      <title>How to Choose a Pennsauken, NJ Realtor?</title>
      <description>&lt;p&gt;I received a question last week on a consumer real estate information website, and it hit home that some people are still at a loss as to where to turn to find a good Pennsauken, NJ Realtor.&amp;nbsp; Sometimes, they are not actually asking the right question.&lt;/p&gt;
&lt;p&gt;For example, recently a home seller wanted to know who has sold the most homes in Pennsauken.&amp;nbsp; They were looking to have a good sales experience.&lt;/p&gt;
&lt;p&gt;Here's my answer to that query, for which I received a "thumbs up" best answer of all the answers given by Realtors who responded.&amp;nbsp; Maybe it will help you in deciding how to choose a Pennsauken Realtor, or a Realtor to sell your home in your town!&lt;/p&gt;
&lt;p&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;strong&gt;&lt;em&gt;Hi Annie, &lt;br&gt;I certainly understand your trepidation with regard to choosing the right agent. I would suggest however, that the "who has sold the most" approach may not be the best approach. Numbers can be skewed and massaged many different ways to look like something that they're not. Interview at least three agents. Make sure that they present a marketing plan that fits your needs and incorporates all the strategies that are important to you. Determine during the interview if they have a communication style that matches yours, and make sure they have a plan for keeping you informed during the process. Annie, I started my career at the RE/MAX office in Pennsauken and thus have sold countless homes in Pennsauken, and if you search Pennsauken Real Estate agents on google, you'll find me...but I may not be a good fit for YOU. So anyone that tells you they're the right agent just because they've sold a lot of homes or because their agency has sold a lot of homes,&amp;nbsp;I think, is missing the point. &lt;h1&gt;"Concerning the ethical rules of a listing agent... is it legitimate for them to tell a prospective buyer that the seller declined a prior offer?," the homebuyer asked.&amp;nbsp; She went on to say, "Specifically, would it be proper for them to tell that prospective buyer that the seller was offered X but declined so that if they want the property they need to offer higher? This, before anything is even in writing?&amp;nbsp;&lt;br&gt;&lt;br&gt;Here's my answer for which I received a "Best Answer" thumbs up!&amp;nbsp; Hope you find the information helpful!&lt;/h1&gt;

&lt;p&gt;Hi Annie, &lt;br&gt;&lt;br&gt;I'm going to speak about NJ because you are in NJ. In NJ it is NOT ethical for the listing agent to reveal anything to the buyer or buyer's agent without the express permission of the seller. This is an ethics violation. Please read the Consumer Information Statement that your listing agent should have provided you. &lt;br&gt;So if the seller says to the listing agent. "I know my house is listed at 200k, but I'll take 190k and not a penny less" it is not ethical for the listing agent to divulge that without first asking the seller. If you're a seller, you have very valid reasons for guarding your motivations to sell. Why? The buyer's agent, if they're good, will try to ascertain the reason for selling, share that with the buyer and this may result in a lower offer to the seller. This is one reason I counsel my sellers to leave the home, if possible, during showings -- I caution them that if they must stay, they should not get into any casual conversation with the buyer's agent wherein they might divulge something that will weaken their negotiating position. &lt;br&gt;&lt;br&gt;Even if my seller tells me, "You can tell them I won't take any offer lower than "x"; I will still counsel my seller that "You may not want me to say that. Why? Because then all they'll offer is "x" when maybe you could've gotten "x+5,000". Take it from me, someone who used to work in the cutthroat world of Manhatten's major-label music industry, It's best not to say anything and just let the negotiations play out and see where they lead. Remember, in negotiations, he who blinks first, or breaks the silence, usually loses -- so why would you want to start off giving the other party ANY information??? &lt;br&gt;&lt;br&gt;I hope that this answers your question!&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;THE MATTER OF "DISTRACTED RESTRICTIONS" WHEN DRIVING.&lt;/strong&gt;&amp;nbsp; This subject came to my attention several years ago.&amp;nbsp; Granted, it was prior to the introduction of texting.&amp;nbsp; However, I believe that the risk to real estate brokers when an agent is texting is the same as an agent using a cell phone &lt;strong&gt;while on real estate business.&lt;/strong&gt;&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="text-decoration: underline;"&gt;Cooley Godward&lt;/span&gt;&lt;/em&gt;, a Virginia-based law firm, was slapped with a $30 million wrongful death suit where an employee of theirs was conducting business on her cell phone when she struck and killed a fifteen-year-old boy with her car.&lt;/strong&gt;&lt;/li&gt;
