Wellington Short Sales- What you need to know before you sell your Wellington home.

There are many situations that you may be facing when the subject comes up in your house about whether a Wellington short sale is your best option or not.

The most common reason that a homeowner does a short sale is because they are facing foreclosure.

Because this is the most common reason people do short sales it may seem to many people that you have to be in some stage of foreclosure in order to do a short sale. This is not the case.

If you are in foreclosure in Wellington Florida then the bank does want to try to work things out with you in regards to resolving your serious delinquency. Most of the time, when we are negotiating short sales for Wellington homeowners the banks are more agreeable in negotiating terms with you than if you are current on your mortgage.

If you are behind in your Wellington Florida house payments but not in foreclosure yet the bank also wants to give you the option of doing a short sale in most cases. This is a great time for the bank to save some money by not pursuing the foreclosure filing in the state of Florida but also a good time for you to do a short sale to be able to negotiate the best outcome.

If you are current with your mortgage payments many real estate agents, attorneys and friends will tell you that you can not do a short sale if you are current on your mortgage payments. This is not true in most circumstances. A lot of this depends on your bank and who the note owner on your mortgage is. So it depends on a lot of factors. But for the most part, most Wellington homeowners who are contemplating doing a Wellington short sale and are current on their mortgage payments may pursue a short sale.

If you are current on your mortgage but are in danger of becoming delinquent you are also a good candidate for a short sale. If you are depleting all of your savings and are laid off from work this is a good case to make to your lender that you really don't want to have a foreclosure on your credit report and you also don't want to go late on your payments. This is a good time to pursue a short sale.

If you are current on your mortgage, have tenants in your property but the rent does not cover enough to make your mortgage payments- you can do an investor short sale. We work with Wellington property owners and Wellington investors who have lost so much equity in their properties and can not get re-financed. If you are in this situation we have a lot of experience in helping investors get their Wellington short sales approved.

If you are current on your mortgage and do have enough money to keep making your mortgage payments you may be able to do a 'Strategic Short Sale'. In Wellington there are many homeowners who have lost equity in their property- some to the tune of 50% of their equity evaporated in the mortgage melt down and real estate bust in South Florida. Most of the time with strategic short sales you will get your best offer from your lender if you do go late on your payments. That is when the bank is going to make a move in looking at your short sale seriously. If you keep current on your payments your bank may require a larger cash contribution than if you are late or default. Again, it all depends on who your servicer is and who owns your note. They all have different guidelines.

YES! YES! YES! There are EXEMPTIONS to the FEDERAL Fair Housing Act.

This is a good article by Wallace Gibson about the freedom of association and the courts ruling in favor of roommates who want to choose who they share their rooms with!

Many people are looking for ways to supplement their income and one of those ways is to get a room mate or rent out a room in your home. If you rent out a room in your home you are allowed to advertise who you wish to apply.

In this situation, the lady advertised that she wanted a female Christian roommate. Of course the Department of Civil Rights took her to court over this but the Alliance Defense Fund provided her with legal counsel and HUD did agree that under the first amendment of the US constitution this lady had a right to say who she wanted to be roommates with.

What really gets me though about this story is that this lady put the ad for this roommate request on her church bulletin! So is the department of civil rights snooping around all the churches now to see if they can catch someone violating the law???

What every real estate agent has heard and few remember is that there are EXEMPTIONS to the FEDERAL Fair Housing Act.

One of those exemptions is the Mrs. Murphy's rule OR Mrs. Murphy's Exemption under the FHA. This exemption provides that if a "dwelling" has four or fewer rental units and the OWNER lives in one of those units, that the home is exempt from the FHA. There really is no Mrs. Murphy * she is a fictional elderly widow who has converted her home into a rental or boarding house to supplement her income.

NOW, with the economic downturn, there has come the recent EXPLOSION of roommate advertising and matching websites.

Trisha Rowe of Grand Rapids Michigan wanted a roommate for the three bedroom single family home she owned. She posted a notice in a church bulletin indicating that she was looking for a female CHRISTIAN roommate. The Fair Housing Center of West Michigan filed a complaint stating that Ms. Rowe expressed an ILLEGAL preference for a Christian roommate. This prompted the Michigan Department of Civil Rights and the U.S. Department of Housing and Urban Development to take action.

....almost like Mrs. Murphy was NOT a feature in the FHA.

The Alliance Defense Fund provided legal assistance to Ms. Rowe and invoked her freedom of association under the First Amendment of the US Constitution and ULTIMATELY HUD agreed.

In a separate case, Roommates.com, which provides roommate locator service from their website, requests that users provide a "profile" where their roommate preferences can be "searched".

