FHA Short Sale Secret

One key item many short sale listing agents don't know is that when you are handling an FHA Short Sale, it's absolutely critical to secure the Approval to Participate before listing the property in the MLS.

Why?

Because part of the process for the servicer to issue the Approval to Participate is to obtain an FHA appraisal.

FHA appraisers are instructed NOT to use distressed properties, unless they are the only valid comps.

The servicer is required by HUD to share the full appraisal with the listing agent.

An FHA Buyer is REQUIRED to use the same appraisal.

This means that if you list the FHA Short Sale at the FHA appraised value, an FHA buyer will be able to purchase the property at that price, secure in the knowledge that it has already appraised for the purchase price.

In a market with distressed properties, and at least for now, low inventory, this can mean a higher sales price than going the traditional short sale route, and allow a FHA Buyer to beat out the cash investors.

There's a nasty rumor going around that even if you purchase a different property, there may be an effort to attach the junior liens to the new property!?!?

Great advice - whether in New Hampshire or in Arizona. Bottom Line - Seller Beware - Choose Wisely - You Get One Bite at the Apple...

The one thing most people agree on is that Short Sales will continue to be a large part of our market for at least the next year. I work on a lot of Short Sales both as a Listing Agent and a Buyer Broker here in the Manchester NH area. The short sale process is not regulated, therefore the way agents handle it varies widely. There are some outlandish trends happening that are making the process frustrating that just do NOT have to be. There is no easy way to say it and this is no time to be polically correct when the result of a poorly handled short sale can lead to foreclosure.

What is KILLING All the SHORT SALES!!!

1. INEXPERIENCED AGENTS Listing them

2. PRICING THE HOME BELOW MARKET VALUE

3. OUT OF TOWN AGENTS taking listings

4. DISCOUNT BROKERS not providing full service

5. INEXPERIENCED NEGOTIATORS

6. SUBMIITING MULTIPLE OFFERS FOR APPROVAL

7. INCOMPLETE SHORT SALE PACKAGES

8. NO COMMUNICATION OR FOLLOW-UP BY AGENTS

9. UNREALISTIC TIME FRAMES

10. BUYERS WHO ARE NOT EDUCATED WHAT A SHORT SALE IS AND HOW THE PROCESS WORKS.

THE TOP THINGS YOU CAN DO ABOUT IT:

1. CHOOSING A LISTING AGENT: When choosing a listing agnet to conduct a short sales the seller should note that all agents are not created equal. They should also know they have a choice.

a. EXPERIENCE: Choose an agent who is experienced in Listing, Negotiating and Selling Short Sales. This is not the time for "on the job training". Do not settle.

b. CHOOSE ONLY LOCAL AGENTS: Too many home owners see flashy TV commercials and think that is their only choice. It is NOT. Interview and choose a local agent who will be there through each step of the short sale selling process.

c. FULL TIME AGENTS: Whether Buying or Selling you want and need a FULL TIME agent whose sole job is to assist buyers and sellers with Real Estate.

d. FULL SERVICE: Using a discount Broker could lead to discount services. In a short sale you need every advantage you can. This is not the time tio skimp. For sellers commission is deducted from the proceeds teh bank is willing to accept. Choosing a full service broker does not cost more but could mean the difference between an approval or losing the home.

2. PRICING THE HOME: When listing short sales the practice of listing the home "way under market value" to attract more offers is leading to an increase in short sale rejections. This practice should be avoided as it is not helping out sellers who are losing their homes to foreclosure becuase of it.

3. Some of the trends and practices you should avoid are:

a. Paying up front to List your house as a short sale

b. Paying up front for a negotiator

c. Paying for an appraisal to submit an offer.

d. The bank is not the seller in a short sale - the home owner is the seller.

CONCLUSION FOR BUYERS: If you are considering buying a Short Sale, whether you are in the Manchester NH area, Southern New Hampshire or located aywhere else thoughout this great country of ours, the short sale process is the same. As a buyer there are some things you need to do in order to have an advantage and opportunity to have your short sale approved. The short sale process can be long, it can be frustrating but it does NOT have to be.

CONCLUSION FOR SELLERS: If you owe more than your house is worth, if you are behind in your payments or if you have to move. A Short Sale could be for you. The most important tips is to list with an agent who is well experienced in listing, negotiating and selling Short Sales. If you live in NH, call me first. I use a professional negotiator that works on the sellers behalf when negiotiating with the bank at no cost to you. Most often the home owner can complete a short sale at no cost to them.