&lt;/ul&gt;
&lt;p&gt;&lt;strong&gt;A good article about this matter can be found at &lt;strong&gt;&lt;a title="Cell phone use on the job" target="_blank"&gt;Employers Guide to Cell Phone.&lt;/a&gt;&lt;/strong&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;When&amp;nbsp;I read about the&amp;nbsp;&lt;em&gt;&lt;span style="text-decoration: underline;"&gt;Gooley Goodward&lt;/span&gt;&lt;/em&gt; case in Virginia, I contacted my attorney and, after consultation, we decided&amp;nbsp;that, in order to limit broker liability, which would be similar to the law firm liability in the Cooley case,&amp;nbsp;Homefinders.com would&amp;nbsp;implement a BROKER POLICY&amp;nbsp;to the effect that Independent Contractors who were agents of the brokerage would&amp;nbsp;acknowledge receipt of a NOTICE that it was broker policy that agents would not use cell phones while driving.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Agents signed the acknowledgment letter and it was kept in their employee file.&lt;/strong&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;I could not control agents' use of their cell phone while driving.&amp;nbsp; However, implementation of the broker policy served several purposes.&amp;nbsp;&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;&lt;strong&gt;It made agents more aware of the dangers of talking on the cell phone while driving.&lt;/strong&gt;&lt;/li&gt;
&lt;li&gt;&lt;strong&gt;It gave some protection to my real estate brokerage and myself as the broker.&lt;/strong&gt;&lt;/li&gt;
&lt;/ul&gt;
&lt;p&gt;&lt;strong&gt;WE ARE ALL AN "ACCIDENT ABOUT TO HAPPEN".&lt;/strong&gt;&amp;nbsp; To this day, I do not talk on my cell while driving.&amp;nbsp; Calls go to my 800# and I check messages regularly.&amp;nbsp; If I make an outgoing call on my cell while in my vehicle, I first pull over to a safe place.&amp;nbsp; That said, I understand well the pressure for agents&amp;nbsp;to &lt;strong&gt;be connected&lt;/strong&gt; while on the road.&amp;nbsp; Agents on my network are usually anxious to answer a call from me because they know it's important.&amp;nbsp; I'm usually calling with a buyer referral.&amp;nbsp; However, I still would not encourage them to answer a call while driving.&amp;nbsp; With a "&lt;strong&gt;HANDS FREE"&lt;/strong&gt; device, voice activated agents may have a margin of safety.&amp;nbsp; However, law enforcement folks claim that simple talking is distracting.&amp;nbsp; I&amp;nbsp;don't have an answer for that, or anything else for that matter.&amp;nbsp; I&amp;nbsp;would just like to raise the awareness of&amp;nbsp;the subject for my&amp;nbsp;ActiveRain friends.&amp;nbsp; When an agent doesn't answer, I&lt;strong&gt; assume&lt;/strong&gt; that they are driving and wait a reasonable time before calling another agent to make the referral.&amp;nbsp;&lt;/p&gt;

      <description>&lt;p&gt;I watch for questions on a consumer-focused website and answer those that I find compelling.&amp;nbsp; This question asked today breaks my heart, and unfortunately many folks are finding themselves in the same dire straits as the Mullica Hill home buyers who asked it.&lt;/p&gt;
&lt;p&gt;Here's the transcript of their question and my answer. If you have additional feedback, or have experience with this scenario, I'd love to get your input as well.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;&lt;em&gt;"We are having a new home built and recently found out that the builder has filed for bankruptcy. We did make a deposit but they have not started&amp;nbsp;building yet. I am very skeptical and want to cancel the contract and get my deposit back. My husband is more optimistic and is williling to work with the situation. Any advice?"&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;