The Fair Housing Councils of San Fernando Valley and San Dieto filed lawsuits against Roommates.com indicating that these searches were a violation of the FHA.

Today, the U.S. Court of Appeals of the Ninth Circuit rejected these Housing Councils' claims.

The Court indicated that a roommate's unfettered access to one's home implicated considerations of SAFETY, PRIVACY, PROPERTY PROTECTION and the CONSTITUTIONAL FREEDOM of ASSOCIATION.

How many horses can I have in Paddock Park II in Wellington Florida?

We get a lot of questions in our ActiveRain contact box and our email boxes from prospective sellers and buyers for property around Wellington Florida and other locations in South Florida.

One of the questions that came in last week was: How many horses can we have in Paddock Park II?

Paddock Park II and Saddle Trail equestrian communities in Wellington Florida have acreage lots with homes and acreage suitable for your horses. If you buy a home in either of these communities you can apply for a permit to build stalls on your property.

You are allowed to have 4 stalls per acre in each of these equestrian communities in Wellington according to the Village of Wellington code compliance. So that means you can have 4 horses per acre in Paddock Park II and Saddle Trail.

Please bear in mind that if you are new to horses and the equestrian lifestyle that just because you are allowed to have 4 stalls per acre does not mean that is the most ideal environment for your horses.

Horses like to graze. Horses are top grazers which means they like to eat the top of the grass and in Florida the grass on your land is not always in the best condition for horse grazing.You can plant bermuda grass in Florida and in the winters your horses should do fine. Make sure to take into consideration how much grazing areas you have to raise a healthy horse.

Baby Boomers Plan To Enjoy Their Retirement- Move To Wellington Florida

Baby Boomers plan to enjoy their retirement instead of saving an inheritance for their kids. More and more baby boomers are saying they have already given their kids enough and now it is their turn to enjoy life and enjoy their money. Many baby boomers even plan on leaving nothing behind for their kids.

Some baby boomers have paid for medical school, law school and even taken care of the grandchildren financially. Many of them are saying that they plan to spend their money while they are alive. Out of a survey that was taken about the investment habits of millionaire baby boomers only 49% said that it was important to leave money to their children when they die.

There are 77 million baby boomers that are or will be shortly making these kinds of decisions. Many other baby boomers are worried that they are not going to live out their golden years the way they want to because they are taking care of their grown children, their grandchildren and their parents financially and timewise.

Baby boomers are those who are between the ages of 47 to 65. Many baby boomers spent their lives building successful businesses and careers and many did so at the expense of free time, their health or even their marriages and other relationships because they were looking at the goal of having financial independence and doing what they want to do when they reach a certain age. They pay for pricey college educations for their children so they don't get pangs of guilt about wanting to spend their hard earned money.

Baby boomers are not interested in giving up traveling, buying a second home for all cash in South Florida, golfing or going on cruises just so that they can leave money for their children to inherit. Most of them think that the amount of money they have been helping their grown kids with is equivalent to an inheritence anyways. They are supporting elderly parents, they are taking care of unemployed children, they are buying homes with all cash for their children who went through foreclosures or short sales.

When we were at our son's baseball game the other night I saw the sticker on an SUV: " We're spending our kids' inheritance." If you want to spend your kids' inheritance here in Wellington Florida- we will be happy to oblige:)!

Saturday Night Lights at Wellington Equestrian Festival- Fun For The Entire Family

Looking for something to do in Wellington Saturday nights?

Join us out at the Winter Equestrian Festival events that are here through April 5, 2012.

Saturday nights here in Wellington come alive with all kinds of equestrian fun and excitement.

The Winter Equestrian Festival invites families, couples and singles out to Saturday Night Lights at the Palm Beach International Equestrian Center.

This event is free to everyone on Saturday nights. There is a $20 per car-load parking fee. There are public and private pavillions. The public pavillians have some great food for you to enjoy. There are things for the kids to do including pony rides. But our kids and grandkids don't care about any of the kiddie fun- they like to watch the horses and riders compete.

Our son who is nine goes around with his iPad taking photos and he is getting quite good at it. Here is one of the photos he took of the jumper events while we were enjoying an afternoon visiting with friends and competitors at the Winter Equestrian Festival.

If you have not been out to the horse showgrounds for an exciting afternoon or evening of Equestrian events you are missing out on some of the most amazing entertainment around. Of course we are biased. We love horses. We come from horse families and love riding.

One of the most graceful and majestic animals is the horse. The horse is also smart and a great companion. It is easy to get hooked on horses and the equestrian life.

