"I Want to Do a Short Sale" Says the Seller

Wendy Rulnick makes some great points in this post. The drawbacks vs. benefits should be explored and analyzed fully before making a decision to pursue a short sale. I would also add: what is the average market time in your area? If it is greater than 90 days and the seller is behind on payments, an inquiry needs to be made to see if the bank will postpone foreclosure proceedings with adequate documentation. I would also recommend giving the buyer a document explaining the short sale process and ask them to sign it. Unfortunately, their agent may not give them this information and you are less likely to have the buyer walk-away if they are fully informed of the process up-front.

I get calls daily from property owners in my Destin FL area who want to do a Short Sale. These are the bullet points from my qualifying conversation with them:

Your lender will want to know what your hardship is. What has changed from when you first took out your mortgage until today -where you can no longer keep up with the payments?   If it's not loss of income, unemployment, relocation, medical expenses, divorce, mortgage rate increase or similar, then you probably don't qualify for a Short Sale.

Is your monthly net income less than your total monthly expenses? Include mortgage payments, taxes, insurance, food, utilities, child care, alimony, credit card, auto loan, etc. We're not talking vacations, pet grooming, tennis lessons and child's birthday presents! (Yes, I've actually had some of my sellers think those are basic expenses.) Your mortgagee wants to know you are living in an austere manner to try to make your mortgage payments. If not- you probably won't be approved, as I discussed in Qualifying The Short Sale Seller.

Do you have a substantial balance in a non-retirement savings or checking account? If you do, be prepared to give some of it to your lender. For example, if you have $12,000 in savings, your bank might ask for $10,000 as a cash contribution at closing if they approve your Short Sale. Even if you don't have much, they still might ask. I want you to be prepared for that.

Is there a second mortgage, and if so, is it in collections? When your note goes into collections and is being handled by a third party, such as a law firm, be prepared for more stringent Short Sale terms, a greater cash contribution and/or promissory note.

You may be asked to sign a Promissory Note. Ideally, you won't, but if so, most Short Sale lenders will ask for some monies to be paid back at 0% interest over 5-7 years. It may be as little as $5,000. Be prepared.

Have you been making your mortgage payments? If so, know that some lenders won't approve your Short Sale. Why should they? They have 20,000 files before yours from mortgagors that cannot pay, and you are paying. That doesn't mean you won't be approved, for example, if you are taking funds from your retirement or charging basic expenses, or getting cash advances from your credit card to make payments. Be aware, however, that not making payments will affect your credit. It's a personal decision for you to make.

Have you received a Lis Pendens or Summary Judgment notice from your lender? If so, please contact an attorney for legal advice. If you already have a foreclosure sale date, we don't have much time.

As you can see, this qualifying conversation can branch out into many directions, but it is critical to get it right, and inform your seller at the start, before ever beginning the Short Sale process.

Why List with the #8?

How do you price your properties? Do you carefully look at pricing as a strategic way to place your property?

I recently sent a market analysis to a seller with a recommend price of $224,800 for his property. He then called me and asked "Why not list the property at $225,000"? Well, here are the reasons why:

1. Listing the property at $225,000 could be a HUGE $1 mistake! Why? Well, because of the property search page on the many sites on which we syndicate our listings. On some sites, if a buyer enters, "under $225,000" for their price range, properties priced at $224,999 will show up, but those priced at $225,000 will not.

2. Look at the "active" listings you are competing with in the MLS. They are ALL priced at $225,000 and $224,900. By pricing the property at $224,800, we are placing the property "under" all of the others and thus, make ourselves look like the better deal on paper.

3. The #8 is good Feng Shui - and in this market, we need all the help we can get!

Pricing a property shouldn't be just some arbitrary number, remember $1 can make a huge difference!

Short Sales - the Bank's Perspective

I've been reading some seemingly uninformed comments regarding short sales lately and thought I would share some insight. By no means do I consider myself to be an expert on short sales; nor do I have any desire to be. That being said, I reside in the same household with a person who is employed by one of the largest banks in the world and happens to work in this department. Please do not ask me which bank nor what their position is as I do not want to put their job in any type of jeopardy. There. My disclaimer is done.

First, let's talk about the definition of a short sale. The "shortage" is the amount the bank is being asked to waive, forgive, delay collecting......the definition varies depending on the circumstances and the state and local laws.

See that word I just used? LAWS. Yes, this entire process is governed by laws. Laws you and I do not know and understand because we are not attorneys. Am I saying that agents are stupid and attorneys are genuises? No! I am just saying that this is a legal process and sellers should really be consulting an attorney from the get-go to be advised regarding all of their legal options.

