them selling their own property before buying yours. If you end up negotiating with such a buyer, counter with a clause that states you have the right to accept a better offer if it should be offered to you.
Other Things to Consider
Will you hire a home inspector to do your own inspection before putting the house on the market? It's an extra expense, but it can give you a firmer negotiating position if you're aware of problems the house may have before it goes on the market.
Review your strategy regularly. If something isn't working for you, don't be afraid to change it if you and your agent can work out a better one.

A new program was recently introduced by Fannie Mae , essentially it does create a new option for people losing their homes. .

and the bank becomes a landlord to rent it back for market value.

Introduction
Fannie Mae is introducing the Deed-for-Lease Program (D4L), a program designed to minimize family displacement, deterioration of neighborhoods caused by vandalism and theft to vacant homes, and the effect these have on families, communities and home price stabilization. D4L allows qualifying borrowers of properties transferred through deed-in-lieu of foreclosure (DIL) to remain in their home and community by executing a lease of up to 12 months in conjunction with a DIL. Investment properties that are tenant-occupied may also be considered as long as the borrower is cooperative in providing information from the tenant to facilitate the D4L.
With the D4L program, servicers are expected to follow their regular process in considering a borrower for a DIL in accordance with Fannie Mae’s workout hierarchy. Once the servicer determines a borrower is eligible for a DIL through its normal course of business, the servicer will notify Fannie Mae that the borrower may also be eligible for D4L based on an initial screen of predetermined eligibility criteria. Fannie Mae, or its designee, will take the steps necessary to further verify property and borrower eligibility, determine the rental rate, and, if appropriate, execute the lease agreement. To qualify for D4L, the occupant of the property must have the ability to pay market rent not to exceed 31 percent of his or her monthly gross income. The lease agreement will be contingent on successful completion of the DIL.
Banks and loss mitigation departments throw around the phrase short sale package like everybody knows what that means. Not everyone is fluent in Spanish or French and not everyone speaks Real Estate either.
So, what is the short sale package?
The short sale package is a package of materials that needs to be submitted to a mortgage lender in order for the mortgage lender to consider the short sale of a property. For most lending institutions, the package usually consists of the following:
Hardship Letter
Financial Statement
2 months pay stubs
2 months bank statements
2 years tax returns
Listing agreement
Purchase agreement
HUD-1
Some banks want much of this information to be submitted on their own forms. Others are not particular. Additionally, some mortgage lenders do require other items that are not included in this list. It's a good idea to telephone the mortgage lender and verify what they require as part of the short sale package.
In any case, the next time someone speaks Real Estate and uses the words short sale package, now you'll understand what they mean.