Agents Taking Listing Photos - Counter Points To An AR Featured Post

There is a featured post called:

"Don't let your agent photograph your home with their cell phone". It was a members only post so I can not link to it from this post since my post is public. The short of it is that Eric Hemler gave his opinion about photos taken of listings. He made a comment that created a pretty good debate. Allen May let me know that I can link to the members only post and if you are logged in you will be able to get to the post. So I added the link just now.

What sparks most of the comments was that he said that sellers should not allow the listing agent to take listing photos with their phone.

I was one of the commenters that totally flat out disagreed with that statement.

Actually it got me to thinking that if I had more time I could create an entire article series and tutorials on making the most of your iPhone 4 and iPad2. But I really don't have that kind of time right now.

The point is that if you can take good photos of your listings with a shoe box camera than go for it.

It is not so much the camera as it is the vision and talent and skill set of the person taking the photos. Many agents become very good at photography. There are photographers who become agents and visa versa. Just because you are a real estate agent does not mean you have to hire a professional photographer for all your listing photos. Just because you are a real estate agent does not mean you can not also be good at taking great photos.

If you look at our high end listings- we take those photos.

Nestor takes great photos and I also take good photos. We enjoy taking the photos ourselves because we know what buyers are looking for in the house. A photographer might be able to take a great photo but it may be the wrong photo! An agent who is good at marketing- which should be the second skill set after good communication skills- will know how to capture the look and feel that a potential buyer would be attracted to. Buyers find our listings online and they make offers on our listings. They compliment our photos often.

The other side of this argument is about truth in advertising. How much should that photo be photoshopped before it is considered false advertising? An agent taking photos is going to have a much more realistic approach. But that is a subject for another post.

Now for the camera points-

You can have the fanciest and most expensive camera in the world and still take crappy photos.

You can have a simple point and shoot camera and take a great photo.

In this day and age saying that a phone is a bad way to take a photo and that a sellers should not hire you because you are going to take photos of their home with your iPhone is just- well- not understanding technology!

There are entire awesome groups of photographers who have abandoned their expensive camera equipment and gone all out with iPhone apps, a tripod and lighting. There are entire short movies being made just with an iPhone and the apps to make that process awesome.

We get the iPhone magazine and in the latest edition there were pages and pages devoted to all the cool iPhoto apps that are now available for pro photographers. You can with a few apps, take a photo on your iPhone, add framing, lighten it up, remove shadows, crop the image, add saturation and all the other techie touch ups to a photo like you can in iPhoto- and even upload that photo right to your website, facebook page and posterous, etc.

Here is a beautiful short video that was entirely filmed and produced on the iPhone of the California Redwoods. It is only about 2 minutes long. But when you see what you can do in the forest with the iPhone you can also do on your listings.

The iPhone 4s camera is an 8 megapixels camera with state of the art optics that compete with the best in cameras. It also has 1080 hd video. With the new pixels on this phone you can print up to an 8x10 photo- that has never been done before on a phone. The lighting in the iPhone is even better- the "custom lens uses five precision elements to shape incoming light which makes the image sharper". The camera lets more light in which makes sharper images. It also has an infrared filter that keeps the IR light out so your colors look better than in a regular camera.

It has an A5 chip which makes the processor just as good as those in DSLR cameras. You can also take the photos in HDR. This is just the tiny part of what the iPhone camera can do. I hope to find the time to gather up for you the coolest apps on the planet to help you edit your photos right on your camera.

Here are a few photos that we took with our iPhones and also some that were taken without any editing at all from the Apple website. ( Apple's TOS says you can use their images to share information about their products). These photos were unretouched!

The Golden Market- Miami- South Florida- Market Report

2011 was a great year for real estate in South Florida- especially in Miami. So if you have been sitting on the fence waiting to buy that perfect Miami oceanfront condo you may just have sat a wee bit too long:).

2011 far exceeded all expectations of the turnaround in the market in Miami. This was fueled in large part by our amazing international and foreign buyers who are flocking to Miami and South Florida including to Wellington Florida to buy property while their money is strong and the American dollar is weak. Brazilians are the number one buyers in South Florida right now.

South Florida is the TOP market in the nation for foreign home buyers.

The numbers are in for 2011 and Miami and South Florida outperformed the rest of the nation! Miami is recovering faster and stronger than ANY OTHER market in the ENTIRE USA!!! We are so excited about this because this is going to be great for the Miami and South Florida economies.

The absorption rate is down too so don't count on finding those properties lurking around time on the market because the good investments, the prime real estate in Miami is going, going, gone- fast.

While much of the nation remains stagnant Miami home sales in 2011 were +26% and so far this year in2012 just in year to date home sales are up +50%.