&lt;p&gt;Dear Ca, &lt;br&gt;I have not had an opportunity to read all of the other responses but here's my two cents: &lt;br&gt;&lt;br&gt;RUN!!! If you can get the deposit back, get it and immediately cancel the contract. But I doubt they'll return it. &lt;br&gt;&lt;br&gt;Frankly, if they've already filed for bankruptcy they are not allowed and not required to give you the deposit back as they have to account for all funds and cannot disperse to some creditors but not others; they're not required because bankruptcy gives them protection from their creditors - YOU - until a court-appointed trustee works out a plan. You'd have to file a proof of claim and get in line. &lt;br&gt;&lt;br&gt;My guess is that they sense your husband's willingness to continue and may be preying on that -sorry I'm a realist and a bit jaded from what I've seen people go through recently with banks and builders in the last couple of years. &lt;br&gt;&lt;br&gt;My suggestions: &lt;br&gt;1. File a complaint with the NJ State Attorney General's office to get the help of consumer protection agents. Chadd Lackey, Esq. is a friend, and an attorney there. You can tell him Kim Thomas told you to call and he will help you or point you in the right direction; &lt;br&gt;&lt;br&gt;2.. Get your own attorney, like YESTERDAY! &lt;br&gt;&lt;br&gt;3. Start a paper trail. It is very important that you send a demand letter, in writing and by certified mail, to the builder with any demand you may have -- to get your contract canceled, to get your deposit back, etc. &lt;br&gt;&lt;br&gt;4.       <title>The Laws are Changing for South Jersey Real Estate </title>
      <description>&lt;p&gt;Not just South Jersey real estate, either. Since the end of 2007, as the real estate market started to decline, new rules, regulations, mandates and more have come down the pipeline.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;strong&gt;State Specific Laws&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;Take Michigan, for instance. Ranking sixth in the nation on the number of foreclosures, Michigan legislature enacted the "&lt;strong&gt;&lt;span style="text-decoration: underline;"&gt;&lt;a href="http://www.wzzm13.com/news/local/story.aspx?storyid=111013&amp;amp;catid=48"&gt;Lifeline Law.&lt;/a&gt;&lt;/span&gt;&lt;/strong&gt;"&amp;nbsp; This law gives an extra 90 days for homeowners to work with banks to come up with solutions other than foreclosure.&amp;nbsp; California did the same, with the &lt;strong&gt;&lt;span style="text-decoration: underline;"&gt;&lt;a href="http://www.corp.ca.gov/FSD/CFP/default.asp"&gt;California Foreclosure Prevention Act. &lt;/a&gt;&lt;/span&gt;&lt;/strong&gt;&amp;nbsp;In New York, judicial hearings are mandatory for both borrowers and lenders before foreclosure can go through.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;strong&gt;Nationwide Laws&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;Other laws have been enacted throughout the United States, such as Congress lowering homeowners' tax deductions.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;Before 2009, if you used your South Jersey real estate as a primary residence for at least two years out of the last five, you could keep up to $500,000 (married couples - $250,000 if single) in real estate gains on your tax return. That exemption is now pro-rated to the time you spent in the house, which could be quite substantially less than what your tax exemption would have been last year.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;As well, new appraisal rules went into effect May 1,&lt;sup&gt; &lt;/sup&gt;and, although they aren't government rules, they do affect Fannie Mae and Freddie Mac loans. With the Home Valuation Code of Conduct (&lt;strong&gt;&lt;span style="text-decoration: underline;"&gt;&lt;a href="https://www.efanniemae.com/sf/guides/ssg/relatedsellinginfo/appcode/pdf/hvccfaqs.pdf"&gt;HVCC&lt;/a&gt;&lt;/span&gt;&lt;/strong&gt;) put into place, every lender that goes through Freddie or Fannie has to follow the HVCC to the letter. The HVCC stops mortgage brokers from having home appraisals done themselves. Instead, the home appraisals must be done by a third party appraisal management company in the same area as the home.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Laws that Affect You&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;Other laws have been put into place that may (or may not) affect the South Jersey real estate you own or are looking to buy. However, with so many coming down the line, make sure that you ask your real estate agent what laws have been put into place that may affect your purchase, sales or ownership.&lt;/p&gt;

