California Civil Code Section 2948.5 restricts lenders from charging more than one day interest from the date the loan is funding until the date the funds are disbursed for the benefit of the borrower. In most cases, the settlement agent makes all the disbursements. As a result many lenders require the settlement agent to disburse timely, or the closing agent will be required to refund the additional days of interest charged to the borrower. Short pay lenders are serious about the principals upholding the terms and conditions placed on them by the short sale agreement. One of the most common conditions reads, "The property will not be sold within 90 days of the closing date of the subject real estate purchase contract." Short pay lenders enforce this condition by checking the chain of title post–closing to verify the property owner matches the buyer shown on the settlement statement provided them at closing. Chicago Title's Albany, Calif. office opened a For Sale by Owner transaction with a sale price of $495,000. The escrow assistant, Debbie Neylan, ordered a title report. The title report reflected two deeds of trust on title, each with a reconveyance recorded with a side note that read, "Said deed of trust appears to be reconveyed by the above recorded instrument. An inquiry must be made with the lender confirming payment prior to close." Debbie requested loan numbers from the seller, an unmarried woman. An Escrow Officer from the Chicago Title Company's Alameda County, Calif. operation was working with an agent named Lynn Lee at Jay Dee Real Estate in San Jose, Calif. on a short sale transaction. On Friday, November 9, 2012 an email was sent from the selling agent to the escrow officer, directing her to wire transfer her portion of the broker's commission in the amount of $5,702.50 to ABC Bank in West Point, Neb. to the account of Beth Black. Below is an article about a man who stole foreclosed properties from large lending institutions in Southern California. Mr. Boucher identified REO properties in Los Angeles, Riverside and San Bernardino Counties and executed grant deeds as the lender's "authorized representative." In many instances, the individuals he deeded the properties to were the very persons upon whom the lender had previously foreclosed.

It is amazing how a divorce can affect a closing. Many people believe their domestic problems become the settlement agent's problem and often look to the settlement agent to be the tie–breaker for them. It is important for a settlement agent to take a step back, stay out of the drama and never lose sight of the proper escrow procedures and underwriting requirements. As I read the book the Answer by John Asharaf there are some great reminders of the things that we need to and should be doing on a daily basis! Here are a few nuggets about goal setting: Give Your goals some meaning. Purpose- A monetary goal is great, nbut unless you attach it to something that stirs your soul, it is just a number! BE SPECIFIC- Financial, Personal, Faith, Family & Physical Monetary Goal- Give Benchmarks- Net worth, Annual Income & the Gift of Giving... As we round out 2012 And we start running or business for 2013, are we thinking big and dreaming even bigger. It is that time of the year again where monies are collected in escrow for the 1st installment of property taxes! As a reminder as to how they are collected, i have attached a copy f our cheat sheat flier! It is important for agents/lenders to know these schedule, because it can affect the dollar amounts on the good faith estimates, and can potetially throw the numbers of with dollars to close. (especially if its a refi and the borrower currently has impounds)

I lost my dad just over six months ago, and it was quite unexpected for us all. The last six months have been a roller coaster of emotions, and sometimes absolutely overwhelming. This past weekend, my family and I honored a tradition he had started by heading back to Notre Dame, to spend time as a family, remember our time with him and enjoy each other.