2011 units sold are still being totally tallied but it is projected by the numbers so far that Miami sales in 2011 are going to exceed the number of units sold at the height of the market in Miami in 2005.

Lifestyle remains the number one attraction to Miami and South Florida with great weather, diversity in culture and record affordability along with great rental returns.

There is now a limited supply of homes and condos on the market having been absorbed at record pace. There is now a limited supply and a large demand.

The inventory in Miami and South Florida has dropped by 40%. We can attest to that because our inventory has dropped also by 40% since 2008 and so has all the top brokers we talk to in our markets here in South Florida.

In 2011 in Miami, the price of condos increased four months in a row at the end of the year and this trend is going to continue to move upward now.

Distressed properties- bank-owned properties also known as Miami REOs- are in high demand.They sell seven times faster when they come on the market. There are so few bank-owned properties available now. HUD homes are sold before they are even advertised. As soon as they are in the MLS, they are gone.

The bank-owned Miami properties are now down to 56% of closed sales. That is down from 73% for condos at the beginning of 2011. That is a super fast take-down!

Miami and South Florida are global real estate markets and news of our inventory and great lifestyle are now visible around the globe to France, Spain, the United Kingdom, Italy, Russia, India, China and many other countries in Europe and Asia and of course throughout Latin America.

Wellington Equestrian Market Report Year End 2011

Wellington Equestrian properties and Wellington Equestrian Farms are in high demand this season. We are busy with equestrian visitors from Canada and South America and new visitors from Europe in the Dressage circuit who are looking for equestrian farms to occupy during the Wellington Winter Festival and the Global Dressage as well as International Polo.

The season here in Wellington for Equestrian properties is between November and April. It is mostly the opposite of folks up north as people up north buy in the summers and people buy here in the winters. Much of the circuits are here in Wellington during the winter seasons so we the town is bustling with horse trailers and riders. This time of year you walk into our local Publix supermarket and Whole Foods and you will see people dressed in their riding attire. You will also see license plates from many states around the parking lots in Wellington.

Over the past year in 2011 - 57 Equestrian properties, Wellington Farms and other equestrian style estates sold and closed.

The top three properties that sold that are considered to be prestine Wellington Equestrian properties are as follows:

4741 Garden Point Trail in Palm Beach Point sold for $ 7,650,000 and the buyers paid ALL CASH for this outstanding Wellington Equestrian Farm. The property was on the market for 749 days which is a typical market time for properties of this stature and price range.

Wellington Vacant Land Market Report

Wellington does not have much vacant land left as much of the land has been built on. We are a small town or village as we like to call it.

While there are some lots left on which you can build a house on that are in subdivisions around Wellington, those are not in high demand as the cost to build a new house is more than what you can buy a house for in the same neighborhood in many cases.

However, the Wellington vacant land that is always in demand is in the Wellington Equestrian areasof Wellington. Whenever we get a listing in one of these prime locations we get offers on the land nearly straight away if the owners have priced the property in line with the value.

In 2011 there were 11 such land parcels that sold and closed in the Wellington Equestrian property areas.

Most of the land parcels that sold were located in Palm Beach Point. Most of the land parcels consist of 5 acre lots. These lots have no improvements. You can build an estate equestrian farm in Palm Beach Point with a barn, paddocks and dressage rings.

The top sale for a 5 acre land parcel was located in Palm Beach Point and sold for $695,000. It is located at 15565 Palma Lane.

The second top sale for land in the Wellington equestrian area was sold for $567,000 and it was also located in Palm Beach Point.

Should you sell a Wellington short sale to an investor or a first time homebuyer? This article written by my friend and broker Elizabeth Weintraub in California wrote the following article about selling a short sale to investors and first time home buyers. Of course, in California short sales are handled differently than they are in Florida because the foreclosure laws are different.

But an important point to be made for our Florida markets is you can not depend on Zillow for house value estimates because for the Florida Markets we are in Zillow has one of the lowest accuracy rates based on their own analysis.

In Florida, our home values are mostly based on air conditioned space. Most of the aggragators of listing data do not have a field for this and take into account ALL the total built area. Here in Florida having a shed that is not A/C'd is not a very valuable piece of real estate:) .

I was all primed to write about investors who are buying short sales this morning when I received an email from a buyer's agent who is representing herself. She's trying to buy a short sale in Elk Grove. I have to share this. The agent said she was withdrawing an offer she made yesterday that was too low. I had asked her to bump it up to meet the comps. She said, "According to Zillow.com, it is worth $XXX." As a licensed real estate agent, she has world class tools at her disposal to help her to determine market value but this agent relies on a worthless website such as Zillow? See, this is part of what's wrong with the Sacramento real estate market.

