Carbon Monoxide Detectors Now Required in ALL Colorado Residential Homes for Sale (HB-1091)

If you are looking to sell your Colorado home, you now need to make sure that you have Carbon Monoxide (CO) detectors in your homes.

What is Carbon Monoxide?

Carbon Monoxide is an odorless, colorless gas that can have harmful - fatal effects on humans and pets.

According to the Environmental Protection Agency (EPA),

"Carbon monoxide is an odorless, colorless and toxic gas. Because it is impossible to see, taste or smell the toxic fumes, CO can kill you before you are aware it is in your home. At lower levels of exposure, CO causes mild effects that are often mistaken for the flu. These symptoms include headaches, dizziness, disorientation, nausea and fatigue. The effects of CO exposure can vary greatly from person to person depending on age, overall health and the concentration and length of exposure." (EPA.gov)

What IS the new Carbon Monoxide Detector Law?

Colorado House Bill 1091 (HB-1091):

"Requires any existing single-family dwelling or dwelling unit of an existing multi-family dwelling offered for sale or transfer on or after July 1, 2009, that has a fuel-burning heater or appliance, a fireplace, or an attached garage to have an operational carbon monoxide alarm installed within a specified distance of each room lawfully used for sleeping purposes."

What does this mean for Colorado home sellers?

If you are looking to sell your Colorado home, you will need to install (or have installed) a Carbon Monoxide detector. Here are the basics of this new law.

A Carbon Monoxide detector ...

must be installed 15 feet of every room lawfully used for sleeping, and
must be hard-wired or plugged into a non-switch outlet and have a battery back-up, and
must produce a distinct, audible alarm.

The Fountain CO real estate market is a town located south of Colorado Springs and includes some unincorporated areas of Colorado Springs, like Security and Widefield.

If you are looking to write an offer on a Colorado Springs foreclosure or Colorado Springs short sale here are the Top 5 things are some things that you will want to consider, when you ask:

What Should I Know About Buying a Colorado Springs Foreclosure?

1. Writing an offer on a Colorado Springs foreclosure is different than writing an offer on a bank owned home. A “foreclosure” generally is a home that the owner is trying to sell before it forecloses. In many cases this is also a short sale - meaning that the home is being sold for LESS than the owner OWES the mortgage company, or bank.

2. Many local foreclosures are quite affordable. These homes are generally priced to sell quick. Chances are, you will get a “good deal” when buying a foreclosure.

3. Be prepared to wait up to 9-12 months before you can close. Most foreclosures/short sales are a long and tedious process. There is a lot of negotiating and waiting that happens. Sometimes this can take a couple months, but, depending on the bank, this process can be dragged on and on ans on… If you need to move quickly, then a foreclosure may not be the answer. Try a bank owned home or a “regular” home.

4. Ask for a home warranty. Many homeowners who are trying to avoid a foreclosure, do not have the funds to make the home in perfect condition. A home warranty could be a great answer to protecting yourself from any unseen issues.

5. Make sure that you are represented by a competent Colorado Springs Realtor®. They will have your best interests in mind and will keep you updated throughout the entire process. Additionally, you will want to amke sure that a Certified Distressed Property Expert is the listing agent on the seller’s side. This will make the process even EASIER!

There are definite benefits to buying a foreclosure, but make sure you understand what you are getting yourself into before making that offer!