      <description>&lt;p&gt;If you're looking at South Jersey Homes for sale, you want to buy a home and are waiting around for better prices, you might want to rethink your strategy.&lt;/p&gt;
&lt;p&gt;If you're a market watcher, soaking up the information overload across news media and Internet websites, you're probably overwhelmed with confusion by now. Is the housing market getting better? Is it getting worse? Was there really, when it gets down to it, a housing bubble collapse? And, if so, who popped it?&lt;/p&gt;
&lt;p&gt;&amp;nbsp;First, the quick answers. Yes, there was a bubble and it collapsed, and everybody had a hand in popping it: the government, the lenders, the investors and the general public. Now the hard answers: it's getting better - and worse.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;The truth is that market predictors are all on the fence. With the &lt;strong&gt;&lt;span style="text-decoration: underline;"&gt;&lt;a href="http://www.recovery.gov/Pages/home.aspx"&gt;ARRA&lt;/a&gt;&lt;/span&gt;&lt;/strong&gt; (American Recovery and Reinvestment Act) giving first time homeowners some incentive to buy South Jersey homes for sale and elsewhere, there has been a steady increase of sales. However, once the tax credit deadline hits at the end of this month, the numbers are once again expected to drop.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;Again, though, it's better and worse. While the housing market is still dropping in some areas, such as the southeast in Mississippi, Alabama and so forth, there are definitely some &lt;strong&gt;&lt;span style="text-decoration: underline;"&gt;&lt;a href="http://images.businessweek.com/ss/09/08/0811_strongest_housing_markets/1.htm"&gt;strong markets&lt;/a&gt;&lt;/span&gt;&lt;/strong&gt; in the country.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;For instance, Boulder, Colorado holds 60% of the share of increasing home values. The average value is about $350,000, but there's a limit in place on the amount of homes allowed in the area. In Binghamton, New York, the average value of a home is around $112,000. They also have a housing limit, which means a small supply, so prices probably aren't going to plummet.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;strong&gt;Just because this is a buyer's market, doesn't mean you'll get the exact price you're looking for&lt;/strong&gt;. If you want to buy a home and you're waiting around for the prices of homes to plummet into a "sweet deal," make sure you don't wait yourself into an expensive mistake.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;Instead of checking market forecasts, potential homebuyers need to look at things the way we always should have. Do I want to buy a house? &lt;strong&gt;&lt;span style="text-decoration: underline;"&gt;&lt;a href="http://www.hsh.com/calc-howmuch.html"&gt;Can I afford one of the South Jersey homes for sale&lt;/a&gt; &lt;/span&gt;&lt;/strong&gt;&amp;nbsp;the way things are now?       <description>&lt;p&gt;Halloween is over, but if you're looking at the homes for sale in South Jersey, it's probably the first-time buyer fears that have your knees shaking. Hey, buying a house seems like such a final thing, so that's understandable. It could be the biggest change in your life - EVER!&lt;/p&gt;
&lt;p&gt;&amp;nbsp;Now that I've thrown some scary thoughts your way, let's take a turn at facing those first-time buyer fears.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;ul type="disc"&gt;
&lt;li&gt;
&lt;strong&gt;Am I crazy?&lt;/strong&gt; No, you're a first-time buyer. You may alternate between periods of paranoia, confidence, nervousness and calm, but you aren't crazy to want to buy one of the homes for sale in South Jersey&lt;/li&gt;
&lt;/ul&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;ul type="disc"&gt;
&lt;li&gt;
&lt;strong&gt;Is this really the right time to buy a house&lt;/strong&gt;? The best way to answer this question is with a few questions. Do you have good credit? Do you have a decent job? If the answers to these questions are "yes," then there's never a bad time to buy the right house. Especially now, with tons of inventory, &lt;strong&gt;&lt;span style="text-decoration: underline;"&gt;&lt;a href="http://www.cnbc.com/id/32350362"&gt;record low interest rates&lt;/a&gt;&lt;/span&gt;&lt;/strong&gt; and the $8000 tax credit.&lt;/li&gt;
&lt;/ul&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;ul type="disc"&gt;
&lt;li&gt;