The other part is our local real estate market is exploding at the moment. We've got investors and buyers fighting over the same Sacramento-area properties. The reason is simple. Investors can get positive cash flow because of today's prices and historically low interest rates. This means an investor can collect more in rent than she pays for a mortgage payment. Many renters should be home buyers because it's costing them more to rent than to own.

Much of the inventory available for sale is a short sale. As a Sacramento short sale agent, I carry a large inventory of short sale listings. My goal is to put that short sale into escrow and close it. To accomplish that goal, I help my sellers to choose the best short sale offer. Is that an offer from an investor or a home buyer, in other words, an owner occupant? Which is the best buyer?

Most of the time, sellers prefer to choose the offer from the owner occupant. Why would they do that when the investor can wait forever and the first-time home buyer typically cannot? Because there are problems with offers from investors. For starters, if the short sale home is occupied by the seller and a Notice of Default has been filed, investor buyers must comply with the Home Equity Sales Act. Many of them don't and have never heard of this law. But if they don't comply, the seller can rescind the transaction 2 years later -- after the seller restores credit from the short sale.

Another problem is some investors want to hold title as an LLC, and short sale banks don't like to accept offers from an LLC. Additionally, some investors want to flip the property. Many short sale approval letters restrict flipping for 90 to 120 days. If that's the goal, the buyer will cancel upon short sale approval. And not to mention, sometimes the buyer's agent is acting as principal and, when that happens, the banks don't always allow the agent to receive a commission. These types of offers magically vanish when agents discover they are stiffed.

But aside from all of that, who is more motivated to wait for short sale approval? Who is more motivated to increase the sales price if the short sale bank demands it? Who is emotionally connected to the home, enough to jump through qualifying hoops the bank throws into the air? Which type of buyer does a seller feel attracted to? Mr. Money Banks who wants to rent out his home and retire with a big, fat, 401K? Or, Miss FHA first-time home buyer?

I'm not even going to talk about the investor who is trying to cancel one of my short sales because another came back on the market that caught his eye . . .

How To Start and Use Google Collections- Video Tutorial- Technology For The Non-Techies

You need to first have a free Google gmail email account. You can learn how to get a free google gmail account with the Technology for the non-techies video tutorial: How To Set Up Your Free Gmail Email Account.

Here is a video tutorial for you non-techies about how to use Google Collections. This is what we use for our listings, contracts, tracking and follow up and also what we use for doing your website makeovers and SEO campaigns. It is really fast and easy to learn.

You can open up two windows on your browser. You should use Google Chrome browser to do this. Open up two windows. One window to watch this video tutorial and the other window to open up your gmail account so you can follow right along my tutorial and do the steps. If I am talking too fast in the tutorial then just pause the video until you are caught up.

The Technology for the Non-Techie play-list in youtube will have more video tutorials so consider subscribing to my youtube channel so you don't miss any tutorials. Sometimes I run across a photo that we have taken on one of our travel adventures that is very memorable. It speaks to us long after we get back home. I love to travel. It is in my blood to travel - my mother used to tell me we must have been gypsies in another life. She took us everywhere when we were children throughout most of Europe. We lived in Germany for 4 years and in many other places. After I left home very young and moved to Hawaii- I traveled Asia. Even after I got married and had children, traveling was something that was part of living. So my children were blessed with my love of travel and grew up being homeschooled and traveling the world too.

Already there are 22 businesses and/or people who have turned in their applications to purchase their own custom domain real estate. So who do you think is on the list so far?

For SEO purposes we have mostly believed that the .com and the .org suffixes carry the most weight in the SERPS on Google and Bing. Most SEO folks agree and even though there is not really any concrete evidence of this it is the consensus that this is so.

So if that is true, how are these vanity suffixes going to be weighed in the search engines?

It is anyone's guess right about now. We will have to wait to see how it all works out. I believe that at the end of the day the extension and the suffix will play a part in branding and if your keywords are matched correctly to your branding then it will be of a benefit to you.

But I also believe that most people buying these vanity domain extensions are doing it to protect their own brand names they already have like Microsoft and Google and Nike. And I think that some people will buy them just because they can or to stroke their own egos. I doubt that any of them are thinking SEO strategies.

SOPA and PIPA were dropped by Congress- at least for now and at least in their present forms.Because of all of you who called your Senators and Congressmen and Women, because of all your support in the online protests, because of you re-blogging the important information, because of you who spread the word on Twitter, Facebook and Google Plus and on ActiveRain, because of you taking a stand.... we were able to get enough votes to get the two bills canceled.

This was the largest protest in the history of the Internet.