A seller or someone legally (there's that word again) authorized to act on their behalf, requests a short sale package from the bank. The bank cannot legally share any information regarding the short sale with anyone who is not legally authorized by the seller to discuss it. Having a signed sales contract is not sufficient in the bank's eyes to speak with someone. The Privacy Act governs this.

So, now the bank has a complete package (if you are lucky). Unfortunately, the banks are completely overwhelmed by short sales and the paperwork constantly coming in and yes, things get lost....a lot. Think of it this way....the bank is running a business that is losing money and they are laying people off and cutting back. Yet, in the department they are bleeding from, they need to increase staffing and production.

Ok, let's say the package is really complete and really gets to someone to review. Unlike what many people think, this isn't a quick "this makes sense" decision. What makes sense to us may not make any sense to the bank's bottom line. Why? Laws (again). Let's look at this scenario: a short sale request comes in for a house in State C. In State C, if the bank forecloses, the bank is not permitted by law to go after a deficiency judgement nor any other loans they may have with the borrower. So, before a bank can make a decision whether to approve a short sale or foreclose, they need to research and determine if the seller has any other debt obligations with them. Maybe there is a debt that was sent to a collection agency a couple of years ago. The bank will have to track down that debt and find out what the current balance is on it and get this....how much the bank will need to pay the 3rd party collector to buy the debt back in order for it to be "erased".

In some states, if the bank opts to foreclose, they have the ability to "unforeclose" should they choose to do so in a specified period of time. Why would they do that? Well, maybe the house has been a meth lab which requires so much money spent on remediation that it is not worth the bank carrying on their portfolio. What happens when a bank "unforecloses"? The house goes back to the last owner or the taxes just go unpaid to a point where the municipality takes the house.

In other states, the bank may be legally permitted to file a deficiency judgement, garnish wages, etc. Depending on the laws and whether or not the borrower has filed for bankruptcy, the bank may be able to go after retirement or investments. Maybe the borrower just filed for bankruptcy hoping to "protect" their assets, the bank may want to send their attorneys to attend the bankruptcy hearing and try to get it thrown out.

So, I suppose this is enough for part 1 of the bank's side. Please do not assume I am taking sides...because I am not. Just keep in mind the following:

1. An agent's E&O insurance may not cover the negotiation of short sales.

2. What makes sense to "us" might not make any sense whatsoever to the bank.

3. The bank is being asked to "eat" tens, even hundreds of thousands of dollars.

4. There are no guarantees on timeframe for approval. If you have to make a specific deadline, let the bank know; however, don't schedule life around it.

5. A short sale is not always the best option for the borrower. There are instances when a foreclosure may be a wiser financial decision (which is why professionals should always be consulted).

I hope this information was helpful in telling the "other" side of the story.

Bouncing the Active Rain Friendship Ball to Justin Williams and Tom Plant

Here comes the Active Rain Friendship Ball.

It got passed along to me by my friend Brian Block from up in Northern Virginia. After reading Brian's blog posts for a long time, we were finally able to meet in person at Inman Connect in San Francisco. Brian is a very cool dude - he is the winner of the Makeover to Takeover Competition here on AR and he is also a ballroom dancer....a lethal combination!

The object of this game is to tag two people and send them this FRIENDSHIP BALL. Then they get the honor of passing it along by copy and paste and writing something about the people they tag.

Wow - who to bounce it to??????

My FRIENDSHIP BALL is being bounced along to Justin Williams and Tom Plant.

I was introduced to Justin Williams by Naoma Doriguzzi, my good blogging friend from Wachovia Mortgage (who is no longer allowed to blog...read my blog for details). You may know Justin here on the 'Rain as "Just-in-Time Loans". After spending time at Homes.com, Justin just returned to the mortgage business in March and Naoma introduced him to ActiveRain. Justin is now the in-house loan officer in my office and the agents adore him! He's a knowledgeable loan officer who NEVER says "No". He is eager to share his wealth of blogging, SEO and internet capabilities. And..to top it off, he's young and cute and bought the office lunch yesterday! Need I say more?

After "meeting" on Active Rain, I had the honor of meeting Tom Plant in person at Inman Connect. Since I was am Inman "newbie", Tom took me under his wing and showed me the ropes, introduced me to people and in general, just hung out with me (actually, come to think of it, maybe he was just stalking me!). Tom is a successful agent from Murietta, California and has a very pretty house (he showed me a picture of it on Streetadvisor.com). Tom is also an Active Rain Ambassador - which I believe gives him the task of following pathetic new people around conferences (like me!).