&lt;strong&gt;What if I don't pick the right neighborhood?&lt;/strong&gt; What if I buy, move in, hate it, and then can't turn around and sell the house? An understandable fear; one of the most common horror stories is moving into the perfect house, right next to the neighbor from the Black Lagoon. This is why it's imperative to do your research (or, at the very least, tell your real estate agent exactly what kind of neighborhood you want). With the Internet, you can find out everything from the &lt;strong&gt;&lt;a href="http://www.bestplaces.net/Default.aspx"&gt;Crime Rate of an area&lt;/a&gt;&lt;/strong&gt; to the quality of the schools.&lt;/li&gt;
&lt;/ul&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;ul type="disc"&gt;
&lt;li&gt;
&lt;strong&gt;What if I lose my job&lt;/strong&gt;? I won't say that's not a possibility. However, keep in mind that you have the same question when you're renting. The difference is that if you can't pay the rent, you can be evicted within days, depending on where you currently live. While some lenders may do the same, most &lt;strong&gt;&lt;span style="text-decoration: underline;"&gt;&lt;a href="http://howto-you.com/http:/howto-you.com/family/episode-36-why-lenders-dont-want-to-foreclose"&gt;lenders don't want to foreclose&lt;/a&gt;&lt;/span&gt;&lt;/strong&gt; and are willing to work with you to keep you in the home and making your payments. In addition, many are willing to wait for at least two months of nonpayment before starting the foreclosure process. &lt;/li&gt;
&lt;/ul&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;If you've been a renter all your life and are looking at the homes for sale in South Jersey, take a deep breath. Yes, it's scary and yes, the worries can give you worse nightmares than the freakiest horror movie you've ever experienced. However, remember what made you decide to start looking in the first place. If those reasons still exist, go for it!&lt;/p&gt;

It's a beautiful place to live, and I'm glad to be a part of it. As Thanksgiving time is upon us, and the leaves change color and fall, I get to see a whole other side of this place - which has given me the inspiration for another blog:&lt;/p&gt;

&lt;p&gt;Most, and probably all, Pennsauken real estate agents will tell you that &lt;strong&gt;&lt;span style="text-decoration: underline;"&gt;&lt;a href="http://www.bhg.com/home-improvement/exteriors/curb-appeal/ways-to-add-curb-appeal/"&gt;good curb appeal&lt;/a&gt;&lt;/span&gt;&lt;/strong&gt; can make a sale. What they may not realize is that using the seasons can help just as much. Truth be told, it didn't click with me until earlier this week, when I realized Thanksgiving was just around the corner and started thinking about the past.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;This time of year always brings a nostalgic touch to the air for me, and many potential homebuyers feel the same way. The holidays have people thinking about hearth and home, family and friends. How can you use the season to sell your house?&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Raking&lt;/strong&gt; - Although many homeowners &lt;strong&gt;&lt;span style="text-decoration: underline;"&gt;&lt;a href="http://www.homeownernet.com/lawn-care-how-to/leavescleanup.html"&gt;rake their yard&lt;/a&gt;&lt;/span&gt;&lt;/strong&gt;, if your home is up for sale and sitting empty, you may not think about it. Yes, a colorful blanket of leaves on the ground can be beautiful, but to homebuyers it may come across as a lack of care on your part. If you don't care about the home, why should they? If the home is empty, make sure to drop by and see if the leaves are piling up.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Redecorating&lt;/strong&gt; - Most homeowners won't take the time to decorate a home they're selling, unless they're still living in it. However, a little &lt;strong&gt;&lt;span style="text-decoration: underline;"&gt;&lt;a href="http://www.bhg.com/decorating/seasonal/autumn/inspired-fall-decorating-ideas/"&gt;fall d&amp;eacute;cor&lt;/a&gt;&lt;/span&gt;&lt;/strong&gt; here and there can help bring out that nostalgic feeling in homebuyers. The key is to decorate just enough, and not so much that the homebuyers can't see their own tastes.&lt;/p&gt;