On January 18th over 13 Million of us- people- regular people- dialed those phones, put our fingers to those keyboards and made sure the the switchboard in Washington DC was lit up!

This was a game changer... our VOICES made a difference on January 18th!

Over 10,000,000 signatures

Over 3,000,000 emails sent

Over 115,000 sites participated in the strike

But even more important than that we set an example to the world as there were over one billion people from around the world watching this go down here.

If you ever felt like your vote did not count, that your voice is drowned out by those who have more power than you or more influence than you, if you have ever felt like there is no use to speak up anymore... just let this sink in. Let this really sink in.

This might have just been a huge game changer in our world today for public interest and one that is not going to be taken for 'friendly' from those in power. Because we have power on the Internet and we need to keep it that way. That of course is a scary thing for the governments. Because as Thomas Jefferson said many years ago: The people have the power when government fears the people which is liberty. It is when the people fear the government there is tyranny.

The MPAA who is the lobbying group for the movie studios who created these two bills were very shocked at this outcry and the amazing mobilizing we were able to accomplish so quickly. They were also humbled by our voices.

Guess who is the Chairman of MPAA?? - those of you in real estate know him very well- former Senator Chris Dodd! Isn't he the one that should be in jail for mortgage fraud? He was totally shocked by our voices and how fast we were able to get this out that we are against these two bills. He said, " This was a whole new different game all of a sudden." He said in four decades he has not seen anything as big as this was.

Yes, it is different because now what you say on the house floor is tweeted around the world in seconds. You can no longer run around behind closed doors giving out all your favors.

Thank you to Mozilla, ActiveRain, Google, Wikipedia, Tumblr, Wordpress.com and Wordpress.org, Reddit and so many more of you.

And guess who also was watching this all unfold? The people of China. China was of course censoring even our tweets about the protest and policing the content very closely yet it was being watched and the message was clear. The Chinese were watching and seeing what we would do.

"We should learn something from the way these American Internet companies protested against SOPA and PIPA. A free and democratic society depends on every one of us caring about politics and fighting for our rights. We will not achieve it by avoiding talk about politics."

Not Paying Your HOA Fees Is The #1 Killer of Short Sales and Deed In Lieu

Not paying your HOA Fees is the #1 Killer of Short Sales and Deed in Lieu.

Many homeowners who are behind in their mortgage payments are also behind in their HOA fees. When we take on a short sale listing it is very important for the seller to understand the ramifications of NOT paying HOA fees.

In the state of Florida the HOA can foreclose on you, they can lock you out of the pool and clubhouse, they can evict you after the foreclose on you and rent your condo or property out, they can deny you access through the gate.

And the HOA can do this very fast. Many people here are being told by their agents, by their attorneys and by their friends and family members that their HOA can not foreclose because the first bank, the main lien holder, is in first position and if your bank has not foreclosed the HOA can't. Well, that is NOT TRUE.

The HOA can foreclose on you subject to the first lien holder. They don't need your bank to foreclose on you first or at all.

If you are planning on doing a short sale then you should do all you can to keep up with your HOA payments. If you are far behind and the HOA has their legal council contacting you- make some arrangements to pay towards the part you are behind.

If your HOA fees get too high, your lender is not going to approve those to be paid out of the net loss they are getting at closing.

If you want to do a deed in lieu you have to be current with your HOA fees or you have to negotiate with your lender to pay a portion of those fees for you because you must give clean title in a deed in lieu.

Attorneys tell us that for deed in lieu- the number one killer is the homeowner being behind in their HOA payments.

Most every attorney we know that understands the short sale process advises their clients that even if they are not making their mortgage payments they should keep current with their HOA payments.

Florida encourages entrepreneurship and small cottage business. Florida has many benefits for healthy living for both your body and your pocketbook.

Florida just passed a new law that allows you to cook in your home and then bring those home-baked goods to your local green markets to sell them.

We love going to the Wellington Farmers' Market weekly to discover all the new creative innovations and baked yummy goods from local entrepreneurs and local people who are looking for additional ways to make some money during these economic times. This is the spirit of America.

When things get tough you figure out a way to make some money to take care of yourself and your family that also adds value to the lives of others. Nothing like smelling fresh baked pies on a Saturday morning at a farmer's market near you.

Throughout South Florida farmers' markets are all the rave.

This new law is called the "Cottage Food Law" and it is about time we had one of those around here!

This new food law does away with all the regulations and licensing fees that most mom and pop type start ups can not afford to pay for nor have the time to go through all the red tape just to test a new baked pie or bread on the market.