It does not take magic to turn your "For Sale" sign into a "Sold" sign. it takes a full time Local Agent who specializes in Listing homes like yours.

In a declining market such as the Phoenix area, list price should be at or below both the most recent SOLD comp and all UNSOLD comps - Active/Expired. Then - adjust from there. Fortunately with a Short Sale, price reductions don't (usually) affect the Seller's bottom line.

How do REALTORS® and people selling privately determine the price of a property? The key element is to research the market and find comparable properties. Making comparisons is a blend of good research and market knowledge. Some basic guidelines to finding comparable homes (both sold and currently for sale) are:

The closer in physical proximity to your home, the more comparable. Houses in Vancouver are unlikely to make good comparisons to similar homes in Ottawa. Some out of town Buyers are amazed at the market differences. There really aren't comparisons that can be legitimately made across the country or across the city. Remember the adage: Location, location, location.

The closer in date to today for a sale or another listing, the more realistic the market indicator.

The ability to be honest with yourself about what makes a comparison.

The knowledge of sold prices. While you may know what your neighbour asked for his/her home, you may not know what the final sold price paid was and if there were any concessions such as decorating bonus, closing costs, redone roof prior to possession, etc.. The sold price, more than the asking price, is the real indicator of realistic expectations.

The ability to adjust prices between similar properties that have differences. For example, adjusting the price for the difference of a two car garage in one home and only a parking pad on the other, the former will have more value. (If the garage is functional ) If one has an updated kitchen and the other is all original from 1970, then the former will have more value. While location is key and timeliness is vital, features cannot be ignored.

Be honest with yourself about your ability to get good comparisons. You may find the "Free Market Evaluation" that most REALTORS® provide is a start. Talk to people in the business. If you think a salesperson is going too low, you might want to get the opinion of two or more REALTORS®. Be wary of an estimate that seems too high - even though you would celebrate selling your home for that price. You might not have the time to have your house on the market for 6 months or longer waiting for some naive person to pay the price. No sign of things doing much different in the Phoenix area either. It will be years before things get back to "normal". Short Sales are a growth industry unfortunately.

THREE REASONS WHY AMERICANS CAN EXPECT A DOUBLE DIP IN THE HOUSING MARKET IN 2011 -Looking at the Market in Central Florida will give insight as to what other areas can expect.

Osceola County was one of the fastest growing counties in Central Florida in 2005. By 2007 the boom turned to bust, and builders by the boatload were stuck with excessive inventory in a rapidly declining market.

"Until the balance of supply and demand can be equalized prices can't stabilize" said Sean Snaith, economist with UCF at a recent economic forum held in St. Cloud Florida addressing the local Chamber of Commerce.

Three Reasons Why Americans Can Expect a Double Dip in the Housing Market in 2011 are:

1) Hidden foreclosure Inventory- Lenders are currently holding a five year inventory of foreclosed properties. They have learned that releasing large quantities will further drive prices in housing down- the freeze allowed a blimp to appear on the radar-this was a temporary. The inventory is still there and will eventually come to market.

2) Unemployment- Unemployment and Under-employment postpones home ownership and contributes to the distressed property inventories.

3) The Lack of Pent Up Buyer demand- Buyers are being cautious. The New York Times recently published this article

Lending requirements.- Tighter restrictions* have sidelined many potential home buyers. Lenders were not only controlling the origination of new mortgages they were restricting sales with contingencies on Short Sales and disallowing investors with cash. Resulting in lower sales at lower prices.

*Lenders are grappling with new models to lower FHA score requirements as perspective home owners who wanted to buy were turned down for loans. Recently Wells Fargo announced that they will consider loan applications for applicants with credit scores below 600. They would require 5-10% down payment money, no late payments for 12 months, and a 2 year job history of steady employment.

Federal Programs have filled the gap for some buyers with the utilization of the Neighborhood Stabilization Program and Rural Housing Loans. These have effectively opened the door to home ownership for many buyers who qualified for these Federally funded programs. They typically are buying lower end homes as well, watching carefully their expenses in an economic climate of uncertainty. There is also the Section 502 Guaranteed Single family Loan Program available for homes in Osceola County, Florida.