      <description>&lt;p&gt;By now, everyone knows that, just like the Dot Com bubble, the real estate market grew its own bubble to a degree that it finally popped.&amp;nbsp; &lt;strong&gt;&lt;span style="text-decoration: underline;"&gt;&lt;a href="http://www.realtytrac.com/foreclosure/foreclosure-rates.html"&gt;Foreclosure numbers&lt;/a&gt;&lt;/span&gt;&lt;/strong&gt; went up, sales went down and everyone, from the government to lenders to John Q public, started looking around for someone they could point a finger at and blame.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;The hard truth is that placing blame doesn't do anyone any good, especially those trying to save their South Jersey homes. The truth is that it's time to do what Americans have been doing since the country was founded - picking ourselves up off the ground, dusting off and working with what we still have. Thanks to new acts such as the &lt;a href="http://www.zillow.com/blog/mortgage/2009/05/21/president-obama-signs-helping-families-save-their-homes-act/"&gt;"&lt;strong&gt;Helping Families Save Their Homes Act of 2009&lt;/strong&gt;,"&lt;/a&gt; it's even more possible to do that.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;If you've been dealing with the possibility of foreclosure, you may have missed the news, so here are a few uplifting highlights that can make all the difference:&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;ul type="disc"&gt;
&lt;li&gt;If you rent your South Jersey home and the home is foreclosed upon, you have to receive a 90-day eviction notice. You can't just be preemptively kicked off the property. &amp;nbsp;As well, if you have a lease you have to be allowed to live on the property until the lease is up unless: &lt;/li&gt;
&lt;/ul&gt;
&lt;p&gt;&amp;nbsp;&amp;bull;a)&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; the new owner wants to move in and make it his or her residence or&lt;/p&gt;
&lt;p&gt;&amp;bull;b)&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; state law says the lease can be terminated on notice.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;Although three months doesn't seem like a lot of time, that's three months you wouldn't have had in most states before the Act was passed.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;ul type="disc"&gt;
&lt;li&gt;Lenders and homeowners are now receiving incentives for successful loan modifications and refinancing under the Making Homes Affordable Program. According to the &lt;strong&gt;&lt;span style="text-decoration: underline;"&gt;&lt;a href="http://www.whitehouse.gov/the_press_office/reforms-for-american-homeowners-and-consumers-president-obama-signs-the-helping-families-save-their-homes-act-and-the-fraud-enforcement-and-recovery-act/"&gt;White House government website&lt;/a&gt;&lt;/span&gt;&lt;/strong&gt;, "Servicers covering more than 75 percent of loans in the country have now begun modifications and refinancing under the Administration's MHA Program."&lt;/li&gt;
&lt;/ul&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;ul type="disc"&gt;
&lt;li&gt;One of the biggest challenges to homeowners is finding out who owns the mortgages on their homes.&amp;nbsp; This can make it incredibly difficult to discuss refinancing or modification with the mortgage owner. Thanks to the Act, you have to be informed whenever your loan is sold or transferred to another party. Now, you always know who has control of your mortgage and who you need to talk to.&lt;/li&gt;
&lt;/ul&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Dealing in the current real estate market can be hard. If you're already struggling financially, it can be even harder. Try to keep abreast of the current laws that can help homeowners and families keep their South Jersey homes!&lt;/p&gt;

      <title>Cheating On Your Agent</title>

&lt;/p&gt;&lt;p&gt;&lt;strong&gt;Buyers: Guess what?&lt;/strong&gt;&amp;nbsp;&lt;strong&gt; You too have some responsibilities in the homebuying process.&lt;/strong&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;The Buyer's Agent who is dedicating their time, knowledge, loyalty and expertise to you and your good outcome, can't afford to work for free. They have families to care for, and need to put gas in and maintain the car that is going to all of the showings that you will want to have.&amp;nbsp; So, reward them with loyalty! That's all they ask.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Read further for more details on how to have a great relationship with your Buyer's Agent. You will reap the rewards in the end when they get you to that well-priced, home that's perfect for you!&lt;/p&gt;