One lady who lost her job loves to bake pies. She is 52 years old and started to bake her pies. She has over 50 different baked pies that she sells at local green markets. This is how she does what she loves to do, baking and makes some cash too.

You can make loaf breads, pies, cakes, cookies, pastries, jams, candies, honey, jellies, dried fruits, dry herbs, teas, seasonings, homemade pasta, cereals and popcorn just to name a few of the items.

The Cottage Business Law has restrictions. Before you start cooking in your home you need to make sure you comply with the new law. There are certain products that you can not sell such as fresh meat or fresh fish, any products containing fresh cream and the like.

I also found out that you can not sell your goods that fall under the Cottage Business law on the internet but you can deliver in person to your customer's homes and places of business.

Speechless Sunday- San Francisco's 49ers Played A Memorable Game!

The San Francisco 49ers played an incredible game tonight. I remember the days of Jerry Rice- that gives away my age:) I remember the days my father took me to as many 49er games as he was on leave to take me to. I loved going to the stadium to watch our favorite team play. My paternal grandparents lived in San Francisco for over 50 years. I guess you know who I wanted to win tonight and go to the Super Bowl!!!

Yes, sometimes it feels that I left my heart in San Francisco....

You can move the girl from the west but you can not take the west out of the girl....

I think these seals at Fisherman's Wharf are sharing their opinion about their 49er's losing the big game tonight....

Wellington Equestrian Village Gets Approved!

This is exciting news from Wellington Planning-Zoning & Adjustment Board. The controversial Equestrian Village has been approved. Here is a photo of one of the listings we had near where the new Wellington Equestrian Village is going to be. This is just to give you an idea of what Wellington looks like near the new village location but this is not an exact placement photo. Just for example purposes.

There was a standing room only meeting at the Village meeting regarding this new addition to Wellington. There were over six hours of discussion.

The old Palm Beach Polo Stadium is the area of Wellington for the new Wellington Equestrian Village which most equestrian folks are in favor of. This is a 96 acre facility and the new approval will allow there to be an Equestrian Village hotel. We are so in need of a hotel in Wellington near the showgrounds. We get at least a half dozen requests a week at International Properties and Investments for short term housing for equestrians who are only coming into town for a couple of weeks. There really is no convenient place for them to stay.

We also want Dressage to come to Wellington in a big way. We have the area to compete on the international scene of Dressage just as we do for Polo and Hunter/Jumper. Dressage high level competitors have to go all the way to Europe. If we can get them to come here to Wellington instead- it will be great for our local economy.

This project is going to cost between $50 million and $80 million to build. It will take about two years to complete the project. Also, the hotel will have condos that you can buy and then rent out to equestrian visitors who need to stay here in Wellington longer than a couple of weeks. This project will create jobs here in Wellington and the hotel will have full time employment as well.

Right now for short term stays, Wellington gives up about 80% of the economic impact of the equestrian industry. This money is being spent now outside of Wellington. That does not seem like a smart choice when that money can be spent right here in Wellington.

The board ending up voting 5 to 2 in favor of the hotel and the Equestrian Village project.

Wellington Tiger Shark Cove Park- Community Project

Many of you already know but for those of you who are new to Wellington you may not know.Wellington's Tiger Shark Cove Park right next to the Wellington Community High School on Greenview Shores Blvd in Wellington was a community project that was build in 2000.

In 2000 the community of Wellington residents and business owners came together to build Tiger Shark Cove. This project was a huge success. We raised the money from local businesses to buy the park equipment and then the residents here all chipped in with their time and money to build the park.

Many of the youth who helped during this project were from the Church Of Jesus Christ of Latter Day Saints. Many of these youth have since gotten married, have children of their own and many have moved away from Wellington Florida because of work or college. But their dedication to Tiger Shark Cove will not be forgotten.

Tiger Shark Cove was build entirely by volunteers.

Tiger Shark Cove is now in need of some updates. Local school children have been asked about what they would like to see in way of updates to the park. The updates will mostly all be build with volunteers just like before.

When you visit Tiger Shark Cove you have the warm memories of a community coming together to build a wonderful community park for the community to enjoy.

On Saturday January 21 at Tiger Shark Cove- the re-design and updates will be revealed from 10 a.m. to 12 p.m.

The actual work will begin on March 21 and should be finished by March 25th. Bring your kids with you and be a part of the community experience!

This is a bipartisan bill and it has bipartisan opposition so don't be afraid to take a stand. One of the sponsors of the Bill has no clue about the internet and he even violated his own SOPA by placing an image on his website that was copyrighted so he would be classified as a felon today if SOPA is the law.

SOPA would make FELONY criminals of you having a YouTube video singing Happy Birthday to your 2 year old child!!!