So, there you have it.....my ball has been bounced from coast to coast!

Facebook - What's In It for the Agent?

When I'm teaching a class on social networking to real estate agents, I am often asked "what's the point"? Well, with Zolve, Linkedin and ActiveRain, the answer is pretty obvious. But, what about Facebook? Can using Facebook really benefit the agent?

The answer is YES!

Here is how......

1. Feed your blog posts to Facebook - keep your friends and clients updated on what you are doing and thinking about.

2. Become a "friend" to everyone you went to high school and college with - they are the ones who know you, yet probably don't know that you now sell real estate.

3. Become a "friend" to your former clients. This is a great way to keep up with what is going on in their lives.

4. You can add a listing feed to your Facebook wall as well as a separate page for just real estate.

5. Each day you get a list of your friend's birthdays - what a great excuse to make contact!

Can Roots, Trees and Branches Help Your Business?

I started working on our family tree when I was pregnant with my son (about 6 years ago). Since my husband was adopted at birth and since I didn't know much of my ancestry past my grandparents, I had a lot of work to do. According to my Nana, (my mother's mother), the world started with her and I didn't need to know more beyond that! (Yes, she really told me that!).

If you have ever been on Ancestry.com or Geneaology.com, you may find, like I did, that it can get addictive. Once you start on the branch of a tree, it can be hard to stop as there never really is an end. We've found ourselves sifting through papers at Grandmother Merritt's house, hiking through cemeteries in the Blue Ridge, visiting the Lexington Historical Society....I could go on and on.....

Through Ancestry.com, I have made lots of contacts with mostly (very) distant relatives. I am big on accurate documentation, so often, my tree is accessed by others looking for information. Last week, someone contacted me to see if I needed help with a particular branch and to let me know her daughter in law is a real estate agent too. Wow! I now have a referral source in Rockbridge County, Virginia!

There are some pleasant surprises...like the flower shop my Great Grandfather Meskers started in the Bronx is still there (he immigrated here from Holland). Then, there are some not so pleasant ones...like the distant cousin who, when his wife died, married her sister!

Do I think my tree will ever become a major source for business? Absolutely not and that is not why I work on it. But, I've made some great contacts that I never expected who just happen to be potential referral sources. I've also, hopefully, created a history that my son someday will appreciate. Sure beats making cold calls or knocking on doors!

How Do You Fix a Broken System?

Richard Foster caught my attention with a recent blog post. In his post, he vented his frustration of working in a field where practically anyone who breathes can get a license to practice. He went on to use examples of other occupations which have more stringent requirements for licensure such as hair dresser and nail technician.

But, will this really fix the broken system?

Won't Brokers continue to recruit and recruit and recruit without regard to ethics, education and professionalism? (I'm talking about Realtors here, not licensees who aren't members of NAR and aren't promising to be ethical in the first place).

Does the fault lie with current commission based structure?

Think about it.....with the current structure, agents do not get paid one dime unless they close a sale. Isn't that, in and of itself, inherently asking for unethical behavior?

Can an agent who is say, facing personal financial difficulties, really be expected to look out for the best interests of their client over their own family? Is it really fair to put someone in that position to begin with? (Yes, I know the Code of Ethics and what it says....I am talking about DESPERATE times calling for desperate decisions where the Code may be "forgotten").

In order for an agent to survive financially, they must be successful enough and disciplined enough to ride out the low periods for extended periods of time. I have met top agents who have gone months without a paycheck while still shelling out tons of money for marketing, gas, supplies, dues, etc. That's the life of an agent, right?

Some Brokers have tried the salary + commission structure. Well, doesn't that put even more pressure on the agent to "perform" (i.e. make sales) or risk losing their salary or being fired? Are Brokers really willing to pay an agent a salary for a few months without a closed sale?

For a buyer or seller to truly get unbiased representation from their agent, how should the agent's pay structure be defined?

A salary plus a commission based off of the client's satisfaction with their agent? What if the sale didn't close and it was because the agent was looking out for the client's best interests and the client is happy it didn't close? Who pays the agent for sticking to their guns and looking out for their client?

A pay-as-you go/fee for service system where the agent charges the client an hourly fee for services rendered and expenses?

A "team" based commission model where a client hires a team and each team member is paid a salary from a pool of the total commissions earned by the team.

Of course, Brokers and the industry in general need to redefine "success" in real estate as creating happy clients instead of dollar signs. Seriously, is the "Number 1" agent ever really the "best" agent????