&lt;p&gt;And &lt;strong&gt;Remember, any listing agent that shows you a home when you've told them that you have a Buyer's agent is acting unethically.&lt;/strong&gt; &lt;strong&gt;Do you want to work with an&amp;nbsp;unethical person?&amp;nbsp;Their loyalty MUST, contractually, be to the seller. That's the "Law of Agency" in NJ. So they cannot legally represent your best interest in that transaction because their first loyalty must go to the seller who employs them! &amp;nbsp; Anything you tell them about your motivation for buying, what you will pay, what you will give up to get the house -THEY MUST SHARE THAT INFORMATION WITH THE SELLER! &lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;So, where does that leave you in this scenario? Vulnerable! That's why &lt;span style="text-decoration: underline;"&gt;you should always have your own agent and never work with the listing agent in buying a home.&lt;/span&gt; If they tell you they can get you a better deal if you go with them -they are breaking the law. It is not true.&lt;/p&gt;
&lt;p&gt;You will get a worse deal going with them because they must tell the seller everything they learn about you -so how do you think that will impact your ability to negotiate a better deal???&amp;nbsp; Caveat Emptor (or, in English); let the buyer beware!&lt;/p&gt;

&lt;p&gt;&lt;em&gt;John: "Well, I knew you had family obligations today so I was driving around on my own.&amp;nbsp; I drove past one of the houses you e-mailed me, and I really really liked it.&amp;nbsp; So, I called the agent on the sign.&amp;nbsp; She came out right away and showed it to me.&amp;nbsp; And you know, what?&amp;nbsp; She told me I could actually get a better deal if I bought directly from her.&amp;nbsp; We went straight to her office and wrote an offer and guess what?&amp;nbsp; It got accepted by the sellers!&amp;nbsp; Isn't that awesome?&amp;nbsp; I just wanted to tell you thanks for all your hard work.&amp;nbsp; I'll send you a Christmas present."&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;&lt;em&gt;&amp;lt;click&amp;gt;&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;I felt like the wife that just found out her husband cheated on her.&amp;nbsp;&amp;nbsp;&amp;nbsp;Did the buyer know any better?&amp;nbsp;&amp;nbsp;Probably not.&amp;nbsp; He wasn't trying to keep me from getting a paycheck.&amp;nbsp; &lt;em&gt;He simply didn't know - because I didn't tell him any different.&amp;nbsp;&lt;/em&gt; He thought I would be sincerely excited that he got the house he wanted.&amp;nbsp; Did the agent know better?&amp;nbsp; Probably, or he wouldn't have asked me if he had signed anything.&lt;/p&gt;
&lt;p&gt;This was back in 2005, when I first got my license.&amp;nbsp; Since then, I've found that I have to be the one to educate my buyers.&amp;nbsp; Although I've still had a few buyers get cold feet, their financing falls apart, or they just flat out change their minds -&amp;nbsp;I rarely have a buyer call the agent on the sign.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;So how do you keep your buyer from straying?&amp;nbsp; &lt;strong&gt;It's simple - just educate them about the process&lt;/strong&gt;.&amp;nbsp; If you don't focus on building a relationship with your buyer and explaining to them that they have responsibilties in the process too, who will?&amp;nbsp; The answer is either no one or another agent.&amp;nbsp; Remember, most buyers (especially first time buyers) don't know the inner workings of real estate.&amp;nbsp; These are the five key points I tell all of my buyers.&lt;/p&gt;
&lt;p&gt;1.&amp;nbsp; Don't call the agent on the sign.&amp;nbsp; I will do everything in my power to be available during the times that you need appointments, but I'll&amp;nbsp;need some notice.&amp;nbsp; If I can't show you homes at that time, my partner can.&lt;/p&gt;
&lt;p&gt;2.&amp;nbsp; I'm your advocate.&amp;nbsp; I'm looking out for your best interests, and I want to get you the best deal.&amp;nbsp; I'm on your side in this process and we are a team.&lt;/p&gt;
&lt;p&gt;3.&amp;nbsp; I don't get paid a salary, or per house I show.&amp;nbsp; I only get paid when you buy a house.&lt;/p&gt;
&lt;p&gt;4.&amp;nbsp; I'm making a commitment to you to share my time, expertise and market knowledge.&amp;nbsp; I need you to make a commitment to me that I am your agent. (After a few showings or when it's time to write the first offer, this is when I bring out the buyer's agency agreement.)&lt;/p&gt;
&lt;p&gt;5.&amp;nbsp; If we work together, we can have a successful outcome.&lt;/p&gt;
&lt;p&gt;The key point is this - Never forget that although we do this every day, not everyone does.&amp;nbsp; It may seem simple to us, but to others it's not.&amp;nbsp; Help your buyers understand how the process works - it's not just for your benefit, but for theirs.&amp;nbsp;&lt;/p&gt;