SOPA would make ACTIVERAIN open up a whole LEGAL team department and shut your blog down just based on someone's complaint about your blog- no evidence is required and NO due process is given to you. Companies like ActiveRain would have to close their doors because they don't have the kind of money it would take to stay open. Not even Twitter and YouTube could keep their sites online.

This has to do with you. DON'T Be someone who just does nothing. It only takes 5 minutes to call your Congressman right now to tell them that you want him or her to VOTE NO TO SOPA.

Read Mashable's article about SOPA. It is very well written and it will send chills down your spine.

Even worse is that with SOPA if someone complains about your site and you don't have the money to go to where they are to defend yourself they get awarded your domain name!!!! IMAGINE THAT!!!

ALL OF US HERE ON ACTIVERAIN could be labeled as FELONY CRIMINALS just because someone posts a comment on your blog or a video on your blog with a song or a video clip from a movie, etc, etc, etc.

Justin Beaver would be a FELONY Criminal. Remember how he was discovered? He played popular songs on YouTube and a producer discovered him. He has become famous and has made millions of dollars because of his exposure on YouTube. Well, that would not be able to happen any more. What if your son or daughter has talent and wants to get discovered????

Thousands and thousands of online businesses are voicing their opinion to congress. Tell Congress to stay off of the internet. It is as though no matter how loud we all shout- they are plugging their ears but we must NOT stop sending our message.

Think of the vast implications of this bill. Call your congressman or woman today, right now. Please help us stop SOPA.

Wellington Colts Travel Team Wins Lake Worth Spring Bash Tournament

We had two full days of competition this weekend in the eastern Lake Worth baseball fields. Lake Worth hosted a Baseball Travel Team tournament. This is a pre-season tournament.

Our team did fabulous and we won the championship! The parents were all so supportive of their sons. We all spent the entire day on Saturday and Sunday playing seeding games and then the play off game and then the Championship game.

Tristan played short stop second to none. He made some play book perfect plays in his position. He also played third base and played 2 innings as Pitcher. He knows how to "pick off" the players stealing bases and got three outs in a row through strike outs and pick offs. It was so much fun to watch. He was on his game this weekend, no doubt about that from anyone!

They also met Jordan Schafer and got his autograph on their baseball hats.

It was so cute too because at the end of the tournament when the Wellington Colts won the championship game some of the kids were "Tebowing". I am so happy that kids today have a great role model like Tim Tebow in sports.

SOPA- Why ActiveRain- Wordpress- Zillow- Wikipedia and Every Other Platform Needs To Say NO to SOPA! This just in from GOOGLE:

So is Wikipedia and many other sites. Wikipedia will shut down their English version for 24 hours starting tomorrow. Jimmy Wales, co-founder of Wikipedia said that these bills will endanger free speech and create internet censorship like we have never seen before.

Google will be lodging their official protest against SOPA tomorrow on their homepage. Twitter and Facebook are joining in on the protest by trying to pass the word to stop SOPA. Google.inc will place a link on January 18th on its' home page to protest both of the anti-piracy measures in the house and senate.

Google has measures in place to combat copyright infringement. Last year alone they took down 5 Million websites that were violating copyrights. Not only that, but we each have protections in the copyright laws.

If you notice when you go to your sites on Wordpress, you will see a STOP SOPA banner across the right side of your site in the upper corner.

They will tell you that SOPA- which stands for Stop Online Piracy Act is to stop online piracy. But that is not what this bill will do. This bill is being pushed and driven by lobbyists and the Hollywood elite. The unintended consequences will be beyond what we can imagine.

This bill will hurt bloggers, site owners, ActiveRain and all other sites that allow content on their sites. This bill is only for big corporations and the Hollywood movie producers who do NOT want to go through due process of the law. This bill can literrally get entire networks like Wordpress.Org shut down ONLY on an allegation!

Just imagine what your competition can do to you!!!!

The damage just to the infrastructure of the internet will be so huge that the censorship issue in this bill will be meaningless.

What is worse than all of this, you have congressmen and women who are admitting on recordings that they do not understand the internet. You can hear them saying things like, "pass the bill then we will worry about what is in it."

Google executives and programmers tried to get a hearing on this only to be called "computer nerds and geeks" and were not even given the time of day to explain the repurcussions of this bill. These politicians were saying they would not understand what they would say anyways, so what is the point? Well, heck, don't pass things you don't understand!!!!!!!!!!

The Senate Bill is S.968 and the House Bill is H.R. 3261.

Contact your Senators and Congresspersons tomorrow to tell them to say NO To SOPA and PIPA. Make those phones on Capital Hill ring, ring, ring!
